Resolution to consider recommendation from the Planning Commission to approve the Zoning Map Amendment (PF-18-03) request for 710 Menominee Road, to amend the current zoning from R-1 One Family Dwelling District zoning to R-3 Multi-Family Dwelling District recommendation to be conditional and contingent upon the lot split of the subject parcel #64-14-31-127-001. 8. Resolution to consider recommendation from the Planning Commission to approve the Zoning Map Amendment (PF-17-30) request for 1416 Joslyn Road to amend the current zoning from C-4 Suburban Business District zoning to C-3 Corridor Commercial District. 9. Resolution to consider appeal request from Aerostar Holdings Inc., regarding the Planning Commission’s denial of a Special Exemption Permit for a Specially Designated Merchant (SDM), a Sunoco Mini Mart. Call to Order at 5:30 p.m. Roll Call Members Present: Carter, Miller, Taylor-Burks, Waterman, Williams and Woodward. Members Absent: Pietila. Mayor Waterman was absent. Clerk announced a quorum. 18-51 Excuse Councilperson Mary Pietila for personal reasons. Moved by Councilperson Woodward and second by Councilperson Carter. Ayes: Miller, Taylor-Burks, Waterman, Williams, Woodard and Carter No:None Motion Carried. 18-52 Approval of the Agenda. Moved by Councilperson Woodward and second by Councilperson Taylor-Burks. Ayes: Taylor-Burks, Waterman, Williams, Woodward, Carter and Miller No: None Motion Carried. Deputy Mayor arrived at 5:31 p.m, Attorney Anthony Chubb arrived at 5:35 p.m. Mayor Deirdre Waterman arrived at 5:43 p.m. Discussion 1·eganling the City of Pontiac Code of Ethics and Council Rules & Procedures. There were 2 individuals who addressed the body during public comment. Call to Order at 6:00 p.m. Roll Call Members Present: Cmter, Miller, Taylor-Burks, Waterman, Williams and Woodward. Members Absent: Pietila. Mayor Waterman was present. Clerk announced a quorum. 18-53 Excuse Councilperson Mary Pietila for personal reasons. Moved by Councilperson Woodward and second by Councilperson Waterman. Ayes: Miller, Taylor-Burks, Waterman, Williams, Woodward and Carter No:None Motion Carried. 18-54 Council President ask for a motion to amend the agenda to move Item #4- amend budget appropliations FY 2017/2018 before item #3-adoption of 10th council code of ethics. Special Presentation -Annual Audit Repmt from City Auditors Rehmann Robson for period ending June 30, 2017 and City of Pontiac Optimist Club. Deputy Mayor introduce the item for the public hearing. 1 Februaiy27, 2018 President Williams opened up public hearing to remove parcel 64-14-34-380-043 from the TIFA boundaries and amend United Shore Redevelopment Brownfield District for parcels 64-14-34-351- 006, 64-14-34-351-007, 64-14-34-380-041 to include 64-14-34-380-043 at 6:22 p.m. There was 1 individual who addressed the body during public hearing. 1. Billie Swazer, 1619 Marsh bank, Pontiac, MI. She stated so, the City of Pontiac made an error, and Oakland County caught the error so now this item is back. Well, do they have to sign a waiver? If the retirees have to sign a waiver, the businesses should too. Attorney intervene to clarify that the council is asked to first remove parcel #64-14-34-380-043 from the TIF A boundaries; then amend United Shore Brownfield District of three parcel to include parcel mention above. President said they would vote on it next week. Councilperson Taylor-Burks rescind her motion and Councilperson Woodward rescind his second. There were 11 individuals who addressed the body during public comment. 18-58 Resolution adoption for the 10th City Council Code of Ethics. Moved by Councilperson Taylor-Burks and second by Councilperson Woodward. The Pontiac City Council shall: • Respect the confidentiality of privileged information; • Recognize that an individual council member has no authority to speak or act for council; • Work with other council members to establish effective policies; • Delegate authority for the nmning of the city to the proper staff; • Encourage the free expression of opinion by all council members; • Seek systematic communications between council, staff and all elements of the community; • Render all decisions based on tl1e available facts and independent judgment rather than succumbing to the influence of individuals or special interest groups; • Make every eff01t to attend all meetings; • Become informed concerning the issues to be considered at each meeting; • Avoid conflicts of interest or the appearance thereof; • Refrain from using this position for personal benefit, nor for the benefit of family members or business associates; • Use the same care and caution when using electronic media as would be exercised when speaking face-to-face or through written memoranda; • Avoid use of derogatory or denigrating language. Be It Resolved, that the I 0th Pontiac City Council approve their Code of Ethics. Ayes: Miller, Taylor-Burks, Waterman, William, Woodward and Carter No:None Motion Carried. 18-60 Resolution approval to remove parcel 64-14-34-380-043 from the TIFA boundaries and amend United Shore Redevelopment Brownfield District for parcels 64-14-34-351-006, 64-14- 34-351-007, and 64-14-34-380-041 to include 64-14-34-380-043, WHEREAS, the Pontiac City Council held a public hearing during its regular scheduled City Council meeting at 6:00 P.M. on Tuesday, February 27, 2018 in Pontiac City Hall, City Council Chambers, 47450 Woodward Ave., for the purpose of receiving public comment on the proposal to remove from the boundaries of the Tax Increment Finance Authority parcel 14-34-380-043. WHEREAS, the City of Pontiac Community Development Department recommends the approval of the amendment to the brownfield district for parcels 14-34-351-006, 14-34-351-007 and 14-34-380-041 to include parcel 14-34-380-043 NOW THEREFORE BE IT RESOLVED THAT, the Pontiac City Council approves the removal from the boundaries of the Tax Increment Finance Authority parcel 14-34-380-043 and the amendment to the brownfield district for parcels 14-34-351-006, 14-34-351-007 and 14-34-380-04lto include parcel 14-34- 380-043.
