9 FINANCIAL AND WORK PROGRAMME REPORT FOR THE PERIOD ENDED 31 MARCH 2013 The Council considered a report by the Group Manager Corporate Services and Corporate Planning Manager reporting progress against Council’s work programme and financial results for the period ended 31 March 2013. Councillors asked questions relating to a number of activities.

Clr Fraser suggested that in regard to the level of service under Democracy, to ‘Communicate with the community’ provision be made on Council’s website for a repository of some of Council’s public documents historically, to allow members of the public to view the documents, look at any changes that have been made over the years and make comments. It was suggested that this possibility be looked at when Council’s website is upgraded.

10 2013 LOCAL AUTHORITY ELECTIONS – EARLY PROCESSING OF VOTES (File E2/2) The Council considered a report by the Electoral Officer seeking approval for the early processing of returned voting documents for the 2013 local authority elections.

“That the Council resolves that the returned voting documents for the 2013 Local Authority Elections are to be processed during the voting period pursuant to Section 79 of the Local Electoral Act 2001 and the Local Electoral Regulations 2001.”

Timaru District Council Council Meeting 826044 4 25 June 2013 11 2013 LOCAL AUTHORITY ELECTIONS – ORDER OF CANDIDATE NAMES (File E2/2) The Council considered a report by the Electoral Officer seeking a decision on the order of candidates’ names on the voting papers for the 2013 local authority elections.

Clr Earnshaw referred to research indicating that the order of candidates names on voting papers can have an effect of up to 10%. Clr Stevens reported that he had examined the results of the previous two local authority elections in regard to the Timaru Ward and found that in 2010, the order of names was a 4% factor in the result but in 2007 the order of names had a 15% influence on the results.

12 RECOMMENDATIONS FROM RESOURCE PLANNING AND REGULATION COMMITTEE – 23 APRIL 2013 12.1 Building Advisory Services Delegations Register The Council considered a recommendation from the Resource Planning and Regulation Committee of 23 April to approve the delegations outlined in the Building Services Delegation Register.

12.2 Review of Council’s Gambling Machine and Board (TAB) Venue Policy The Council considered a recommendation from the Resource Planning and Regulation Committee on the Gambling and Board Venue Policy.

“That the existing Class 4 Gambling Machine and Board Venue Policy be adopted and that the Council agrees to undertake a Social Impact Assessment prior to reviewing the policy again in 2016.”

MOTION CARRIED 12.3 Swimming Pools Submission The Council considered a recommendation from the Resource Planning and Regulation Committee on Council’s submission on proposed changes to the Fencing of Swimming Pools Act 1987.

14 CONSIDERATION OF MINOR NATURE ITEM Advice of Tenders Let The District Services Manager reported briefly on the outcome of the Tenders Subcommittee meeting held earlier in the day, which approved the letting of tenders for two contracts of significant value – the utilities maintenance contract, awarded to City Care Ltd and the construction of the Elginshire Street extension at , awarded to Fulton Hogan Ltd.

“That the 100th anniversary of World War 1 be referred to Council’s Cultural and Learning facilities (library, museum, art gallery) and other local organisations for a coordinated response to the anniversary, including appropriate funding opportunities.”

MOTION CARRIED

The Council considered the request to build a memorial to commemorate the 100th anniversary. However, the Council believes there are already enough war memorials in the District and an additional, separate memorial is not necessary.

Purpose of Report The purpose of this report is to adopt the Timaru District Council 2013/14 Annual Plan.

Background The Annual Plan 2013/14 represents Year 2 of the 2012-22 Timaru District Long Term Plan (LTP). It includes the budget, work programme and fees proposed for the 2013/14 financial year along with variations to the LTP 2012-22 document.

It has been consulted on, using the Special Consultative Procedure.

Options Section 95 of the Local Government Act 2002 requires the Council to prepare and adopt an Annual Plan for each financial year. The Plan must be adopted before the commencement of the year to which it relates.

Identification of Relevant Legislation, Council Policy and Plans Local Government Act (LGA) 2002 Timaru District Council LTP 2012 - 2022

Assessment of Significance This matter is significant under the Council’s Significance Policy and has been consulted on using the Special Consultative Procedure under Section 83 and 85 of the LGA.

Consultation Consultation included:  Pre-consultation with community boards on projects in their communities  Summary delivered via the High Country Herald on Wednesday 17 April to all Timaru District residents  Document mailout to interested parties  Media releases and publicity through Council Noticeboard  Availability via hard copy through the Council offices and libraries  Webpage and online submission opportunity on Council’s website.

Timaru District Council Council Meeting 826044 23 25 June 2013 The Draft Annual Plan 2013/14 was consulted on from 13 April to 13 May 2013 and 82 submissions were received on a wide range of issues. A public hearing was held on Tuesday 4 June. All changes made by Council have been incorporated in the final document.

Other Considerations There are no other considerations relevant to this matter.

Funding Implications There are no funding implications associated with this report.

Conclusion The adoption of the Annual Plan 2013/14 is the final step in the corporate planning process. The Plan is based on Year 2 of the 2012-22 LTP and has been through the appropriate consultative processes.

Balanced Budget Requirement (File C5/17/3)

Purpose of Report The purpose of this report is for Council to resolve to permit an unbalanced budget in the 2013/14 Annual Plan.

Background In its forecast Statement of Comprehensive Income, Council is reporting a surplus due to forecast income including grants and subsidies specifically provided by external parties to fund capital expenditure projects. These grants and subsidies are not available to meet day to day forecast operating expenses. Expenditure associated with these grants and subsidies is recorded in the Forecast Statement of Financial Position, not the Forecast Statement of Comprehensive Income. Forecast interest income on Special Funds invested is allocated to and reinvested with those special funds and is therefore also not available to meet forecast day to day operating costs.

Council fully funds depreciation on assets and maintains investments to match depreciation special fund balances. Timaru District Council is of the opinion that it is financially prudent not to have a balanced budget in the Forecast Statement of Comprehensive Income and, due to the matters noted above, it is necessary for forecast income to exceed forecast expenditure in the Forecast Statement of Comprehensive Income.

Therefore in line with Subsection 2 of Section 100 of the Local Government Act 2002, it is financially prudent for the Council to project operating revenues at a different level from that required by Subsection 1 of Section 100 of the Local Government Act 2002.

Options To permit an unbalanced budget for the year commencing 1 July 2013.

Identification of Relevant Legislation, Council Policy and Plans Section 100 of the Local Government Act 2002 states as follows:

"Balanced Budget Requirement - 1) A local authority must ensure that each year’s projected operating revenues are set at a level sufficient to meet that years projected operating expenses.

Timaru District Council Council Meeting 826044 25 25 June 2013 2) Despite Subsection (1), a local authority may set projected operating revenues at a different level from that required by that subsection if the local authority resolves that it is financially prudent to do so, having regard to –

a) the estimated expenses of achieving and maintaining the projected levels of service provision set out in the long term Council Community Plan, including the estimated expenses associated with maintaining the service capacity and integrity of assets through their useful life; and

b) the projected revenue available to fund the estimated expenses associated with maintaining the service capacity and integrity of assets throughout their useful life; and

c) the equitable allocation of responsibility for funding the provision and maintenance of assets and facilities throughout their useful life; and

d) the funding and financial policies adopted under Section 102."

Assessment of Significance This matter is not deemed significant under the Council’s Significance Policy.

Consultation Consultation has been included as part of the consultation on the Annual Plan.

Other Considerations There are no other considerations relevant to this matter.

Funding Implications The budget has previously been reviewed by Council.

Recommendation

That in accordance with Section 100 of the Local Government Act 2002, the Council resolves to permit an unbalanced budget in the Annual Plan for the year commencing 1 July 2013.

RESOLUTION TO SET RATES Timaru District Council has adopted its Annual Plan for 2013-14. It has made no changes to its proposed rating policy as a result of submissions received during the special consultative procedure and is now moving to set and assess the rates described in its rating policy.

1 That the Timaru District Council set the following rates under the Local Government (Rating) Act 2002, on rating units in the district for the financial year commencing 1 July 2013 and ending on 30 June 2014. Such rates shall become due and payable by instalments on the dates prescribed in clause 13 of this resolution.

2 All rates and charges are inclusive of the Goods and Services Tax (GST).

3 General Rate

That pursuant to Section 13(2)(b) and Section 14 of the Local Government (Rating) Act 2002 a general rate set as a rate in the dollar on the land value of all rating units within the Timaru District, assessed on a differential basis as described below:

That pursuant to Section 16 (4)(b) of the Local Government (Rating) Act 2002 a differential targeted rate on all rateable and non-rateable land to which the “three bin” waste collection service is actually provided (a) of $318.00 per standard size “three bins” provided to each rating unit in the urban area; (b) of $405.00 per large “three bins” provided to each rating unit in the urban area; (c) of $317.00 per standard size “three bins” provided to each rating unit outside the urban area; and (d) of $405.00 per large “three bins” provided to each rating unit outside the urban area; and (e) of $69.00 per additional small recycling bin provided to each rating unit; and (f) of $79.00 per additional large recycling bin provided to each rating unit; and (g) of $111.00 per additional small compost bin provided to each rating unit; and

11 Water Charges

That pursuant to Section 16(3)(b), (4)(a) and (b) and section 19 of the Local Government (Rating) Act 2002 targeted rates for the supply of water in the following areas as follows.

(a) Geraldine, Pleasant Point, Peel Forest, Temuka, Timaru and Winchester urban supplies

A differential annual charge of $234.00 on each rating unit or separately used or inhabited part of a residential rating unit receiving an ordinary water supply and $117.00 on all rating units situated within 100 metres from any part to the water works to which water can be but is not supplied within the urban areas.

(b) Rural

(i) The Rangitata-Orari Water Supply District A rate of $17.00 per hectare.

(ii) The Downs Water Supply District a) A charge of $175.00 for each unit of water supplied; b) A charge of $353.70 for each tank except where there is more than one tank to any rating unit as a technical requirement of the scheme, in which case only one charge will apply.

(iii) The Orari Township Water Supply District A charge of $364.00 for each unit of water supplied.

(iv) The Seadown Water Supply District a) A rate of $13.50 per hectare; b) A charge of $338.00 for each domestic supply; c) A charge of $135.00 for each woolshed and other farm buildings which are separately supplied.

(v) Beautiful Valley Water Supply District A rate of $3.69 per hectare.

(vi) Downlands Water Supply District On so much of the rating unit appearing on Valuation Rolls number 24640, 24660, 24670, 24680, 24690, 24700, 24710, 24820, 24840, 24850, 24860, and part 25033, as is situated within the Downlands Water Supply District.

a) A charge of $409.00 for each ordinary domestic supply within the Pareora Township and for halls within the scheme. b) A charge of $701.50 per school within the Pareora Township. c) In addition a charge of $395.00 for each hotel, motel, market garden, golf club, sawmill, racecourse, shop, commercial or industrial premises and all other supplies of an extraordinary nature, within the Pareora Township.

(c) Water by Meter

A targeted rate for water supply, set under Section 19 of the Local Government (Rating) Act 2002 per cubic metre of water consumed to any rating unit situated in the following areas which has been fitted with a water meter:

12 Community Centre Charges

That pursuant to Section 16(3)(b) and (4)(a) of the Local Government (Rating) Act 2002, the following Community Centre Charges in respect of each dwelling unit in each Community Centre Area which lies within the defined area in each case.

15 Discount

That pursuant to Section 55 of the Local Government (Rating) Act 2002, the following discount will apply:-

A discount of 2.50% will be allowed on the total rates set, if the 2013/2014 rates, including any current additional charges, are paid in full on or before 20 September 2013.

16 Additional Charges

That pursuant to Section 57 of the Local Government (Rating) Act 2002 the District Council prescribes the following additional charges to be added to unpaid rates:-

(a) An Additional Charge

An additional charge under section 58(1)(a) of 10% of the amount of the unpaid instalment or portion of instalment will be added if not paid on or before the instalment due date.

(b) Further Additional Charges

A further additional charge under section 58(1)(b) and 58(1)(c) of 10% of the amount of the unpaid rates, including any additional charges previously imposed will be added on 20 September 2013 and 20 March 2014 to all previous years’ rates and penalties remaining unpaid as at those dates.

Recommendation That the Council resolves to exclude the public on the grounds contained in Section 48(1) of the Local Government Official Information and Meetings Act:

Confirmation of Minutes - Council Meeting Tenders Subcommittee Temuka Community Board Policy & Development Committee

Section 7(2)(a) The withholding of the information is necessary to protect the privacy of natural persons.

Section 7(2)(b)(ii) The withholding of the information is necessary to protect information where the making available of the information would be likely unreasonably to prejudice the commercial position of the person who supplied or who is the subject of the information

Section 7(2)(h) The withholding of the information is necessary to enable the Council to carry out, without prejudice or disadvantage, commercial activities.
