    Assassination Records Review Board Releases Transcripts of BriLab Conversations It has sometimes been suggested that organized crime figures may have played a role in the assassination of President John F. Kennedy. One of the principal suspects of such a theory has been Carlos Marcello, the long-time head of organized crime in New Orleans. Attorney General Robert F. Kennedy had launched deportation hearings against Marcello. In the late 1970s, the FBI investigated Marcello in an operation code-named “BriLab,” which stood for “bribery of organized labor.” As part of this “BriLab” investigation, the FBI conducted electronic surveillance for approximately eight months on Marcello’s home and on his office at the Town and Country Motel. Some writers have suggested that the “BriLab” tapes might contain conversations in which Carlos Marcello, or his brother Joseph, acknowledged that they were involved in the Kennedy assassination.1 Several members of the public urged the Review Board to examine BriLab records to determine whether this was true. Although the FBI Field Office in New Orleans maintains the tapes and transcripts from the BriLab surveillance, the tapes have remained under seal of the Federal District Court in New Orleans because they were made under the authority of 18 U.S.C. § 2501 et seq. (“Title III”).2 Thus, researchers and historians were unable to confirm or reject allegations that the tapes or transcripts actually contain information relevant to the assassination. In order to investigate this issue, the Review Board requested and obtained a court order from federal Judge Sears of the Eastern District of Louisiana, who granted members of the Review Board staff full access to all of the BriLab materials.

INTRODUCTION The United States Constitution affects the ability of federal, state and local governments to combat criminal activity. Since the relevant constitutional provisions are in the form of broadly stated legal commands,' the constitutionality of specific law enforcement practices can only be determined when the courts, ultimately the Supreme Court of the United States, interpret these commands in cases in which they are challenged.     Carlos Marcello and the Sicilian Mafia in the U.S. by Cynthia Butler Carlos Marcello was the epitome of the Sicilian Mafia and its far-reaching “black hand” in the United States. His employment of Mafia strong-arm tactics and the Omerta code of silence worked very effectively for him throughout the majority of his long life. This study will explore Marcello’s rise to power within the Mafia’s ranks and his impact on the New Orleans community during the 1950s and 1960s. From the latter part of the 19th Century through the early part of the 20th Century, multitudes of Italians immigrated to the United States. By 1910, there were approximately 200,000 Italian immigrants living in New Orleans, alone, but there were also large populations living in other American cities by then as well. 1 Most of these immigrants were single men who had been poor farmers, unskilled laborers, or craftsmen in Italy. They often came to America looking for the economic opportunity that would allow them to save money, return to their mother country, and buy their own farms. The majority were good, law-abiding citizens who enriched America with their colorful Italian culture and love of family, but there was also a small percentage who belonged to the Sicilian Mafioso.2 This faction brought with them their subversive Mafioso code of conduct. They formed gangs that preyed on their own countrymen’s successes by extorting money from neighborhood businesses and others who “paid-up” just to keep from being attacked. These Sicilian extortion gangs and their tactics were known as “the black hand.” Their tactics included, but were not limited to: sending letters to victims, threatening bodily harm, kidnapping, arson, and even murder if they were not paid.3 One of the members of this underworld organization who ascribed to such tactics was New Orleans’ mob boss and Sicilian by birth, Carlos Marcello.

    Dexter Babin, II History 505 Winter 2018-2019 The FBI’s Unsuccessful Investigations into the New Orleans Mafia, 1977-1989 At a time when the FBI was eliminating entire chains of command in East Coast Mafia families with numerous investigations, eventually culminating with sentencing the bosses of the infamous “Five Families” to 100 years each in prison, a structural RICO indictment of the New Orleans Mafia was never successful until after New Orleans Mafia boss Carlos Marcello’s death.1 Though the FBI’s 1981 BRILAB insurance kickback sting would send Marcello to prison, his conviction would later be thrown out by an appellate court in 1989; freeing Marcello after serving only 8 years of his 17 year sentence, which also included bribing a California federal judge in an unrelated matter.2 This would leave the FBI’s BRILAB sting the only successful FBI operation in a handful that targeted Marcello during the 70s and 80s. This paper will propose that the FBI’s lack of success when it came to Marcello at this time as threefold: a general lack of structural identity of the New Orleans Mafia, Marcello’s political connections, and the way Marcello handled his finances all shielded him from a major indictment. Moldea October 24, 2017 ANNOTATED On July 17, 1979, upon the release of the final report of U.S. House Select Committee on Assassinations about the murder of President John Kennedy, its chief counsel, G. Robert Blakey—one of the world’s experts on organized crime in America and the author of the 1970 RICO Act—declared: “The mob did it. It’s a historical fact.” Again, that took place in July 1979. Now, let me tell you what happened two years earlier, leading up to that moment. But first, I want to state that any reasonable definition of “organized crime” is that it is enterprise crime. It is conspiracy crime. And it is crime by association. So please keep that in mind during these next few minutes. In 1977, forty years ago, I was finishing up the research for my first book, The Hoffa Wars, about the rise and fall of Jimmy Hoffa. In late-September, I called one of my best sources, Ed Partin, whom I had earlier met through my friend and mentor, Walter Sheridan, who was a top lieutenant for Robert Kennedy during their work together on the Senate Rackets Committee when Kennedy was its chief counsel and later when Kennedy served as Attorney General. Walter Sheridan headed Kennedy’s “Get Hoffa Squad,” and it was Sheridan, who flipped Partin in September 1962.
