Questions & Answers Where can a BCPD officer take a student if they are incapacitated? An officer from the BCPD may assist an incapacitated student to a health facility or the police station with or without the consent of the student.

What are a student’s rights if a BCPD officer takes them into protective custody? When a student is taken into protective custody, they are held at the police station. The student has a right to request a Breathalyzer test. The student will be informed of this right in writing. The student also has a right to make one phone call.

When a BCPD officer takes a student into protective custody, do their parents have to be notified? If the student is under the age of 18, the BCPD is required to contact that student’s parent or guardian upon arrival at the station.

What happens when a student is documented for an alcohol or drug violation? An incident report will be filed and the student will meet with a member of the Dean’s office or the Residential Life staff to discuss the report. At this meeting, the case may be closed, a resolution may be reached, or the matter may be referred to a Judicial Board for a hearing.

What is the Student Judicial Board? The Student Judicial Board is composed of six students who hear a case and determine if the student is responsible or not responsible for the alleged incident. When appropriate, the Student Judicial Board recommends a sanction to the Dean’s office.

What is the Administration Hearing Board? The Administration Hearing Board consists of three administrators and/or faculty members who hear cases dealing with more serious issues. This board also determines if the student is responsible or not responsible, and, when necessary, recommends sanctions to the Dean’s office.

What happens if a BCPD catches me with a fake ID? BC has instituted a new minimum sanction for possession of a fake id. Students found with false identification would be subject, at a minimum, to a $100 fine and automatic deferred housing suspension.

Questions & Answers

What are some of the sanctions for violation of the University’s alcohol and drug policy? Each case is handled individually and with the consideration for all parties and circumstances involved. Punitive sanctions range from Disciplinary Warning to Dismissal from Housing or the University. Educational or community service sanctions are also given and usually involve completion of a project or individual assessment with the Assistant Dean for Alcohol and Drug Education by a specific date. Failure to complete such projects by the assigned date result in a freeze of university records and an inability to register for classes, sign up for housing, or use a meal card.

What happens if I take my roommate or friend to the infirmary after they have been drinking? If you are concerned about how much a roommate or friend of yours has had to drink, you should bring them to the infirmary. All contact between the student and the infirmary is confidential. Thus, no report will be filed, and no judicial action or notification of that student’s parents will occur. The only exception occurs when a student is so intoxicated that the situation is life threatening and transport to the hospital is necessary. In this case, a report must be filed. If you are unable to deal with a situation on your own, you should seek out the assistance of your Resident Assistant or the BCPD. A report will be filed in both of these cases, as well. The Dean’s office stresses that each case is handled individually so you should not be afraid to seek out assistance.

What should I do if a friend or roommate has been drinking and is sexually assaulted? You should encourage that student to discuss the situation with your RA. They can also contact the Sexual Assault Network, the BCPD, or University Counseling Services. None of these responses requires that charges be brought against an alleged perpetrator. These services are designed to assist a victim by listening, answering questions, and managing the emotions, which exist as a result of a sexual assault.

What is the Sexual Assault Network? The Sexual Assault Network is a trained group of students and staff members who provide and will explain the medical, legal, and University Judicial action to a student that has been sexually assaulted. If a student calls, they may remain anonymous, and all contact with the Sexual Assault Network is confidential. The Sexual Assault Network Advocates are available 24 hours a day, and may be contacted at the Sexual Assault Network Hotline at 552-BC11.
