ISSN 1020-7473 Introduction The classical definition of refugee contained in the 1951 Refugee Convention was ill- suited to the majority of African refugees, who started fleeing in large numbers in the 1960s and 1970s. These refugees were by and large not the victims of state persecution, but of civil wars and the collapse of law and order. Hence the 1969 OAU Refugee Convention expanded the definition of “refugee” to include these reasons for flight. Furthermore, the refugee-dissidents of the 1950s fled mainly as individuals or in small family groups and underwent individual refugee status determination: in-depth interviews to determine their eligibility to refugee status according to the criteria set out in the Convention. The mass refugee movements that took place in Africa made this approach impractical. As a result, refugee status was granted on a prima facie basis, that is with only a very summary interview or often simply with registration - in its most basic form just the name of the head of family and the family size.1 In the Somali context the implementation of this approach has proved problematic. -

7|2011 KAS INTERNATIONAL REPORTS 79 SOMALILAND – A WALK ON THIN ICE 1 Harriet Gorka “Northerners can in no way claim that the 1960 merger with the South was a shotgun wedding – by all accounts unification was wildly popular. Northerners could argue, however, that they asked for an annulment of the union prior to the honeymoon and that their request was unjustly denied.”2 This statement by a legal scholar reflects the prevailing balancing act of the conflict in Somaliland, which some might say started with the voluntary unification of Harriet Gorka worked Somaliland and the Italian Trust Territory of Somalia. Yet from February to April 2011 at the Konrad- the conflict goes deeper and is more far reaching than Adenauer-Stiftung in “just” the desire to secede from the Somali state. It is Windhoek, Namibia. an ongoing debate whether the right to self-determination should prevail over the notions of territorial integrity and sovereignty. May 2011 marked the 20-year anniversary of Somaliland’s proclamation of independence. However, its status has not officially been recognised by any state, even though it has a working constitutional government, an army, a national flag and its own currency, which should make Somaliland a stand out example for other entities seeking independence. The territory also sets itself apart from the rest of Somalia because it is stable and peaceful, which has been achieved by integrating clan culture into its government. The Protectorate, located at the southern end of the Red Sea, was on the direct route from England to India via the Suez Canal. 1894 Tripartite Accord was reached by Great' Britain, Italy and Ethiopia over other Somali territories. Italian control was established over an area on the Indian Ocean to a point south of Mogadishu. • This became Italian Somaliland and the Southern Regions of what is now Somalia. -

The northern territory of Somaliland is peaceful and is an emerging democracy. The south of Somalia is a rump state, and lacks local legitimacy” (Jhazbhay, 2008, p. 61). After the Somali civil war succeeded in ousting dictator Siad Barre in 1991 warlords and their militias have turned the south of Somalia into their own personal fiefdoms (Farah, Hussein and Lind, 2002; Terliden, 2004; Woodward, 2004). Since then Somalia has been unable to retain even the most minimal central administration – it is “the failure among failed states” (Menkhaus, 2004, p. 16). Over the years a number of peace and reconciliation efforts have been carried out, with outsiders attempting to build stable state structures top-down, but none of these has taken root (Kaplan, 2008, pp. 146-147). In contrast, Somaliland has been described as “the inspiring story of resilience and reconstruction and of a truly African Renaissance which has many lessons to teach the rest of Africa, and the international community” (Brickhill and Johnson, 2001 cited in Jhazbhay, 2008, p. 61). While the road has not always been smooth, the Republic of Somaliland, the secessionist northwestern slice of Somalia that declared independence in 1991, has managed to construct a functioning government from the bottom up, on its own, with little outside assistance. Indeed, the incorporation of traditional Somali forms of governance and the utilization of traditional peace building methods helped to create one of the most democratic and stable political system in the entire Horn of Africa, which has not yet been recognized by the international community (Bradbury, Abokor and Yusuf, 2003; Kaplan, 2008; Mangan, 2010; Richards, 2008; Simanowitz, 2005). -

In Siyaad Barre’s Prison: A Brief Recollection Mahamud M. Yahya I. Introduction In my view and in the view of many witnesses of Somalia’s recent his- tory, an important element of the terrible abuse of power and authority during the dictatorial regime of the late Gen. Mohamed Siyaad Barre was the arbitrary and widespread detention of dissidents, political opponents, and even ordinary Somalis who just expressed an honest opinion on the state of affairs in their country. These incarcerations were usually without any charges, and, in the end, without trial. For this reason, men like Aden Abdillah Osman, the first President of the Somali Republic; Premier Abdirazak H. Hussein; the late Mohamed Ibrahim Egal, ex-President of the self-declared Somaliland Republic and former Prime Minister of Somalia; Abdillahi Issa, First Foreign Minister; Gen. Mohamed Abshir Muse, former Commander of Soma- lia’s Police Force; Michael Mariano, pioneer nationalist, Parliamen- tarian, and distinguished civil servant; Col. Abdillahi Yusuf, current President of the Transitional Federal Government of Somalia; the late Gen. Mohamed Farah Aideed, former USC leader; and Col. Jama Ali Jama, one-time president of the Puntland region; each had to spend months or years in detention, some in solitary confinement. But they were never brought to a real court of justice because they were simply being persecuted for reasons that included possibly rallying righteous disapproval and discontent, competition for power, or because Siyaad Barre disliked them personally. 77 Bildhaan Vol. 5 The injustices of the dictatorial military regime that turned many Somalis against that government—despite its popularity at the begin- ning of its reign in 1969—were, in the opinion of many experts on Somali affairs, the main cause behind the inception of the armed rebel- lions against the old regime and its eventual downfall in 1991. -

Most remarkable is the sheer durability of what is now Somaliland, Puntland, and the recently formed Federal Government of Somalia (FGS).2 How they came about and why they have endured for more than twenty years is a complex political puzzle that has engendered a significant body of literature. Yet behind the range of explanations and the more immediate news of Somali political struggles, al-Shabaab’s persistence, humanitar- ian crises and international involvements, there are compelling historical influences that are able to shed some light on present circumstances.3 Some of these influences can be observed in the deep-rooted path of Somalia’s political culture, or rather, the distinctive historical political culture paths of the “three Somalias.” Of these three independently administered regions, Somaliland and Puntland have been and still are relatively peaceful, consensual in character and economically viable, though in their own distinctive ways.
