MEMORANDUM October 30, 2003 To: Members of the City Ethics Commission From: Mark Low, Senior Policy Analyst Re: Commissioner Boyarsky Request For Data Regarding Contributions by City Commissioner-Lobbyists and Their Clients Relative to the 2001 City Elections At your September 9, 2003, meeting, Commissioner Boyarsky requested data regarding contributions made to candidates in the City’s 2001, 2003, and secession- related elections that were attributable to City commissioners who were also lobbyists (“commissioner-lobbyists”). Additionally, Commissioner Boyarsky requested that the staff also report on contributions made in those elections by those commissioner- lobbyists’ clients. Contributions made by these entities relevant to the 2001 Citywide elections is detailed in this report. Contributions that may have resulted from the fundraising efforts of commissioner-lobbyists are not included here.1 Due to the time needed to conduct the requested research, this report is limited to data from the 2001 elections; it does not include information for the 2003 or secession- related elections. If you would like us to report on those elections at a future meeting, we would be happy to do so. 1 Existing law requires that lobbyists disclose political contributions they make, deliver, or for which they acted as an intermediary to City candidates and officeholders. Registered lobbyists who engage in fundraising activities, including hosting or sponsoring political fundraisers, will be required to disclose the contributions to City officeholders and candidates that result from those activities effective January 1, 2004. City Ethics Commission October 30, 2003 Page 2 of 9 Background For purposes of compiling the requested information, we first determined which City commissioners during the 2001 election cycle were also registered lobbyists during the same time period, namely 1999 though 2001—the fundraising window for the 2001 elections. According to the Office of the City Clerk, which maintains the listing of sitting commissioners on the 59 City boards and commissions that serve the City of Los Angeles, 369 commission positions exist. According to that office, their listing is perpetually updated as new appointments are made to fill vacancies created by Commissioners leaving their posts due to term expiration or by their voluntary resignation. The Clerk, however, does not maintain a historical list of past commission members. To ensure that the list of commissioner-lobbyists during the time periods under review was complete, we reviewed the City Ethics Commission’s database of the over 250 commissioners whose pre-confirmation Statements of Economic Interests were reviewed by the Commission during that period. While the universe of commissioners identified by these methods does not include any individual who already was a sitting City commissioner prior to the 2001 election cycle, given the limited historical information available it nonetheless provides the best available gauge of the commissioners serving the City during the period. Mike Monasmith Board of Los Angeles Verizon California Export Terminal Katherine Moret Metropolitan Water District Katherine Moret of Southern California Robyn Ritter-Simon West Los Angeles LA Area Chamber of Commerce Area Planning Lisa Specht Recreation and Parks Manatt, Phelps & Phillips, LLP City Ethics Commission October 30, 2003 Page 3 of 9 Ronald Stone Board of Neighborhood Strategic Government Affairs Commissioners Contributions Made by Commissioner-Lobbyists Using the list of the above nine commissioner-lobbyists, we searched the Commission’s campaign electronic filing database (http://ethics.lacity.org/campaigndb.cfm) and analyzed quarterly lobbying reports filed for the years 1999 through 2001 to determine the amount of contributions these nine individuals were reported to have made to candidates in the 2001 City elections. For purposes of this analysis, we considered the contribution to be “made” by a commissioner/lobbyist only if: (1) the contribution was made during the commissioner’s term of City service, and (2) the commissioner was also registered to lobby in the City at the time the contribution was made. For the 2001 primary election—when all three Citywide offices and seven Council seats were on the ballot—four commissioner-lobbyists contributed a total of $9,900 to candidates in that election. Five had no reportable contribution activity for the period. For the 2001 general election cycle, three commissioner-lobbyists contributed a total of $6,500 to candidates running in that election. In total, commissioner-lobbyists contributed $16,500 to all candidates in both elections. For reference purposes, contributions from all sources to candidates in the combined 2001 primary and general elections totaled $31.7 million. A review of quarterly lobbying reports filed with the Commission from 1999 through 2001 revealed that two commissioner/lobbyists disclosed contributions totaling $5,500 they delivered or for which they acted as an intermediary to candidates in the 2001 primary election.
