Les Cahiers du Conseil constitutionnel Cahier n° 13 Commentaire de la décision du 4 avril 20022 Arrêtant la liste des candidats a l'élection présidentielle En application des dispositions de l'article 3 de la loi organique du 6 novembre 1962 relative à l'élection du Président de la République au suffrage universel, le Conseil constitutionnel a, lors de sa séance plénière du 4 avril 2002, arrêté la liste des candidats à l'élection présidentielle du 21 avril 2002. Pour établir cette liste, le Conseil constitutionnel a effectué les vérifications qui lui incombaient : - tant en ce qui concerne les présentations de candidats par les élus habilités (procédure dite des « parrainages »); - qu'au regard des autres conditions auxquelles la loi organique subordonne la validité des candidatures (âge, possession des droits civiques, inscription sur une liste électorale, déclaration patrimoniale...). Queer Citizenship in Contemporary Republican France
View metadata, citation and similar papers at core.ac.uk brought to you by CORE provided by Stirling Online Research Repository The PACS and (Post-)Queer Citizenship in Contemporary Republican France Cristina Johnston, University of Stirling, UK Abstract This article examines the theoretical debates that have arisen from the development and subsequent implementation of same-sex partnership legislation in France in 1999. The significance of these debates extends far beyond the specific legislation that triggered them and can be understood as contributing to a far broader analysis of the relevance of traditional French republican ideologies to the realities of contemporary, metropolitan France. The article outlines the socio-political climate against which the legislation evolved and demonstrates how its detail engages with, and challenges, key notions at the heart of French republicanism such as, for instance, the public/private division and questions of kinship, filiation, and the family. Through analysis of the writings of three key figures at the interface of sociological analysis and queer studies in France – Frédéric Martel, Eric Fassin, and Maxime Foerster – I examine how same- sex couples have come to act as figureheads for the problematic status of minority groupings more generally. Ultimately, the article seeks to examine whether this legislation can, through the dialogue and debate it has provoked, pave the way for what can be termed ‘post-queer’ French citizenship, a renegotiation of the relationship between queer citizens and the republic. The French Spring of la Manif pour tous: Conservative Protests against Same-Sex Marriage and Adoption in France Posted on November 26, 2013 Share on facebook Share on twitter Share on email Share on print More Sharing Services 6 Click on the images below to navigate the articles in this special feature. by Léa Morabito On September 14th and 15th 2013, la Manif pour tous, a French protest group fighting against same-sex marriage, organized a summer school near Paris to celebrate a year of mobilization against the Taubira law. This law, named after the French Minister of Justice, Christiane Taubira, passed in April 2013, legalizing same-sex marriage and the adoption of children by same-sex married couples. In August, le Printemps français, another group protesting against the law, had also organized a summer school, which lasted a week and took place in a castle in the countryside. The summer schools were opportunities to take stock of the protests organized for the past year, but also to plan new offensives against the socialist government and its projects dealing with family and education. These groups’ new bêtes noires are now the extension of medically assisted procreation to lesbian couples – which was excluded from the Taubira law but is demanded by LGBT groups – and what conservative groups call ‘gender ideology’, especially at school. These conservative groups denounce the promotion of sex and sexual undifferentiation leading to the normalization of homosexuality, transgenderism and queerness. In spite of their failure to prevent the passing of the law, la Manif pour tous and le Printemps français display a willingness to keep on protesting and consider their year-lasting mobilization to be a victory. -

Kiely - University College London Abstract: In June 2000, the French Senator Françoise Abadie defined homosexuals as ‘les fossoyeurs de l’humanité’ [‘the gravediggers of humanity’]. This definition, which came as the Senator’s reaction to the recently enacted PaCS or Civil Partnership legislation, neatly circumscribes the homophobia of the twenty-year period that had preceded it from the beginning of the HIV/AIDS crisis. Concentrating on gay men, this paper focusses on the connections between HIV/AIDSphobia and homophobia in France by focussing firstly in particular on one case of homicide in the late 1980s – that of ‘le tueur de vieilles dames’ [‘the killer of old ladies’], Thierry Paulin, who admitted to at least twenty-one killings, but whose murderous acts were imbricated indissociably by the press not only with his ‘identity’ as a homosexual, but also with his serological status – thought perhaps to have rendered him disturbed. In this period, HIV infection, homophobia and identity become intertwined with murder, be it in the literal bludgeonings of Paulin, or the fear of gays as spreaders of a deadly disease to the ‘innocent’ heterosexual population in what ACT Up-Paris call ‘le fantasme du séropositif meurtrier’ [‘the fantasy of the murderous HIV-positive person’]. More worryingly, this logic extended to isolationist and even homicidal logic against HIV sufferers around the world, leading Leo Bersani to ask in in 1987 – ‘Is the rectum a grave?’ Just over a decade later, the Pacte Civil de Solidarité (PaCS) [‘Civil Union’] debates saw similar amalgamations between HIV/AIDS and gay identity, mixed with the homicidal rage of certain of the anti-PaCS demonstrators. -

The French Presidential Election: An Assessment By Thierry Leterre, Professor of Political Science, Faculty of Law and Political Science, University of Versailles, St. Quentin In the Constitution of the Fifth Republic (founded by General Charles de Gaulle in 1958), the presidency is the key-stone of French institutions. Presidential elections are dramatic moments in the country’s democratic life: the people of the Republic choses by direct universal suffrage the incarnation of its sovereignty for five years. (The term was seven years until the 2001 constitutional revision: see US-France Analysis by Olivier Duhamel, “France's New Five-Year Presiential Term, http://www.brookings.edu/fp/cusf/analysis/quinquennat.htm). The President of the Republic is elected by an absolute majority of votes cast. If no candidate obtains a majority on the first ballot, a second ballot is organized with the two candidates who have won the greatest number of votes in the first ballot. This two-round system avoids an election with only a relative majority and prevents third party candidates-such as Ross Perot or Ralph Nader in recent American elections-from distorting the outcome. The French believe this would weaken the bond between the nation and its supreme representative. Any French citizen who meets certain eligibility criteria can run for president. These criteria include paying a deposit of €153,000 and getting “500 signatures”-the patronage of at least 500 elected officials (from a list of about 45,000) from 30 départements. There are some 15 official candidates in the 2002 election (see table). The final contest, however, will be a showdown between two, and only two, competitors. -

Making Sense of the Anti-Same-Sex-Marriage Movement in France Scott Gunther [“Making Sense of the Anti-same-sex-marriage Movement in France,” French Politics, Culture and Society, summer 2019, Volume 37, Issue 2] Abstract This article examines the political style and rhetoric of the Manif pour tous (MPT), the main organization opposing same-sex marriage in France, from summer 2013 to the present. It exposes how the MPT's style and rhetoric differ from those of their American counterparts, and what this tells us about the different strategies of political movements in France and the United States generally. It is based on an analysis of the language used by activists whom I interviewed in 2014 and 2015 and on a discourse analysis of the MPT’s website, Facebook page, Twitter feed, and press releases since 2013.
