I. INTRODUCTION

(i) Aim

1. Theaimofthisreportistodescribetheresultsofthetechnicalandlegalanalysiscarried outinrelationtopatentsreferringtoLepidiummeyenii (or“maca”).Similarly,anattemptis madetodrawattentiontoaseriesofelementsandproblemsassociatedwiththistypeof patentsofparticularimportanceforPeru.

(ii) Descriptionoftheproblem s

2. ThepatentsreferringtoLepidiummeyenii ormacaareonemoreexample,amongmany whichexist,ofhowtheintellectualpropertysystem–bymeansofpatents –isbased,mainly intheUnitedStates,ontheprivatizationofbiologicalandgen eticcomponentsandmaterials inisolation,aspartoflargerinventions.Inthiscase,theseareresourcesinrelationtowhich Peru(asthecountryoforigin)hasaseriesofrightswhicharenottakenintoaccountor respected.Thissamecasereferstoknowledgewhich,althoughdifficulttodocument,has beenbroadlyusedbyoldPeruviansforalongperiodoftime.Thisisobviousowingtothe factthatmanyfood-related,nutritionalandmedicinalusesofmaca,claimedinthesepatents, havetraditionallybeenusedbytheindigenouspeoplesofPeru.

3. ThissituationisinnowayparticulartoPeru.Inthefinalanalysis,variouscountries withahighconcentrationofbiologicaldiversityandindustrialandcommercialpotential sufferexact lythesameproblemasregardsthewayinwhichtheintellectualpropertysystem, andpatentsinparticular,areused.Inthisconnection,someoftheconclusionsandfinal recommendationsofthisreportarepossiblyvalidoutsidethespecificsituationinPeru relatingtoLepidiummeyenii .

(iii) INDECOPIinitiative

4. Atthebeginningof2002,anumberofinstitutionssuchastheAssociation, PROBIOANDES,ETCGROUP,andcertainpublicsectorinstitutions,drewattentiontothe patentsgrantedintheUnitedStatesofAmericaforinventionsrelatingtomaca.Facedwith thepossiblerightsinfringedinPeruasthecountryoforigin,theassignmentofrightsofits indigenouspeoplesasholdersoftheirancestors’knowledgeoverdifferentusesofmacaand thepossiblecommercialeffectswhichthesepatentsmighthaveonPeruvianproducersand exportersofmaca,the NationalInstitutefortheDefenseofCompetitionandProtectionof IntellectualProperty (INDECOPI)tooktheinitiative,inthe middleof2002,toconvenea workinggroupinordertoanalyzethepatentsgrantedandtheapplicationspending,which refertoLepidiummeyenii anditsconsequencesand,similarly,toassessalternativesfor dealingwiththem.

(iv) Contentofthereport

Thereportisdividedintotensectionsorsubjectswhich,inturn,havebeensubdivided owingtotheirdegreeofcomplexityandspecificity.Afirstpartdealswithquestionsof contextandthestandard -settingpolicyframeworkwithinwhich theproblemofpatents relatingtomacaispresented.Asecondpartdescribes Lepidiummeyenii andprovidesanidea ofitsbotanical,biological,commercialandothervalue. II. BRIEFDESCRIPTIONOFTHECONTEXT:PATENTS,BIOLOGICAL DIVERSITYAND“BIOP IRACY”

(i) Ageneraloverview

6. Accesstoandtheuseandappropriationofbiologicalmaterials(andrelatedindigenous knowledge)originatingfromdevelopingcountrieswithgreatbiologicalwealthonthepartof institutionsfromdevelopedco untriesconstitutesapermanentveryoldprocess,whichhas beenwidelydocumented.

7. Theuseoflessobviousandsufficientlymoremechanismsthanforceandthephysical controlofthesematerialsis,bycontrast,amuchmorerecentphenomenon.Intellectual propertyand,inparticular,patents(specificallyinthefieldofbiotechnology)formpartof mechanismsthroughwhichthelawlegitimizescertainmethodsofpropertyassignment.

8. Inthepastfewyears,thisdirectorindirect appropriationofbiologicalmaterialsand indigenousknowledgethroughtheuseofpatentshasbecomeknownas“biopiracy.” Biopiracyisattheverybasisofthedisputeoverwhomandunderwhatcircumstancesrights overinventionsandproductsderivedfr ombiologicalmaterialsmaybeinvoked,basedin manycasesontheuseofindigenousknowledgeassociatedtherewith.Thishasbeen accentuatedmuchmoresincetheentryintoforceofthe ConventiononBiologicalDiversity (CBD)in1993,inacontextinwh ichcertainbasicprincipleshavebeenestablished,providing accesstotheseresourcesandknowledge,andlegitimizingandregulatingtheiruse.

9. Asoneofitsmaintasks,theCBDseekstobalancethelackofequilibriumbetween thosewhoare abletousebiologicalresourcesandtheircomponents(theindustrialized countries)forcommercialandindustrialpurposes,andthosewhodonothavesuchcapacities butdohavetherawmaterial,i.e.theseresourcesandtheircomponents(developing countries).Forthispurpose,theCBDestablishesrulesandprinciplesontheconditionsfor thisaccessanduse,andastohowthebenefitsderivedfromsuchuseshouldbesharedina fairandequitablemanner.

(ii) Intellectualpropertyrights;patents

10. Thecommonaimofintellectualpropertyrightsistoprovidecompensationforthe creativeandintellectualeffortsofhumanbeings,bothinartisticandscientificterms.This needtocompensatecreativeeffortshasbeenrecognizedas afundamentalrightsincethe 1948 UniversalDeclarationofHumanRights.

11. Copyrights,patents,tradesecrets,marksandbreeder’srightsaresomeofthebasic instrumentsandtoolsofintellectualproperty.Eachofthemhasbeendesignedovertime to protecttheinterestsandpropertyofauthors,inventors,entrepreneursandimprovers.

12. PatentsweredevisedinthefifteenthcenturyinEnglandasameansofrewardingthe creativecapacityofinventors.Withthepassingoftime,aregula torysystemforpatentshas beenputinplacewithelementsofnationalscopeandothersofinternationalscope.Itis universallyrecognizedthataninventionmaybepatentedinanytechnologicalfield,provided thatitisnovel,involvesaninventivest epandisindustriallyapplicable.Theownerofa patentisentitledtoexcludethirdpartiesfromusing,marketingandgenerallyexploitinga WIPO/GRTKF/IC/5/13 Annex,page 3 particularinvention,withouthisauthorization.Asacounterparttothisexclusiverightandin ordertopromo tecontinualscientificandtechnologicalprogress,aninventormustdescribehis inventionanddiscloseitsothattheprocessofcreationandhumaninnovationcontinues therefrom.

13. Technology,whichoriginallyconcentratedontheimprovementofequipment,tools, devicesandtheprocessesfortheirgeneration,hasbeguntodevelopinfieldsinwhichworkis donedirectlywithbiologicalmaterial.Biotechnologyand,inparticular,geneticengineering arebasedonthepossibilitiesformanipula tingbiologicalorlivingmaterialandtransforming itforcommercialandindustrialpurposes.Thesystemofpatentshascertainlybeenobligedto respondandadaptitselftothisnewsituation.

14. Countrieshaveadvancedindifferentwaysas regardswhethertheyallowthelegal protectionofinventionsderivedfrombiotechnology.Whereasunderstandablydeveloped countries,whichhaveledthistechnologicalrevolution,havedemonstratedtheirmuchgreater determinationtoauthorizepatentsfo rtheseinventions,lessdevelopedcountrieshave expressedanumberofreservations.WiththeadoptionoftheWorldTradeOrganization (WTO)AgreementonTrade-RelatedAspectsofIntellectualProperty,certainminimum standardswereestablishedfortheprotectionoftheintellectualpropertyrightsenshrined therein.Althoughthescopeofthesestandardscontinuestobediscussed,asageneralrule countriesallowbiotechnologyinventionstobepatented(somewithmorelimitationsthan others).

(iii) Biologicaldiversityanditsimportance

15. Insimpleterms,itisrecognizedthatbiologicaldiversityconstitutesthematerialbasis forthesurvivalofalifeonearthand,inparticular,forthemaintenanceofhumanlife.Asa sourceofmedicines,food,clothing,,pollenators,biologicalcontrollersand,interalia , environmentalservices,biologicaldiversity –atanecosystemiclevel,ofand geneses –isessentialforsatisfyingthebasicneedsofsurvivalandcomfortofhuman kind.

16. Theimportanceofbiodiversitycanbemeasuredfromaneconomicperspective(the globalmarketforgeneticresourcesandproductsderivedtherefromvariesbetweenUS$ 500 and800 billion,includinginthiscalculationthebiotechnolo gysector,theagriculture industry,cosmeticsector,horticultureetc.);fromapoliticalpointofview(15 megadiverse countrieshold75percentoftheplanet’sbiodiversity);fromasocialandculturalperspective (millionsofpeopleandindigenousa ndlocalcommunitiesaroundtheworldliterallydepend onbiodiversityfortheirdailyandimmediatesurvival);andanecologicalorenvironmental perspective(theenvironmentalservicessuppliedbyelementsofbiodiversityandcertain ecosystemsaresimi larlyvitalforthe“health”oftheenvironment).

(iv) “Biopiracy”

17. Biopiracyshouldbeunderstoodasapoliticalratherthanalegalconcept.Biopiracy referstosituationsinvolvingdirectorindirectappropriationofbiologicalorgenetic resources ortraditionalknowledgebythirdparties.Thisappropriationmayoccurbymeansofphysical control,theuseofintellectualpropertyrightsoverproductsincorporatingtheseitems (obtainedunlawfully)or,insomecases,throughtheinvocatio nofrightsdirectlyoversuch items. Thereisawealthofliteratureondifferentformsandcasesofbiopiracythroughoutthe world.InPeruandtheAndeanregioningeneral,suchasquinua,ayahuasca,grade blood,macaitselfandco lorcottonaresomeofthetraditionalexamplesusedincasesin which,sometimesinvolvingthespecificlegalsysteminforce,alegalsituation(wherebya thirdpartyisconsideredthelawfulownerorholderofaright)ismadelawful,wherethisis lessunjustandquestionablefromthepointofviewoftheprinciplesandspiritoftheCBD. Obviously,assumingthattraditionalmaterialsorknowledgeinfringingthelegislationinforce areused,thisformofbiopiracyclearlybecomesunlawful.

19. Asalreadystated,theCBDaimstobalancethesituationbetweenrichcountrieswith biologicaldiversityandthosewhich,basedontheirtechnologicalprogress,maybenefitfrom andusethisdiversityinthepharmaceutical,biotechnology,agricultureindustryandother sectors.Thisisparticularlyimportantforthemegadiversecountriesinsofarastheyholda largeshareofthisdiversityanditiscalculatedthattheannualglobalmarketforgenetic resourcesreachesUS$500–800,000 million(tenKa teandLaird,2000).Inadditiontothe accuracyofthefigures,themagnitudethereofshowsthatwearedealingwithamarketto which,withcompletesecurity,themegadiversecountriesmakeasubstantialcontributionbut fromwhich,inmostcases,they donotbenefit.

III. POLITICALANDREGULATORYADVANCESINPERUANDTHEANDEAN REGION,ANDTHEINTERNATIONALCONTEXTASREGARDSACCESS, TRADITIONALKNOWLEDGEANDINTELLECTUALPROPERTY

20. TheCBDemergesnotonlyastheagreementofStatestopreservebiologicaldiversity whichisdeterioratingrapidlyatthegloballevel.ThegreatbargainoftheCBDwasto respondinaprecisemannertotheproblemofbiopiracyandtotheunfairwayinwhich certainpartiesbenefitfrombiologicalandgenetic resources,withouttakingintoaccountthe rightsandinterestsofothers.Atransitionwasthereforeachievedfromtheparadigmoffreely accessibleresources,characterizedas“thecommonheritageofhumanity,”toasituation wherethesovereignrights ofcountriesoversuchresourceswererecognized.TheStates agreedthatinordertogainaccesstotheseresources,thebenefitsarisingfromsuchaccess andutilizationshouldbesharedinafairandequitableway(Article 15oftheCBD).

21. Thediscussionsonthesubjectofaccesstogeneticresourcescontinuetobeamongthe mostintenseandcomplexwithinthesphereoftheCBD.Inordertoassistcountriesintheir relatedinternalpolicyandregulatorydevelopmentprocesses,in 2002the BonnGuidelineson AccesstoGeneticResourcesandFairandEquitableSharingoftheBenefitsArisingoutof theirUtilization(Decision VI/24oftheConferenceoftheParties(COP),2002)wereadopted andprovideguidelinesanda(non-binding)referencetothelegalfactorswhichcouldbetaken intoaccountindevisingpoliciesandaccessrulesandregulations.

22. PeruquicklyratifiedtheCBD(LegislativeResolution 26181,1993)and,atthetimeof itsentryintoforcein 1993,oneofthemainaspectsforimplementationofArticle 15atthe nationallevelwastoestablishrulesandstandardsgoverningaccesstogeneticresources,the fairandequitablesharingofbenefits,andtheprotectionofknowledge,innovationsand practicesofindigenous communities. 23. Thesameconcerninthenationalspherealsohadrepercussionsattheregionallevel betweenthecountriesofthe AndeanCommunityofNations(CAN),andinJuly 1996CAN Decision 391providingaCommonRegimeonAccesstoGenetic Resourceswasapproved. Thisregulation–whichislawineachofthemembercountriesofCAN:Venezuela, Colombia,,Peruand –specificallydeterminesthejointrulesastohow,by whomandunderwhatconditionsaccessispossibletoth egeneticresourcesintheregion.

24. The RegionalBiodiversityStrategyfortheTropicalAndeanCountries (CAN Decision 523,2002)andthe NationalBiodiversityStrategy(SupremeDecree102-2001- PCM)constitute,intheirturn,biodiversitypoli cyandplanninginstrumentsinwhichthe geneticresourcescomponent(andthetraditionalknowledgeofindigenouspeoples)formsan essentialpartoftheactionplansandactivitiestobecarriedoutbothintheregionalcontext andthenationalsphere.

25. Therulesandregulationswhichreferorcouldbeseentorelatetogeneticresourcesare certainlynotlimitedtoDecision 391ortotheregionalsphere.Atthedomesticlevel, Law 27300onSustainableDevelopmentofMedicinalPlants (2000)andLaw 27821on PromotionofNutritionalSupplementsforAlternativeDevelopment(2002)aretworecent examplesoflegalsystemswhichaffectthemethodofandexistingconditionsfortheuseof biologicaldiversitycomponents,inthisspecificcasemedici nalplantsorthosewith nutritionalpropertiesrespectively.

26. Asregardstraditionalknowledge,thesubjectisalsoamatterofpriorityandstrategyfor thecountriesintheregion.Thisisreflected,asalreadyindicatedintheactionlinesofthe RegionalStrategy.MentionisalsomadeinthespecificDecision 391andinCAN Decision 486concerningaCommonIntellectualPropertyRegime .However,onlyPeru possessesaspecificlaw –Law 27811,whichestablishesthe RegimeforProtectionofthe CollectiveKnowledgeofIndigenousPeoplesLinkedtoBiodiversity (2002) –designedto protectthisknowledgeandtoestablishtherulesforitsuseandtreatment.

27. Inthespecificcontextofpatents,anovellandmarkinthelegislationonthissubject, CANDecision 486,hasexpresslyestablishedthat:(a)individualbiologicalcomponents (whichdonotclearlyinvolveaninvention)arenotpatentable,and(b)inthecaseof inventionsincorporatingbiologicalorgeneticcomponents,ortr aditionalknowledge,thegrant ofthepatenttitleissubjecttothelegalprovenanceofthesematerialsandknowledgebeing demonstrated,andapatentmayberefusedorevenrevoked,wherethisrequirementisnot satisfied.Inotherwords,theregimeis dependentoncompliancewithotherlegalstandards, includingtheCBD,Decision 391and,inthecaseofPeru,Law 27811.

28. Asindicatedabove,the WTOAgreementonTrade-RelatedAspectsofIntellectual Property (TRIPS)establishescertainminim umstandardsfortheprotectionofintellectual propertyrights.Itshouldbespecifiedthatalthoughtheserequirementsarenotexplicitly envisagedintheTRIPSAgreement,nothingpreventsthistypeofmeasurebeingestablished, forthebenefitofcountriessuchasPeru(andothermegadiversecountries). IV. WHATISMACA?

29. InPeru,theIncasandtheirancestorsdomesticatedmorethan180 cultivatedspeciesof plantsoveraperiodofseveralthousandyears.Thiswasfeasibleowingtothe existenceof greatecologicalandclimaticdiversity,availabilityofthousandsofspeciesofplants,andthe Andeaninhabitantswhodevelopedagriculture.OneofthecropsintheAndesismacawhich, untilashorttimeago,wasvirtuallyunknown.

30. The,knowninQuechuaasmaca,maka,maino,ayakchichita,ayakwillku;in Spanishasmaca;andinEnglishasmacaorPeruvian,comesfromtheCentral highlandsofthePeruvianAndes,whereithasbeencultivatedformanycenturiesforits swollenrootswhichareedible.Itisamagnificentexampleofaplantdomesticatedbythe ancientPeruvians,whichhashelpedtofeedtheinhabitantsofChinchaisuyo,inan environmentwithlowtemperaturesandstrongwinds.Inthoseareas,these climaticfactors limitthecultivationofotherspecies.Forcenturiesmacawasusedtobarterforother foodstuffsortopaytaxes.

(i) Historicalprecedents

31. Macaisbrieflydescribedinpart 1oftheworkbyPedro CiezadeLeón,in 1553, entitled“LaCrónicageneraldelPerú”(theGeneralChronicleofPeru).Vásquezde Espinoza,whovisitedPeruin 1598,alsoprovidesashortdescriptionofmacainhis “CompendiumandDescriptionoftheWestIndies,”andFatherBernabéCobo,whovisited Perubetween 1603and 1629,alsoincludesitinhis“HistoryoftheNewWorld”(Ochoa& Ugent,2001).

32. InBook 4,Chapter XV,Father Cobo(1956)saysthat“onlyintheprovinceof Chinchaycochawasasmallplant,knownasmaca,cultivated,whichdoesnotgrowfromthe ground,andwherenootherplant,ofthosecultivatedforhumansustenance,growsowingto thefrequentsnowsandfrosts.Thisplantproducesarootintheformofachervilpear,white insidelikea,andwhichservesasbread,greenanddry,whichtheykeepforthewhole year.Ithasastrangeproperty,since,astheygrowwiththisroot,itsnaturalfeaturesnotonly donotdecreaseinnumber,asintheotherprovincesinPeru,butincreasedaily,forwhich reasonitis saidthatthisrootisvirtuous.”Inviewoftheworthofthisfood,Spanishtax collectorsdemandedthattheinhabitantsoftheprovinceofChinchaycochashouldpaythem withmacaharvests.

33. InhisaccountofhisjourneytothedepartmentsofCentralPeru,in 1777and 1778,the SpaniardHipólitoRuizstatesthattheareawheremacaisproducedandconsumedwerethe villagesofCarhuamayo,PampadelosReyes,Ninacacaandareasattachedtotheseparishes, whichcurrentlybelongtothedistrict sofCarhuamayoandOndoresinthedepartmentof Junín.Inhisaccount,hesaysthattheyare“…potatoesorpotatoroots,thesizeofhazelnuts… verytastybutburningandanaphrodisiac,orwhicharouseVenus;forwhichreason,many peoplebelievethattheymakemenandwomenfertile…”

(ii) andbiologicalcharacteristics

34. Macaistheonlycultivatedcruciferousspecieswhichproducesstarch.Itisclassifiedin the Family, Lepidieae Tribe,MonoplocaSectionandLepidiu m Genus,and Lepidiummeyenii Species(Quirós&Aliaga,1997). WIPO/GRTKF/IC/5/13 Annex,page 7

35. Themacaplantisherbaceousandischaracterizedbytheformationofarosetteofshort anddecumbentstemswithnumerousleaves,andwhichgrowsalmoststucktotheground, ther ebymakingitverytoleranttofrosts.Intheground,thepartofthestemwhichisbelow thecotyledons(hypocotyl)acquiresafleshystructurewhichcomprisesaradicletextureand endswithaswollenrootandnumerousabsorbentlateralroots.Thishypocotyl- rootis tuberous,succulentintheformofaturnip,andistheedibleportion.Themacacropswhich currentlyexistaremainlydistinguishedbythecolorofthehypocotyls -rootswhichmaybe white,yellow,grey,purple,black,yellowandpurple,andwhiteandpurple.Theleaves exhibitadimorphousstructure,andarelongerinthevegetativephaseandmorereducedinthe reproductivephase.Theflowersarenotparticularlynoteworthy,withfoursepalsandfour smallwhitepetals,aswellastwoorrarelythreestamens.Theovaryisovalandbicarpelar withashortstyle.Theflowersaregroupedinaxillarbunches.Thefruitisasiliquawithtwo seeds(Quirós&Aliaga,1997).

36. Macaisautogamous,isreproducedpredominantlybyself -pollination,andproduces fertilepollentrinuclearseeds.Ithas2n=8x=64chromosomesandisadisomicoctoploid.It producesseedswhicharerarelydormantandgerminateinfivedaysat25oC(Quirósetal. 1996;Quirós&Aliaga,1997).

(iii) Genetic diversity,relatedwildspeciesandtheirconservation

37. Althoughlittleinformationexistsregardingthe LepidiumspeciesendemictotheAndes, thosewhichareknownareclassifiedinthe Dileptiumand Monoplaca sections.Allthese, includin gmaca,growinhighaltitudehabitats,upto4,500 metersabovesealevel.Brakoand Zarucchi(1993)reportedsixother LepidiumspeciesinPeru,distributedbetweenthe DepartmentsofAncashandPuno.However,someofthosespeciesarealsotobefoundin Ecuador,BoliviaandArgentina.

38. Toledoetal.(1998)reportedonastudywithRAPDmolecularmarkersof29entriesof cultivatedmaca,whichappeartorepresentapproximately80percentofknownmacacrops, and27 entriesof Lepidiumbip innarifidum,L.kalenbornii andL.chichicara wildspeciesfrom Ecuador,PeruandBolivia,whicharemorphologicallydifferenttomacaandareclassifiedin the DileptiumSection.Alltheentriesofeachspeciesformedseparateconglomeratesandthe authorsconcludedthatnoneofthewildspeciesstudiediscloselyrelatedtomaca.They recommendedastudyofthe L.solomonii (Bolivia),L.jujuyanum(Argentina)andL. weddellii (Peru)species,whichareclassifiedinthesame MonoplacaSectionasmaca.In addition,L.weddellii appearstobetheonlyspecieswhichproducesswollen hypocotyls -roots.TheRAPDmarkersalsoshowedalowlevelofpolymorphismbetweenthe samplesofmacastudied,whichwouldindicatethatmacahasaverynarrowgeneticbase. SimilarresultswerereportedbyKianian&Quirós(1991),usingRFLPsandRAPDswith 30 cropsand21 wildspeciesfromEcuador,PeruandBolivia.

39. Chacón(2001)reportedonwildformsofmacaknownbythecommonnameof “shihua”andwhichare tobefound,veryrarely,incultivatedmacafields.

40. Thelargest LepidiumcollectioninPeruiskeptintheLaMolinaNationalAgrarian University(UNALM),whichcontains93 macaaccessions,41wildLepidiumspecies,and 38 familylinesofselections.TheInternationalPotatoCenter(CIP)holds23 accessions,most ofwhichduplicatetheUNALMcollection,andareconservedasseeds(> 2,000per WIPO/GRTKF/IC/5/13 Annex,page 8 accession)refrigeratedat - 20oC.Theseseedsareobtainedfrom20 plantsperaccessionand tests tomonitortheirviabilityarecarriedouteverytwoyears.Alltheaccessionshavebeen characterizedusingmorphologicaldescriptors.

41. CIPexpertsconsiderthatthecollectionsconservedexsitu donotrepresenttheexisting diversity insitu .

(iv) Originandgeographicaldistribution

42. Verylittleisknownabouttheoriginofmacaandawildspecieshasnotyetbeen identified,whichmightbeconsidereditsancestorandfromwhichitwasdomesticated.Maca appearstohavebee ndomesticatedbyhumangroupsoriginatingfromthePeruvianforest, knownas“Pumpush,”whopopulatedareassuchasCuncushRunaontheBumbushor Bombónplateau,wherethelagoonofChinchaycochaorJunínislocated.ThePumpush requiredsaltwhichwas producedintheCerrodelaSalinTarma,CatamarcaorCachipuquio, locatedinSanPedrodeCajasandSanBlas.Ancestralmacaplantsappeartohavebeenone ofitssourcesofnutritionandtheprocessofitsdomesticationappearstohavebegunin 1,200 B.C.intheareasaroundSanBlas(Rea,1992,Obregón,1998).

43. AccordingtoJavierPulgarVidal,thewordmacacomesfromthewordsMa,which means“highup”(whichhasbeencultivatedoriscultivatedataltitude)andCa“foodwhich strengthen s.”InQuechua,itappearstomean“foodwithastrongtaste”(Obregón,1998).

44. ItisbelievedthatintheXVI th andXVII th centuriesmacawasmorebroadlydistributed ingeographicalterms.However,untilafewyearsago,thegeographicaldistributionofmaca wasrestrictedtotheareassurroundingtheJunínlagoon,inthecentralhighlandsofPeru. Traditionally,thelargeareasundercultivationweretobefoundintheDepartmentofJunín,in manycommunitiesinthedistrictsofOndores,Huayre,Carhuamayo,TarmaandJunín,inthe DepartmentsofPascoenNinacaca,YanachachiandVicco.Recently,itscultivationhasbeen extendedtootherDepartmentssuchasHuancavelica,Ayacucho,Apurímac,CuscoandPuno. Alltheselocalitiesaresituat edintheagroecologicalareasSuniandPuna,atanaltitudeof between3,500and4,500meters.

(v) Nutritionalandpharmacologicalpropertiesofmaca

45. Thefreshhypocotyls -rootsofmacacontain80percentwaterand,whentheyaredry, they haveanutritionalvaluesimilartothatof,,andwheat.Itscomposition includes55to60percent,tento12 percentproteins,eighttoninepercent fiberandtwotothree percentlipids.Macacontainslargequantitiesofes sentialaminoacids andhighlevelsofironandcalcium.Italsocontainsfattyacids,ofwhichlinolenicum, palmiticumandoleicumarethemostimportant.Italsocontainsesterolsandalkaloids (Quiroz,etal.,1996).

46. ThemostimportantknownpropertyintheAndeantraditionisitseffectonfertility;this hasbeenthemainfeatureattributedtomacasincetheXVI th centuryandisconsideredtobe oneofthefactorsinincreasingthepopulationinthehighestlyingareasinPeru.Itis also usedtotreatfrigidity,sexualimpotenceandmentaldeficiency(León,1964,1986;Obregón, 1998;Johns,1980). Theeffectsofmacaonfertilityhavebeenverifiedinrats,inwhichanincreasein spermatogenesisoccurs,alongwiththematuringoffolliclesandanincreaseinoffspring whentheyaresuppliedwithamacaalkaloidextract(Chacón,1961);inguineapigs,which whenfedwithdrypowderedmacaincreasetheirfertility(100percent)andtheiroffspring (Alvarez,1993;Jeri,1999);insheep,whichwhenfedwith80 gramsofmacafortwoweeks increasedthevolumeofsemen,spermconcentrationandthemotilityofspermatozoids;and ininfertilecowswhichregaintheirfertilityafterbeingfedwithmaca(Pulgar,1978).Reports alsoexistontheuseoftraditionalrecipestotreatinfertilityinmenandwomen(Garcíaand Chirinos,1999).Thepropertiesofmacainimprovingfertilitycouldbeduetothepresenceof biologicallyactive,derivedfromthehydroly sisof,specifically duetobenzyl -andp-metoxybenzylisothiocyanate(Li,etal.,2001).

48. Macaisalsoknownasanaphrodisiacwhichcuresfrigidityinwomenandisaremedy forimpotenceinmen(Pulgar,1978;Ob regón,1998;GarcíayChirinos,1999).Agreatdeal ofevidenceonsuccessfultreatmentwithmacaforcasesoffrigidity,impotenceandsterilityis tobefoundinaFolkloricClinicinJunín(León,1986).Thispropertyofmacacouldbedue totheprese nceofprostagladinesandesterolsinthehypocotyl -root,andofamidesof polyunsaturatedfattyacids(Li,etal.,2001).

49. Anothermedicinalpropertyattributedtomacaisitsanticarcinogeniceffect(Quirozand Aliaga,1997).However,alonglistofscientificarticlesexists,whichrefertothe anticarcinogeniceffectofglucosinolatesandbenzyl -isothiocyanateofvariousspeciesofthe BrassicaceaeFamily,towhichmacaalsobelongs(Wattenberg,1977,1983,1990; Verhoevenetal.,1996).SinceJohns(1980)isolatedisothiocyanatesfrommacaextracts,itis verypossiblethatmacaalsohasananticarcinogeniceffect.

50. Macaisalsousedtraditionallytoregulatechangesinmenstruationandthemenopause, andalleviatesinsomnia andthelossofhearingandvision(Pulgar,1978;Obregón,1998).In addition,thisplanthasbeenusedsincetimeimmemorialforitsrevitalizationproperties (Obregón,1998),totreatmalnutrition,aidconvalescence,andrestorephysicalandmental ca pacity(QuirozandAliaga,1997).

V. MARKETINGOFMACA

51. Macaispartofarapidlyexpandingmarketandthecharacteristicsofthisnaturaland organicproduct,andpropertieswhicharescientificallyverified,makemacaaproductwith great potential.ThecurrenttrendinEurope,theUnitedStatesandJapan,whereconsumers areveryconcernedwithhealthcare,istowardtheconsumptionofnaturalproducts,thereby allowingproductssuchasmaca,withhighenergyandnutraceuticalvalue,tobeingreat demand.

52. AccordingtoinformationsuppliedbyPROMPEX(CommissionforthePromotionof Exports),exportsofmacahavegrownfromUS$ 1,056,287.79in 1998toUS$ 3,016,240.03 in 2002.Thisisequivalentto293,548metrictonsexporte dperyear(indifferentforms: powders,tabletextracts,caramels,etc.).ThemaindestinationmarketsareJapan(almost 50 percentoftheexportmarketfromPeru),UnitedStates,VenezuelaandHungary; WIPO/GRTKF/IC/5/13 Annex,page 10 representingabout80 percentoftheFOBvalueexportedin 2002.In 2002,13,557metric tonsofmacawereexportedindryfragmentformforanamountofUS$ 863,094(FOBprice), thisbeingthesecondmostimportantcategorythatisexportedimmediatelyaftermeal, powderandmicrospray(174,642 tons, equivalenttoUS$ 1,244,066).

VI. RESPONSESOFPERU:FORMATIONOFAWORKINGGROUPFORTHE ANALYSISOFPATENTS

53. Facedwiththissituation,INDECOPIcalledameetinginJuly 2002ofagroupof individualsandinstitutionstodiscussthesemat ters,aswellasthestrategytobeadoptedin relationthereto.

54. TheGroupbaseditselfontheideathat,priortogivingavaluejudgementonthese patents,itwasnecessarytoexamineintechnicaltermswhethertheyshouldbegranted,from thepointofviewofpatentlaws,since,forthispurpose,itwasnecessarytogatherinformation inordertodeterminewhethertheexaminationofpatentabilityoftheinventionsinquestion wasdulycarriedout.

55. TheGrouphasanalyzedthepatentsandpatentapplicationsdetailedinparagraph 7,and hascompiledasignificantamountofinformationrelatingtomaca.

56. TheGrouphasalsoanalyzedwhethercausesotherthanpatentlawsexist(forexample, non-compliancewithregulationsonaccesstogeneticresources),whichjustifysomekindof questioningofthesepatents 1,aswellasthemeasuresthatcouldbeadopted.

57. Inrelationtothecomponentsoftheextract,thefactthatthefirstthreecomponentsare knownasco mponentsofmacaandareattributedmainlytothebenzylisothiocyanate componentsandesterolswithbiologicalactivity,appeartomakeitnecessarytodemonstrate theadvantagesofanextractwithmacamidecomponentoveranotherextractwhichdoesnot co ntainthatcomponent,forwhichreasonthecomparisonmadeinexamples 9to 11for examples 1and 5providesinsufficientevidence,andsinceitdealswithcomponentmixtures ofdifferentconcentrationsdoesnotallowacorrectcomparisontobemade.Thus,althoughin example 5,4.4 percentofmacamideisdetected,alargerquantityofbenzylisothiocyanate (4.1 percent)andesterols(0.4 percent)thanthatdetectedinexample 1(0.89and0.079 per cent)isalsoobserved,asmaybenotedinthefollowin gtable:

Ontheotherhand,itshouldbehighlightedthatmanyreferencesexistbyvarious authorswho,workingbothwithmacaextractsandthecookedandliquefiedplant,havetested thisbeneficialeffectonanimals,asmaybenotedinreference 1whereanal kaloidextractis testedinratsandtoads:reference 2inlambs,reference 3inratsandreference 7inmice;the conclusionofallsuchauthorsisthatmacapossessesabeneficialeffectonfertility.

116. Inconclusion,theclaimsincludedin patentsnos.US 6,267,995andUS 6,428,824are suggestedbythenewpriorartcompiledbytheworkinggroup,therebyaffectingitsinventive step.

IX. INADDITIONTOPATENTS

(i) Accesstogeneticresources

117. ThepatentsreferringtoLepidiummeyenii alsobringtolightproblemsconnectedwith themethodofaccesstothesematerialsandwhethercompliancehasbeenachievedwiththe basicprinciplesoftheCBDandwiththerelevantlegislationinforceintheAndeanregion andPeru(specifica llywithDecision 391concerningaCommonRegimeonAccesstoGenetic Resources ).Attentionisdrawntothefactandconcernexpressedthattheintellectualproperty regime(inthisspecificcasethatrelatingtopatents)grantsrightsovermaterialsandresources whichcouldhavebeenobtainedunlawfully,contrarytothespecificDecision 391oreventhe rulesinforceforcollectingandexportingbiologicalmaterials.

(ii) Protectionofknowledge

118. Lepidiummeyenii hasbeenknownandusedin variouswaysandfordifferentpurposes byindigenouspopulationsinPerusincetimeimmemorial.Onequestionwhicharisesasa resultofthepatentsanalyzedisthedegreeofindigenousknowledgewhichwasusedto generatetheclaimedinventions.Inad ditiontowhetherornotrulesexistforregulatingor protectingindigenousknowledge,orwhetheritispossibletodosooncethisknowledgeis disseminatedoutsidethesphereofthecommunitiesinquestion,itisobviousthatatanypoint intimeduringthescientificprocessofresearchanddevelopment(recentorpast),whichgave risetotheseinventions,thisknowledgemusthavebeenuseddirectlyorindirectly.

X. CONCLUSIONSANDFINALREMARKS

(i) Asregardstheinternationalpatentapplication,someoftheanalyzedclaimsdonotmeet therequirementof novelty ;althoughcertainothersdo,theydonotmeettherequirementof inventivestep ;finally,sincethebiologicalactivityoftheisolatedcompoundsofclaims 13 to 15hasnotbeendemonstrat ed,theseclaimsdonotappeartomeettherequirementof industrialapplicability .Insum,theclaimedinventiondoesnotappeartobepatentablein theseterms.

Ontheotherhand,asregardstheinventionsclaimedinAmericanpatents,fromtheanalys is madeitisconcludedthattheydonotmeettherequirementofinventivestep.Inthisregard, thesepatentsareveryquestionablefromalegalpointofview. WIPO/GRTKF/IC/5/13 Annex,page 25

(ii) SixoftheseveninventorsmentionedinthepatentsoftheUnitedStatesofAmericaand internationalapplicationsanalyzedrecognizethattheyobtaineddrymacarootsfromPeru in 19982.However,thereisnoevidencethat:(i)thesematerialshavebeenlawfullyobtained fromPeruorthattheycomplywiththecorrespondingnationallegislati on,and(ii)that provisionhasbeenmadefortheequitablesharingwiththecountryofthebenefitsderived fromtheuseofthesepatents.

(iii) Athirdconclusionwhichemergesfromtheworkofthisgroupistheenormous difficultyencounteredbytheco untryinitsattemptstochallengeorquestion,for administrativeorlegalreasons,intheUnitedStatesorEurope,patentsofthisnature. Althoughtherulesofthegameareclear,therealityisthatevenwherewewishtousethem, thecosts,time,andneedforspecializedadvicemakeeffectiveactioninrelationtheretoand othersimilarpatentsverydifficult.Anyactiontakenaftertheeventisprohibitively expensive.

(iv) ThemethodologyusedbytheWorkingGroup,combininglocalandinternational experience,complementingthescientificandlegalcapabilities,andactinginanopenand participation-basedmanner,makeitpossibletoconcludethatasanareaforevaluatingand analyzingsimilarpatents,thisformofworkisappropriateanditistobehopedthatthe possibilityarisestoinstitutionalizethefunctioningandoperationofanationalgroupor committeewhichisdirectlyresponsibleforcasessuchasthatanalyzed.

(v) Thisnationalgrouporcommitteeshouldassessamonitoringorear ly -warning mechanism,providingfamiliaritywithsimilarsituationswhere,throughtheuseofmaterials orcomponentsofnationalbiologicaldiversity(withoutfollowingthecorresponding procedures)orancestralknowledgeofourcommunities(withouttheir consent),orthrougha mistakeninterpretationofthespecificrulesorprinciplesofintellectualproperty,attemptsare madetoinvokeparticularrights.Inaddition,thegroupmustestablishachannelof communicationwithpatentandintellectualpropertyofficesinothercountriessothatthey requestinformationfromitwhenapplicationsonresourcesormaterialsofPeruvianoriginare filed.

(vi) Ithasremainedclearthat,althoughmuchliteratureandinformationexists(agreatdeal ofwhichisclearlydocumentedandisinthepublicdomain)onLepidiummeyenii ,accessto thisinformation(anditsgeneralavailability)isattimesdifficult.Thisexplainswhypatent officesfromthirdcountrieshavenotinstitutionalizedthepracticeofrevising documentsand literaturewhichcouldrefertoancestralusesofcomponentsofbiologicaldiversityby indigenouspeoplesortodifferentmanifestationsoftraditionalindigenousknowledge.These practicaldifficultiesaffectthepossibilitiesforrigorousandcomprehensiveexaminationsof patentapplications,givingrise,inmanycases,tothegrantingofrightsofdoubtfullegitimacy.

(vii) Thelattergivesrisetotheneedtoevaluatehowitwouldbepossibletoorganizeand systematizemuchofthisin formationandtherolethatcouldbeplayedbyanationaldatabase inthatregard.Insummary,howisitpossibletoarticulatethisdatabaseandinformationwith thesearchproceduresandexaminationsofthemainpatentofficesthroughouttheworldin ordertoavoidpatentsbeinggrantedonthebasisofpartialandlimitedexaminationsof noveltyandinventivestep.

(viii) SuchprinciplesandrulescontainedintheAndeanCommunityLegislation (Decision 486ontheCommonIndustrialPropertyRegime),CostaRica,andsome othercountries,inwhichsupervisionoftheoriginofbiologicalmaterialsandknowledge whichcouldbepartofaninvention(especiallyinthebiotechnologyfield)isrequired,and whereitisevennecessarytodemonstratetheleg alprovenanceofthesematerialsasa requirementfortheprocessingofpatentapplications,shouldbeincorporatedininternational patentlegislationandthedomesticlegislationofallcountries.Thisisanalternativefor avoidingcasesofbiopiracyinwhichattemptsaremadetoinvokerightsoverproductswhich incorporatematerialsunlegallyorunlawfullyobtainedandused.

(ix) Asthecountryoforiginofagreatvarietyofnativecropswithcommercialand industrialpotential,itistobehopedth atinthefutureinPerucasessimilartothatof Lepidiummeyeniicontinuetobepresented.Inthatregard,thereisanurgentneedforthe developmentofastandardforprotectionofnativecrops.

(x) Asthecountryoforigin,Perushouldconsiderthe possibilityofparticipatingmuch moreactivelyintheresearchanddevelopmentprocessesrelatingtoplantsandbiological materialsand,especially,beingpartytothebenefitsderivedfromtheproductsresultingfrom suchresearchanddevelopment.For thatpurpose,anationallegalregimeisrequiredto generateappropriateincentivesforcooperationinresearchanddevelopment.

(xi) Asafinalcomment,itwillbeverydifficulttogenerateappropriateincentivesforthe preservationofbiologicaldiversityandcompliancewiththeCBDingeneral,notonlywhere casessuchasthesubjectofanalysesinthisreportarepresentedbut,forexample,situations suchasthoseimposedbytheEuropeanregulationsonNovelFoodsarise(European Communities Regula tion (EC)258/97ofJanuary27,1997)whichhavealreadyledto restrictionsontheexportofmacafromPerutoEurope.

Theseinitiativesplaceatriskanypossibilityofexportingproductspreparedfromthe biodiversityexistinginPeru,sinceastheyar econsideredtobenovelfoodstuffsormedicinal plants,itshouldbeverifiedthattheiruseisnotharmfultohumanbeings,whichwouldbe verycostlyandcomplicatedforourcountry.Thisspecificpointdoesnotdealinaprecise mannerwiththesubjec tofpatents,butthereisacumulativeeffectinthesenseofbiopiracy ontheonehand,andtraderestrictionsontheother.Inessence,itplacesatrisksustainable businesswhichseekspreciselytogivevaluetobiodiversityandtherebyprovideanin centive foritspreservationandbetteruse.Inthefinalanalysis,itplacesatriskthepoliticaland regulatoryagreementsassumedasapartytotheCBD,insofaras,inpractice,theoptionsof countriessuchasPeruarelimitedanditsimplybecomesimpossibleforthecountrytomeet itsobligations.
