First of all, it analyzes the historical causes that characterize the current Italian situation: the condition of the judges during the fascist dictatorship and the resulting reasons why the founding fathers of the Republic trusted the judiciary in a very limited way. Then, the paper seeks to explain the unique problems that today undermine the independence of judiciary - the practice of judges running for political offices, the progressive politicization of the High Council of the judiciary, the judicial intervention in economic matters and the trend of judges making public statements to matters under judicial scrutiny - and explores the effectiveness of the current guarantees given judges to secure their independence. Such a situation derives at least in part from the vacuum created by the crisis of the political class which started in the 1990s. Key words: judicial power, independence of the judiciary, Italian Constitution, judges as legislators, responsibility of judges. Introduction The paper examines independence of the judiciary in Italy, viewing it from two standpoints: freedom of the judiciary from political interferences and the need for judges to desist from taking an ideology based approach to matters that come under judicial scrutiny.

They are not only Nostra; facilitators the product of specific socio-economic and political conditions but also of the extensive complicity on which they can count. It is this fertile ‘grey zone’ of mafia relations with accomplices identi- fied as enablers, facilitators, sponsors and helpers that is ana- lysed here. Engaging with the existing literature and using a range of new judicial sources, including evidence from mafia trials, this article develops in-depth case studies to identify and examine the hidden face of Italian mafias.

    The 2013 Italian Election A Global Counsel political briefing February 2013 . The Italian election of February 24-25 is becoming increasingly hard to call with any certainty, as the centre-right under Silvio Berlusconi continues to close the gap on the centre-left coalition led by Pier Luigi Bersani. Berlusconi’s Lazarus-like return remains this election’s wildcard. The centre-left is most likely to win in the Camera, but the crucial Senate election will be decided by races in Lombardy and Sicily which both look too close to predict. A Berlusconi victory in either would force Bersani into a complicated coalition negotiation with Mario Monti’s centrist coalition. Personality and policy will both be important. A Bersani-led coalition promises a high level of continuity with the agenda pursued by Monti’s technocratic government over the last fourteen months. Bersani is a pragmatic social democrat with a record in government of product market reform. Bersani has pledged to lower payroll taxes, reduce Italy’s property taxes and widen economic participation among women. A Bersani government is unlikely to take leftist gestures like Hollande’s 75% top tax rate, but neither will it introduce sweeping liberalisation. On the European level a Bersani government will be a strong potential ally for Paris. Bersani sees himself as pro-European and has deliberately distanced himself from anti-German rhetoric on the campaign trail. His support for tougher European oversight of national budgets will win him friends in Berlin. His views on the need for debt mutualisation in the Eurozone will not. For the markets, continuity will matter.

First, this essay offers an analysis by using symbols and their meanings, which are illustrated through the ‘pyra- mid of social protest’. Second, the framing and process of the protest are analysed. Two new concepts are presented: the culture of lawfulness frame and the implicit contested process. Third, this essay shows that defying the Mafi a be- gins with individual motivation but ends with the collective motivation behind the decision to be an activist. This de- cision includes ethically oriented reasons rather than being based on a materialistically calculated reasoning. Finally, the struggle of anti-Mafi a movement illuminates cultural anthro- pology through its desire for a progressive society in which strong symbolic interactionism among the activists play an important role. Through these interactions, a semiotic approach may identify similarities and a common understanding of various notions. However, the same symbols that the activ- ists value may seem antagonistic to other actors in society (Alexander 2001: 195). E' solo nell'agosto del 1998, a cinque anni dai fatti, che un libro sui misteri legati all'arresto del boss Totò Riina ("C'era una volta la lotta alla mafia", edito da Garzanti), scritto dai giornalisti Attilio Bolzoni e Saverio Lodato porta all'attenzione dell'opinione pubblica l'oscura vicenda della mancata, quanto insensata, perquisizione dell'appartamento in cui viveva il boss dei boss. A dar vigore alle rivelazioni contenute nel libro è, paradossalmente, la querela presentata dal generale dei Ros Mario Mori, dal cap. Giuseppe De Donno e dal magg. Sergio De Caprio, meglio noto come "Ultimo" l'uomo che secondo una vulgata catturrò materialemnte Totò Riina. I tre ufficiali dei carabinieri ritengono diffamatorie alcune affermazioni contenute nel libro e contestano la ricostruzione delle vicende che ruotano proprio attorno alla cattura di Riina. In realtà le modalità della cattura del boss di Cosa Nostra da parte del Ros dei carabinieri, avvenuta il 15 gennaio 1993, e la mancata perquisizione del covo di via Bernini, subito dopo l'arresto del boss di Corleone e sullo smantellamento dell'apparato di controllo a distanza che il Ros aveva collocato nella zona sono oggetto da diversi anni di un'indagine avviata dalla procura di Palermo. Un'indagine scaturita poco tempo dopo la cattura di Riina, quando dell'intervento di una squadra mafiosa con compiti di "pulizia" nel covo di Riina aveva parlato il "pentito" Gioacchino La Barbera, ascoltato nel '94 dai magistrati di Palermo Giuseppe Pignatone e Franco Lo Voi.
