Bar Packages The Pony* $20/person for three hours. This bar includes house brand liquors, sodas, domestic bottled beer and both red and white house brand wines (see product list.) Up-charge of $2/person for imported or craft beers. Up-charge of $2/person for any wine listed at $28/bottle or less. The Mustang* $30/person for three hours. This bar includes call brand liquors, sodas, domestic bottled beer and red and white house wines (see product list). Also includes all items in the Pony Bar and listed up-charges. The Stallion* $40/person for three hours. This bar includes premium brand liquors, soda, domestic and imported bottled beer, and house brand red and white wines along with one moscato, one up-charged red and one up-charged white wine (see product list). Also includes all items from The Pony and Mustang Bars. The Stampede* Bar set up fee: $55 per bar. Includes normal bar mixers and set up. 125 guests and under: One bar 126+ guests: Two bars Bartender fees: $30/hour per bartender. Minimum of two bartenders per bar for 50+ guests. Minimum of $400 in start-up products. Have it your way! Set up your bar with select products that we offer or have us check to see if we can get the product you want. All products are charged by the full bottle of liquor or wine (any additional bottle opened is charged full bottle price), sodas are by twelve count, and beer by twelve count of brand. You may limit the number of bottles to be used. If you request a specialty beer that we don't normally carry you need to tell us the amount of cases and you will be charged for the whole amount. All specialty requests must be made at least three weeks in advance (see product lists). The Round-Up Private Bar* Bar set up fee: $55 per bar. Minimum of $250 in sales per hour or person booking will be charged the difference. We'll stock the bar with a selection of products from all levels of liquor, sodas, wines and both domestic and imported beers. Mixers used are Soda Water, Tonic, Soda, Bloody Mary, Sweet and Sour, Piña Colada, Strawberry Daiquiri, Margarita Mix, Pineapple Juice, Grapefruit Juice, Cranberry Juice, Orange Juice, Tabasco, Soy and Worcestershire Sauce. Additives are Olives, Maraschino Cherries, Pickles, Celery Salt, Lemons, Limes and Oranges. Add Monster as a drink mixer for $4/can. The Stagecoach Bar (Hosted Open Bar)* 1st hour: $13/person 2nd hour: $8/person 3rd – 5th hours: $6/person Includes house and call liquor, house wines and choice of six domestic or import beers. All set up and mixers included in price. Maximum of five hours (see Pony/Mustang Bar for product list). *Number of persons is based on the amount of adults 21 and older confirmed to attend the event. ** Number of persons over the age of 3 confirmed to attend the event. The Mugsy Bar (Soft Drinks)** $4/person for one hour and $2/person for each additional hour. The Draft Horse (Beer, Wine and Soda Bar)* $10/person for one hour and $7/person for each additional hour. Includes red and white house wines, soda and domestic and imported beers. The Carriage Bar (Champagne and Wine Bar)* $12/person for one hour and $8/person for each additional hour. Includes house champagne and house red and white wine (see Pony Bar product list for wines). Bar Package FAQ’s Why use a Pony, Mustang or Stallion over any other type of bar? These are all based on a 3-hour time block per person. No extra fees unless you do upgrades. What is the difference between using the Stampede, the Stagecoach and the Round-Up Bars? The Stampede is all of your own choices, no per person fees, totally hosted and paid for your guests by you, no time limit. The Stagecoach has a pre-chosen product list, has per person fees, a 5-hour time limit and is again fully hosted and paid for by you for your guests. The Round-Up has a product list picked by us, with set up fees and minimums. Either you or your guests may pay for the drinks. Would I be able to have more than one type of bar in one event? Yes, you could have one type for three hours and then add another. Would I be able to add hours to one of the 3-hour bars? Yes, we can accommodate that. Would I be able to add my favorite spirit to one of the bars if it isn't included?     Wine Bar Volunteers One hour before performance Hang coat and place personal belongings in Purple Room. Purses may be stored in box office if volunteer is not comfortable leaving in Purple Room. Get name tag in Box Office and sign in. Immediately plug in coffee maker (takes about 10 minutes to warm up); green light must appear before you make coffee. Set out wine/beer displays, signage, coffee tray, tea basket, napkins, glasses and tip jars. Start tip jars with $1 from cash box. See diagram/photo of Wine Bar set up. Get Wine Bar cash bag from House Manager. Bag should contain $200 for the register, and keys for the Wine Bar cabinets, wine refrigerator and beer cooler. Make coffee starting with hot water (for cocoa and tea), non-caffeinated coffee and then caffeinated coffee. Set 8 cups next to each coffee/water pot; this will help you know when to brew new pot, as each pot holds 8 cups. See separate coffee making instructions for more detail, if needed. 45 minutes before start of show Be familiar with wines and beers for sale (see cheat sheet), and prices of all beverages. Assist guests with purchases. Let them know that they may take drinks into theater (but no glass containers, see below). Pour wine and beer into plastic glass. The exception is Surly beer; you may serve in can with top popped. Ask for proper ID (anyone who looks under 35) and ticket proof for alcohol sales; anyone purchasing alcohol must be attending the performance. Use tally sheet to record all CASH sales of coffee, tea, hot chocolate or water (anything other than alcohol) by placing a ‘hash mark’ under the title of item sold.

This was an increase from the 7.5% share in 2011. Market share of bottles priced ¥500 JPY ($6.33) or under and ¥1000 – 1500 JPY ($12.66 – 18.99 USD) continue to increase. Bulk wine imports continue to grow as domestic Japanese wine companies bottle their own wine. Executive Summary: Executive Summary Distribution of Japanese bottled wine is approximately 900 thousand hectoliters. This plus 1.81 million hectoliters of imported bottled wines totaled 2.71 million hectoliters of wine distributed in Japan. The Japanese wine market continues to be very competitive. Although 50 countries supply wine to Japan, ten countries account for approximately 96% of the imported volume. On-premise consumption continues to increase as the Japanese economy improves and wine becomes more generally affordable. Upscale Japanese izakaya restaurants are performing quite well, and standing wine bars are becoming more popular, particularly among middle-aged and older men. Off-premise o Off-premise consumption has increased as well. Supermarkets are carrying more inexpensive (under ¥1000 JPY or $12.66) wines, and premium wines are increasingly being consumed from online sources.

Background and pleadings 1) On 8 January 2018 Clare Joanne Evans applied to register the following trade mark for goods and services in Classes 32 and 33: Lord Nelson The application was published for opposition purposes on 2 February 2018. During the course of these proceedings an amendment to the specification in Class 32 was accepted, so that the specification of the opposed mark in Classes 32 and 33 now stands as shown in the Annex to this decision. 2) The application is opposed by Heaven Hill Distilleries, Inc. (“the Opponent”). The opposition, which is directed against all the goods applied for, is based upon section 5(2)(b) of the Trade Marks Act 1994 (“the Act”), for the purposes of which the Opponent relies upon the following EU trade mark registrations for the following respective marks and goods: EU 16756652 ADMIRAL NELSON’S Class 33: Spirits; rum. EU 14329254 2 Class 33: Spirits; rum. 3) EU 16756652 was filed on 22 May 2017 and registered on 5 September 2017. EU 14329254 was filed on 02 July 2015 and registered on 15 October 2015. The significance of these respective dates is that (1) both the Opponent’s marks constitute earlier marks in accordance with section 6 of the Act, and (2) they are not subject to the proof of use conditions contained in section 6A of the Act, their respective registration procedures having been completed less than five years before the publication of the Applicant’s mark.
