Senator Muhammad Talha Mehmood: Will the Minister for Water and Power be pleased to state: (a) the details of private power producers in the country; and (b) the quantum of electricity purchased by the Government from each of the said power producers during the last five years indicating also the rate at which the same was purchased in each case? Khawaja Muhammad Asif: (a) Private Power and Infrastructure Board (PPIB) is currently administrating thirty one (31) commissioned private power projects with a cumulative gross capacity of 9,081.50 MW. These projects are based on various technologies such as diesel engines, combined cycle, steam turbines consuming a variety of fuels such as gas (pipeline or low BTU), RFO and hydel resources. List of commissioned Independent Power Producers (IPPs) is placed at (Annex-A). (b) The quantum of electricity purchased by the Government during the last five years from power producers alongwith their rate of purchase is placed at (Annex- B & C)

Question No. 116 stands in the name of Senator Muhammad Talha Mahmood. *Question No. 116. Senator Muhammad Talha Mehmood: Will the Minister for Water and Power be pleased to state the details of increase made in electricity tariff during the last five years indicating also the basis / reasons for increase in each case? Khawaja Muhammad Asif: (a) A utility can run its operations only if full cost of supply is recovered through tariff. NEPRA determines tariff of all distribution companies based on cost of supply of each company. Tariff determined by NEPRA is being charged to consumers after its notification by GOP. However, GOP notifies uniform tariff that stands lower than the tariff determined by NEPRA due to its policy based on socio-economic conditions of the country. The difference between NEPRA determined Tariff and GOP notified tariff is paid by the government as Tariff Differential Subsidy. The regulator considers various factors while determining the tariff which can result in increase in tariff. Question No. 117 stands in the name of Senator Mohammad Talha Mahmood. *Question No. 117. Senator Muhammad Talha Mehmood: Will the Minister for Water and Power be pleased to state: (a) the year in which the last audit of accounts of National Power Construction Company was conducted; and (b) whether any irregularity was surfaced in the report of the said audit, if so, the details thereof and the action taken in the light of that report? Khawaja Muhammad Asif: (a) The last Audit of Accounts by the Office of Auditor General of Pakistan was carried out for the year ended June 30, 2013. In addition, Audited Accounts of NPCC and report of the Auditors for the year ended 30th June 2013 & 2014 prepared by the Chartered Accountants appointed by NPCC Board, have been approved in the 39th and 40th Annual General Meeting of the Company respectively. (b) The replies/clarifications to the observations/ comments of Audit authorities were of routine nature and have already been recommended for formal settlement. ںھٹ ےہ۔ We now move on to question No. 118. Question No. 118 stands in the name of Senator Mohsin Aziz. *Question No. 118. Senator Mohsin Aziz: Will the Minister for Water and Power be pleased to state: (a) the criteria laid down for appointment of CEO’s of Power Distribution Companies (DISCOs) in the country; and (b) whether it is a fact that CEOs of most of the DISCOs are working on contract basis at present, if so, the reasons thereof?

Khawaja Muhammad Asif: (a) The criteria lay down for appointment of CEO’s by the Ministry of water and Power being the owner of the Company is as under:— i. CEO should be thoroughly familiar with the economic, social legislative and political enviromnent in which today’s electric utility industry operates.

ii. CEO should have an understanding of legislative and community relationships, essential for utility’s growth.

iii. CEO should hold a professional degree, minimum Bachelor, from a recognized institution.

iv. Preference will be given to CEO holding a Master’s Degree in business, management, accounting, communication or engineering.

v. CEO should have overall minimum of 15 years of professional experience preferably in Power Distribution Sector, 10 years of which should in Public/Private Sector serving in a senior management position.

vi. 5 (2) of Public Sector Organizations (Corporate Governance) Rules, 2013, which is reproduce as under:

“The Board shall evaluate the candidates based on the fit and proper criteria and the guidelines specified by the Commission for appointment to the position of the chief executive, and recommend at least three individuals to the Government for appointment as chief executive of the Public Sector Company. On receiving concurrence of the Government, the Board shall appoint the chief executive in accordance with the provisions of the Ordinance. The Board shall also be responsible for development and succession planning of the chief executive.

Several new solar and biomass based power generation projects have also been launched by the present Government, as shown at Annex-I, which are in different stages of development. The projects are being developed through private investors and no government expenditure is involved. 2. Private Power and Infrastructure Board (PPIB) Private Power & Infrastructure Board (PPIB) under the auspices of Ministry of Water & Power has been working to attract and facilitate foreign direct investment (FDI) for private sector power projects in Pakistan. PPIB is actively pursuing establishment of several hydel/coal based IPPs and Private Sector Transmission Line Projects. The present government has launched several hydel and coal based power projects with cumulative capacity of 8571 MW to facilitate foreign investment to the tune of US $ 12,332 Million. These projects are at various stages of processing and development. Details are at Annex-II. PPIB processes power projects in the private sector only i.e. without involvement of funds from public sector. Further arrangement of financing ieguired for establishment of power project is either through equity injection and/or lending is responsibility of the sponsors.

However, project wise status is as under:— Right Bank Outfall Drain (RBOD): • There are three components of RBOD Project i.e RBOD-I, RBOD-II & RBOD-III.

• RBOD-I & RBOD-III Projects are being executed by WAPDA whereas RBOD-II Project is being executed by GoS.

RBOD-I Project:

The updated physical progress of the Project is 89.69%.

The project has been delayed due to financial constraints and is expected to be completed by December 2015 subject to the availability of funds.

RBOD-III Project:

The updated physical progress of the Project is 82.80%.

The project is delayed due to financial constraints apd realignment issue between Provincial Irrigation Departments GoS and GoB and is expected to be completed by December 2015 subject to resolution of realignment issue as well as timely release of funds.

RBOD-II Project:

The construction of RBOD-II Project is being carried out by GoS from Schwan to Sea in order to dispose off entire effluent of RBOD. The work is 72% completed and is under progress.

Left Bank Outfall Drain (LBOD) Project:

• LBOD Stage-I Project is located on the left side of River Indus under the perennial command of Rohri Canal and Nara Canal.

• The Proejct was executed during 1984-1997 by WAPDA and is aimed at providing drainage facility to 1.270 Million acres of districts Nawabshah, Sanghar and Mirpurkhas which has been handed over to Provincial Irrigation Department. GoS by WAPDA as under:—

The most important part has been omitted hence the substance has been taken out of my question. I will come to it later but allow me to say a few words about this great human tragedy which has fallen on people of my area, in 2005 earthquake in the city of Balakot, 5000 people died and the living were rendered homeless, after passage of ten years, they are homeless. The city lies on the fault line and as such the ERRA decided that no permanent construction will take place here, it was decided to build a new city in another tehsil. I think, this was intensely a wrong decision that population of one tehsil was shifted to another tehsil disturbing the demographic mosaic of the area. I think, there has been a reason that people have been dragging feet and this project has not seen fulfillment even after passage of ten years. I would like to ask ERRA and Government of Khyber Pakhtunkhwa, they are blaming each other. The people visited Government of Khyber Pakhtunkhwa and Government of Khyber Pakhtunkhwa says that it is ERRA’s project; ERRA says that the land is not being given to us. (R) Syed Tahir Hussain Mashhadi: Will the Minister for Law, Justice and Human Rights be pleased to state: (a) whether it is a fact that Pakistan has signed United Nations convention on Child Rights in 1990; (b) whether it is also a fact that the incidents of domestic violence against the children are increasing in the country, if so, the steps taken / being taken by the Government to control the same? Senator Pervaiz Rashid : (a) Pakistan ratified the United Nations Convention on the Rights of the Child on November 12, 1990. (b) It has been reported by media that incidence of domestic violence against children is increasing. According to data collected by the Ministry of Law, Justice and Human Rights, there are 157 cases of domestic violence against children during this year. After the 18th Constitutional Amendment, the subject has been devolved to the provinces; however, various legal and programmatic measures have been undertaken by the federal and provincial governments. The details are as under: Measures taken/being taken at Federal level: • At Federal level, draft Domestic Violence (Prevention and Protection) Bill for ICT has been drafted by National Commission on the Status of Women (NCSW) and forwarded to this Ministry to introduce in the National Assembly. The draft Domestic Violence Bill

has been shared with the stakeholders for their comments and be finalized and introduced in the National Assembly shortly.

• A Criminal Law Amendment Bill has been drafted which covers all aspects of child protection/ violence. The Bill has been referred to the National Assembly Standing Committee on Law, Justice and Human Rights for its review.

• Another Bill has also been drafted for establishment of an independent commission to monitor, protect and promote the National Assembly Standing Committee on Law, Justice and Human Rights for its review.

• A project titled “preventing violence against children in Pakistan” is being implemented with the support of SAARC Development Fund. The South Asia Initiative to End Violence against Children (SAIEVAC), an apex body of the SAARC, a Strategic Work Plan 2011-2016 is also being implemented to end violence against children.

• The Pakistan Bait-ul-Mal has launched Child Domestic Labor Project to contribute to the progressive elimination of child labor in domestic service in the country and to protect children working as domestic servants though the Basic Education Enabling Program (DEEP).

• A National Campaign against Corporal Punishment has been launched with support of UNICF during, 2014. • The Commission on the Status of the Women is mandated to oversee cases of violence and abuse of girl child in the country and take appropriate actions. • The Wafaqi Mohtasib has appointed Child Commissioner at the Federal level and Provincial

Ombudsmen have appointed Child Commissioner to monitor and address such grievances. • On the direction of the Prime Minister of Pakistan, a National Action Plan has been prepared to improve the situation of Human Rights including child rights. • The Ministry of Law, justice and Human Rights is in process in setting up Human Rights Management Information System (HRMIS) to streamline the disaggregated data/information on cases of human rights violation including domestic violence against children. Measures taken/being taken at provincial level: Khyber Pakhtunkhwa (KP): • A Bill on domestic violence has been referred to a committee for further deliberations. The Government of KP has established Child Protection and Welfare Authority and Child Protection Units for the protection and rehabilitation of vulnerable children under the KP Child Protection and Welfare Act, 2010. Sindh: • The Government of Sindh has enacted Domestic Violence (Prevention and Protection) Bill, 2013. A commission will be constituted to monitor the implementation of legislation in this regard. Furthermore, the Government of Sindh has promulgated the Sindh Child Protection Authority Act, 2011. Punjab: • The Government of Punjab has drafted a Bill to prevent violence against women including girl child. Moreover, the Government of Punjab has established

Child Protection and Welfare Bureau/ Child Protection Units for the protection and rehabilitation of vulnerable children under the Punjab Destitute and Neglected Children Act 2004. Balochistan:

• The Balochistan Domestic Violence (Prevention and Protection) Act, 2014 has been enacted by the Government of Balochistan.

Senator Nawabzada Saifullah Magsi: Will the Minister for Housing and Works be pleased to state: (a) the number of officers / officials belonging to Balochistan who have been allotted Government accommodations in Islamabad since June, 2013; and (b) the steps taken by the Government to overcome shortage of Government accommodations in Islamabad during the last ten years? Mr. Akram Khan Durrani: (a) 08 officers/officials belonging to Balochistan have been allotted Government accommodations in Islamabad since June, 2013 (list enclosed as Annex-A). (b) The Federal Cabinet has decided on 13-3-1995 that the Federal Govt. shall not carry out any new construction of official residences for the Govt. employees. Therefore, none of the

56 new schemes for construction of govt. accommodation at Islamabad have been launched during the last ten years.

(b) In pursuance to the orders of Supreme Court of Pakistan in C.P. No. 1498/2011, the Ministry of Housing and Works is making allotment of government accommodations strictly on merit from the General Waiting Lists. *Question No. 132. Senator Sirajul Haq: Will the Minister for Law, Justice and Human Rights be pleased to state the names of the persons acquitted in cases under Juvenile Act during the last four years indicating also the nature of allegations and details of decision in each case? Senator Pervaiz Rashid: After the 18th Constitutional Amendment, the subject of minor has been devolved to the provinces. The required information to respond the said question relates to Judicial System (High Courts/Courts of Session) which are not in the control of the Government. Accordingly, the Islamabad High Court, Provincial Governments including Gilgit Baltistan were requested on 6th May, 2015 to provide the requisite information. To this effect, following steps are being taken:

• The government has introduced Petroleum Policy, 2012 with better incentives • New exploration Licences are being granted. During the tenure of this Government 46 new exporlation

licences covering an area of 95,225.58 Sq. Kms have been granted to different E&P companies. • 186 wells have been spudded since 05-06-2013. • Monitoring of E&P activities have been enhanced. • 9919 L/Kms. of 2D and 7704 Sq.Kms. of 3D seismic survey have been acquired since 05-06-2013 . • Apart from conventional reserves, the Government is also making all out efforts to pave way out for exploration of unconventional reserves like Tight gas, Shale Gas, Marginal fields and Low BTU gas etc. By taking the aforesaid steps, additional volume of around 34,000 Barrel of Oil per day (BOPD) of oil and around 500 MMCFD of gas has been added in the system. During the tenure of current Government 54 discoveries have been made since 05-06-2013 and 1,010 BCF reserves of gas and 16 Million US barrels reserves of oil have been discovered. 14 discoveries are under evaluation. There is two-pronged manifestation of import of oil, i.e., crude oil imports to be processed by the Local refineries to produce refined petroleum products and direct import of refined petroleum products. As regards, reduction in imports of refined products, Government is encouraging establishment new Oil refineries by the private sector. Recently, Byco has installed a new refinery with total capacity of 5.45 million tons per anum and total refinery capacity in the country has increased from 13.34 million tons to 18.79 million tons per anum. This will substantially reduce the deficit of refined products leading to lesser dependence on direct imports of refined products. *Question No. 136. Senator Sirajul Haq: Will the Minister for Law, Justice and Human Rights be pleased to state: (a) the number of reports prepared by Council of Islamic Ideology since its inception with year wise break up; (b) the number of the said reports presented before the Parliament; and

(c) the number of those reports discussed in and legislated upon by the Parliament? Senator Pervaiz Rashid: (a) The Council of Islamic Ideology (CII) since its inception has prepared 69 reports up till 2011-12 (detail is at Annex-I). Whereas, the annual reports for the year 2012-13 and 2013-14 have been sent to the Printing Press for publication and will be shortly placed before the Parliament. (b) Up till now, total 69 reports have been placed before the Parliament. (c) Debate on the reports has not taken place. 35 reports were placed before 1990 (Annex II) and the remaining reports were laid thereafter. A special committee was setup in the Senate in 1990 which divided the recommendations contained in the reports of the Council of Islamic Ideology till then into following six heads:— (a) Islamic Social Order (b) Education System (c) Aqaid-o-Ibaadat (d) Mass Media (e) Economic System (f) Law and Justice System

The special committee submitted its report containing recommendations of the Committee on the heads a (a), (b), (c), (d) above, which also could not be discussed in Senate. Discrimination Against the Officers from Sindh and Balochistan Senator Col. (R) Syed Tahir Hussain Mashhadi: Thank you sir. I move to call the attention of the honourable Minister Establishment to the recent, unjust and discriminatory decisions against Pakistan Administrative Services (PAS) officers belonging to the Province of Sindh and Balochistan taken by the Special Committee and SSB-1 in the recently held meeting. The Committee while promoting 13 officers from PAS grade- 21 to 22 completely ignored officers from Sindh and Balochistan. Not a single officer from the Province of Sindh and Balochistan was promoted to Grade-22. The injustice to these two provinces is already prevalent out of 40 Federal Secretaries only one belongs to Sindh. Three junior PAS officers are working as Additional Secretaries, whereas there are officers senior to those and yet they have not been considered to meet the shortfall leaving Sindh highly under represented at the highest level in the Federal Government. It is reported that 8 officers of PAS group from Sindh province have been superseded or deferred/ ignored despite the fact that they were meeting the required criteria. But officers junior to them belonging to Punjab were given additional marks by the Board and were cleared for promotion from BS-20 to 21. Similarly a number of officers from Sindh despite meeting the criteria for promotion from BS-19 to 20 were ignored/ superseded. As per para 4 of Article 27(1) of the Constitution under representation of any class or area services is to be redressed through an Act of Parliament but in recent years instead of redressal the

75 under representation of Sindh and Balochistan the gap has widened. I request that the Government through its honourable Members may give the reasons for such victimization and unfair treatment to two most important federating units of Pakistan i.e. Sindh and Balochistan and to state the concrete steps being taken by this government to remove this grave injustice. Sir, it’s a matter of great regret and sorrow. The Province of Sindh and Balochistan have been from long ignored, suppressed/ oppressed whatever neglected for some reasons or the other they have always been given step motherly treatment. In every affair of development they have been left behind, when it comes to sharing of power at the center they have always been completely ignored. We have had to fight for our rights throughout since the very conception of this great nation of ours. Sindh by the grace of God and Balochistan have produced the most prominent citizens that this great nation of ours has yet produced. You take it from Quaid- e-Azam to Shaheed Zulfiqar Ali Bhutto to Bibi Benazir Bhutto Sahiba to A.K. Brohi to Sadqain, the list is never ending and in Civil Service we have provided the best the land has ever produced. They have given their best service to this great nation of ours and yet when the time comes, when these types of promotions were held what answer you can give to the loyal people of these two provinces. Out of 39 Ministries today you had no Secretary from the Province of Balochistan. Balochistan doesn’t belong to Pakistan, is Balochistan not part and parcel of

76 the Federation of Pakistan. Doesn’t Balochistan having any right, do the people of Balochistan have not any right, should the students of Balochistan stop studying because they are not going to get any job, they are not going to be treated at par with the rest of Pakistan, they are going to get nothing, when the time comes, when the paramount comes, when the time comes to rise to the top, they are going to be deprived just because they belong to a backward province or may be don’t belong to the blue-eyed province. Now these types of things are very, very harmful for the Federation, harmful for the national integrity, harmful for the national unity, harmful to the very concept which created this great land of ours. The land of opportunity, the land for all on equal terms, not only for the provinces, but land of all religions. Quaid- e-Azam promised all the religions that they will have equal representation in this nation of ours. Everybody will have equal rights and yet the rights of province of Balochistan have been completely ignored. And Sindh, out of 37, we have one Federal Secretary. Why are we being punished, why are the people of Sindh being deprived in such a manner. The injustice can be further seen. It’s all on proof, it’s in writing. All you have been doing bring on your records. The honourable Minister must go back to his Ministry and just bring on the records. There are the officers who were superseded; Mr. Iqbal Bablani, from the Common Group 13, he had a score of 73. Regarding this matter before you decide, I appreciate the suggestion of the honourable Minister. if we are going to appoint a committee, that would be a wonderful thing but in the meantime, there should be a stay from the Government side for implementation of their so-called promotion policy. Of course, this matter has to go to the Prime Minister and we have full faith and hope that the Prime Minister will give due justice to the smaller provinces. If they could wait for sending up the summary, for the report of the committee which could be an urgent meeting and we could put up our recommendations, it would strengthen and clarify the case for the honourable Prime Minister as what actually is happening. An Evaluation Committee was formed and that Evaluation Committee did the technical, financial and many other aspects of all these companies. A due diligence was done of all these companies and all three companies were given very balanced platform, giving them whole data of about HEC, so that they can evaluate and come up with their proposals. س س س س س س س ں data evaluate companies ن ان وتن س ئ ںکا ا و ر ا نپ خو اےل ےس انون ئ ا ی س proposals بائ سر وع ںک۔ On 3rd of March somehow Fauji Company went back and did not come after, I guess who are going through the whole documents and data they had seen and the balance sheets and everything. They backed off

92 on the 3rd of March and, at the same time, Elahi Company which was supposed to give earnest money, on the 4th of March, did not show up further earnest money. That is why first the Fauji Company and then others somehow did not come into the bidding process. And a company which I really do not know what that Cargill and everything is but that Cargill Company remained.

Somehow this company is a subsidiary of Cargill progressive Group, it is a Cargill Progressive Group in Kenya and this is, you can say, a subsidiary of Cargill Holding Limited which was made out of that Kenyan company. We all very much know that all big companies in the world when they look upon different opportunities to go into bid process for investment or any such opportunities in the world, س س وہ ا ن ی ےہ mother companies ےس نبر ا ا۔ے subsidiaries بائ ے ں ہ which go into different areas for investment or any other business venture they want to do in. So, their main company is basically Cargill Progressive Group and Cargill Holding Limited is its subsidiary. This I want to clear and yes, it is not registered in Pakistan. It is registered in Kenya and in this process of documentation, it was stated that international bidding of any company would be acceptable and it was not bound for any company to be of Pakistan. So, I am sure, the Cargill Company Holding which honourable member was referring and which was registered in Pakistan as a Company

ہ س س س م س س انون ئ ا نی apprehensions اس ںیل اط ےہر یک ےہون یگ ہک سا ںی ان کا ان ےس کوئ relationship ےہو but I tried to clear it, it was a company of subsidiary of Cargill Progressive Group in Kenya. At the same time when their processes, technical evaluation and all things were done and at the end only company which left out was basically Cargill Company. The matter was taken up in the PC Board for its approval and, at the same time, in the CCoP and at the same time, as they mentioned of Deloitte was hired to assess what should be the value of this whole divestment which we are going to do. Let me correct, let me not in terms of share holding but in terms of money value, I would say, Deloitte had given a range from 400 million to 900 million rupees. If anything in between this comes up, then there can be a way forward of negotiating further with them. So, the price was negotiated obviously with the bidder. The final bid which came up was 1100 million, it was not 200. The over all money for which the bidding was final, I will read it out; the CCoP was again requested to consider, decide upon the revised offer of the sole bidder given in para, the CCoP in its meeting held on 26th of March 2015 considered the recommendations of the PC Board and approved the sale of the HEC. Subsequently, the letter of acceptance was issued to the buyer on the 7th April, 2015 with the condition to finalize the share purchase agreement within the next 25 days for a full and final sale consideration amount to approximately Rs.1100 million.

Now, the bifurcation of that 1100 million is such cash to be paid was, yes 250 million running finance liability of BOK 435 million, gratuity was 30 million, potential tax benefit from losses was 190 million and sales tax refund was 191 million, at all. So, this was basically, the whole process which was taken in terms of seeing divestment of HEC. The Boards of the company were taken on board in every step from the first stage of bidding to processing from evaluation for negotiating with the final bidder and the processes and the final amount to which it was finally like as said with all its details was diversified. First and the foremost I express my gratitude to Almighty Allah who has bestowed honour and responsibility upon me to be here, then to the Leadership of Pakistan Tehreek-e-Insaf and all MPAs of Khyber Pakhtunkhwa who trusted me, voted for me and I am here today. Mr. Chairman, let me acknowledge the distinguished services that you have rendered all your life for the supremacy of law and sustainability of democracy. I applaud your vision, your integrity and rare contents of moral character that all along you have shown and because of that you have earned respect across the board among all parties and their leadership. I assure you sir that I will cooperate with you for the integrity of the House and for my great nation. Mr. Chairman, let me also say to all Members of this August House, to all of them that I will join, follow their collective wisdom to uproot corruption, extremism and terrorism that we are facing today. I cannot forget

97 the day when twenty-six Members of this House stood by me in Supreme Court of Pakistan in case of Reko Diq, they have supported me in Hajj corruption case and many others public related cases. Sir, in the years to come, in the days to come, I will be needing their supports, their prayers and their cooperation not for myself but for the people of this country and especially for the people of Khyber Pakhtunkhwa and other under developed parts of the country who have been left behind to enjoy prosperity and progress.
