The attached 10 pages of regulations, dealing with 4 AAC 04.210, 4 AAC 12.305,4 AAC 12.310, .395; Designate and Establish Qualifying Scores of Teacher Competency Examination, etc, are hereby certified to be a correct copy of the regulation changes that the State Board of Education & Early Development adopted at its March 14, 2014, meeting, under the authority of AS 14.07.060, AS 14.20.030, AS 14.20.010, AS 14.20.020, AS 14.50.080, and after compliance with the Administrative Procedure Act (AS 44.62), specifically induding notice under AS 44.62.190 and AS 44.62.200 and opportunity for public comment under AS 44.62.210.

This action is not expected to require an increased appropriation.

On the record, in considering public comments, the State Board of Education & Early Development paid special attention to the cost to private persons of the regulatory action being taken.

The regulation changes described in this order take effect on the 30th day after they have been filed by the lieutenant governor as provided in AS 44.62 .1 80.

We have reviewed the attached regulations from the State Board of Education and Early Development. I have reviewed this project under a specific delegation dated May 13, 20 I 4 from the Regulations Attorney. A duplicate of this memorandum is being furnished to Commissioner Hanley, along wi th a copy of the regulations.

The Department of Law has reviewed the attached regulations against the statutory standards of the Administrative Procedure Act. Based on our review, we find no legal problems. This memorandum and the attached duplicate memorandum dated May 14, 2014 constitute the written statement of approval under AS 44.62.060(b) and (c) that authori zes your office to file the attached regulations.

The regulation changes were adopted by the State Board of Education and Earl y Development after the close of the public comment period. The regulations update provisions that set out the examinations required for teacher certi fication.

The certification order for the regul ati ons states that this acti on is not expected to require an increased appropriation. Therefore, a fiscal note under AS 44.62.195 is not required.

We have made some technical corrections to conform the regulations to the drafting manual under AS 44.62.060 and 44.62. I 25 . BRIEF DESCRIPTION

The Department of Education & Early Development proposes to amend this regulation to allow revised, updated and new exams to be used for teacher certification and to further clarify requirements for an endorsement in school psychology.

The Department of Education & Early Development proposes to adopt regulation changes in Title 4 of the Alaska Administrative Code4 AAC 04.210 Highly Qualified Teachers, 4 AAC 12.305 Teacher certification, 4 AAC 12.310 Designation and qualifying scores of teacher competency examination, and 4 AAC 12.395 Endorsements, which may include issues such as the following:

The Department of Education & Early Development proposes to amend this section by: 1) revising and updating Praxis II scores for highly qualified and professional certification; 2) adopting a new version of the Praxis I examination for initial certification; 3) adopting new examinations for the purpose of adding an endorsement; and 4) clarifying the requirements for an endorsement in school psychology.
