CASE CLOSED OR EVIDENCE IGNORED? JOHN H. DAVIS CASE CLOSED OR EVIDENCE IGNORED? Gerald Posner's book, CASE CLOSED - Lee Harvey Oswald and The Assassination of JFK, is essentially a lawyer's prosecutorial brief against Oswald as the lone, unaided assassin of President Kennedy, emphasizing the slender evidence for his sole guilt, and downplaying, even ignoring, the substantial body of evidence that suggests he might have had confederates. The book contains nothing new except a wildly implausible theory of the first shot fired at the presidential motorcade in Dealey Plaza. Essentially the book is a re-hash of a thirty-year-old discredited theory that repeats many of the failings of the Warren Commission's deeply flawed 1964 investigation. Along the way Mr. Posner is guilty of gross misstatements of fact and significant selective omission of crucial evidence. Mr. Posner's new theory of the first shot is perhaps the most implausible of any JFK assassination writer, including the wildest conspiracy theorists. Posner would have us believe that Lee Harvey Oswald's first shot was fired between Zapruder film frames 160 and 166 through the foliage of a tree and was deflected away from the presidential motorcade by a branch. Any marksman knows that his first shot at a target is always 2 his best shot because he has time to aim without the interference of having to operate the bolt in a hurry to load. Posner would have the marksman Oswald take his first shot through a thicket of tree branches and leaves when he couldn't clearly see his target. -

Assassination Records Review Board Releases Transcripts of BriLab Conversations It has sometimes been suggested that organized crime figures may have played a role in the assassination of President John F. Kennedy. One of the principal suspects of such a theory has been Carlos Marcello, the long-time head of organized crime in New Orleans. Attorney General Robert F. Kennedy had launched deportation hearings against Marcello. In the late 1970s, the FBI investigated Marcello in an operation code-named “BriLab,” which stood for “bribery of organized labor.” As part of this “BriLab” investigation, the FBI conducted electronic surveillance for approximately eight months on Marcello’s home and on his office at the Town and Country Motel. Some writers have suggested that the “BriLab” tapes might contain conversations in which Carlos Marcello, or his brother Joseph, acknowledged that they were involved in the Kennedy assassination.1 Several members of the public urged the Review Board to examine BriLab records to determine whether this was true. Although the FBI Field Office in New Orleans maintains the tapes and transcripts from the BriLab surveillance, the tapes have remained under seal of the Federal District Court in New Orleans because they were made under the authority of 18 U.S.C. § 2501 et seq. (“Title III”).2 Thus, researchers and historians were unable to confirm or reject allegations that the tapes or transcripts actually contain information relevant to the assassination. In order to investigate this issue, the Review Board requested and obtained a court order from federal Judge Sears of the Eastern District of Louisiana, who granted members of the Review Board staff full access to all of the BriLab materials. -

The Chicago Crime Commission is a non-political, non-partisan, private-citizen organization of Chicago professional and business men who are interested in better law enforcement in the metropolitan Chicago area. Prior to his appointment as Operating Director of the Commission Mr. Peterson was a special agent of the F.B.I. for over 11 years and was in charge of offices in Milwaukee, St. Louis, and Boston. He is the author of two books; Barbariansin Our Midsi, which deals with the history of crime and politics in Chicago, and Gambling: Shmuld It Be Legalized. All of Mr. Peterson's career since his graduation from Northwestern University Law School has been in the field of law enforcement and criminology. An era of jazz Jalopies Prohibition And Trigger-Happy Punks.” — Baby Face Nelson this essay examines a distinctive and coherent cycle of films, pro- duced in the late 1950s and early 1960s, which exploited the notoriety of Prohibition-era gangsters such as Baby Face Nelson, Al Capone, Bonnie Parker, Ma Barker, Mad Dog Coll, Pretty Boy Floyd, Machine Gun Kelly, John Dillinger, and Legs Diamond. Despite the historical specificity of the gangsters portrayed in these “bio-pics,” the films each display a marked interest in relating their exploits to contemporary topical con- cerns. Not the least of these was a desire to exploit headline-grabbing, sensational stories of delinquent youth in the 1950s and to link these to equally sensational stories of punk hoodlums from 1920s and 1930s. In the following pages, some of the crossovers and overlaps between cycles of juvenile delinquency films and gangster bio-pics will be critically eval- uated.
