The Applicant has stated that many of the State Pollution Control Boards in the south of India have not complied with the direction given by the Hon'ble Supreme court of India in WP(C) No.375 of 2012 between Parayavaran Suraksha Samithi Vs Union of India, 2017(5)SCC 326. The Applicant is aggrieved with the non-compliance of the said direction specifically OCEMS portal is not being maintained properly as only a few last recorded emissions or effluent levels are available on the portal for each industry. The Historical data is not available for public access to make any kind assessment with respect to emissions or discharge by industries are shown in active as per Para 10 (ii) of the Original Application". 2. It is humbly submitted that, the Hon'ble Supreme Court of India in WP (C) No.375 of 2012 between Parayavaran Suraksha Samithi Vs Union of India, 2017(5)SCC 326 directed the states "to make provision for online, real time, continuous monitoring system" to display emission levels, in public domine, on the public portal of the concerned State Pollution Control board . 3. It is also submitted that as per the directions of the Hon'ble Supreme Court, the central server of the Online Continuous Emission Monitoring System (OCEMS) for the state of Telangana was made live in the year 2017. The provision for online, real time, continuous emission monitoring has been implemented in Telangana in the year 2017 onwards and after the commencement of the OCEMS, the Board has taken all the steps to bring all the major industrial units in OCEMS. Presently 383 industries are connected to the Online Continuous Emission Monitoring System. The list of industries connected to the OCEMS of this Board are attached Annexure-I). It is submitted that the industries connected to OCEMS include all the 17 category industries functioning in the state. Provision has been for provided the public to access the real time emission data through the site https://tspcb.cgg.gov.in without any register or login procedures. At present historical data for 30 days can be accessed by the public. Historical data is available for the Board officials from the inception of the OCEMS itself. The link for this site is als0 provided in the official website of Telangana State Pollution Control Board at http://183.82.41.227:8080/enviroconnect/aqms. 5. It is submitted that, the system OCEMS portal is being maintained by properly and emissions or effluent levels are available on the portal pertaining industries connected to the OCEMS Server. It is respectfully submitted that facilities are available to the Board officials for monitoring the historical data from the date of inception and it is helping the Board in keeping the vigil on from pollution the industries. The public can also access the system and can keep themselvesinformed of the present status of pollution levels for the day. The reason for showing gaps in the recorded emissions or effluent levels on the portal for industries is due to internet/data transmission issues at the industry site location. The Board is monitoring OCEMS data on daily basis with a separate cell consisting of 5 Officers under the Project supervision of senior officers of the Board and constantly keeps watch on the data. Exceedences and data not received industries in OCEMS server of the Board is immediately informed to the industry for rectification. 6. It is humbly submitted that as far as the Telangana State Pollution Control Board is concerned it has complied with OCEMS as per the Supreme Court directions in 2017. He called upon them to focus their attention on improving literacy, educational levels, and nutritional requirements of people, as these are the prerequisites of development. Sri A Rama Lakshman, IAS (Ret.), Advisor to Govt. for Welfare, said that by spending over Rs. 40,000 crores on an array of welfare schemes, Telangana has emerged as a role model for other States. He stated that the welfare schemes are covering all segments of poor people across the State, irrespective of caste, creed, and religion. He advised the District Officers to create wider awareness among people, especially in the rural areas, about the welfare schemes in order to ensure that their benefits reach the needy beneficiaries.
