The general overall description of the work of the Contract for the: FDOT District Five HQ Partial HVAC Replacement 719 S Woodland Blvd, DeLand, FL 32720 can be summarized as follows: The Florida Department of Transportation (Department) intends to partially replace the existing HVAC system at the District 5 headquarters office annex building. The proposed work will consist of new mechanical equipment that consists of Outdoor VRF Heat Pump With Heat Recovery Systems. tasks include architectural and electrical work to support the complete project scope. This project will require phasing to allow for functional operations of the existing facility while the HVAC replacement takes place. In addition to the new HVAC equipment, work includes selective demolition, architectural finishes, ductwork and electrical items. B. Refer to Asbestos Containing Materials (ACM) and Lead Based Paint (LBP) report provided by the FDOT. C. Contract Documents: 1. Requirements of the work are contained in the Contract Documents, and include cross-references herein to published information, which is not necessarily bound therewith. 1.2 ASSIGNMENT OF MANUFACTURERS’ OR OTHER SELLERS’ WARRANTIES A. The Contractor shall assign to the Department any and all manufacturers’ or other sellers’ warranties that come with any products, material or supplies which are incorporated into or are consumed in the project in any way. Assignment of such warranties shall be effective on the date of Final Acceptance. To the extent that any such warranties do not extend to subsequent purchasers or owners or such warranties contain a limitation on assignment, the Contractor agrees that the Contractor purchased the products, materials and supplies on behalf of the Department with the intent that the Department be the intended recipient of any State of Florida DOT SECTION 01 10 00 SUMMARY FDOT District Five HQ Partial HVAC Replacement Page 1 of 3 100% Construction Document Submittal Date – December 10, 2018 FPID 440452-3-52-01 warranties. All documents associated with or describing any such warranties shall be delivered to the Engineer along with the other project Final Acceptance documents and shall be deemed to be a part of the required Final Acceptance documentation. The Contractor shall not take any action or fail to act in any way which voids any such warranties. All subcontracts shall contain a similar provision which requires subcontractors to assign any such warranties to the Department. B. All costs for manufacturers’ or other sellers’ warranties shall be borne by the Contractor, as no separate payment shall be made for this work. All costs associated with this warranty shall be included in the Lump Sum Cost of this work. The Department reserves the sole right to determine defects in the materials and systems installed or modified by this project and the acceptability of the warranty repair and defect correction, including adjustment of equipment provided as a part of this project. 1.3 LIMITS OF CONSTRUCTION A. All existing facilities disturbed by the Contractor outside the construction limits indicated on plans, shall be restored, to the Engineer's satisfaction, at the Contractor's expense. 1.4 CONSTRUCTION LAYOUT AND STAKES A. The Contractor shall furnish all lines and measurements necessary for the proper protection and control of the work under these Contract Documents. 1.5 SCHEDULING A. The Contractor shall be responsible for the planning and scheduling, and the coordination of all work performed under the Contract Documents, and the entire project as a whole so that materials will arrive on schedule and installation will proceed without delay. 1.6 COOPERATION BETWEEN CONTRACTORS A. The Department reserves the right to contract for and perform other or additional construction on or near the work covered by this Contract. B. When separate contracts are let within or near the limits of this project, the Contractor shall conduct his work so as not to interfere with or hinder the progress of completion of the construction performed by other contractors. Contractors working on the same project shall cooperate with each other as directed by the Engineer. From legislative, liability, and institutional controls to an outdated and unresponsive business model, recording companies have demonstrated time and time again that they have been unable to adapt to music’s digitalization. While numerous scholars have tackled the prob- lem, few conceive of illegal downloading as a market problem, one that needs a market solution. To that end, this Article argues that the music industry should follow the Hulu model. Hulu is the television industry’s answer to visual digi- talization; by providing content for free streaming and paying for it through advertising revenues, the company is likely turning a profit and offers a promis- ing model for the music industry. This Article argues that record companies should adopt a similar approach by partnering with multiple online intermediar- ies who will offer advertising-supported free music streaming and downloading. However, this proposal differs from the Hulu model in significant ways. First, in contrast to visual media delivery, which is straightforward, online mu- sic delivery is rapidly evolving.     CITY OF LOS ANGELES RESOLUTION Women's Lung Health Week WHEREAS, every five minutes, a woman in the U.S. is told she has lung cancer; and WHEREAS, lung cancer is the #1 cancer killer of women in the U.S., surpassing breast cancer in 1987; and WHEREAS, the lung cancer death rate in women has more than doubled over the past 35 years; and WHEREAS, women are disproportionally burdened with COPD compared to men in terms of illness and death; and WHEREAS, asthma and is more common in women than men; and WHEREAS, advocacy and increased awareness will result in more and better treatment for women with lung cancer, COPD, asthma and other lung diseases and will ultimately save lives; and WHEREAS, LUNG FORCE is the new national movement led by the American Lung Association, with the mission of making lung cancer and lung disease history-uniting women to stand together with a collective strength and determination to lead the fight against lung cancer and for lung health: NOW THEREFORE BE IT RESOLVED, that by the adoption of this resolution, the Los Angeles City Council hereby designates the second full week of May 2014 as WOMEN'S LUNG HEALTH WEEK throughout the City of Los Angeles and encourage all residents of Los Angeles to learn more about the detection and treatment of lung cancer and all lung disease.
