Brown1 Australian National University, Australia Abstract The primary goal of this paper is to raise awareness regarding legal loopholes and enabling technologies, which facilitate acts of cyber crime. In perusing these avenues of inquiry, the author seeks to identify systemic impediments which obstruct police investigations, prosecutions, and digital forensics interrogations. Existing academic research on this topic has tended to highlight theoretical perspectives when attempting to explain technology aided crime, rather than presenting practical insights from those actually tasked with working cyber crime cases. The author offers a grounded, pragmatic approach based on the in-depth experience gained serving with police task-forces, government agencies, private sector, and international organizations. The secondary objective of this research encourages policy makers to reevaluate strategies for combating the ubiquitous and evolving threat posed by cyber- criminality. Research in this paper has been guided by the firsthand global accounts (via the author’s core involvement in the preparation of the Comprehensive Study on Cybercrime (United Nations Office on Drugs and Crime, 2013) and is keenly focused on core issues of concern, as voiced by the international community.

The author conducted these interviews with investigating police officers in relation to cases where DNA evidence was produced in court, but an acquittal nevertheless resulted. The interviews were removed from the following pages: 104, 127 and 151-2. ii ABSTRACT This research examines the effects of forensic deoxyribonucleic acid (DNA) evidence on decisions in the courts and on the conduct of criminal investigations. To assess effects on court decisions, quantitative analyses were conducted using primary data from the State of Queensland. A control-comparison method was used to assess the effects in court, and this was made within a context of other evidentiary and extra- legal factors that had a bearing on case outcomes. These other factors included defendant confessions, independent witness testimony and fingerprint and photographic evidence. A sample of 750 cases referred by police for prosecution and finalised past the appeal stage in court, was selected for examination.

It can be argued that these “cop shows” are productive forms of public relations for police agencies, particularly the co-produced reality TV variety, and as such valuable commodities for producers and broadcasters. As cultural objects these programs both draw upon and generate expressions of national identity. This dissertation examines a selection of Australian police television series—Recruits, The Force: Behind the Line, RBT, Blue Heelers, Wildside, and East West 101—applying a multi-perspective approach that analyses their relationship to the symbolic and real-world institution of policing. In so doing, I explore three key elements fundamental to these programs; their production, textual content and reception. As complex audio-visual texts, cop shows can generate myriad meanings and messages regardless of factors underpinning their production. However, in the case of reality TV, what became evident is that institutional reputation is foremost: this, ironically, undermines the reality of police work as it is presented on television. The drama series, free from the strictures of the television producer and police partner bond, can go beyond the observational documentary script; however, the programs surveyed here did not use this freedom to challenge the legitimacy of the institution.
