TERMS AND CONDITIONS 1 The Authorised Officer (AO) exercising the powers under the Securitisation and Reconstruction of Financial Asset and Enforcement of Security Interest Act, 2002 read with Security Interest (Enforcement) Rules, 2002 (hereinafter referred to as "the SARFAESI Act") is selling the asset/property mentioned at item No.III on page no.7 of this Bid Document (hereinafter referred to as the 'Secured Asset') and the same are being sold free from charges and encumbrances of the secured lender mentioned at item No. IV of the Bid Document. 2 Issue of Bid/ Offer / Bid Document The Bid Document is available from 16-09-2017 to 13-10-2017(Upto 5:00 PM) on any working day (except 2nd and 4th Saturdays) between 11.00 AM to 5.00 PM. and can be obtained from the Authorised Officer, IDBI Bank, NPA Management Group, 2nd Floor, 5-9- 89/1 & 2, Chapel Road, Hyderabad- 500001 (or) It can also be obtained from Shri. VRP Raman (9848197950/ 9642633213) of Aabram Enforcement & Recovery Services Pvt Ltd, (Enforcement-cum-Recovery Agent) of IDBI Bank. Ravikanth. 4 The sale of Secured Asset is on “As Is Where is Basis”, “As Is What Is Basis”, “Whatever There Is Basis” and “Without Recourse Basis”. The description of the immovable property is based on the mortgage created by the Borrower/Mortgagors with the Secured Lender from time to time and the representations made by them. The AO/Secured Lender does not take or assume any responsibility for any shortfall of the immovable asset or for procuring any permission, etc. or for the dues of any authority established by law. All Statutory Liabilities/Taxes/Maintenance Fee/Electricity/Water charges etc., outstanding as on date and yet to fall due would be ascertained by the interested Bidder and would be borne by the successful Bidder. It is expressly made clear that the AO/Secured Lender does not take any responsibility to provide information on the same. The AO/Secured lender does not take or assume any responsibility for any dues, statutory or otherwise of Synergy Multitech Ltd., including such dues that may affect transfer of the asset in the name of the purchaser and such dues, if any, will have to be borne / paid by the Purchaser. 5 As per available records and to the best of knowledge and information of the Authorised Officer, no other encumbrance exists on the properties. However, the intending Bidders 11 should make their own independent enquiries regarding the other encumbrances, title of property/ies put on auction and claims/rights/dues effecting the property, prior to submitting their Bid. The auction advertisement does not constitute and will not be deemed to constitute any commitment or any representation of the Bank. The property is being sold with all the existing and future encumbrances whether known or unknown to the Bank. The Authorised Officer/Secured Creditor shall not be responsible in any way for any third party claims/rights/dues. 6 Inspection of Asset The interested parties/bidders may, inspect the property at their own cost and expense, with prior appointment on 4th October 2017 between 11.00 AM to 5.00 PM in the presence of representative of the Authorised Officer or Enforcement Agent (i.e. Mr. Shri. VRP Raman or it’s employees) who would be available at the property site to facilitate the inspection. 7 Due Diligence by the Bidders The interested parties may carry out their own comprehensive due diligence in respect of the Secured Asset including any dues relating to the Secured Asset. A bidder shall be deemed to have full knowledge of the condition of the mortgaged asset/property, relevant documents, information, etc., whether the bidder actually inspects or visits or verifies or not. 8 The Bidders shall be deemed to have inspected and approved the Secured Asset to their entire satisfaction and for the purpose, the Bidder(s) may, in their own interest and at their own cost, verify the area of the premises and details of immovable asset, if any and any other relevant information before submitting the Bids. It shall be presumed that the bidder has satisfied himself / herself / themselves about the names, descriptions, particulars, quantities, qualities, specifications, measurements, boundaries and abuttals of the assets / property and that the bidder concurs or otherwise admits the identity of the assets / property purchased by him / her notwithstanding any discrepancy or variation, by comparison of the description in the particulars of the assets / property and their condition. 9 The Bidders shall not be entitled to receive re-imbursement of any expenses which may have been incurred in preparation of the Bid / Offer for submission and/or for carrying out due diligence, search of titles to the asset and matters incidental thereto or for any other purpose in connection with purchase of the asset under reference. 10 Submission of Bid application form and other related documents The Bidder shall complete in all respects the Bid form(s) annexed to the Bid Document, and furnish the information called for therein and shall sign and date each of the documents in the space provided therein for the purpose. The Bidder is required to sign on each page of the Bid application. Bid application forms are Not Transferable. The Format for submission of Profile of the bidder(s) is given in Chapter VII & VIII respectively of this Bid Documents. The Format Chapter VII is for Individuals and The Format Chapter VIII is for Company/Proprietorship/ Partnership Firm. Bidder(s) may fill in only the form relevant to them. 11 The Bid shall be signed by a person or persons duly authorized by the Bidder and a separate authorization letter (containing attested signatures) duly signed by the Bidder needs to be submitted. 12 The Bid shall contain the full residential address, Telephone Numbers, Fax Number., e-mail-ID, if any, of the Bidder(s) for serving notices required to be given to the Bidder in connection with the Bid. 12 13 The Bid form shall not be detached one from the other and no alteration or mutilation (other than filling in all the blank spaces) shall be made in any of the documents attached thereto. 14 a) Last date for Submission of Physical Bid Form/ KYC Documents etc The interested parties may submit physical Bid form, duly filled and signed along with the required documents to the Authorised Officer, IDBI Bank Ltd, NPA Management Group, 5-9-89/2, 2nd Floor, Chapel Road, Hyderabad- 500001 on any working day but latest by 13th October 2017 not later than 5.00 PM in a sealed cover with following superscript: “Bid Form for purchase of Residential plot at Deshmukhi Village, Bhoodan Pochampally Mandal, Nalgonda District,Telangana – Synergy Multitech Ltd”.
