This letter responds to your recent Freedom of Information Act ("FOIA") request received by the Federal Communications Commission (FCC or Commission) and assigned to the Consumer & Governmental Affairs ("CGB") Bureau. You are requesting copies of "all informal complaints received at the FCC regarding the television series SOUTH PARK and found in the CGB database."

According to the Commission' s Records Control Schedule for Informal Complaints ("Records Control Schedule"), the Commission is not required to maintain informal complaints and related conespondence for more than three years after the case is closed. See N 1-173-07-1 , FCC Disposition Authority. Therefore, all complaints records prior to January I, 20 I 0, have been purged pursuant to the Records Control Schedule.

CGB conducted a search of the databases in which we maintain the records of informal complaints filed by, or on behalf of, consumers. Our search revealed 54 documents that are responsive to your request, which are enclosed.

FOIA and FCC rules require the FCC to charge requesters for time spent searching for and reviewing responsive documents, and for copying them. 1 Based on your classification as an "all other" requester, the FCC does not charge you for the first two hours of search time and the first I 00 pages of copying.2 Because preparing the response to your request falls within these limits, the FCC is not charging you for processing it.

Mike Hennigan of my staff redacted all personal identifying information relating to the individuals who submitted or are named in the enclosed complaints or inquiries based on Exemption 6 of FOIA, which permits agencies not to disclose files that would clearly invade personal privacy. Mr. Hennigan also redacted some FCC employee names based on Exemption 2 of FOIA, which permits agencies not to disclose internal personnel rules and practices.

I was shocked that a commercial like this were to appear on a website made for television. So what now? Are people allowed to show porn on TV now? This program is televised before 8pm and the bleeps that were needed to cover up the language should have been the first clue that the timing of this material was too early in the evening. My 14 year old son and I were catching this last segment and marveled together at indecent language mouthed by the writers while they were in the studio making the voice overs. There was no attempt to blur out their mouths. On a side note I was baffled by the comments of the writers that they created this show using the language that 4th graders use today. Are you kidding me!!! Must 60 minutes feature (and with a smile) the idea that our young are without standards. I can with absolute conviction say that I do not know one 4th grader that uses this type of language (our youngest child happens to be 9yrs old and 4th grade). Do these guys and 60 Minutes want to prepetuate the degradation of a civil socitety. It is the FCC's responsibility to monitor indecent material and stop it. The fact that a program like South Park is even on the TV shows the ineffectiveness of the FCC's effectiveness. Please prove me wrong.
