Sin embargo, el traspaso de poder a una autoridad nacional más eficaz, legítima y de base más amplia se ve amenazada por los esfuerzos de diversos dirigentes políticos somalíes y sus partidarios por controlar o malograr el proceso de transición, lo cual exacerbaría la inestabilidad y los conflictos, pudiendo revitalizar a un Al-Shabaab acosado por los problemas. Si bien ese comportamiento “saboteador” es en parte una expresión de competencia política legítima, también es un síntoma de la corrupción generalizada en las instituciones federales de transición. Desde el derrumbe del Gobierno de Somalia en 1991, sucesivas generaciones de dirigentes somalíes han utilizado prácticas políticas y económicas perniciosas que han agravado el conflicto y han contribuido a frustrar el restablecimiento de la paz y la seguridad en el país. Bajo las instituciones federales de transición, la apropiación indebida, la malversación y el robo declarado de los recursos públicos como prácticas sistemáticas se han convertido básicamente en un sistema de gobernanza, plasmado en la frase somalí “Maxaa igu jiraa?” (“¿Qué gano yo?”). Un informe de mayo de 2012 encargado por el Banco Mundial desveló que faltaban 131 millones de dólares de los ingresos del Gobierno Federal de Transición correspondientes al período 2009-2010, a saber, el 68% del ingreso total registrado para ese período. The president already had sorne of these powers before the State of Siege was declared, under the State of Emergency and under the State of Danger to Internal Peace. Under interim provision 24 of the Constitution, which comes into effect during the State of Danger to Internal Peace, the president has the power t o detain individual s without charge for up to twenty days, to banish individuals for three months, and to expel people from or ban them from entering the country.

Bekkin Having survived a civil war and living in international isolation, Somaliland, a de facto independent state in the territory of Somalia, is gradually developing its financial sector. The banking services are interest-free in this entirely Muslim republic. But does it mean they are Shari’ah-compliant? Renat Bekkin, PhD in Law, senior researcher at the Institute for African Studies of the Russian Academy of Sciences, reports. In 1991, the unified country of Somalia de facto ceased to exist. The civil war, which had broken out three years earlier, had led to the break up of the state into three separate areas: Somaliland, Puntland and Somalia. At the time one could hardly call the former British colony and then province of Somalia – Somaliland – a country. It was virtually a bare territory with its infrastructure completely destroyed by the war. The world community did not rush to recognise the new state and hardly anyone would have predicted that the country would survive. But 16 years on, Somaliland continues to exist as a state despite international political isolation and weak central government. The main source of welfare for Somaliland's citizens is not international aid, but money sent by their relatives from abroad. Because of the underdevelopment of the financial sector, money transfer operators have practically taken on the role of banks.
