The Register is available for use by the public in the Commission’s office. Under the legislation, public authorities as specified by the Office of the First Minister and the Deputy First Minister are automatically treated as registered with the Commission. All other employers have a duty to register if they have more than 10 employees working 16 hours or more per week. Employers who meet the conditions for registration are given one month in which to apply for registration. This month begins from the end of the week in which the concern employed more than 10 employees in Northern Ireland. It is a criminal offence for such an employer not to apply for registration within this period. Persons who become employers in relation to a registered concern are also under a legal duty to apply to have their name and address entered on the Register within one month of becoming such an employer.

    Section 355 Review of Output: Q102.9FM (Londonderry) When a local commercial radio licence undergoes a change of control (this includes licence transfer), Ofcom is required, under section 355 of the Communications Act 2003 (the Act), to undertake a review of the effects or likely effects of the change of control in relation to: • the quality and range of programmes included in the service; • the character of the service, and; • the extent to which Ofcom’s duty under section 314 of the Act is performed in relation to the service. Ofcom’s duty under section 314 of the Act relates to securing the inclusion of an appropriate amount of local material, and a suitable proportion of locally-made programmes in the service. Under section 356 of the Act, where it appears to Ofcom from its review that the change of control would be prejudicial to any of the three matters listed above, then it must vary the licence, by including such conditions as it considers appropriate, with a view to ensuring that the relevant change of control is not so prejudicial. In doing so, any new or varied conditions must be such that the licence holder would have satisfied them throughout the three months immediately before the change of control. Ofcom is required to publish a report of its review, setting out its conclusions and any steps it proposes to take under section 356. Where Ofcom proposes to vary the licence, it is required to give the licence holder a reasonable opportunity to make representations about the variation. On 4 December 2014, a change of control took place at Northern Media Group Limited (NMGL) which held the local commercial FM licence for the Londonderry area (AL155).

    Section 355 Review of Output: Q97.2FM (Coleraine) When a local commercial radio licence undergoes a change of control (this includes licence transfer), Ofcom is required, under section 355 of the Communications Act 2003 (the Act), to undertake a review of the effects or likely effects of the change of control in relation to: • the quality and range of programmes included in the service; • the character of the service, and; • the extent to which Ofcom’s duty under section 314 of the Act is performed in relation to the service. Ofcom’s duty under section 314 of the Act relates to securing the inclusion of an appropriate amount of local material, and a suitable proportion of locally-made programmes in the service. Under section 356 of the Act, where it appears to Ofcom from its review that the change of control would be prejudicial to any of the three matters listed above, then it must vary the licence, by including such conditions as it considers appropriate, with a view to ensuring that the relevant change of control is not so prejudicial. In doing so, any new or varied conditions must be such that the licence holder would have satisfied them throughout the three months immediately before the change of control. Ofcom is required to publish a report of its review, setting out its conclusions and any steps it proposes to take under section 356. Where Ofcom proposes to vary the licence, it is required to give the licence holder a reasonable opportunity to make representations about the variation. On 4 December 2014, a change of control took place at Northern Media Group Limited (NMGL) which held the local commercial FM licence for the Coleraine area (AL254).

Chapter 1- Introduction INTRODUCTION TO REPORT 1.1 In March of 2008, the then Minister for Enterprise, Trade and Employment, Micheál Martin T.D., announced the establishment of an advisory group (the Group) to review the current legislative framework regarding the public interest aspects of media mergers in Ireland. This review was undertaken in the context of a wider review taking place on the operation and implementation of the Competition Act 2002. 1.2 The Group was asked to examine the provisions of the Competition Act 2002 in relation to media mergers and in particular the “relevant criteria” specified in the Act, by reference to which the Minister currently considers media mergers. 1.3 The Terms of Reference of the Group were:- To review and to consider the current levels of plurality and diversity in the media sector in Ireland. To examine and review the “relevant criteria” as currently defined in the Act. To examine and consider how the application of the “relevant criteria” should be given effect and by whom. To examine the role of the Minister in assessing the “relevant criteria” from a public interest perspective and the best mechanism to do so. Development in the sector during the year include the launch of a CityBeat i-phone application, allowing owners of the handset to listen to live output, In 2009, CityBeat also won a gold and two silver awards at the New York Festivals Radio Programming and Promotions Awards, as well as a Chartered Institute of Public Relations Award for Best News Programme. Downtown Radio renewed its focus on news provision and launched extended news bulletins at lunchtime and in the early evening. BBC radio In March 2010, BBC Northern Ireland announced that it would be commissioning a further seven digital radio transmitters to provide coverage for the Enniskillen and North Antrim coast areas, as well as improving coverage for the Belfast area. The BBC also announced plans to trial a solution, known as dynamuxing, to partially address the carriage of BBC Radio Foyle on DAB. Dynamuxing will enable the capacity currently reserved for BBC Radio Ulster to be split in half to allow Foyle to be broadcast digitally at certain times throughout the day. In September 2009, Radio Ulster won the Counsel and Care Awards Best Radio category with its coverage of a Northern Ireland charity’s Community Safety for Older People campaign.

    RADIOCENTRE RESPONSE TO DCMS ‘SMALL SCALE DAB LICENSING CONSULTATION’ INTRODUCTION 1. Radiocentre welcomes this consultation, which paves the way for a new licensing framework for small scale DAB and provides the prospect of affordable access to digital radio for smaller commercial and community services. With digital listening continuing to grow it is increasingly important that radio stations have the opportunity to broadcast on DAB, ultimately boosting the range of choice and content for listeners. 2. To date, many smaller analogue radio stations (broadcasting on FM or AM frequencies) have been unable to broadcast digitally on the DAB platform. This is typically due to transmission costs that reflect multi-transmitter networks which can make it unaffordable for some operators and the fact that existing local DAB multiplexes often cover much larger geographical areas than smaller stations wish to serve. 3. The evolution of small scale DAB, often based around a single, low-powered transmitter and ‘open-source’ software multiplex, gives a lower-cost way for smaller stations to broadcast on DAB to smaller areas. The initial assessment of this technology by Ofcom in September 2016 was that the initial trials had been a success, notwithstanding some concerns regarding the power levels and signal strength. Therefore Radiocentre was pleased that an appropriate legislative vehicle was secured to outline the licensing regime. 4. The Private Members’ Bill sponsored by Kevin Foster MP in 2017 – the Broadcasting (Radio Multiplex Services) Act 2017 – provided a useful solution to revising the existing legislation in this area (most notably Broadcasting Act 1996). While Radiocentre was supportive of the new legislation, during the passage of the Bill it did raise concerns with parliamentarians about specific elements of the new licensing framework.
