Externs will also work on motions to modify the rulings of the court’s Commissioner and Clerk. Several such motions are assigned each month, and externs will write a memorandum, recommending a result for each motion, that will be considered by a panel of five justices. Externs may also be asked to write en banc memorandums, recommending whether to grant or deny a particular case; these memorandums are considered by all nine justices of the court. Externs may in some instances get the opportunity to write dissenting or concurring opinions that may be published and become part of Washington’s case law (and, if an extern can sway five justices, she or he could even end up writing a majority opinion that becomes the law of the land). Finally, externs can observe oral arguments and discuss the arguments in chambers with the justice and law clerks.
