INTRODUCTION: UK PAY TV CONSUMERS CAN BE BETTER SERVED 1.1 In January 2007, Virgin Media Limited ("Virgin Media"), together with British Telecommunications plc, Setanta Sport Holdings Limited and Top Up TV Europe Limited (together, "the Parties"), jointly made a submission to Ofcom demonstrating that competition in the UK pay TV market is not working effectively, and calling for Ofcom to make a market investigation reference to the Competition Commission. In this initial submission, a number of subsequent submissions and responses to numerous information request responses2, Virgin Media has provided voluminous evidence of market failure and highlighted specific areas of consumer detriment which result from this market failure. 1.2 Consumers would be demonstrably better off if steps were taken to remedy the features of the market which are preventing, restricting or distorting competition in the supply of pay TV in the UK. Against that background, this supplementary submission provides: (a) further evidence that consumers are not being well served by the current market structure; and (b) [CONFIDENTIAL], a more detailed explanation of the ways that Virgin Media could innovate (and the types of offerings consumers could expect to see) were the distorting features of the market corrected. 1.3 Ofcom has a discretion under section 131 of the Enterprise Act ("EA") to make a market investigation reference to the Competition Commission where: "… it has reasonable grounds to suspect that any feature, or combination of features, of a market in the United Kingdom for goods and services prevents, restricts or distorts competition in connection with the supply or acquisition of any goods or services in the United Kingdom or a part of the United Kingdom." 1.4 There can be no question such "reasonable grounds" have been established since the inception of this process approximately nineteen months ago.

Channel 4 welcomes the opportunity to provide its views to the BBC Trust’s review of BBC services for younger audiences. Channel 4 is a publicly-owned, commercially-funded public service broadcaster. Its core public service channel, Channel 4, is a free-to-air service funded predominantly by advertising. Unlike the other commercially-funded public service broadcasters, Channel 4 is not shareholder owned: commercial revenue is only a means to delivering Channel 4’s public purpose end and any surplus revenues are reinvested in the delivery of its public service remit. 2. In recent years, Channel 4 has broadened its portfolio to offer a range of digital services, including the free-to-air, commercially-funded digital television channels Channel 4+1, E4, E4+1, Film4, More4 and 4Music. Channel 4 also offers a video on demand service, 4oD, and it is expanding its range of services at channel4.com. In addition, Channel 4 offers a range of online education projects for 14 to 19 year olds and has launched an innovation pilot fund, 4iP, which seeks to stimulate whole new digital media services across a range of areas, including video games, the arts, democracy and sport. 3. REPORT CARD: MAKING THE HDTV PLUNGE By RON HRANAC After putting it off for several years, I finally joined the slightly more than one-third of Americans who have already done so, and got a high definition TV (HDTV) set for home use. I had all sorts of excuses for putting this off, among them cost, a 15+ year-old conventional TV set that still works fine, a wife who said the 15+ year-old TV set works just fine (see a trend here?), picture quality with standard definition (SD) sources, rear projection vs. liquid crystal display (LCD) vs. plasma, and even picture quality with HD sources. During the past few years, the cost of HD sets has come down dramatically. Technology has improved to the point where both SD and HD picture quality are quite good on many of the new sets, though there are still some HD sets that do an abysmal job displaying SD material. The latter is important because, quite frankly, a lot of video content is SD and will be for the foreseeable future. Then and now My first experience with HDTV goes back to a 1980s National Association of Broadcasters convention. The concept of high-def had been introduced as a way to provide widescreen TV viewing rivaling projected 35 mm motion pictures, accompanied by CD-quality audio. One of the hopes was that a global HDTV standard could be developed, avoiding the NTSC/PAL/SECAM format battles that have long plagued broadcast TV - OK, maybe that was wishful thinking.
