Declaration by the Presidency on behalf of the European Union on Angola Brussels, 29 May 2001

The European Union strongly condemns the attack by UNITA near the town of Caxito and the abduction of children. It calls for the immediate release and safe return of all abducted children, and stresses the importance of bringing the perpetrators to justice. This attack represents a further example of the terrible distress that the war in Angola continues to inflict on the majority of its citizens.

A peaceful and lasting solution to the conflict, based on the Lusaka protocol, is necessary to the democratic and economic development of the country in the interests of all its people. The EU notes that elections were last held in Angola in 1992 and reiterates the importance it attaches to the Government's commitment to hold free and fair general elections in the second half of 2002. It is essential that these elections be preceded by a period of intensive preparation aimed at developing the democratic culture necessary for the conduct of successful elections.

The EU is encouraged by some recent developments, including the Amnesty Law and the establishment by the National Assembly of a Standing Committee on Peace. It welcomes the indication by President dos Santos in his speech in Luanda on 2 May that his Government is ready to engage in a dialogue on how peace may be achieved on the basis of the Lusaka Protocol. The EU notes that the President was responding to an earlier radio interview with Mr Savimbi and strongly urges the UNITA leader to engage seriously and effectively in the search for peace and to comply with the Lusaka protocol.

The EU supports the role the Churches and Civil Society are playing in promoting a culture of openness and dialogue. The EU welcomes the continuing engagement of the UN Secretary General in the search for peace and reaffirms its commitment to the enforcement of UNSC sanctions against UNITA for its failure to comply with the provisions of the Lusaka Protocol.

The Government’s decision to establish a Fund for Peace and National Reconciliation to assist the reintegration into society of former soldiers can play a useful role provided that all the operations of the Fund are fair and transparent. The fund should operate alongside a Poverty Reduction Strategy which addresses the needs of the communities to which the ex-combatants will be returning.

In this context the EU reiterates the importance it attaches to the fulfilment of economic and social reforms. It welcomes the Government's engagement with the IMF in a Staff Monitored Programme and encourages it to meet its economic targets in order to progress to the conclusion of an agreement for a Poverty Reduction and Growth Facility. It urges the Government to implement as speedily as possible measures agreed under these programmes and to actively promote good governance in particular concerning transparency issues and the fight against corruption.

The EU remains deeply concerned at the prolonged severe humanitarian crises that has left three million people declared as internally displaced persons. It urges the Government to expand its humanitarian assistance programme (PNEAH) as an expression of its ultimate responsibility for the well being of all citizens in Angola. The EU deplores the continued difficulties regarding the distribution of humanitarian assistance for displaced persons. The EU encourages the Government to spare no efforts in order to better secure the access of humanitarian aid within Government controlled areas. The EU demands all parties in the conflict, and in particular UNITA, to stop their minelaying activities.

103/2001 Declaration by the Presidency on behalf of the European Union on the sentences against Dr. Saad Eddin Ibrahim/Ibn Khaldoun Centre Brussels, 28 May 2001

The European Union is deeply disturbed by the harsh sentences handed down by the Egyptian Supreme State Security Court on 21 May 2001 against Dr. Saad Eddin Ibrahim and staff members of the Ibn Khaldoun Centre. Dr. Ibrahim was sentenced to seven years imprisonment on charges which included accepting foreign funding without authorisation (including from the EU) and for harming Egypt's reputation abroad. The staff members of the Centre were given prison terms of between two to five years. The European Union monitored the trial as an observer. The speed at which the verdict was reached raises concerns that the Court did not take fully into account evidence for the defence, some of which was submitted on the day the verdict was given. This is particularly worrying since there is no right to appeal the verdict on the substance of the case, but only on procedural grounds. Dr. Ibrahim is an Egyptian intellectual of international repute. The European Union has co-operated with the Ibn Khaldoun Centre for several years and has i.a. funded women's projects and voter education. These activities are in line with the principles of the Barcelona Declaration, adopted in 1995 by the 15 European Union Member States and the 12

The EU was deeply concerned to receive information about the edict of the Taliban leader, Mullah Omar, ordering all Hindus in Afghanistan to wear identity marks.

The EU notes that the Taliban claim to be seeking to identify Hindus to avoid them being harassed "by mistake". The EU recalls that the Taliban have to respect and protect the human rights of all persons belonging to the ethnic and religious minorities in Afghanistan. Forcing persons belonging to ethnic and religious minorities to wear distinctive clothing or identity marks is a form of

discrimination which is prohibited by international human rights law. The EU urges the Taliban leadership not to implement this unacceptable decision which will violate the human rights of Hindus in Afghanistan.

The European Union welcomes the electoral victory of Dr. Alejandro Toledo. 109/2001 Declaration by the Presidency on behalf of the European Union on the recent Summit of the IGAD Committee on the Sudan, held in Nairobi on 2 June 2001 Brussels, 8 June 2001

The European Union has consistently supported the IGAD peace initiative but has also expressed concern at the lack of progress made so far in the peace process.

The European Union welcomes the holding of the Summit of the IGAD Committee on the Sudan on 2 June 2001 and expects that it will yield early progress towards peace.

The European Union notes the expressed intention to convene a new Summit within two months, and to make the negotiating teams permanent. It encourages Kenya, in its capacity as chairman of the IGAD Committee on the Sudan, as well as the other IGAD countries to press on to reinvigorate the peace process in the Sudan.

The European Union welcomes the commitment by the Government of Sudan to halt aerial bombings, expects that it will be strictly observed and urges the Government of Sudan and the SPLM/A to immediately stop hostilities in order to create a conducive environment for negotiations.

A continued active involvement at high political level of the IGAD is crucial in order to achieve substantial progress towards an end to the war. However, even more important is a firm political determination of both the Government of Sudan and the SPLM/A to find a peaceful solution to the conflict. The European Union therefore calls on the parties to engage themselves in a continuous and sustained negotiation towards a just and lasting political settlement of the conflict in the Sudan and considers essential that a comprehensive cease-fire effectively monitored by observers accepted by both sides be promoted as a matter of urgency within the context of the ongoing IGAD negotiating process.

Declaration by the Presidency on behalf of the European Union on the Humanitarian Accord between the Government of Colombia and the FARC Brussels, 8 June 2001

Recalling its declaration on 19 January 2001 on the peace process in Colombia, the European Union welcomes the Humanitarian Accord agreed upon by the Government of Colombia and the “Fuerzas Armadas Revolucionarias de Colombia” (FARC) on 2 June 2001.

The European Union sees this agreement as a positive step towards a necessary increased respect for International Humanitarian Law. As such, it is also an important element for the creation of mutual confidence in the peace process between the parties, the public at large and the international community accompanying the negotiating process.

The European Union encourages the parties to rapidly achieve further concrete progress in the negotiations, in order to decrease the level of violence. The European Union encourages the Government of Colombia to continue to adopt effective measures against the paramilitary groups. The European Union furthermore urges the FARC to fulfill their unilateral decision reflected in the Humanitarian Accord to liberate a large number of soldiers and policemen, in addition to the exchange currently being carried out.

Finally, the European Union urges the FARC and the “Ejército de Liberación Nacional” (ELN) and other groups, to immediately and unconditionally release those civilians who have been kidnapped, and to terminate the abominable and unacceptable practice of kidnapping.

The Iranian people have once again endorsed with an overwhelming majority the policy of reform represented by President Khatami. This is a clear signal of Iranian voters for the strengthening of democracy, the establishment of the state of law and stronger guarantees for fundamental freedoms in their country. The EU encourages the Government of Iran to continue its work towards reform and respect for human rights.

The European Union hopes that the convincing results of the election will provide a good basis to extend the scope for enhancing its relations with Iran and stands ready to co-operate with President Khatami towards the achievement of these goals.

113/2001 Declaration by the Presidency on behalf of the European Union on Belarusian election Brussels, 11 June 2001

The EU would in response to the announcement by Belarus to hold presidential elections on September 9 like to reiterate its support for a democratic development in Belarus and underline the importance of free and fair elections.

As stressed on several occasions, the up-coming elections represent an opportunity for Belarus to improve its relations with the EU and the international community. The EU therefore asks the authorities to take necessary measures so that a fair campaign and, later on, election can be held.

The EU would in this context urge the Belarusian government to honour its commitments under the OSCE Copenhagen Document and refrain from interfering in the work of the political opposition and independent movements. Respect for the principle of freedom of assembly is here central. The EU would also like to remind the Belarusian government about the need for objective reporting on all candidates in the state media. Independent newspapers should be able to work under the same conditions as state owned newspapers and not be subject to discrimination.

Democratic elections could be promoted by taking fully into account recommendations by the OSCE, for example as regards the implementation of the election law. In this context, the EU recalls that the right of Belarusian citizens to engage in domestic election observation is guaranteed by law. The government should therefore not counteract the building and training of domestic networks of non-partisan observers. The EU reiterates its concerns about decree no 8 and its possible implications on the activities of non-governmental organisations, in particular in the institutional building and training fields.

The role of the OSCE during the election period is of great importance. The EU fully supports the work of the OSCE Advisory and Monitoring Group (AMG) working within its mandate, and will closely consult with the OSCE during the election period. The EU expects the Belarusian authorities to up-hold a dialogue with the AMG and to co-operate constructively with Ambassador Wieck.

The EU is ready to engage in a dialogue with the Belarusian government in order to promote democratic presidential elections. The EU would be willing to take a first step in normalising its relations to Belarus, should the election be assessed as free and fair by domestic and possibly also an ODIHR mission according to international standards.

Statement by the Presidency on behalf of the EU at the Consultative Group Meeting on Cambodia, 11-13 June 2001 in Tokyo Brussels, 12 June 2001

The European Union welcomes this opportunity to review the progress made by the Kingdom of Cambodia towards the goals set at the last CG meeting in Paris.

The Union welcomes the positive steps taken by the Royal Government of Cambodia over the last year. We congratulate Cambodia on macro-economic growth, overall political stability, improved fiscal performance and bank reform. We also continue to encourage the RGC to overcome the challenges which hamper the development, including further growth and equitable distribution of income, in Cambodia.

Important prerequisites for economic development and the reform agenda as a whole are a strengthened civil society in a stable social framework which is based on the rule of law and the development of transparent systems of governance. The EU would like to emphasise the urgent need to improve governance and strengthen the rule of law, and is ready to continue to help Cambodia in these fields. Law enforcement should be improved - to overcome impunity, to safeguard human rights, and to provide a firm basis for sustainable economic development. On the issue of corruption, the EU is encouraged to note that the government regrets its rampant prevalence in the public sector. But more decisive action is still needed in this field, we urge the government to fully implement the National Anti Corruption Plan. The judicial system, including human resources, needs to be strengthened. The ongoing reform towards decentralisation should be pursued. We are encouraged by the progress in preparations for communal elections in 2002. Given the right conditions, the elections will constitute an important step for accelerating democratic governance. We encourage the RGC to take every possible step to ensure that these elections will be free and fair, and take place in a secure and peaceful environment.

Similarly, the administrative reform should be given momentum. The EU welcomes the RGC's plan to increase public sector pay.

The EU strongly urges the RGC and the Cambodian Parliament to reach an agreement on the Khmer Rouge Tribunal. It urges the RGC and the Parliament to rapidly complete and adopt the law on the Tribunal, in order to try the Khmer Rouge leaders responsible for the most serious violations of human rights, in accordance with international standards of justice, fairness and due process of law. The EU urges the RGC and the Parliament to establish the tribunal without further delay.

The EU welcomes the RGC's increased focus on poverty eradication as reflected in the Socio- Economic Plan and PRSP process. Real disbursements to the social sectors still need to increase. This can be made possible by implementing the armed forces demobilisation programme. The EU is ready to contribute to such a programme.

Transparency and accountability are key to our co-operation with Cambodia. A crucial implementation measure is to fill the National Audit Authority with qualified members and to make it operative rapidly.

The draft laws on land reform and Forestry Law will be key tools to fight corruption and reduce poverty. The EU strongly encourages the RGC and the Cambodian Parliament to proceed with their adoption and implementation. We would also like to underline the importance of addressing the protection of the communities rights to land and, on forestry, the need for the Cambodian authorities to continue their work to redress the illegal logging issue.

The European Union continues to be strongly committed to Cambodia, and stands ready to continue to support Cambodia in her development efforts.

The European Union is increasingly concerned by the renewed military activity by the SPLA, particularly in Bahr al-Ghazal in Southern Sudan, and by the Government of Sudan's resumption of aerial bombings in response to this offensive.

The European Union calls on both parties to halt their military activity and urges the Government of Sudan fully honour its commitment to cease aerial bombings. The European Union urges both the Government of Sudan and the SPLA to immediately stop hostilities in order to create an environment conducive to negotiations and the safe delivery of humanitarian assitance to the affected civilian population.

The European Union reiterates its call on all sides to engage in a continuous and sustained negotiation towards a just and lasting political settlement of the conflict in Sudan, and considers essential that a comprehensive ceasefire, effectively monitored by observers accepted by both sides, be prompted as a matter of urgency within the context of the ongoing IGAD negotiating process.

EcoSoC strongly supports policy change in favour of broad-based sustainable development - economic, social and environmental. However, it sees society at large as insufficiently informed and yet bluntly states that policy for sustainable development will not succeed without strong public support. So a sustained effort is needed with sustainability an ideal case for wider public participation in EU- policy. For this EcoSoC sees Göteborg as the starting point with Laeken and Barcelona as further key stages. In short, EcoSoC fully supports the strategy but calls for time and much effort to mobilise support and refine practical details.

èOn the basis of the analysis carried out, the Committee underlines, in the conclusions of this own-initiative opinion, the fact that the forthcoming WTO negotiations, eastward enlargement of the EU and the mid-term review, should be used to introduce a new agricultural policy which is more in tune with conservation of the environment and nature. èFinancial incentives to promote an agricultural sector which pays adequate heed to nature conservation are at present inadequate in many cases. The CAP financial instruments should be geared towards the results-oriented promotion of environmental and socio-cultural interests (biodiversity, positive impact on jobs). To this end, indicators will need to be formulated to gauge the successes of agricultural policy. A consensus between organisations representing farmers, environmental associations and the social partners needs to be achieved. èThere is generally a low take-up rate for agri-environmental measures in highly-productive, intensively-farmed regions. It is particularly in these regions that species diversity is under serious threat. The Committee therefore recommends, as a matter of urgency, that a review be carried out of aid provisions funded under the first pillar to determine whether they are in line with environmental protection and nature conservation.

The Committee emphasises that involvement should be understood in its broadest sense, covering all decision-makers at all stages of the process and all possible methods and instruments for training and educating authorities, businesses, trade unions, sectoral and consumer associations as well as the individuals concerned. − Sustainable economic development in the applicant countries, based on new, clean technologies and improved environmental management, is vital to preserving their positive environmental aspects - which are due more to their relatively low level of development than to conscious choices. − Rewarding more environmentally-aware behaviour, in part through non-economic incentives (along the lines of eco-labelling), is globally a more effective instrument than sanctions, which risk pushing problems elsewhere while failing to provide the coherent environmental protection which is needed as part of a world view. − Market instruments such as eco-taxes and environmental tax reforms should be examined more closely in order to assess the real benefits for the environment, and must address the need for a harmonised approach at Community level, without distorting competition within the Community or jeopardising the competitiveness of European industry.

èThe Committee welcomes the Commission's intention of introducing a market regime for public passenger transport based on controlled rather than full competition. However, the Committee remains sceptical as to the arrangements laid down for applying the specified resources and instruments. èThe Commission should consider whether it should not recommend specific Europe-wide minimum criteria. èThe duration of contracts should be such as to guarantee exclusive rights for a period long enough to enable operators to recover their investment, and should be from eight to fifteen years depending on the type of service. Contracts entailing reckless underbidding should not be accepted. èAs soon as a Member State has defined a transport service as a service of general interest the competent authorities should be allowed to opt for direct management of these services. èThe Committee has some criticisms to make of the power of the competent authority to require that the operator sub-contract some of the services covered by the contract. The Committee welcomes, however, the Commission's intention to provide direct protection for staff in the case of a change of operator. The Committee suggests a selective system of transitional periods differentiating between the various categories and modes of transport.

èThe Committee considers that in general the Erika II package is a step in the right direction towards establishing safe navigation conditions and avoiding accidental pollution, and for ensuring, in the event of an accident, sufficient and fair compensation for all the damage caused to individuals and the environment. èHowever, there is still a long way to go before the legislative proposals on maritime safety are fine-tuned and completed, bearing in mind at all times the international character of maritime transport and the powers and role of the current regulatory and standards institutions, in particular the IMO and ILO and their conventions and recommendations, and more generally the whole international convention system encompassed by the United Nations Convention on the Law of the Sea which lays down the rights and obligations of flag, coastal and port states, all institutions and conventions which play a key role and need to be strengthened.

èThe Committee welcomes the latest proposals for a programme of innovative actions and fully agrees that programmes promoting the widespread introduction of innovative capacity and the technologies of the new economy to all sectors of production and society are crucial to regional development. Moreover, it stressed only recently that the capacity to use information and communication technologies can determine the success of a possible development or the loss of further jobs in a particular area. èIn addition, the best focus for innovative action programmes in the three main source areas of growth - entrepreneurship, training, and the proactive involvement of public bodies, cultural and research institutes and the social partners - is the local level, especially in disadvantaged regions. Geographical proximity, closer understanding of the difficulties inherent in the social and productive fabric, and the increased responsibility of local authorities arising from the

− The Commission's assessment for the European economy of a slight slowdown in growth is over-optimistic; because of this change in the balance of risks, the ECB should maintain a flexible approach to the setting of interest rates. − The Council's rhetoric on structural reform and the development of the knowledge-based economy must at last be matched by commensurate policy actions. − The problems of turning words into action also exist at the national level with the very uneven progress of tax, social security and pension reform. − The Committee subscribes to the goal of ensuring sustainability of public finances, but this must not be at the expense of public investment that is essential for the infrastructure and human capital required for a knowledge-based society. − The aspirations to make the Union the most competitive and dynamic knowledge-based economy in the world must now be converted into real achievements; the Committee commends the BEPG 2001 for early and effective implementation.

The report should focus on evaluation and analysis, paying special attention to jobs generated or preserved, the effects in terms of innovation, and results in the area of equal opportunities and partnership. This approach would make it easier to assess the impact of structural policy.

Key points:

The Committee notes that the participation of international financial institutions and the private sector in co-financing projects eligible for ISPA funding has been restricted due to the application of Article 114(1) of the Financial Regulation. The Committee approves the Commission's proposals both to amend the Regulation establishing ISPA by inserting provisions allowing a derogation from this Article, which it considers likely to increase the scope for co-financing; and also to seek the assistance of a committee involving the Member States, the Commission and the European Investment Bank. The Committee believes that eligibility for participation in ISPA should be extended to Cyprus, Malta and Turkey. Considering the need to examine in more detail the way in which ISPA funds are structured and operated, the Committee proposes to draw up an own- initiative opinion on the subject in the near future.

Key points:

èThe Committee's opinion examines the possibilities for improving intrabrand competition, dealer independence and the provision of technical information by manufacturers to independent repairers, as well as recommending changes to take into account both past experience and technological advances. It also suggests updating the Communication on intermediaries, and setting up guidelines on the use of the Internet by dealers and producers. èIn order to raise the overall level of competition to improve consumer choice and the operation of the Single Market, the Committee feels that the best way forward is to attempt to modify and prolong the block exemption, strengthening the position of intermediaries in making the most of the opportunities offered by parallel trade, rather than putting an end to the selective distribution system.

Key points:

è The Commission's proposal seeks to a) ensure a high level of professional competence among insurance intermediaries, b) facilitate the cross-border activities of intermediaries via a uniform registration system, and c) thereby guarantee a high level of protection for consumers. èThe ESC expressly endorses these basic objectives but feels they are not always adequately met in the proposed directive.

èThe opinion maintains that insurance intermediaries must have specialist training, and suggests a minimum of 300 hours' theoretical and practical training, whilst leaving it to Member States to decide the level and content. èThe ESC feels that this minimum requirement is also necessary to bring about the freedoms of the Single Market, in view of the current variety of national rules and resulting compartmentalisation of markets. èFinally, in order to improve consumer protection, the Committee argues that all insurance intermediaries should be registered on the basis of certain minimum professional requirements. Hence intermediaries whose principal professional activity is not insurance mediation should nevertheless be included within the scope of the directive.

èThe ESC supports the Commission's plan to extend the current CMO for a further two marketing years and warmly welcomes the Commission's decision to give close consideration to the quality strategy for olive oil in the EU, believing that this should represent the main objective of CMO reform over the coming years.

èThe ESC believes that under present circumstances, in which consumers are insufficiently familiar with the oils available on the market, using acidity as the classification parameter could, in some cases, confuse consumers and lead them to make wrong judgements. For this reason, it considers that the packaging of currently designated "olive oils" should not indicate their degree of acidity, since they are obtained from a blend of refined and virgin oil. Furthermore, it is essential to impose a blanket prohibition across the EU on the production and sale of blends of vegetable oils with olive oil.

Key points:

èWhilst welcoming the proposal the ESC condemns the fact that it is limited to dry sows and does not include farrowing and suckling sows and criticises the fact that only the Standing Veterinary Committee is to be consulted on the proposed amendments to the Annex, rather than all the EU institutions. èThe ESC feels that the importance of space requirements for fattening pigs and preventive healthcare must be highlighted more clearly, thus helping to avoid or reduce the risk of disease outbreaks. The ESC calls for a better, more accurate analysis of the cost of the proposal. The ESC endorses the proposed requirements on advice, guidance and appropriate training for animal handlers, but would stress that this must build on their existing expertise. Safety aspects and accident risks must also be taken into account.

Key points:

The Committee generally welcomes the Commission's initiative. The use of uniform terms and definitions in Community law generally enhances transparency and legal certainty. The Committee underlines the view expressed by the Commission in its proposal that the aim is to continue to afford the protection provided by the original Directive. Care must, however, also be taken to avoid abuse in the case of the "rebuilding" of enterprises, i.e. to facilitate the financial rehabilitation of enterprises at the expense of the guarantee institutions. The Committee welcomes the fact that the scope of the Directive has been made more precise and is now to include part-time employees, workers with fixed-term contracts, workers with a temporary employment relationship and homeworkers. The Committee takes the view that domestic servants employed by a natural person and share-fishermen should not be excluded from the scope of the Directive, but that persons who exercise a controlling influence on the management of an enterprise may be invoked by Member States for exclusion.

Key points:

èThe Committee broadly approves the text of the proposal, which is designed to protect public health, and it is pleased that the proposed directive consolidates equality of rights for people throughout the Community.

èThe Committee considers that one of the EU's priority objectives is to lay down the foundations for achieving high safety and quality standards for blood and blood components used within its territory. As a consequence it deems the provisions contained in the proposed directive to be positive, since, taking into account ethical and deontological principles as well as current international standards, they ensure that this objective will be met, necessarily covering the eligibility of donors and the collection, testing, processing, storage and distribution of whole blood and its components.

èIn view of the shortage of blood and given that blood donors make a humanitarian and benevolent gesture which is anonymous and unpaid, the Committee suggests that the Commission urge Member States to carry out more campaigns aimed at enhancing the public image of blood donors and thus providing the best incentive possible to give blood.

Self-sufficiency in the blood sector is an EU objective which has to be secured. In line with the draft directive, the Committee stresses how vital it is not to allow a mercenary, profit-oriented approach to blood donations to develop on the part of the establishments which collect and process blood.

In accordance with the agreement of 17 November 1994 between Parliament and the Commission on the procedure whereby the Commission informs Parliament of action taken on texts adopted in plenary, the tables below set out the action taken on texts adopted at the April 2001 part-session. The analysis of legislative amendments is based on the interinstitutional agreement on the drafting quality of legislative texts of 22 December 1998 and their general scope. N.B.: Under Council Decision 1999/468/EC (OJ L184, 17.7.99), called the comitology decision, and the Parliament/Commission agreement on the same subject (OJ L 56, 10.10.2000), the European Parliament has the right to be informed about (Article 7) and the right of examination of (Article 8) draft implementing measures presented by the Commission.
