• The House and Senate were in session this week, with the Senate meeting through-out the week and approving legisla- tion to extend public safety officer death benefits to public safety officers whose death is caused by COVID–19, legisla- tion to collect data on officer suicides, and a resolution to recognize National Police Week. The House considered a $3 trillion spending package to respond to COVID-19. This package included over $1 billion to the law enforcement community to address its needs. • Law Enforcement Congressional Briefing on LE Needs During COVID-19 - Law enforcement is facing un- precedented challenges as COVID-19 impacts communities across the nation. Earlier this week, representatives from twelve public safety associations hosted a congressional staff briefing webinar to brief Congress on what the public safe- ty community is seeing during COVID-19. You can watch a recording of the briefing here.

• SEARCH Organizes May 8 Webinar on NICS for Capitol Hill Staff - SEARCH organized a webinar for Capitol Hill staff to provide an overview of the National Instant Criminal Background Check System (NICS). The May 8 event featured experts from the Federal Bureau of Investigation (FBI), U.S. Department of Justice’s Bureau of Justice Statis- tics (BJS), National Center for State Courts (NCSC), and SEARCH, who briefed dozens of congressional, agency, and association staff.

Panelists outlined how the firearms eligibility process works by providing an overview of NICS — including the data- bases involved, where the information comes from, and where it is stored. They also explored the critical role of the local and state agencies in contributing data, and that of the states and the FBI in the firearms eligibility decision-making process. In addition, panelists provided details on current funding programs that support the NICS, as well as challeng- es, obstacles, and successful information sharing strategies for making records available for firearms eligibility decisions.

• GAO Report on Algorithms Used in Federal Law Enforcement - The Government Accountability Office re- cently released a review of forensic algorithms used by Federal law enforcement. The review found that Federal law enforcement is primarily using three types of forensic algorithms to help assess whether or not evidence collected in a criminal investigation may have originated from an individual: probabilistic genotyping, latent print analysis, and face recognition. • Report on Drone use by Public Safety Agencies - In February 2019, the COPS Office, the Police Executive Re- search Forum (PERF), and the U.S. Department of Homeland Security (DHS) convened a two-day conference in Wash- ington, D.C., to discuss the policy and operational issues regarding the implementation and use of drones. A recently released report details information presented and discussed by the conference participants; lessons learned; and prom- ising practices gathered from interviews, policy reviews, and survey data for the purpose of providing law enforcement agencies with guidance on implementing a drone program. • Collaboration Services for Telework - The National Security Agency recently released cybersecurity guidance contains a snapshot of current, commercially-available collaboration tools available for use, along with a list of security criteria to consider when selecting which capability to leverage. In addition, the guidance contains a high-level security assessment of how each capability measures up against the defined security criteria, which can be used to more quickly identify the risks and features associated with each tool. • Grants Awarded to Combat Violent Crime - This week, DOJ announced that it awarded seven cities with more than $61 million in grant funding to support the Operation Relentless Pursuit initiative. This initative aims to intensify federal law enforcement resources into seven cities with violent crime levels several times the national average. These cities include Albuquerque, Baltimore, Cleveland, Detroit, Kansas City, Memphis, and Milwaukee. You can read the press release here.

• CLIENT IN THE SPOTLIGHT: Rapid DNA technology continues to play an important role in solving crimes. Recently, the Butte County Sheriffs De- partment used an ANDE Rapid DNA machine to solve a string of vehicle burglaries in 2019 and 2020. This technology was able to link a suspect to the scene of multiple crimes. You can read more about this here.

• ARTICLES OF INTEREST: Trump Justice Department asks for more resources to enforce gun laws Politico | Betsy Woodruff Swan As gun sales surge during the coronavirus pandemic, the Justice Department is asking Congress for more enforcement resources — including to confiscate guns from people who shouldn’t legally be able to own them. In recent outreach to Capitol Hill, DOJ made two requests related to the spike in gun purchases, according to two sources with knowledge of those asks. First, the department asked for funding to help the FBI hire more staff to keep up with the growing num- ber of background checks and appeal requests going through the National Instant Criminal Background Check System. The bureau runs that system, which handles background checks on millions of gun buyers every year. Continue read- ing here.

Republicans press DHS for details on Chinese drones donated to law enforcement Washington Examiner | Mica Soellner Republican lawmakers are raising security concerns about drones provided by Chinese company Da Jiang Innovations being used by law enforcement and public safety agencies throughout the United States. In a letter to Chris Krebs, di- rector of the Homeland Security Department's Cybersecurity and Infrastructure Security Agency, GOP members of the House Judiciary Committee asked for information about how state and local law enforcement use the devices to help against the coronavirus pandemic. The letter is signed by 14 Republicans, including Reps. Matt Gaetz, Jim Jordan, and Jim Sensenbrenner. Continue reading here.

Cities Seen Losing $360 Billion of Revenue From Economic Rout Bloomberg Government | David Voreacos, Amanda Albright and Danielle Moran U.S. cities are projected to lose about $360 billion of revenue through 2022 because of the economic damage caused by the coronavirus pandemic, an unprecedented loss that would trigger deep spending and job cuts, according to a Na- tional League of Cities analysis released Thursday. Pennsylvania’s municipalities will be hit the hardest, with the poten- tial loss of about 40% of their revenue this year, followed by those in Kentucky, Hawaii, Michigan and Nevada, the ad- vocacy group calculated. The projections are based on the expected rise in unemployment and assumes that every 1 percentage point increase in joblessness will cause tax revenues to fall about 3%. The dire outlook adds to the growing warnings from state and local government officials about the financial impact of the pandemic-related shutdowns. With- out aid from the federal government, cities will be forced to enact vast budget cuts that would exert a drag on the eco- nomic recovery. Continue reading here.

U.S. Senate votes to extend government surveillance tools Reuters | Patricia Zengerle The U.S. Senate comfortably approved a 2-1/2-year extension of parts of the Foreign Intelligence Surveillance Act (FISA) on Thursday, two months after the divisive provisions allowing government data collection expired. The Senate backed the reauthorization by 80-16, far more than the 60 votes needed for passage. The measure must be approved, however, by the House of Representatives before it can be sent to the White House for President to veto or sign into law. On Thursday, the Republican-led Senate amended the measure approved by the Democratic-led House in March to improve legal protections for those subject to surveillance. Continue reading here.

H.Res. 965 - Authorizing remote voting by proxy in the House of Representatives and providing for official remote committee proceedings during a emergency due to a novel coronavirus, and for other purposes Status: To be considered by the House on 5/15. Summary: Authorizing remote voting by proxy in the House of Representatives and providing for official remote commit- tee proceedings during a public health emergency due to a novel coronavirus, and for other purposes.

H.R. 6800 - The Heroes Act Status: To be considered by the House on 5/15. Summary: This bill responds to the COVID-19 (i.e., coronavirus disease 2019) outbreak and its impact on the economy, public health, state and local governments, individuals, and businesses. This legislation includes: • $500 billion for states, $375 billion split equally between municipalities and counties, $20 billion for territories and $20 billion for tribes, which adds up to $915 billion. They'd also tack on $755 million for the District of Columbia • Pandemic Justice Response Act Grants – $600 million, including: (1) $500 million to prevent, detect, and stop the pres- ence of COVID19 in correctional institutions, and for pretrial citation and release grants, (2) $25 million for Rapid COVID19 Testing at correctional institutions, and (3) $75 million for Juvenile Specific Services. • Would require the release of prisoners and those in the custody of U.S. Marshals Service who are within a year of being released, or those who are juveniles, over 50 years old or have a health condition such as diabetes, heart disease, HIV, cancer or are pregnant. • Byrne Justice Assistance Grants – $300 million to help prevent, prepare for, and respond to coronavirus, including for purchasing personal protective equipment and controlling outbreaks of coronavirus at prisons, with waivers of the local match and nonsupplanting requirements. • Prevents the Department of Justice from preventing these funds from going to sanctuary jurisdictions. • $250 million on Second Chance Act grants • $300 million for COPS hiring grants • Allows all non-profit organizations to be eligible for Paycheck Protection Program Small Business Administration loans

Summary: This bill requires the Federal Communications Commission to designate 9–8–8 as the universal telephone num- ber for a national suicide prevention and mental-health crisis hotline. The Department of Health and Human Services and the Department of Veterans Affairs must jointly report on how to make the use of 9–8–8 operational and effective across the country.

H.R. 6172 - USA FREEDOM Reauthorization Act of 2020 Status: Approved by the Senate as amended on 5/14; Approved by the House on 3/11. Summary: This bill reauthorizes through December 1, 2023, provisions related to intelligence gathering under the Foreign Intelligence and Surveillance Act (FISA) and amends FISA-related provisions. The Federal Bureau of Investigation may not seek certain FISA-authorized orders to obtain (1) call detail records on an ongoing basis, (2) a tangible thing where a person has a reasonable expectation of privacy and a warrant would typically be required, or (3) cellular or GPS location infor- mation. In applications for certain FISA-authorized orders to obtain information or conduct surveillance, the applicant must certify that the Department of Justice (DOJ) has received any information that might raise doubts about the application. The bill imposes additional requirements on FISA-authorized orders targeting a (1) U.S. person, or (2) federal elected official or candidate. The bill increases criminal penalties for violations related to electronic surveillance conducted under color of law or false statements made to the Foreign Intelligence Surveillance Court (FISA court). The bill broadens the criteria for when a FISA court decision shall be declassified and requires the declassification review and release of such opinions within 180 days of an opinion being issued. The bill broadens the FISA court's authority to appoint an amicus curiae (an outside party that assists in consideration of a case) and expands such amici's powers, such as the power to ask the court to review a decision. Each agency that submits applications to the FISA court shall appoint an officer responsible for compliance with FISA requirements.

Ratcliffe to be the Director of National Intelligence Summary: Congressman John Ratcliffe (R-TX4) appeared before the Senate Select Committee on Intelligence as the Presi- dent’s nominee to be the next Director of National Intelligence (DNI). President Trump first nominated Rep. Ratcliffe in July 2019, but withdrew the nomination over concerns that Ratcliffe was too partisan and had embellished his credentials. Rep. Ratcliffe currently serves on the Permanent Select Committee on Intelligence, Ethics, and Judiciary Committees. If con- firmed, Ratcliffe would replace Dan Coats who resigned last July.

House Appropriations Committee - Labor HHS Subcommittee Hearing - May 6 COVID-19 Response Summary: The House Appropriations Subcommittee on the Department of Labor, Health and Human Services, Education, and Related Agencies met to discuss the nations ongoing response to the Covid-19 crisis. Two witnesses, Dr. Tom Friedan, President and CEO of Resolve to Save Lives and former Director of the Centers for Disease Control and Prevention and Dr. Caitlin Rivers, Senior Scholar at the Johns Hopkins Center for Health Security and Assistant Professor in the Depart- ment of Environmental Health and Engineering, were invited to testify. The witnesses emphasized the importance of health care capacity, the need for increased diagnostic testing capacity and contact tracing strategies.

Senate Homeland Security & Governmental Affairs Committee - Full Committee Roundtable - May 6 COVID-19: How New Information Should Drive Policy Summary: The Senate Homeland Security & Governmental Affairs Committee hosted its first fully virtual roundtable with health and academic experts serving as witnesses. The roundtable focused on sharing best practices and lessons learned from individuals confronting the Covid-19 crisis head on. The witnesses commented on best medical practices, the state of testing, and reasons behind viruses disparate effects by region and population. Chairman Ron Johnson, in partnership with Senator Rubio, announced a request for a ten year longitudinal study on Covid-19 from N.I.H. and C.D.C.

House Homeland Security Committee - Full Committee Event - May 8 Coronavirus and Homeland Security Part Six: Long-Term Impact of The Coronavirus Pandemic On DHS’s Mission Summary: The House Homeland Security Committee hosted a virtual conversation between Rep. Xochitl Torres Small and Rep. Bonnie Watson Coleman with former Deputy Secretary of Homeland Security, Elaine Duke. The conversation sought to explore the long term impact of the Coronavirus Pandemic on the Department of Homeland Security’s mission and future work. These concerns included the suspension of in person trainings, the ability to attract and hire front line personnel, backloads in work, lack of preparation for weather related events, and filling politically appointed vacant position.
