3.0 About This Document

3.1 This document sets down the parking and MTC kerbside management and enforcement protocols in the City of Westminster. Parking is covered in section 2 of the document and moving traffic in section 3. It is primarily intended for use by WCC’s Marshals, a term which also includes traffic enforcement camera operators (see section 10.0), but has been made readily available via WCC’s website for the public’s information.

3.2 Through this document WCC seeks to:  Deliver a high quality parking service to all road users in a fair and consistent manner;  Ensure there is clarity of the kerbside policies and enforcement requirements for all; and  Be a single point in which kerbside and enforcement policy is documented and can be updated.

3.3 Document Format Each main area of kerbside use and enforcement is covered by a separate section. An amendment history is included to track changes to the previous version of this document.

3.4 In general terms, temporary or trial changes will not be listed in this document and it will omit specific or ad hoc instructions referring to individual streets or locations. These will continue to be communicated to the kerbside management provider via formal instruction.

3.5 Illustrations and Photographs The illustrations and photographs included in this document are examples used for illustrative purposes only, intended to promote ease of use of this document, and may not reflect the actual signage or restrictions in place on-street. In the case of MTCs, the contraventions are not limited to the signs illustrated in this document.

3.6 Operational Manual The information within this document should be used in conjunction with the Operational Manual. The KMECOP document specifies the kerbside and enforcement protocols Marshals and camera operators should employ when enforcing parking and moving traffic contraventions respectively on behalf of WCC, whereas the Operational Manual outlines operational procedure and best practice. 4 City of Westminster Kerbside Management & Enforcement Code of Practice v4.0 April 2017

4.1 No information has been withheld from this document under FOI exemptions and we do not operate separate full and publication versions.

5.2 Ownership This document is owned by WCC Parking Services.

5.3 Updates Ad hoc changes will be communicated to WCC’s kerbside management provider via formal instruction. The instruction will refer to the section of the document that is being updated. The full document will be reissued only when deemed necessary or appropriate by WCC Parking Services.

5.4 Approval Authority All re-issues must be authorised by the WCC Executive Director for City Management and Communities. This copy replaces all previous versions which are now obsolete.

6.0 Definitions

6.1 Marshals and CEOs Marshals are fully qualified CEOs as defined by section 76 of the TMA 2004, being persons authorised by or on behalf of WCC to enforce road traffic contraventions. The term ‘Marshal’ is used to reflect their additional ambassadorial role. However, as they are still fundamentally CEOs, they are still referred to as such on statutory documents.

6.2 Waiting, Parking and Stopping Parking contraventions are contraventions of the relevant TMOs. As described in the RTRA 1984; parking and waiting are synonymous. Waiting consists of stopping a vehicle where restrictions apply and can be described as occurring where the vehicle has been permitted to remain at rest.

6.3 Where drivers are not present, Marshals are not required to locate the driver. Finding and advising a driver to move the vehicle is not practical and is in no way necessary prior to the issue of a PCN.

6.4 Loading/Unloading This activity needs to be visible and the process (i.e. the delivery/collection and the obtaining of any necessary signature etc) needs to be continuous in order to satisfy the concessions for

loading and unloading. This document details where loading/unloading is and is not permitted and where it is permitted, for how long.

6.5 Private vehicles are only afforded loading/unloading concessions when goods are being loaded/unloaded that are too heavy or bulky to be carried from a legal parking place. The vehicle must therefore be parked at the particular location as a matter of necessity rather than mere convenience. This stipulation does not apply to commercial vehicles.

6.6 Picking Up/Dropping Off of Passengers The definition of picking up/setting down is stopping at the kerbside in order to allow a passenger/passengers to board or alight the vehicle and to load/unload their luggage. In such cases the vehicle should generally not be left unattended. This document details where picking up/setting down is and is not permitted and if so, for how long.

6.7 Heavy Goods Vehicles (HGVs) HGVs are vehicles over 3.5 tonnes in weight. They may have chevrons at the rear although if present these only indicate vehicles that are over 7.5 tonnes.

7.0 Exemptions to this KMECOP

7.1 Exemptions and observations listed in this document do not apply:  If it appears that the vehicle is not being used in accordance with the exemption or concession which is being relied upon. For example, an observation period should not be given to a commercial vehicle parked on a yellow line if it is evident that the crew are having lunch in a nearby café etc.  Where vehicles are known to use the maximum observation times under these protocols and then move the vehicle, only to immediately re-park in contravention. Instant PCNs may be issued upon the vehicle parking in contravention for the second time.

7.2 If it is felt that a particular concession or exemption is being abused, the protocols detailed in this document may be overridden or disregarded when parking or moving traffic regulations are being enforced. If doing so however, Marshals or traffic enforcement camera operators must make full notes and record a full explanation.

7.3 Problem Areas – Arrangements to Lift KMECOP Requirements Where vehicles are known to regularly or continuously abuse the regulations and park in contravention at a given location or locations, that location and the appropriate VRM(s) may be briefed to Marshals and be subject to immediate enforcement without observation.

7.4 Bases will be requested to provide details over a 2 week period where documented evidence (e.g. other PCNs, Marshal notes) shows that continuous non-compliance is taking place. The notes and evidence provided will then be produced in the case of challenge or appeal against the PCNs subsequently issued.

7.5 Note, 7.1 to 7.4 above do not apply to the statutory 10 mins grace period introduced by the Deregulation Act 2015. This must be granted wherever we are obliged to allow it.

7.6 Extension to Controlled Hours Warning Notices should be issued for 2 weeks during the extension period. Normal enforcement should be carried out during previous core controlled hours. Note, this does not apply to locations converted from SYL to DYLs.

7.7 Introduction of New Restrictions Where brand new restrictions are introduced, Warning Notices only should be issued for the first 2 weeks of controls. This may not occur however where existing restrictions are merely being enforced by new or different enforcement methods.

7.8 Moving On and ‘Appropriate Action’ Attended vehicles parked in contravention should only be moved on or be subjected to ‘soft’ enforcement if this is considered to be the appropriate action. However, a Marshal is under no obligation to ask a motorist to move on before commencing PCN issue.

8.0 PCN Types

8.1 Four different types of PCN are issued by WCC:  Regulation 9 on-street PCNs are either fixed to the vehicle or handed to the person appearing to be in charge of it by a Marshal;  Regulation 10 Vehicle Drive Away PCNs are issued where a motorist drives away whilst the Marshal is in the process of issuing the PCN;  Regulation 10 CCTV parking PCNs are issued remotely by a CCTV camera operator. From 1 April 2015, this PCN type can only be issued in very limited circumstances; and  MTC PCNs are issued remotely by a traffic enforcement camera operator.

8.2 Regulation 9 and 10 PCNs are issued for vehicles contravening the parking regulations under the TMA 2004. MTC PCNs are issued for vehicles contravening the moving traffic regulations under the London Local Authorities and Transport for London Act 2003.

8.3 Regulation 10 and MTC PCNs are issued by post.

8.4 WCC does not issue bus lane or Regulation 10 Prevented from Issue PCNs.

9.0 Marshals

9.1 As per paragraph 6.1 above, Marshals are fundamentally CEOs with an enhanced ambassadorial role, the main objective of which is to establish positive working relationships with motorists and businesses. The Marshal’s role therefore is to provide guidance to motorists, advising where they can legally park and service. However Marshals can still issue a PCN and therefore follow the protocols outlined in this document.

10.0 Enforcement by CCTV and Traffic Enforcement Cameras

10.1 From 1 April 2015, parking restrictions can only be enforced by CCTV in very limited circumstances as prescribed by the Deregulation Act 2015: school clear markings; bus stop/stand clearways; bus lanes; and red routes.

10.2 CCTV Parking Enforcement and CCTV Cars For those few parking contraventions still enforced by camera, the same exemptions and observations apply as to enforcement by an on-street Marshal unless stated. The requirement to move vehicles on where the driver is present does not apply to CCTV or CCTV car enforcement. Section 2 of this document highlights which parts apply to both Marshal and CCTV camera enforcement and which parts refer to Marshal enforcement only.

10.3 In most instances camera operators are instructed to observe footage for 121 seconds before issuing a PCN. This is to give parking enforcement by camera uniformity with on-street enforcement as the process of a Marshal issuing a PCN obviously takes a certain amount of time.

10.4 MTC Enforcement MTC enforcement may be carried out via traffic enforcement camera operators observing traffic enforcement camera footage in real-time or reviewing footage recorded by unattended traffic enforcement camera systems. MTC enforcement may also be carried out via CCTV cars.

10.5 CCTV COP The information within this document should be used in conjunction with London Councils’ COP for Operation of CCTV Enforcement Cameras and WCC’s Corporate CCTV COP and SOP. The KMECOP document specifies the kerbside management and enforcement protocols Marshals and cameras operators should employ when enforcing parking and MTCs by CCTV and traffic enforcement cameras, whereas the CCTV COP outlines best practice and the CCTV SOP outlines operational procedures.

11.0 Marshal Activities

11.1 As well as carrying out parking enforcement, Marshals carry out the following supplementary activities:

 Aiding, assisting and marshalling motorists;

 Identification and reporting of incorrect, missing, contradictory, vandalised and unauthorised street furniture. This includes signs, lines and machines;  Checking of parking suspensions;  Identification and reporting of unauthorised suspensions;  Identification and reporting of unlicensed skips;  Identification and reporting of abandoned vehicles;  Identification and reporting of parking technology failure (e.g. inability to access the Pay-to- Park system);  Identification and reporting of suspected permit or badge fraud and abuse;  Reporting of an event and/or incident which has the potential to bring the WCC into disrepute or negatively impacts the public’s perception of WCC;  Identification and reporting of problematic locations or hotspots within the City;  Low-level highways reporting;  Collation of reports requested by other service partners (e.g. Metropolitan Police Service).  Kerbside management and enforcement of engine idling,  Working in collaboration with other regulatory bodies (e.g. the Police and TfL) to manage kerbside access and compliance.

PCN Code 01 “Parked in a restricted street during prescribed hours”

Enforcement by Marshal

Instant code 01 PCN unless exemption below applies.

Exemptions

1. Any vehicle - do not issue for the first and last 3 mins of controlled hours on SYLs.

2. Notification has been received from Parking Services that special permission has been given to load/unload for as long as necessary at a particular location.

3. Vehicle is identified as having a valid WCC PIB or is displaying a London HAUC board issued by a utility company, as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the respective board’s conditions of use.

4. Vehicle is identified as having a valid WCC-issued SYL/DYL dispensation.

5. Vehicle is in the Whitehall Security Zone.

6. Domestic and office removal vehicles for as long as necessary whilst actively loading/unloading.

7. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

8. Gate or barrier to premises which the vehicle needs access to is being opened or closed and there is no other practical place for vehicle to wait. This applies equally to vehicles waiting to enter a loading bay or other off-street area.

9. Visible signs of unavoidable vehicle breakdown or if a recovery service vehicle in attendance.

10. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

11. London Fire Brigade Vehicle displaying Identifier Board.

12. The main funeral or wedding vehicle, as well as 2 other family vehicles in the funeral or wedding cortege. All other vehicles must park legally.

13. WCC formal instruction to disregard.

Observations

1. There is evidence of loading/unloading bulky or heavy items. For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place. Take logging then give a minimum of 20 mins casual observation.

08:30-11:00 - If loading still taking place after 20 mins, give further 20 mins casual observation. If no loading observed after 20 mins, give 5 mins constant observation before issuing PCN if loading is not observed during this period. If loading is seen, repeat procedure.

11:00-18:30 - If vehicle still in situ after 20 mins, issue PCN. Multi-drops that may take longer than 20 mins are permitted as long as the vehicle is moved in the process. A fresh 20 minute casual observation should be given if vehicle moved.

Note, the TMO allows continuous loading activity for as long as necessary before 11:00, but 20 mins max from 11:00 to 18:30.

2. Evidence of picking up/setting down passengers and their luggage observed, allow as long as necessary. Driver should be with vehicle.

3. Vehicle displaying valid HEB should be kept under casual observation for 60 mins before PCN issued.

4. Vehicle is displaying a WCC-approved exemption board, which allows vehicles to wait for 10 mins outside a named hotel as agreed by WCC, while picking up/setting down passengers.

5. Give 5 mins constant observation to vehicles displaying a valid disabled badge to ascertain whether picking up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

6. Vehicles displaying a valid resident permit (or interim permit) for the same zone to be given 5 mins constant observation on a SYL. If no loading/unloading activity observed after this time, PCN should be issued. If concession blatantly being abused, PCN can be issued without 5 mins observation but full notes must be made.

7. Vehicle displaying hospital car service identifier whilst parked in close proximity to hospital/clinic, give 20 mins casual observation to allow for picking up/setting down passenger(s) and/or patient(s). If no activity seen after 20 mins, issue instant PCN. Record hospital/clinic name.

SYLs – All vehicles SYLs not active therefore no enforcement unless timeplate extends hours, in which case enforcement is identical to DYLs below for the duration of the extended period.

However, no PCNs to be issued for the first and last 3 mins of controlled period.

DYLs –18:30-08:30 Where there is evidence of loading/unloading bulky or heavy items, take logging then give 20 mins casual observation. If loading still taking place after 20 mins, give further 20 mins casual observation. If no loading observed after 20 mins, give 5 mins constant observation and if loading still not observed during this period issue code 01 PCN. If loading is seen, repeat procedure.

Loading/unloading is permitted for as long as necessary. For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place.

PCN Code 26 “Parked in a special enforcement area more than 50cm from the edge of the carriageway and not within a designated parking place”

Enforcement by Marshal

Instant code 26 PCN unless exemption below applies.

If loading/unloading activity is being carried out, the driver should be asked to move to appropriate, available kerbside.

Note, for double parking to be occurring the vehicle must be parked more than 50cm away from both/all kerbs/edges of carriageway.

Exemptions

1. Wide streets in C zone. Do not enforce outside CPZ hours unless vehicle is preventing free flow of traffic. Full notes and photograph required.

2. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

3. WCC formal instruction to disregard.

Observations

1. If evidence of loading/unloading heavy bulky items seen and no other appropriate kerbside available for vehicle nearby –  08:30-11:00 - give 20 mins casual observation. If loading still taking place after 20 mins, give further 20 mins casual observation. If no loading observed after first 20 mins, give 5 mins constant observation before issuing PCN if no further loading observed.  11:00-18.30 - same applies but if vehicle still in situ after first 20 mins, issue PCN.

2. If evidence of picking up/setting down passengers seen, allow as long as is necessary. If no evidence seen, issue instant PCN.

3. Give 5 mins constant observation to vehicles displaying a valid disabled badge to ascertain whether picking up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

Instant code 01 PCN only if evidence of concession being abused, i.e. driver in café etc. Full notes to be made by Marshal.

Exemptions

1. Any vehicle - do not issue for the first and last 3 mins of controlled hours on SYLs.

2. Notification has been received from Parking Services that special permission has been given to load/unload post-11:00 as operation cannot be completed within 20 min allowance.

3. Vehicle is identified as having a valid WCC PIB or is displaying a London HAUC board issued by a utility company, as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the respective board’s conditions of use.

4. Vehicle is identified as having a valid WCC-issued SYL/DYL dispensation.

5. Cleansing and refuse vehicles collecting rubbish from the side of the road. Note, this applies to both WCC and commercial refuse company vehicles.

6. Domestic and office removal vehicles for as long as necessary whilst actively loading/unloading.

7. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

Observations

Unless exemption below applies, any parking contravention within the zone should be issued with a code 01 or code 02 PCN (as appropriate) and not a code 62.

Outside of the hours access is permitted, an instant code 01 or code 02 PCN should be issued as appropriate unless exemption below applies.

For commercial vehicles during hours access is permitted, instant PCN only if evidence of concession being abused.

Exemptions

1. Notification has been received from Parking Services that special permission has been given to load/unload for as long as necessary at a particular location or outside of zone access times.

2. Vehicle is identified as having a valid WCC PIB or is displaying a London HAUC board issued by a utility company, as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the respective board’s conditions of use.

As long as necessary should be given during permitted times.

If loading/unloading is observed, repeat process up until end of permitted access time. If no evidence of loading/unloading after 25 mins a PCN may be issued. When instructed to take enforcement action as a result of a resident permit being altered, the vehicle can be issued with an instant code 12r PCN. Details of this action must be confirmed with WCC’s permit investigation contractor at the earliest opportunity.

Exemptions

1. Vehicle is displaying any of the following valid permits –  Resident permit for the appropriate zone (note, a motorcycle resident permit will be a ‘virtual’/electronic permit) ;  Valid interim or temporary resident permit (‘virtual’/electronic permits).  WCC white disabled badge (note, in a Car Club vehicle the VRM on the badge will not match that of the vehicle).  Official All Zones permit (‘ALL’ or ‘Z’).  Business or Teacher permit in sub-zone C2.  Resident, visitor or business permit or white disabled badge equivalent (RBKC Purple, LB of Camden Green or substitute badge, City of London Red) for a neighbouring borough on a reciprocal street where agreement applies and as denoted on the sign. This does not apply in Queen’s Gate.

2. All vehicles – do not issue for the first 10 and last 3 mins of controls. This does not apply to resident bays that are enforced at all times. For non-24 hour controls, this means -

PARKING BAYS

Shared-Use Bays - Resident Permits and Pay-to-Park

Enforcement by Marshal

Shared-use bays enable resident permit holders and visitors to use the same parking bay. Resident permit holders displaying a valid permit for that zone can park in these bays at any time, whereas visitors must pay to park during the hours controls apply. Some shared-use bays are only available to visitors at certain times during the day as indicated by the signage (e.g. 10am-4pm).

Marshals will need to check for various payment methods at shared-use bays – resident permits, Pay-to-Park, Payment Terminal and Parking Card payments are all valid.

If no resident permit is on display, prior to issue give 5 mins constant observation and confirm on the Pay-to-Park system that no further payment has been made. This 5 mins observation period is to enable the motorist to make payment upon parking. Record location number where vehicle is parked in Notes field on HHD. As the motorist can subsequently top up their payment at any time there is no requirement to give a second 5 mins observation.

Where a payment to park has expired (pay-to-park, Payment Terminal or Parking Card), a PCN may be issued once payment has expired by 10 mins.

When confirming whether a vehicle has paid to park, Marshals must check by both location number and VRM. When entering the VRM, Marshals should take care with the number 0 and the letter O and the number 1 and the letter I. If in doubt, both should be checked.

Where drivers have paid to park, it is acceptable for them to move to another shared-use or paid-for parking bay within the same zone using the same payment until it expires, but not to another zone, even if the tariff is identical.

Vehicle displaying Parking Card face down, obscured, blank or incomplete. Do not issue if Parking Card is upside down but details can be read - check Card for validity. 3. Vehicle displaying an incorrectly scratched Parking Card. 4. Motorist is attempting to rely on a Pay-to-Park payment or Parking Card for another zone. 1-4 above assumes no other valid method of payment has been used.

Instant code 19 PCN If vehicle displaying an invalid resident permit: wrong zone (code 19w); incorrect VRM (code 19x) or expired permit (code 19z), unless exemption below applies.

If note left by motorist indicating the Payment Terminal is not working or their credit/debit card not registering, Marshal should report possible fault, check for payment by other method and if none issue instant code 12s PCN. Full notes to be recorded. If Payment Terminal shows Marshal’s “Out of Order” notice, motorists should either use an alternative payment method or move the vehicle. This is explained at the bay. Code 08 (“Parked at an out of order meter during controlled hours”) is not to be used on shared-use bays

When instructed to take enforcement action as a result of a resident permit being altered, the vehicle can be issued with an instant code 12s PCN. Details of this action must be confirmed with WCC’s permit investigation contractor at the earliest opportunity.

Exemptions

1. All vehicles – do not issue for the first 10 mins and last 3 mins of controlled hours. This means -

Vehicle is displaying any of the following valid items –  Valid Parking Card for the correct zone,  Resident permit for the appropriate zone (incl. ‘virtual’/electronic motorcycle resident permit),  Valid interim or temporary resident permit (‘virtual’/electronic permits).  WCC white disabled badge (note, in a Car Club vehicle the VRM on the badge will not match that of the vehicle)  Official All Zones permit (‘ALL’ or ‘Z’).  Business or Teacher permit in sub-zone C2.  Resident, visitor or business permit or white disabled badge equivalent (RBKC purple, LB of Camden green, City of London red) for a neighbouring borough on a reciprocal street where agreement applies and as denoted on the sign. This does not apply in Queen’s Gate.

3. If vehicle is displaying an expired annual resident permit for zone, take following action -  Permit expired by 1-14 days – Warning Notice  Permit expired by 15 days-1 month – Instant code 19s PCN  Permit expired by 1 month plus - Instant code 12s PCN This assumes no payment to park is evident.

4. The resident parking permit or white disabled badge is obscured in which case a Warning Notice only should be issued if a HHD check confirms the permit/badge as valid.

5. If vehicle is displaying expired white badge, take following action:  Badge expired by 1 day-1 month – Warning Notice  Badge expired by 1 month plus – Instant code 12s PCN This assumes no payment to park is evident.

6. In Lincoln’s Inn Fields a pay and display ticket purchased from LB of Camden, and in Queens Gate and Exhibition Road a pay and display ticket purchased from RBKC.

7. Notification has been received from Parking Services that special permission has been given to load/unload at particular location.

8. Vehicle is identified as having a valid Trades Permit for the zone. Note, a Trades permit issued by a neighbouring borough is acceptable on a reciprocal street.

9. Vehicle is identified as having a valid WCC PIB or is displaying a London HAUC board issued by a utility company, as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the respective board’s conditions of use.

10. Cleansing and refuse vehicles collecting rubbish from the side of the road. Note, this applies to WCC and commercial refuse company vehicles.

11. Domestic and office removal vehicles with special permission from Parking Services, for as long as necessary whilst actively loading/unloading.

12. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

13. Gate or barrier to premises which vehicle needs access to is being opened or closed and there is no other practical place for vehicle to wait. This applies equally to vehicles waiting to enter a loading bay or other off street area.

14. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

15. If vehicle overhanging bay markings (2 wheels or more are outside of the bay and not touching the bay markings), issue Warning Notice unless vehicle is causing an obstruction to other road users, i.e. is a

Observations

1. If evidence of picking up/setting down passengers and their luggage is observed, a maximum of 2 mins is allowed unless this involves a disabled or aged passenger, in which case allow as long as necessary. Driver should be with vehicle.

2. Royal Mail vehicles delivering/collecting postal packets. Give 20 mins casual observation.

3. Evidence of delivering mail or postal packets etc by couriers in which case 20 mins should be allowed before issuing PCN.

4. Commercial vehicles (including long wheel-based vehicles) – give 20 mins casual observation. If vehicle still in situ, issue instant PCN. For all commercial vehicles except long wheel-based vehicles the 20 mins exemption can be used before or after payment has been made to extend the loading/unloading period. If PCN is issued for vehicle exceeding the 20 mins period, this must be evidenced through Marshal observations and notes.

Private vehicles – if evidence of loading/unloading observed, give 20 mins casual observation as above. If no evidence of loading activity seen, instant PCN.

Note, maximum time for loading in designated bay under the TMO is 20 mins, regardless of whether vehicle is commercial or private. If max time exceeded, issue code 12s PCN.

5. Vehicle is displaying valid blue badge, and payment to park has expired by less than 63 mins.

6. Vehicle is a WCC Car Club vehicle and payment to park has expired by less than 63 mins. This applies if either Zipcar Reader, Zipcar badge or WCC Car Club badge are on display.

7. If vehicle is displaying valid HEB badge then 60 minute casual observation should be given before PCN issued.

8. Give 5 mins constant observation to vehicles displaying a valid blue disabled badge (any issuing authority) to ascertain whether picking up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

9. Electric and plug-in hybrid vehicles can park up to the max stay allowed upon purchase of 10 mins parking time. 2 loggings required. Marshals should ascertain vehicle status via vehicle make and model type. If max stay exceeded, 10 mins grace should be given before code 30s issued. Max stay does not apply to vehicles displaying a valid resident permit or white disabled badge.

10. CVIT vehicles actively involved in delivery/collection to be given 40 mins casual observation.

Marshals will need to check for various payment methods at these bays – Pay-to-Park, Payment Terminal and Parking Card payments are all valid. Marshals should allow any valid method of payment in a paid-for parking bay, regardless of specific bay designation.

Prior to issue give 5 mins constant observation and confirm on the Pay-to-Park system that no payment has been made. This 5 mins observation period is to enable the motorist to make payment upon parking. Record location number where vehicle is parked in Notes field on HHD.

A PCN may be issued once payment has expired by 10 mins. As the motorist can subsequently top up their payment at any time there is no requirement to give a second 5 mins observation.

Where drivers have paid to park, it is acceptable for them to move to another paid-for parking bay within the same zone using the same payment until it expires, but not to another zone even if the tariff is identical.

Bay Regulations  Zones A, B, C, D – Bays for motorcycles only at all times.  Zones E, F, G – Bays for motorcycles only 07:00-19:00 Mon-Sat. Non-motorcycle vehicles can use the bays outside of these hours.

Motorcycle defined as a ‘powered 2 wheeler’ or by a tax class of ‘bicycle’.

Motorcycle bay payment does not entitle a motorcycle to use any other bay type (e.g. standard Pay-to-Park bay).

Motorcycles are permitted to move freely from one motorcycle bay to another in any zone as long as a valid payment to park for that day has been made.

Marshals can and should remove the covers from vehicles to take enforcement action. Full notes to be made and photographs taken.

Motorcycle Enforcement Unless exemption below applies, code 11g PCN to be issued after 5 mins observation if no valid motorcycle payment is showing on the HHD during payment hours.

Vehicle to be authorised for relocation. Relocation can occur from 30 mins after the issue of the PCN.

These bays are dual-use, so their use differs depending on the time of the day and/or the day of the week. Signage at each bay advises what use is permitted and when.

The bays are generally a combination of –  Pay-to-Park bays during stated hours of control.  Taxi ranks during specified hours.  Loading bays during specified hours

Other Vehicle (non-taxi) Enforcement Unless exemption below applies, during controlled hours instant code 23 PCN to any non-taxi vehicle parked within the bay. Vehicle to be authorised for relocation. Relocation can occur from 30 mins after the issue of the PCN.

2. Taxis – a correctly scratched and displayed valid zonal Parking Card is acceptable.

4. Taxi is displaying valid WCC white disabled badge.

5. Vehicle (any) is identified as having a valid Trades Permit for the zone.

6. Cleansing and refuse vehicles collecting rubbish from the side of the road. Note, this applies to WCC and commercial refuse company vehicles.

6. Evidence of delivering mail or postal packets etc by couriers in which case 20 mins should be allowed before issuing a PCN.

7. Give 5 mins constant observation to vehicles (any) displaying a valid blue disabled badge to ascertain whether picking up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

8. CVIT vehicles actively involved in delivery/collection to be given 40 mins casual observation.

If no payment shown after this period, issue code 11 PCN.

If payment has expired by 10 mins or more, issue code 05c PCN.

Coach Parking Cards may be used as an alternative to Pay-to-Park (except in the overnight bays in Bulleid Way). If obscured or face down and details cannot be read, issue instant code 11 PCN

Where coaches have paid to park, it is acceptable for them to move to another coach Pay-to-Park bay city-wide using the same payment as tariffs are consistent

There are no exemptions for non-market trader’s vehicles loading/unloading or picking up/setting down.

Vehicles clearly displaying a Market Traders’ permit - Where a valid market trader permit is displayed but no payment is evident issue code 11 PCN. Prior to issue give 5 mins constant observation and confirm that no payment has been made. Record location number where vehicle is parked in Notes field on HHD.

Issue instant code 05 if a valid permit is displayed but where payment has expired by at least 10 mins.

Issue instant code 16q PCN where an invalid, obscured or expired Market Trader’s Permit is displayed regardless of whether payment has been made, Relocate only at specific request of WCC.

Car Club vehicles must be collected from and re-parked in their own bay, which bears the appropriate identifier number. Each individual vehicle may not park in an alternative Car Club bay.

Elsewhere, Car Club vehicles may park in paid-for bays if an appropriate payment to park is made.

Marshals will need to check that the vehicle is a Car Club vehicle registered for the bay in which the vehicle is parked. This will be indicated in one of two ways - 1. Car Club registration will be indicated on the Pay-to-Park system. 2. The Car Club operator will provide a badge which will be displayed in the windscreen.

Whether or not a badge is displayed in the windscreen, confirm on the Pay-to-Park system that the vehicle is registered as a Car Club vehicle at the bay in which it is parked.

Instant code 16e PCN if vehicle not registered at the Car Club bay and/or if vehicle is registered at a different Car Club bay. Vehicle should be authorised for relocation.

Note, no loading/unloading or picking up/setting down is allowed in Car Club bays.

Exemptions

1. Vehicle is registered as Car Club vehicle for the bay and displaying the appropriate Car Club badge.

2. Notification has been received from Parking Services that permission has been given for another vehicle to use the bay (e.g. for loading or substitute vehicle that is not Car Club vehicle).

3. Exempted vehicle is parked across dividing lines within a space provided for 2 or more vehicles.

4. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

5. Visible signs of unavoidable vehicle breakdown or if recovery service vehicle in attendance.

Only electric and plug-in hybrid vehicles may park in these bays (or electric-only motorcycles in electric motorcycle bays). Marshals can check the status of vehicle via the make and model type. Electric and plug-in hybrid vehicles must be plugged in to be charging their batteries.

1 Electric or Plug-In Hybrid vehicles - Issue code 14 PCN if electric or plug-in hybrid vehicle is parked but not charging (i.e. not connected to the charging point). Electric or plug-in hybrid vehicles are only allowed to stay for the max stay for the bay for the times indicated on the time-plate. This restriction only applies Mon–Sat 08:30-18:30.

Issue code 301 PCN if max stay exceeded during controlled hours. Where max stay exceeded, 10 mins grace should be given before PCN issue.

2 Non-Electric or Plug-In Hybrid vehicles - Unless exemption below applies, issue code 231 PCN if the vehicle is not electric or plug-in hybrid.

Note, electric motorcycle bays are for electric motorcycles only. All other vehicles, including electric or plug-in hybrid cars, to be issued with a code 23 PCN in an electric motorcycle bay.

Exemptions:

1. Electric or plug-in hybrid vehicle (or electric motorcycle in electric motorcycle bays), parking within max stay for the bay and actively charging the battery.

For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place. If no evidence of loading activity seen, instant PCN and authorise for relocation to nearest paid-for parking place.

Valid badge holders exceeding max stay (4 hours, Mon-Fri 08.30-18.30), issue PCN code 30 only. Where max stay exceeded, 10 mins grace should be given before PCN issue.

If valid badge holder returns within one hour of leaving during the controlled period indicated on the sign, issue code 22 PCN.

Only use ‘o’ suffix for blue badge holders, not white badge holders.

Exemptions

1. Displaying valid European blue badge, WCC white badge, RBKC purple badge, City of London red badge, Camden green badge or replacement disabled badge, or any other valid disabled badge. Note, 4 hour max stay during controlled hours applies to badge holders only.

The signage at a dedicated disabled bay displays the disabled icon and states ‘Permit holder D___ only’. The bay also has ‘permit holders only’ marked on the road surface. The bay is therefore for the sole use of the vehicle displaying the unique, correspondingly numbered ‘D____’ Westminster white disabled badge. This restriction applies at all times.

Issue instant code 165 PCN to any other vehicle, including those displaying a blue disabled badge or a white disabled badge not valid for parking in the bay. Contravening vehicle should be relocated to nearest paid-for parking place.

Note, the TMOs give no exemption or concession for general loading/unloading or picking up/setting down.

Exemptions

These informal bays merely exempt ambulances from the parking restrictions which are indicated by SYLs/DYLs. Enforcement against other vehicles can only be made under contravention codes for the regulations in force (i.e. code 01 or 02). Yellow lines regulations apply to all other vehicles and usual exemptions to the yellow line restrictions still apply as per pages 9-10 (private vehicles) and 13-14 (commercial vehicles).

Outside controlled hours on SYLs, controls not active therefore no enforcement.

WCC operate both general ‘Loading Only’ and ‘Goods Vehicle Only’ loading bays. The bay may or may not operate a max stay. If so, this will be indicated on the timeplate.

Vehicles may not park in these bays within the hours stated on the timeplate (some apply at all times) without engaging in loading/unloading activity. This must be within the maximum time permitted for this activity if stated on the sign.

Where restriction advised on the signage, vehicles returning within one hour of leaving issue code 22 PCN. If the bay is a ‘goods vehicles only’ loading bay, issue code 222 PCN.

If vehicle is of a class contrary to that indicated on timeplate (e.g. ‘goods vehicles only’), issue code 232 PCN and relocate to the nearest paid-for parking place at the request of WCC.

Vehicles not observed loading/unloading during controlled hours, issue code 25 PCN. If the bay is a ‘goods vehicles only’ loading bay, issue code 252 PCN.

Vehicles exceeding max time stated on the timeplate issue code 30 PCN.

Note, the 10 mins mandatory grace period implemented by the Deregulation Act 2015 does not apply in loading bays as it only applies to designated parking places where a person is permitted to park.

Allow 20 mins casual observation for goods vehicles then additional 5 mins constant. If loading/unloading activity still observed repeat process up to the max stay. If vehicle still in situ at end of max stay driver should be encouraged to move onto SYLs/DYLs to complete loading/unloading activity. If vehicle remains in situ issue code 30 PCN for overstaying regardless of activity within the bay. Private vehicles should receive instant code 232 at any time and be relocated to nearest paid-for parking place at request of WCC.

Enforcement by Marshal

Issue code 61 or 62 PCN as appropriate where the vehicle is blocking the whole of the footway, preventing safe passage along the footway by pedestrians.

If the vehicle is attended and preventing the free flow of traffic, the driver should be asked to move the vehicle. In the event that the driver refuses, then a code 61 or 62 PCN should be issued as appropriate, supported by full notes and photograph.

18:30-11:00 the next day: Allow as long as necessary for loading/unloading the vehicle. Give one hour casual observation. If no loading/unloading seen, give 5 mins constant observation. If loading/unloading observed, repeat process. Every attempt should be made to contact the driver during the constant observation period to determine if activity is taking place or vehicle could be moved. If no activity seen and the driver cannot be found, issue code 61 or 62 PCN as appropriate.

11:00-18:30: One hour is allowed for loading/unloading the vehicle. The vehicle may not return within one hour of leaving. Give one hour casual observation. If no loading/unloading seen and vehicle unattended, issue code 61 or 62 PCN as appropriate.

Exemptions

1. Driver present and loading/unloading taking place; vehicle not blocking the whole of the footway or causing an obstruction; in particular the aged, pedestrians with pushchairs and disabled members of the public can safely pass.

Only electric buses displaying a valid permit may park in these bays. Any contravening vehicle should be relocated to nearest paid-for parking place. Please note there is no requirement for an electric bus to be charging when parked in these bays. Whilst being for electric buses only, the bays have a max stay of 2 hours during the hours 9:00– midnight only.

Issue instant Code 16 PCN if electric bus is parked without clearly displaying a valid permit.

Issue instant Code 22 PCN if the bus returns within 30 mins of leaving the bay.

Issue instant Code 23 PCN if the bus is not electric-only or is any other vehicle type.

Issue instant Code 30 PCN if electric bus exceeds the max stay between 9:00–midnight only. Where max stay exceeded, 10 mins grace should be given before PCN issue

Note, the TMO does not allow general loading/unloading or picking up/setting down.

Footway Parking

PCN Code 61 “A heavy commercial vehicle wholly or partially parked on a footway, verge or land between two carriageways”

PCN Code 62 “Parked with one or more wheels on or over a footpath or any part of a road other than a carriageway”

Enforcement by Marshal

The footway regulation applies at any time. Footway is defined as any part of an urban road over which the public have right of access on foot and can include private land, vehicle crossovers and pavement lights, unless a physical barrier prevents access. It does not include private roads. The same enforcement applies to vehicle crossovers and pavement lights as it does to pavement parking.

Whilst footway is generally separated from the carriageway by a raised kerb, bollards or barriers, some newer schemes in WCC comprise of flush surfaces where both the carriageway and footway are level and the kerb-line is clearly defined by the use of rectangular paving stones of a different material to that of the carriageway and footway.

Where there is no footway (e.g. in Mews), enforcement should be as per restricted street regulations (see pages 9- 17) and pedestrian areas should be enforced using code 01 or 02 PCN, as appropriate (see pages 20-21). In both instances restrictions apply from building line to building line.

Instant code 61 or 62 PCN regardless of street narrowness or vehicle type unless exemption below applies. Check back of vehicle to see if driver in attendance and for evidence of loading activity. Full notes to be made by the Marshal. The appropriate PCN code suffix should be used when issuing a code 61 or 62 PCN

Marshals can and should remove the covers from vehicles to take enforcement action. Full notes to be made and photographs taken.

Marshals should always attempt to move vehicles that are loading/unloading onto the carriageway so that the activity may continue.

Exemptions

1. Notification has been received that special permission has been given by Parking Services or WCC’s City Promotions, Events and Filming team for the vehicle to park on footway in areas where loading/unloading is prohibited.

2. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

3. In the Whitehall Security Zone.

Under the Greater London Council (General Powers) Act 1974, loading/unloading is permitted whilst parked on the footway only if both the following apply and the vehicle is not parked on the footway adjacent to where a loading restriction is indicated on the carriageway - (i) The loading or unloading of the vehicle could not have been satisfactorily performed had the vehicle not been so parked: and (ii) The vehicle was not unattended at any time whilst parked. If this is the case, as long as is necessary is permitted and Marshals should give 20 mins casual observation (40 mins for HGVs) then additional 5 mins constant observation. If loading/unloading observed, repeat process. If no evidence of loading/unloading after 25 mins (45 mins for HGVs) a code 61 or 62 PCN may be issued. PCN may also be issued if vehicle left unattended at any time during the process.

Dropped Footways

PCN Code 27 “Parked in a special enforcement area adjacent to a footway, cycle track or verge lowered to meet the level of the carriageway”

Enforcement by Marshal

The definition of the contravention under section 86 of the TMA 2004 is as follows – (1) In a special enforcement area a vehicle must not be parked on the carriageway adjacent to a footway, cycle track or verge where – (a) The footway, cycle track or verge has been lowered to meet the level of the carriageway for the purpose of – (i) Assisting pedestrians crossing the carriageway, (ii) Assisting cyclists entering or leaving the carriageway, or (iii) Assisting vehicles entering or leaving the carriageway across the footway, cycle track or verge; or

However, code 27 should only be enforced where the footway has been lowered for the purpose of assisting pedestrians crossing the road. We will not enforce code 27 where the footway has been lowered to assist vehicles to enter/leave the road (e.g. driveways). The dropped footway should therefore have a corresponding dropped footway on the opposite side of the road, or a central pedestrian haven.

Code 27 should only be enforced on stretches of SYL outside of controlled hours (code 01 appropriate during controls). Code 27 should not be enforced on areas of DYLs (code 01 appropriate at all times) and cannot be enforced within designated bays. No signage is required.

Where a dropped footway contravention is occurring, instant code 27 PCN. Full notes to be made.

Exemptions

1. Notification has been received that special permission has been given by Parking Services or the WCC City Promotions, Events and Filming team for the vehicle to park.

2. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work .

6. Driver prevented from proceeding by circumstances beyond his control or when it is necessary for him/her to wait to avoid an accident.

7. To enable the removal of any obstruction to traffic. For as long as necessary but exemption applies only where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere.

8. Visible signs of unavoidable breakdown or recovery service vehicle in attendance.

9. Collection of waste by or on behalf of the WCC where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere.

10. Vehicle is identified as having a valid WCC PIB or is displaying a London HAUC board issued by a utility company, as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the respective board’s conditions of use.

11. Domestic and office removal vehicles with special permission from Parking Services, for as long as necessary whilst actively loading/unloading.

12. Gate or barrier to premises which vehicle needs access to is being opened or closed and there is no other practical place for vehicle to wait. This applies equally to vehicles waiting to enter a loading bay or other off street area.

Observations

1. Evidence of picking up/setting down passengers and their luggage observed. Sufficient time must be allowed for this activity (for as long as necessary). Driver should be with vehicle.

2. Evidence of private vehicle loading/unloading observed in which case 20 mins casual observation must be given before PCN issued. For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place.

Give 20 mins casual observation to commercial vehicles even if no loading activity is seen.

Note, observations above only apply where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. Maximum time for loading at a dropped footway is 20 mins, regardless of whether vehicle is commercial or private.

3. Evidence of delivering mail or postal packets etc by couriers in which case 20 mins should be allowed before issuing a PCN.

4. Royal Mail vehicles delivering/collecting postal packets. Give 20 mins casual observation.

5. Vehicle displaying valid HEB should be kept under casual observation for 60 mins before PCN issued.

Suspended Bays

Designated and Specialised Parking Bays (Residents’, Paid-for Parking, Shared-Use, Car Club, Disabled, Doctors’, Diplomatic, Hospital, Electric, Motorcycle etc)

PCN Code 21 “Parked wholly or partly in a suspended bay or space”

Enforcement by Marshal

Instant code 21 PCN and relocate to nearest non-suspended paid-for parking space.

Marshal needs to check sign relative to bay for days and times that suspension is in force. Suspension reference number and the position/location of sign(s) to be recorded. Also record location of vehicle relative to house number/building name.

Includes Post Office Vehicles – no exemption applies.

In motorcycle bays, locks to be cut only when absolutely necessary that the motorcycle be moved.

Exemptions

1. Do not issue PCN during first 10 mins upon a suspension coming into force.

2. Where the suspension only applies during controlled hours, do not issue for first 10 mins and last 3 mins of controls (all vehicles).

3. Suspended resident and shared-use parking bays - if valid resident permit for zone displayed (or interim permit), telephone permit holder on first morning of suspension to advise that they should move their vehicle. If permit holder contacted, give 20 mins before commencing enforcement action. If there is no response and the vehicle is not moved by midday, issue PCN, relocating to nearest available resident bay space in zone if necessary.

4. Emergency resident bay suspensions – where 7 days’ advance notice of the suspension cannot be given, follow steps in exemption #3 above and relocate vehicle, but do not issue PCN.

5. White badge holders in suspended resident, shared-use and paid-for parking bays – Warning Notice only for first 2 days, relocating to nearest available resident bay or paid-for parking space if necessary. PCN and relocate on day 3 if vehicle still parked in contravention.

6. Domestic/commercial removal vehicles carrying out their duties provided the resident or company has booked the suspension for this purpose.

7. City Promotions, Events and Filming permit displayed.

7. Vehicle has stopped to clear an obstruction from the road.

The rank’s signage displays either a ‘no stopping’ or ‘no waiting’ roundel dependent on the restriction of the rank in question. Observation and enforcement may differ dependent upon whether a particular rank is subject to a ‘no stopping’ or a ‘no waiting’ restriction – loading/unloading and picking up/setting down by other vehicles (non-taxis) is only permitted in ‘no waiting’ ranks. Marshal needs to check sign relative to bay for days and times when the bay is for taxis only and whether the bay’s restriction is ‘no stopping’ or ‘no waiting’.

Instant code 45 PCN during controlled hours for ‘no stopping’ ranks unless exemption applies. Relocate to nearest paid-for parking space upon request only.

Instant code 45w PCN during controlled hours for ‘no waiting’ ranks unless exemption applies. Relocate to nearest paid-for parking space upon request only.

Note, Marshals have no power of enforcement against a taxi left unattended in a taxi rank.

Exemptions:

1. Metropolitan Police-registered Hackney carriage taxis during the permitted times.

2. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

3. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

5. WCC CCTV car being used in pursuance of statutory powers or duties.

6. Vehicle belonging to the operator of a taxi drivers’ shelter adjacent to the rank displaying a valid dispensation during the shelter’s hours of operation.

Private vehicles – if evidence of loading/unloading observed, give 20 mins casual observation as above. For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place. If no evidence of loading activity seen, instant PCN.

Note: Maximum time for loading in designated bay under the TMO is 20 mins, regardless of whether vehicle is commercial or private.

Issue instant code 47 PCN and relocate to nearest paid-for parking space upon request. Bus stop clearways can be enforced by CCTV.

Bus stops with white cages and yellow lines running through them are only controlled by the yellow line restrictions and any loading restrictions (see pages 9-23).

RESTRICTED PRACTICES

Engine Idling

PCN Code 63 “Parked with engine running where prohibited”

Enforcement by Marshal

It is a contravention for a driver to idle a vehicle’s engine unnecessarily when stationary.

Unless an exemption applies, a Marshal should ask the driver of a stationary vehicle observed unnecessarily idling to switch off their engine. If the driver refuses to do so, give 1 min constant observation before issuing a code 63 PCN.

If a separate parking contravention is being committed at the same time as the vehicle is idling (e.g. parked on DYLs), the parking contravention should take precedence over the idling PCN. In such an instance the driver should still be requested to turn off the vehicle’s engine.

A code 63 PCN should not be issued if the Marshal has reason to believe any of the below exemptions apply:

Exemptions:

1. When a vehicle is stationary owing to the necessities of traffic.

2. Where the driver cannot prevent a motor vehicle from idling because of a mechanical difficulty over which he/she has no control.

3. Where a passenger is in the act of boarding or alighting from the vehicle.

4. A vehicle propelled by gas produced in plant carried on the vehicle, to such plant.

5. A driver of a vehicle clearing snow or ice from the windscreen of the vehicle.

6. A vehicle operating air conditioning or heating on hot/cold days.

7. Drivers of coaches picking up or setting down passengers, including buses and coaches using an engine to operate a disabled chair lift or ‘observed actual’ use of electric motorised luggage lockers. Note: Coaches in coach parking bays are not exempt unless any of the listed exemptions apply.

8. School bus or school mini-bus with any passenger on board.

9. Vehicles being used for Fire Brigade, Ambulance or Police purposes.

10. Where the machinery of a vehicle is required to be worked for a purpose other than driving the vehicle, necessitating idling -  A refrigeration vehicle for carrying perishable freight at specified low temperatures.  A tipper lorry for operating a tipping system for loading and unloading refuse.  A recovery vehicle for providing vehicle recovery and towing services.  A Street cleansing vehicle for washing the streets or equipped with a water jetting unit for clearing blocked drains.  An hydraulic platform vehicle for operating a cage (e.g. for cutting tree branches).  A refuse collection vehicle for collecting refuse or waste. 74 City of Westminster Kerbside Management & Enforcement Code of Practice v4.0 April 2017

Selling Goods from a Parking Place

Offering or exposing goods for sale from within a parking place is not permitted. Where this is taking place the driver should be asked to move the vehicle and informed that selling goods in parking places is not permitted. If the vehicle remains parked and the activity continues, issue code 18 PCN.

When unable to issue a PCN because the vehicle has moved on, the vehicle registration mark should be reported to the WCC Licensing dept and a statement provided regarding the activities witnessed.

A likely example is ice cream vans in paid-for parking bays. This restriction does not apply to vehicles displaying ‘for sale’ signs in the windscreen or to sign-written vehicles.

1. Vehicle has parked across the dividing lines between a resident bay and a paid-for parking bay and has made payment or is displaying a valid payment.

2. All vehicle wheels are within the bay markings or touching the bay markings.

3. Vehicle appears to have been moved into new position without driver’s consent.

4. Vehicle protruding onto uncontrolled SYL or other uncontrolled area. Note that footway is always controlled.

5. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

Vehicle Type Descriptions –

Police - Marked vehicles commonly have ‘police’ written on all sides, cross hatchings at the rear in high visibility colours, and flashing lights fixed to the roof of the vehicle. They also frequently have stripes on their sides.

Fire appliance - A vehicle equipped for fire fighting, usually a large fire tender carrying an on-board pump to power fire hoses to shoot water or chemical solutions at high pressure.

Emergency Ambulance - These are emergency vehicles with patient treatment facilities on board, staffed by paramedics who treat patients on arrival before transfer to hospital for further treatment. They are tall vehicles with sufficient space at the rear to carry the injured on trolleys while medication is administered. Emergency Ambulances are equipped with a wide range of emergency care equipment and a variety of drugs for medical and traumatic emergencies

Private Blue Light Ambulance - These are NHS-contracted patient-transport services that ferry patients to/from hospital for routine visits. They are unlikely to carry patient treatment facilities on board, although some are adapted for this purpose. Commonly, they are essentially private cars painted in Ambulance and NHS colours.

Exemptions

1. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

2. Unmarked Police car displaying log-book on dashboard.

Note, there are a number of agreed locations with the Metropolitan Police where the above exemptions do not apply and instant PCNs should be issued if Police vehicles are parked in contravention.

3. Unmarked Fire Brigade vehicles displaying identifier badge.

The NHS Blood and Transplant Delivery Service regularly deliver to and from Westminster hospitals and clinics. Drivers are to be allowed to deliver for as long as necessary (PIB exemptions to apply) to all delivery points below. The vehicles are liveried and have the NHS logo on each side.

This applies:  Great Ormond St Hospital - Great Ormond St and Lambs Conduit St  HCA Labs - Weymouth Street  King Edwards Hospital - Beaumont Street  London Clinic - Devonshire Place  London Clinic - Harley Street  St Mary's Hospital - Winsland Street and South Wharf Road  University College Hospital - Whitfield Street  West End Donor Centre - Margaret Street

Vehicles are permitted to park on:  Paid-for parking bays  Resident bays  SYLs and DYLs but the vehicle must not be parked in such a manner as to cause obstruction and where possible avoid parking where loading restrictions are in force.

If a PCN is issued, clear notes must be made and photos taken to validate the issue. Any abuse of the exemption must be reported immediately to Parking Services.

‘Breakdown’ constitutes a sudden mechanical loss of ability for the vehicle to function efficiently which is beyond the reasonable control of the motorist. It does not include problems incurred as a result of poor maintenance (e.g. running out of petrol) or neglect (e.g. leaving the lights on).

Marshals should follow protocols within this document as per bay/use type. Issue instant PCN (as appropriate) and make full notes when:  A note is left in vehicle stating broken down; and/or  Vehicle is unattended.

Exemptions

1. Recovery service vehicle (AA/RAC etc) actively attending a vehicle breakdown.

2. WCC formal instruction to disregard.

Observations

1. A vehicle parked/stopped in contravention which is attended and where there are obvious signs of breakdown, such as:  Large oil/fluid leak;  Steam/smoke;  Driver can show mechanical fault;  Damage following crash at location. Give 30 mins casual observation to allow for a recovery service vehicle to attend. When driver in attendance do not issue PCN. If no recovery vehicle has arrived after 30 mins, issue PCN as per bay type/use, explain how to challenge advising motorist they should provide evidence of breakdown.

Vehicles Involved In Accidents and Abandoned Vehicles

All locations

Enforcement by Marshal

Accidents If vehicle has clearly been involved in a road traffic accident, but no emergency services are in attendance and no driver is present then the Abandoned Vehicles Removal Service (AVRS) should be notified:

If emergency services are already in attendance, then no Marshal action is required.

Abandoned Vehicles An abandoned vehicle can be defined as:  Vehicle with no road tax or road tax that has expired by over one month; and  Vehicle left on any land in the open air in such circumstances or for such a period that it may be reasonably assumed to be abandoned, or, if the vehicle had been brought to the piece of land for the purpose of abandonment.

Marshal should issue a PCN on the first day a vehicle is seen parked in contravention (as appropriate) and believed to be abandoned. The AVRS should be notified.

On the following day a second PCN should be issued. A ‘Suspected Abandoned Vehicle’ notice should be placed on the vehicle. Full details should be passed to the AVRS as below. The AVRS will require the following information:  Make and model,  Colour,  Registration number,  Exact location, e.g. outside/opposite number,  General condition of vehicle.

Marshals are also expected to report suspected abandoned vehicles where they are not parked in contravention. Vehicles without VRMs should be reported immediately.

WARNING NOTICES AND RELOCATIONS

Warning Notices

Warning Notices will mainly be issued in specific circumstances for certain contraventions, as outlined below.

When issuing a Warning Notice, Marshals must -  Tear off the payment slip at the bottom of the PCN template;  Place the Warning Notice in a yellow Warning Notice envelope, rather than a blue PCN envelope, before fixing to the vehicle.

Circumstances When Warning Notices to be Issued Marshals will mainly be required to issue Warning Notices in the following circumstances for the following contraventions. Note, for a vehicle to be relocated not on the basis of a PCN, a Marshal must issue both a Warning Notice and a code 00 dummy PCN, otherwise it will not show on the system and relocation details will not transfer to TRACE. The code 00 PCN must not be placed on the vehicle.

16y “Parked in a permit space or zone without clearly displaying a valid permit (obscured/illegible permit)” In dedicated white badge bays, Warning Notice rather than PCN where badge that corresponds to the dedicated bay is obscured/illegible if a HHD check confirms the badge as valid.

16z “Parked in a permit space or zone without clearly displaying a valid permit (out of date permit)” In dedicated white badge bays, Warning Notice rather than PCN where expired badge that corresponds to the dedicated bay has expired for up to 1 month. Normal PCN thereafter.

19y “Parked in a residents’ or shared-use parking place or zone either displaying an invalid permit, or voucher or pay and display ticket, or after the expiry of paid for time (obscured/illegible permit)” Warning Notice rather than PCN for obscured/illegible resident permit or white badge if a HHD check confirms the permit/badge as valid.

19z “Parked in a residents’ or shared-use parking place or zone either displaying an invalid permit, or voucher or pay and display ticket, or after the expiry of paid for time (out of date permit)” Warning Notice rather than PCN for expired annual resident permit where permit expired by 1-14 days or for expired white badge where badge expired up to 1 month. Normal PCN thereafter.

Marshals should issue one Warning Notice per day where above applies. Code 00 relocations may also still be necessary in other circumstances.

Further ad hoc Warning Notice issue may be required for the introduction of new schemes/controls as and when required. Service provider to be instructed when this applies.

Note, 24u, 40y & 40z are not genuine code/suffix combinations as per London Councils’ current list but have been used by WCC only for the purpose of Warning Notices to enable us to convey to the motorist the error they have made. These codes must not be used for PCNs.

The Warning Notice makes it clear to the recipient that no payment is required, but inevitably some motorists will still be confused and may question a Marshal or call the Contact Centre. If so, the motorist should be assured that no payment or further action on their behalf is required.

WARNING NOTICES AND RELOCATIONS

Relocations

Since 2008, rather than clamping and/or removing vehicles parked in contravention we have only relocated contravening vehicles to near-by pay-to-park bays (contravention dependent).

Below outlines the protocols for relocating contravening vehicles following the issue of a PCN, a Warning Notice or a code 00 dummy PCN.

Relocation Policy  Relocation should only generally occur in conjunction with the following contravention codes: 16, 21, 23, 40, 41, 42, 45, 47, 48 and 99.  A common sense approach should be taken and all relocation activity should be proportionate (e.g. relocation may not be appropriate from an otherwise empty rank of bays)  Disabled badge holders should only be relocated if absolutely necessary  Aligned to the above, relocation should only be considered in the following circumstances – o Where a vehicle is denying a specialist permit holder a space in a specialist bay (PCN codes 16, 23 or 40) o Where a vehicle is denying a vehicle a space in a non-permit designated bay (PCN codes 23, 41, 42, 45 or 47) o Where a vehicle is parked on zig-zags (codes 48 or 99) o Where a vehicle is parked in a suspended bay when the suspension is active (code 21) o Where an external request to relocate has been received from the Police, from a Utility company attending emergency works or from the WCC City Promotions, Events and Filming team.

Approval for relocation can be made by WCC Parking Services, WCC City Promotions, Events and Filming team, the Control Room and the Police. Outside of the hours of 08:45-13:45 Mon-Fri, relocations will only be approved by the WCC Suspensions team (Mon-Fri 13:45-17:00) and by the Control Room (Mon-Fri 17:00-08:45 and all weekend) in emergency or extraordinary circumstances only. The control room must complete a full record of all relocation requests with full justification for each.

The table below shows the contraventions where we would consider relocation to be appropriate, the time constraints (if any) that the TMA 2004 places upon vehicle removal and WCC’s relocation policy.

When relocating, vehicles will be relocated to a pay-to-park bay as near to the original location as possible. Only resident permit holders should be moved to other resident bays. Other vehicles should only be relocated to resident bays or onto yellow lines as an absolute last resort.

A vehicle that has been relocated should not be issued with a further PCN at its new location for the rest of that day. If the vehicle remains parked in contravention at its new location when controls recommence the following day, a new PCN may then be issued.

Driver returns If the driver or the person appearing to be in charge of the vehicle returns before the vehicle has all its wheels on the truck, the vehicle should be released but any PCN remains payable. Even if the vehicle is on the truck we should still look to release wherever practicable.

Unmoved vehicles post-relocation Vehicles are to be left in situ at the new location unless it is necessary to relocate them again due to a suspension or Police request. If the vehicle has not moved from the position it has been relocated to, a PCN can be issued from the beginning of controlled hours the next day. If the vehicle remains parked after this, the AVRS procedure should be followed (see page 84).

The above protocols do not affect abandoned vehicles which can still be removed once the required notifications have been given and statutory time limits have been followed.

Non-contravention relocations We will continue to receive external requests to remove/relocate in certain circumstances, such as from the Police for security reasons, emergency utility company works, WCC City Promotions, Events and Filming team etc. The process for necessary relocations where a contravention is not occurring remains the same, but in these instances a dummy code 00 PCN will need to be created.

Relocation may be required without PCN issue when a code 21r Warning Notice is issued (see pages 85-86). Note, for a vehicle to be relocated in these circumstances, a Marshal must issue both a Warning Notice and a code 00 PCN, otherwise it will not show on the system and relocation details will not transfer to TRACE. The code 00 PCN must not be placed on the vehicle but returned to the Base Manager/Supervisor.

The KMECOP for enforcing parking contraventions by CCTV, where this is permitted under the Deregulation Act 2015, is outlined throughout Section 2 of this document. Enforcement of MTCs by CCTV is unaffected by the Deregulation Act 2015.

Enforcement of MTCs Directional signs on the carriageway only apply once the sign has been passed. The direction is only active in the area behind the sign. These are all ‘positive’ instruction signs.

Enforcement footage should show the sign and the vehicle passing it. However, it is not necessary for the footage to show the front of the sign.

Box Junctions

PCN Code 31 “Entering and stopping in a box junction when prohibited”

Evidence must show vehicle approaching, entering, stopping and leaving the box junction. The intention is to only penalise motorists for entering the box junction when the exit is not clear and having to stop in the junction as a consequence of this action.

Preferably the footage should show the vehicle entering the junction, or at least show the vehicle moving before stopping behind another stopped vehicle at the blocked exit.

Footage merely showing a vehicle stopped in a box junction is not considered evidence that the contravention has taken place.

Exemptions

1. Vehicle may be delayed by oncoming traffic waiting to turn right, in which case do not issue.

2. Vehicle forced to stop in the junction due to the braking of traffic ahead, although the exit was clear at the time the vehicle entered the box junction.

3. Vehicles being used for Fire Brigade, Ambulance or Police purposes.

Turn left or right signs Usually found on traffic islands and at junctions, these are intended to instruct traffic to proceed in the direction indicated by the arrow to prevent entering the path of oncoming traffic. These signs are listed under the TSRGD as diagram 609.

Proceed in the direction indicated by the arrow signs These signs, listed under the TSRGD as diagram 606 "Vehicular traffic must proceed in the direction indicated by the arrow", only apply to the junctions where they are sited. The signs only instruct vehicles not to turn at that junction and to proceed in the direction indicated and do not apply anywhere in the street other than the junction. Vehicles may be ticketed for turning at the junction where prohibited but not for performing U-turns.

One-way traffic signs This is the rectangular sign (TSRGD diagram 652). Contraventions include driving and reversing against the direction indicated.

Evidence must show vehicle approaching and passing sign and driving in the wrong direction.
