Jolly Dayton, Maryland i PREFACE The purpose of this report is to provide a brief historical and current background on the U.S. copper and copper alloy secondary processing industry. It is felt that policy and decision-makers can use a ready reference on an industry that is generally so little understood. The industry has undergone many changes over the past few decades and has been in decline over much of the last ten years. While the coverage is not comprehensive, a brief mention is made of the many problems impacting the health of the industry. The secondary industry and the Government agencies most concerned with legislation affecting the collection, processing and markets for scrap are both working to overcome some of the current difficulties. Nevertheless, for some sectors of the secondary copper industry, the past decade has been particularly difficult, given the restrictions within which they have operated, the potential for new restrictions, and the variable copper markets. The author would particularly like to thank those in the industry who were kind enough to host informative visits to their plants and to provide much of the information contained in this report. In particular, the Late Alan Silberof RECAP, who was of tremendous help in outlining the original report. Daniel Edelstein, Copper Specialist with the U.S. Geological Survey, also provided substantial help and advice. The International Copper Study Group, was, and continues to be of great assistance in providing world copper industry statistics. The research for this report was supported by the Copper Development Association. This thirteenth edition presents updated data tables and observations made since the first report was written in 1999. It is hoped that the historical perspective presented will help in understanding future events and making new decisions. ABOUT THE AUTHOR Janice L.W. Jolly has had more than 35 years experience in both the primary and secondary copper industries. She first spent 14 years as a research geologist with the U.S. Geological Survey and with Roan Selection Trust in the Zambian Copperbelt. Following this, she served 18 years as a foreign mineral and commodity specialist with the U.S. Bureau of Mines. She was the copper commodity specialist for the Bureau of Mines for more than 10 years, responsible for that agency’s data collection and reports on copper and copper scrap. She also worked briefly with the Armed Services Committee of the House of Representatives and the World Bank. She is author of many articles and reports on copper and copper scrap and is especially familiar with the statistics relating to these subjects. She spent almost 4 years in Portugal with the International Copper Study Group (ICSG) as its first Chief Statistician and was instrumental in establishing the ICSG statistical collection and publishing effort on copper. She retired from the U.S. Bureau of Mines in 1993 and from the International Copper Study Group in 1997. (“AZR”)1 respectfully submits the following comments on the City of Chicago Department of Public Health’s (the “Department”) proposed April 18, 2018 amendments (the “Amendments”) to the Rules and Regulations for Control of Emissions from the Handling and Storage of Bulk Solid Materials (the “BSM Rules”). The Amendments primarily address additional requirements relating to the defined term of “Manganese-Bearing Materials.” AZR has invested approximately $2 million to comply with the existing BSM Rules. The Amendments threaten to impose even more costs upon AZR without justification considering that AZR’s operations do not contribute to the public health risks which the Amendments are intended to address. AZR has been a good neighbor within its community. It has not caused fugitive dust problems. It has not created threats to the public health due to manganese or any other toxic substances. What it does do is provide good jobs to its employees and provides an environmentally beneficial operation that uses waste material which would otherwise go to a landfill and turns that material into useful products. AZR appreciates that at other locations within the City of Chicago, there have been developments that warranted regulating certain businesses to address identified problems that presented a risk to the public health or environment.

The Gansu Delegation is a group of government officials and engineers who are involved in energy and pollution programs in their province. The purpose of their trip was to learn more about how the U. S. government and other organizations deal with energy and pollution issues. The visit was coordinated by the 21st Century Institute in Chicago, which is a non-profit organization that promotes exchange programs between China and U. S. in the areas of culture, business, environment and education. Board Member Lin, Attorney Assistant Marie Tipsord, and I hosted the group for a seminar at our offices in Springfield. We spent several hours describing the responsibilities, goals, and organization of the Board, including specific examples of our regulatory and adjudicatory actions. The Gansu Delegation asked numerous questions; and was particularly interested in the interactions among the various Illinois agencies with environmental responsibilities, as well as our relationship to federal authorities. We were greatly honored to have such wonderful guests. In February, the Board also held hearings in three ongoing rulemakings.

It began in Bingham Canyon, Utah located about 26 miles southwest of Salt Lake City, which was destined to become one of the greatest “mining camps” anywhere in the country. Mining in Utah, which was part of Spanish Mexico, can be traced back to Spanish miners in the mid-1700s. The start of mining in Utah, however, is credited to the United States Army in 1863. Troops under the command of Colonel Patrick Connor are credited with the discovery of Utah’s first mining claim and helping to form the first mining company and mining district in Bingham Canyon. The early mining at Bingham was underground with the exception of placer mining. 2 Bingham Canyon was a beehive of mining activity at the turn of the Century. Dozens of small companies dug tunnels and sank shafts in the mountains where they were mining lead, silver and gold ores…but not the low- grade copper ores that were in abundance and considered a nuisance. Then, along came Daniel C. Jackling, a 29-year-old metallurgical engineer, who with his partner, a mining engineer named Robert Gemmell, studied and assayed ore samples from the operations that dotted the canyon. They determined that there were vast tonnages of low- grade copper ore in the main mountain that divided the canyon…it was the kind of ore the mining companies tried to avoid because it interfered with the recovery of the metals they were mining.
