E. B. Du Bois and the Vision of Africa’s Past Tracey Lynn Thompson Doctor of Philosophy Department of History University of Toronto 2011 Abstract Scholars have examined many aspects of W. E. B. Du Bois’s project of empowering oppressed peoples in the United States and around the world. However they have treated in only a fragmentary way one of the principal strategies that he used to counter hegemonic ideologies of African and African American inferiority. That strategy was to turn to the evidence of history. Here I argue that Du Bois, alerted by Franz Boas to Africans’ historical attainments, confronted claims made by European Americans that Africans and a fortiori African Americans lacked any achievement independent of European or other foreign influence. Du Bois linked African Americans to Africa and laid out repeatedly and in detail a narrative of autonomous African historical accomplishment. I demonstrate that his approach to the history of Africa constituted a radical departure from the treatment of Africa presented by scholars located in the mainstream of contemporary anglophone academic thought. I argue that while his vision of Africa’s history did not effect any significant shift in scholarly orthodoxy, it played a crucial role, at a grave juncture in race relations in the United States, in helping to equip young African Americans with the psychological resources necessary to challenge white supremacist systems. -

SS8H7abcd SUMMARY - The New South – Racism – Civil Rights Activists of the Early 20th Century SS8H7a Evaluate the impact the Bourbon Triumvirate, Henry Grady, International Cotton TOM WATSON and the POPULIST POLITICAL PARTY Exposition, Tom Watson and the Populists, Rebecca Latimer Felton, the 1906 Atlanta Riot, the Leo Frank Case, and the county unit system had on Georgia during this period. As a US Congressman and Senator from Georgia and leader of the Populists Political Party, Tom Watson helped support Georgia’s poor and struggling farmers. He created the RFD (Rural Free Delivery) which helped deliver US mail to people living in rural areas that helped build roads and bridges. Tom Watson opposed (was against) the New South movement and many of the conservative Democrat politicians. He believed that new industry in the South only helped people living in urban areas and did not benefit rural farmers. Early in his career Tom Watson tried to help both white AND black sharecroppers, but later in politics he became openly racist. COUNTY UNIT SYSTEM Elections were decided by a unit vote and not by a popular vote of the people. The population in each county determined how many unit votes a candidate would receive. There were 8 Urban counties that had the most population, but they only received six unit votes each. There were 30 Town counties that received four unit votes each. Finally, there were 121 Rural counties that received 2 unit votes each. This allowed small rural counties to have a lot of power in politics, however, the majority of the population of Georgia resided in Urban and Town counties. -

Local clashes matured into widespread, violent confrontations during the Civil War, as an ugly guerrilla war raged through much of the state. Additionally, African Americans engaged in a wartime contest over the meaning of freedom. Nowhere were these interconnected conflicts more clearly evidenced than in the Bluegrass Region. Though Kentucky had never seceded, the Freedmen’s Bureau established a branch in the Commonwealth after the war. -

WHY THE LEO FRANK PARDON IS IMPORTANT By Richard Mamches I have closely followed a new flurry of interest in the Leo Frank case since author Steve Oney published his definitive book on this tragic episode in 2003, AND THE DEAD SHALL RISE: THE MURDER OF MARY PHAGAN AND THE LYNCHING OF LEO FRANK. With the arrival of the 2013-15 centenary of the Leo Frank case, I am surprised by the tendency of some people to downplay or ignore the merits and significance of the posthumous pardon granted to Leo Frank by the state of Georgia on March 11, 1986. The misconception is because Mr. Frank was not officially absolved of guilt in the 1913 murder of Mary Phagan, but was pardoned because the state failed to protect him from the lynch mob, this pardon has little or no real meaning. I believe the posthumous pardon of Leo Frank is both a very beneficial act of restorative justice and a turning point that is one of Georgia's finest moments. If, in the words of Vicki Lawrence's #1 hit song from 1973, the lynching of Leo Frank on August 17, 1915 was “the night that the lights went out in Georgia,”1 his pardon on March 11, 1986 was the day Georgia turned the lights back on, and fundamentally changed its attitude towards the Leo Frank case—so truth, reconciliation, justice and healing could finally overcome a tragic 70-year legacy of bigotry, denial and injustice, long shrouded in shameful silence. It is an inspiring success story that deserves to be remembered at a time when our nation and the world still struggle to overcome prejudice, hatred and intolerance in the 21st century. -

UNIVERSITY OF LOUISVILLE BRANDEIS SCHOOL OF LAW 2013 Brandeis Medal Recipient The Seelbach Hilton Louisville, Kentucky April 18, 2013 Glittering Generalities and Historic Myths When I began the study of constitutional law at Northwestern in the fall of 1945, my professor was Nathaniel Nathanson, a former law clerk for Justice Brandeis. Because he asked us so many questions and rarely provided us with answers, we referred to the class as "Nat's mystery hour." I do, however, vividly remember his advice to "beware of glittering generalities." That advice was consistent with his former boss's approach to the adjudication of constitutional issues that he summarized in his separate opinion in Ashwander v. TVA, 297 U. S. 288, 346 (1936). In that opinion Justice Brandeis described several rules that the court had devised to avoid the unnecessary decision of constitutional questions. As I explained in the first portion of my long dissent in the Citizens United case three years ago, the application of the Brandeis approach to constitutional adjudication would have avoided the dramatic changes in the law produced by that decision. I remain persuaded that the case was wrongly decided and that it has done more harm than good. Today, however, instead of repeating arguments in my lengthy dissent, I shall briefly comment on the glittering generality announced in the per curiam opinion in Buckley v. Valeo in 1976 that has become the centerpiece of the Court's campaign finance jurisprudence, and then suggest that in addition to being skeptical about glittering generalities, we must also beware of historical myths. -

\Judge Lynch" in the Court of Public Opinion: Publicity and the De-legitimation of Lynching∗ Michael Weaver Postdoctoral Fellow Department of Political Science University of British Columbiay [email protected] November 8, 2018 Abstract How does violence become publicly unacceptable? I address this question in the context of lynching in United States. Between 1880 and the 1930s, public discourse about lynching moved from open or tacit endorsement to widespread condemnation. I argue this occurred because of increasing publicity for lynchings. While locals justified nearby lynchings, publicity exposed lynching to distant, un-supportive audiences and allowed African Americans to safely articulate counter-narratives and condemnations. I test this argument using data on lynchings, rail networks, and newspaper coverage of lynchings in millions of issues across thousands of newspapers. I find that lynchings in counties with greater access to publicity (via rail networks) saw more and geographically dispersed coverage, that distant coverage was more critical, and that increased risk of media exposure may have reduced the incidence of lynching.
