Our Up & Coming Lawyers are rising stars in the legal community — Massachusetts attorneys who have been members of the bar for 10 years or less, but who have already distinguished themselves in some manner and appear poised for even greater accomplishments. Our honorees for Excellence in Diversity were chosen for their commitment to diversity, whether through helping a law firm to develop a more inclusive culture or advocating for the legal rights of gay, lesbian, bisexual and transgender people. We have added a new category this year, and the firms and individuals chosen as our honorees for Excellence in Pro Bono are all terrific role models for their work in giving back to the community. In addition, we are honoring the often unsung heroes who make sure our offices run smoothly and the trains run on time with our Excellence in Firm Administration, Marketing and Operations awards. The honorees for Judicial Excellence and Excellence in Legal Journalism, chosen by our partner in this event, the Massachusetts Bar Association, are also featured in this section. This year, the MBA is honoring Chief Judge Mark L. Wolf and Boston Globe columnist Kevin Cullen. The pages that follow hopefully offer some intriguing insights into the individuals selected for their contributions this year. Please join me in congratulating all our honorees. Susan A. At Crane, Poole and Schmidt, the elevator door rings, Margie Coggins steps off and seems to be looking for someone. Margie Coggins: Uh. She tries to get help from someone passing by. She is ignored and doesn't seem to know what to do next. Catherine Piper: She walks up. Hello, dear. May I help you? Margie Coggins: Yeah. I'm looking for a lawyer. Catherine Piper: Yes, I suspected as much. You're in a law firm. Uh, what have you done, dear? Margie Coggins: Well, I got into Harvard and then… Catherine Piper: A pretty little thing like you! Please! Who'd we do, sweetheart? Margie Coggins: Then they rescinded my admission. And now I would like to sue them. Catherine Piper: Of course you would. Uh…She grabs the hand of a person walking by and pulls her in. It's Katie Lloyd. Katie? Be a dear and help this young lady. Uh, Katie will help you, dear. Katie Lloyd: She looks at Catherine in puzzlement. To Margie. Why don't we go to the conference room? Still puzzled, Katie looks back at Catherine as she and Margie leave. Carl Sack: Hello. For attorneys, that’s no different – even when they’re watching lawyers on TV. “Better Call Saul” is the latest in a long line of TV shows about the legal profession. A prequel to AMC’s “Breaking Bad,” the show stars Bob Odenkirk as a crooked-at-times attorney named Jimmy McGill. “He’s a likable guy and you like his character,” said Patrick Fitzsimmons, senior associate at Hodgson Russ LLP in Buffalo. “It’s a great show. I think it’s the one BEN LEUNER/AMC show compared to the others where it’s not about a big firm.” “Better Call Saul” puts a new spin on legal drama as the slippery Jimmy McGill (played by Bob Odenkirk) Also a fan is Michael Benz, an associate at HoganWillig who recently returned to builds his practice. his native Buffalo after working in the Philadelphia public defender’s office and in his own practice as a criminal defense attorney. “(Odenkirk’s character is) the classic defense attorney who will do anything to make a buck or help his client,” Benz said, adding that he often binge-watches shows with his wife, Carla, an attorney in the federal public defender’s office in Buffalo.

DON’T TRY THIS AT HOME: Why You Should Never Emulate TV Lawyers A One-Hour Webinar Covering: Legal Ethics Presented by: Sean Carter CA Bar# 200356 OVERVIEW Lawyers on our favorite legal dramas - Boston Legal, The Practice, L.A. Law, Ally McBeal, Suits – often act in ways that would cause significant trouble for actual lawyers. In this multimedia webinar, legal humorist Sean Carter will demonstrate some of the worst of TV lawyer behavior through short (30-60 second) video clips from these shows. After each video snippet, he will discuss the precise rule violated and what the lawyer should have done to avoid the ethical violation. While these examples will provide for a more engaging experience for the lawyer attendee, they will also serve as a reminder that our clients are watching these same programs. As a result, they are very often developing an unrealistic view of the role of an attorney and the tactics available to that attorney in the furtherance of the client’s cause. As a result, this webinar will serve as a useful reminder for each attorney to manage the client’s expectations by having candid conversations detailing just what the lawyer can (and more importantly, can NOT) do in the course of the representation. TIMED AGENDA DON’T TRY THIS AT HOME (LEGAL ETHICS) 0:00-0:05 Introduction A. The power and influence of television 1. Legal dramas affect client perceptions 2. “IT REVEALS WHO I REALLY AM”: NEW METAPHORS, SYMBOLS, AND MOTIFS IN REPRESENTATIONS OF AUTISM SPECTRUM DISORDERS IN POPULAR CULTURE By Summer Joy O’Neal A Dissertation Submitted in Partial Fulfillment of the Requirements for the Degree of Doctor of Philosophy in English Middle Tennessee State University 2013 Dissertation Committee: Dr. Angela Hague, Chair Dr. David Lavery Dr. Robert Petersen Copyright © 2013 Summer Joy O’Neal ii ACKNOWLEDGEMENTS There simply is not enough thanks to thank my family, my faithful parents, T. Brian and Pamela O’Neal, and my understanding sisters, Auburn and Taffeta, for their lifelong support; without their love, belief in my strengths, patience with my struggles, and encouragement, I would not be in this position today. I am forever grateful to my wonderful director, Dr. Angela Hague, whose commitment to this project went above and beyond what I deserved to expect. To the rest of my committee, Dr. David Lavery and Dr. Robert Petersen, for their seasoned advice and willingness to participate, I am also indebted. Beyond these, I would like to recognize some “unofficial” members of my committee, including Dr. Elyce Helford, Dr. Alicia Broderick, Ari Ne’eman, Chris Foss, and Melanie Yergau, who graciously offered me necessary guidance and insightful advice for this project, particularly in the field of Disability Studies. Yet most of all, Ephesians 3.20-21. iii ABSTRACT Autism has been sensationalized by the media because of the disorder’s purported prevalence: Diagnoses of this condition that was traditionally considered to be quite rare have radically increased in recent years, and an analogous fascination with autism has emerged in the field of popular culture.

  • 'To Sue and Make Noise': Legal Theatricality and Civic Didacticism in Boston Legal
Katja Kanzler “'To Sue and Make Noise': Legal Theatricality and Civic Didacticism in Boston Legal [A client asks to be represented in suing the U.S. government for inactivity in the face of genocide in Darfur.] Lawyer Lori Colson: “I have a crazy idea. [...] In tort law, you see a guy lying on the side of the street, you have no obligation to pull over and help. But if you do pull over, you incur a duty to complete that rescue, the theory being other would-be rescuers pass by thinking help is already on the scene. [...] The United States has declared a war on terrorism. We've talked the talk when it comes to Sudan. We've even given financial aid. Our theory of law would be analogous – other countries have stayed out, thinking America is stepping in when we're not.” Lawyer Paul Lewiston: “It's not a winner.” Colson: “But perhaps colorable enough to sue and make noise.” (Boston Legal, “Schmidt Happens”) The legal drama episode from which this dialogue is taken depicts an impossible case: A Sudanese immigrant, who lost most of his family to the violence in Darfur, wants to sue the U.S. government for failing to intervene in the face of obvious genocide. The case is unwinnable. Lori Colson's construction of a legal basis for the case is more than shaky. But neither the client nor his lawyers expect to win the case. Their proclaimed objective – to “make noise” – pinpoints a significant cultural potential of litigation, of its 'real' practice in the courtroom and, even more importantly, in its various forms of mass-medialization and fictionalization: to raise public awareness about instances of injustice, to educate the public and encourage civic debate.
