I am always most grateful for your support, even if I don’t always make that very evident. 3 Abstract This study examines and critiques New Zealand intellectual property protection for industrial designs, taking into account that many New Zealand industrial design owners outsource manufacture of their designs to China. Industrial design, which refers to improving the aesthetics of products to increase their marketability, is evolving conceptually and practically. In New Zealand, copyright and registered design laws each protect, respectively, the visual expression and the “eye appeal” of an original design. As design practices evolve with advances in technology however, it is increasingly evident that industrial design is about more than just visual expression or “eye appeal”. Many designers are not focusing solely on product stylisation and decoration, but on the provision of a more holistic product experience for the consumer. The development process of industrial designs from concept to marketable product is also changing, with many New Zealand industrial design owners employing increasingly efficient design development strategies. The fast-paced, cost-effective infrastructure of China is often utilised by New Zealand businesses for the manufacture of industrial designs. This study therefore sought to determine how to appropriately protect New Zealand industrial designs, in light of: a. foreseeable advances in technology; and b. the fact that many New Zealand industrial designs are manufactured in China. To answer these questions, this study examined and analysed New Zealand’s copyright and registered design laws, taking into account not only existing protections, but also factors that are likely to be of significant relevance in the future, such as the impact on industrial design from developments in 3D printing and virtual reality. The Chinese intellectual property regime for industrial designs was also examined because China is a major trading partner and often, as noted, the locus of manufacture. 4 The study included an empirical investigation, in the form of interviews with designers and design academics as well as legal practitioners specialising in intellectual property law. The input of the interviewees, together with the legal analysis, informed a series of suggestions and recommendations for New Zealand policy and its law-makers regarding how industrial design protection can be improved. A key finding of this study was that existing legal protections do not appropriately protect increasingly holistic designs, as well as new types of designs emerging from developing fields such as virtual reality. In assessing the appropriateness of protection, the interests of industrial design owners were balanced against the public interest in protecting the public domain. It is suggested that to achieve equilibrium copyright law should be expanded to protect design expressions for all senses. Moreover, new categories of copyright protected works should be introduced to accommodate emerging design. The definition of design in registered design law should also be reconceptualised in order to acknowledge new types of designs and evolving design practices. Industrial design owners who outsource manufacturing to China can protect their designs via copyright as well as design patent. However, enforcement of intellectual property protection is unsatisfactory in many areas of China. Therefore, New Zealand industrial design owners should also employ non-legal protection strategies. Interviews with successful businesses, in the course of the empirical investigation for this study, revealed that the leveraging of existing relationships of those with already established operations in China, and intentionally splitting an industrial design’s component parts for manufacture among several factories in different locations, are useful strategies to employ. 5 Contents 1. In general, the burden of proof has to be assumed by plaintiff, except, with respect to trademarks and patents, when the culprit refuses to give proof and information regarding: a) the name and address of whoever sold or deliver the infringing goods, when such transaction took place, as well as to exhibit the respective invoices; b) the amount of units manufactured or sold and their price, as well as to exhibit the sale invoices.

    DESIGN PATENT INFRINGEMENT: POST- EGYPTIAN GODDESS Marta Kowalczyk* I. INTRODUCTION The United States Court of Appeals for the Federal Circuit overturned de- sign patent precedent in its en banc decision in Egyptian Goddess, Inc. v. Swisa Inc.1 Prior to Egyptian Goddess, courts had been applying a two-prong test to determine design patent infringement. Egyptian Goddess eliminated one of those prongs: the point of novelty test.2 The Federal Circuit in Egyptian God- dess instead only focused on one test, the ordinary observer test, to determine design patent infringement.3 The Federal Circuit not only held the ordinary observer test to be the sole test in determining design patent infringement but also modified this test.4 This recent development discusses the rejection of the point of novelty test and the modification of the ordinary observer test in Egyptian Goddess.5 Part II briefly overviews design patent law prior to Egyptian Goddess, focusing on the evolution of the two-prong test of design patent infringement. Part III discusses the facts and analysis of Egyptian Goddess. Part IV reviews case law post-Egyptian Goddess and comments on the effects of Egyptian Goddess on design patent infringement law. Part V provides concluding remarks on the future of design patent law post-Egyptian Goddess. II. DESIGN AND DESIGN FRAMEWORKS: INVESTMENT IN KBC AND ECONOMIC PERFORMANCE This chapter addresses the nature and the economic impact of design by looking at design-related intellectual property and how businesses protect their knowledge based capital. The chapter reviews the nature and various definitions of design and how design-related IP, specifically registered designs, relates to other formal IP mechanisms such as patents, trademarks, and copyright. It looks at the primary areas of design activity in a subset of OECD countries and investigates the similarities and differences of the constituent design IP regimes as well as the various treaties governing international design IP regulation. The review continues with an examination of how design-related IP functions in comparison to and in conjunction with other formal and informal IP protection mechanisms and what factors motivate firms to choose and appropriate combinations of protection mechanisms. By examining historical patterns of design registrations in a variety of ways, this chapter identifies trends, at the national level, of how firms perceive the importance of design-related IP. Analysis of national origins of registrations in both the European Community and the United States provides an indicator of the activity of those countries’ businesses relative to their proximities to the markets. It explores the existence of possible alternative indicators for design activity and of industry-specific variations across the sample set. The chapter concludes with a review of input and output measures as stated in the limited set of studies that have endeavoured to establish or quantify the value and/or benefit of design and design-related IP.

Different forms of intellectual property usually protect different aspects of a product. In the design context, however, precisely the same features are often subject to design patent, trademark, and copyright protection-andparties commonly claim more than one of those forms. Yet, as we show, the claiming regimes of these threeforms of design protection differ in significant ways: the timing of claims; claimformat (particularlywhether the claims are visual or verbal); the multiplicity of claims (whether and how one can make multiple claims to the same design); and the level of abstractionat which parties claim rights. These methodological differences have significant effects on the operation of each individual regime.
