Guidelines for the Bar Exam READ CAREFULLY AND RETAIN FOR YOUR RECORDS.

The State Bar Examination will be held at the Mountain America Credit Union Expo Center, 9575 South State Street, Sandy, Utah, on Tuesday and Wednesday, July ___ and ___.

You must be at the exam site by 8:00 a.m. each morning for registration.

The Utah Bar does NOT send out admission tickets in advance of the exam. Each day prior to both the A.M. and P.M. test sessions, you will register by showing your picture ID and signing in; once you do so you will be given an admission ticket. Before entering the test , you must present this ticket and your picture ID to an exam proctor who will be standing at the door. The test materials are developed by the National Conference of Bar Examiners (NCBE). In order to protect the integrity of the exam, the NCBE requires that strict security measures be followed. All applicants will be searched before entering the test area. Unless expressly permitted below, personal items are not allowed.

Restrooms and drinking fountains are located inside the test area. Once you have been screened and admitted you will NOT be allowed to exit the test area.

Your admission ticket will include your seat assignment. Each applicant is pre-assigned a seat; alternative seating is not available. Once inside the test area, you should locate and take your seat. If you are taking the exam on your laptop, you must follow the laptop setup instructions that will be provided to you at registration. An ExamSoft technical support proctor will be available to assist if needed.

The start of the exam will not be delayed for any reason (e.g. traffic, laptop setup delays, bad weather, late-arriving applicants, or because applicants are not in their seats). Late- arriving applicants will be required to wait outside the test area until the exam has started and must use test time to complete whatever administrative tasks have already been completed by the group. Applicants who arrive more than an hour after the exam has started may be denied entry.

REQUIRED ITEMS: You must bring the following items with you to the examination:

Day One

• Picture Identification, • Black or Blue Pens, • Laptop Computer and power cord* (if registered to use ExamSoft), and • Clear, quart-sized plastic bag (approx. 7 in. x 7.5 in.)

Day Two

• Picture Identification, and • Clear, quart-sized plastic bag.

* The power cord should be 6-8 feet in length. Mac Users: be sure to bring your Apple extension cord.

PERMITTED ITEMS**: You may bring the following items into the test area:

• Jacket or sweater; dress in layers to compensate for temperature variations; if you bring a jacket with a hood the hood must be kept down at all times; • Keys and wallet; the wallet must be small enough to fit in the quart-sized plastic bag; • External Mouse for your laptop (you may not bring a mousepad); • Feminine Hygiene Products.

**Prior to the exam, your keys, wallet, and feminine hygiene products must be placed in the clear, quart-sized plastic bag. Both required and permitted items must be presented to a proctor for inspection upon entry into the test area.

PROHIBITED ITEMS: If an item is not listed above it is NOT allowed in the test area; below is a list of commonly-seen prohibited items:

• NO watches, clocks, or time-keeping devices; clocks will be placed throughout the test area; • NO earplugs; one pair of foam earplugs will be provided by the Bar each day; • NO food, candy, gum or beverages; this includes bottled water; drinking fountains will be accessible during the exam; • NO medications, whether prescription or over-the-counter, unless pre-approved for good cause shown; • NO lotion or lip balm; • NO tissues; these will be available at the front of the test room; • NO full-size keyboards, mouse pads, flash drives, or CDs; • NO highlighters; • NO pencils, sharpeners or erasers; the Bar will provide applicants with pencils, sharpeners and erasers for taking the Multistate Bar Examination (MBE); • NO handbags, purses, computer cases, backpacks, briefcases, lunch bags, etc.; • NO cell phones or other electronic devices, including but not limited to pagers, calculators, cameras, recording devices, tablets, etc.; • NO scratch paper; the test booklets will have blank pages you can use to take notes; • NO test materials, books, notes, papers, or study materials in any format or media; • NO headphones or headsets; • NO weapons of any kind, including pocket knives; • NO hats, caps, or coats.

There is NO secure location for you to leave prohibited items while the test is under way. The Bar will not store or be responsible for the loss of or damage to any personal property. Please leave personal items at home or locked in your vehicle.

EXAMINATION CODE OF CONDUCT

Any applicant who breaches an examination regulation is subject to sanction. Breaches of exam regulations include having prohibited items in your possession during the exam, copying another’s answers, continuing to work after test time has elapsed, not following test instructions (such as remaining quiet while exam materials are collected and counted), failing to upload computer essay answers, or engaging in conduct that disrupts the Bar examination process. Possible sanctions for the above behavior include:

1. Ejection from the examination site; 2. Nullification of the examination taken or the application made by the applicant; 3. Transmission of a written report on the matter to the Character and Fitness Committee for disciplinary action; and/or 4. Transmission of a written report of the matter to the Bar in any where the applicant is currently licensed or applies for admission.

EXAM SITE CONDITIONS

To assist applicants in keeping track of time, clocks will be placed throughout the test area; in addition, those using their computer will be able to track their time using the timer in ExamSoft. You should not rely on a single clock to gauge the time you have remaining, but refer to two or more clocks that will be visible from your seat.

The Bar strives to maintain a quiet test room but cannot guarantee a soundproof testing environment. Inside the test area you will encounter venting noises (air conditioner/furnace), sounds from the movement of people, tables and doors, and the sound of typing on keyboards. Noises outside the test area such as alarms, sirens, weather disturbances, traffic, voices, and barking dogs are possible and are beyond the power of the Bar to control. To minimize noise, infants and toddlers are not allowed in the foyer area while the exam is in progress, and examinees are asked to wear soft-soled shoes (avoid flip-flops or high heels). If you are concerned about being distracted by noise during the exam, you should use the foam earplugs that will be provided by the Bar.

TRANSPORTATION

There is ample free parking at the Expo Center. Also, the TRAX station located at 9400 South is within easy walking distance.

THE EXAMINATION

Utah administers the Uniform Bar Examination (UBE). It is a two-day process. On the first day, the written portion of the exam is given and involves six hours of testing. The written portion includes six questions from the Multistate Essay Examination (MEE) in the morning and two Multistate Performance Tests (MPT) in the afternoon. On the second day, the Multistate Bar Examination (MBE) is given. The MBE also involves six hours of testing. For security reasons, test takers who finish early must remain quietly in their seats until the exam is over. Please note that examinees who miss the first day of the examination are not permitted to sit for the second day.

The lunch break is approximately one hour, beginning sometime between 11:30 a.m. and 12:30 p.m. A list of nearby restaurants is attached. No other break periods are given during the test.

Taking into account the time required for registration, the reading of exam instructions and the collection and counting of test materials, examinees will be dismissed between 4:30 and 5:00 p.m. each day.

ANNOUNCEMENT OF RESULTS

Results will be emailed eight to ten weeks after the Bar exam. The precise date that scores will be available is not released. Rather than contacting the Bar, please check your email or online account to determine if exam results have been released. Essay answers cannot be reread or regraded. Results are final and unappealable.

Carefully read the results email. For passing applicants it will contain important information regarding the steps that must be taken in order to be admitted. For those needing to retake the exam, it will provide the application filing deadline for the February 2020 exam.

Restaurant Information This list is provided as a general guide for your convenience and is subject to change. You should confirm the information prior to the date of the Bar exam as the accuracy of the list is not guaranteed.
