Montgomery County provides from work in observance of persons and events significant to the country’s history and culture. Montgomery County observes the following holidays:

New Year's Day The 1st day of January Martin Luther King Day The 3rd Monday in January Presidents' Day The 3rd Monday in February Memorial Day The last Monday in May Independence Day The 4th day of July Labor Day The 1st Monday in September Columbus Day The 2nd Monday in October Veterans Day The 11th day of November Thanksgiving Day The 4th Thursday in November Day after Thanksgiving Day* The 4th Friday in November Christmas Day The 25th day of December

*Non-bargaining unit employees and bargaining unit employees as specified by contract. Employees represented by 1199, Health Care Workers, observe Christmas Eve rather than the day after Thanksgiving.

A holiday falling on a Saturday will be observed on the preceding Friday, and a holiday falling on a Sunday will be observed on the following Monday.

Contractual provisions may differ.

Eligibility Employees are entitled to holiday pay if they work, or are on paid leave the last scheduled work day prior to and first scheduled work day following the holiday.* Paid leave is defined as any leave under which the employee remains in active pay status, including , paid personal leave, long term , and compensatory time. Employees who are in an unpaid status on the regular workday immediately preceding or following the holiday are not eligible for holiday pay. Contractual provisions may differ.

* – employees whose effective date of retirement coincides with a holiday are exempt from the requirement to work or be on approved paid leave on the first day following the holiday.

Leave If an eligible holiday occurs during a period of paid long term sick leave or vacation leave, the employee will be regarded as having been off duty and will receive normal pay and will not be charged sick or vacation time.

Payment will not be made for a holiday occurring during unpaid leave. A should not start or end on a holiday.

Religious Holidays Religious holidays, other than those listed above, will be given consideration as requested. However, approved time off must be charged against the employee’s available paid personal

Leave of absence without pay is only considered when an employee has no paid leave balances. Employees must request time off in accordance with the provisions of the type of leave requested.

Overtime/Working on a Holiday An employee who is required to work on the day a holiday is observed shall be entitled to pay at the rate of one and one-half times his/her regular rate of pay. The regular rate includes shift differential, if applicable. Compensatory time off at time and one-half may be taken if mutually agreed to by employee and management. The employee shall also be entitled to holiday pay.

A holiday with pay shall be included as time worked for purposes of computing . Hours actually worked by an employee on a holiday shall be excluded in the calculation of hours in overtime status as holiday work premium of time and one-half has already been paid for these hours.

Compensation Regular Full-Time Employees:

1. Full-time employees shall be entitled to eight (8) hours of holiday pay at the regular rate or the number of hours they are normally scheduled to work over eight (8) hours (e.g., employee normally scheduled to work ten (10) or twelve (12) hours per day should receive ten (10) or twelve (12) hours of holiday pay). 2. An employee who is required to work on a holiday observed by the Board of County Commissioners will receive holiday pay in addition to pay or at management’s discretion compensatory time at the rate of time and one-half for the hours actually worked. 3. If a full-time employee's work is other than Monday through Friday, the employee shall be entitled to eight hours of holiday pay, or the number of hours they are normally scheduled to work over eight (8) hours (e.g., employee normally scheduled to work ten (10) or twelve (12) hours per day should receive ten (10) or twelve (12) hours of holiday pay) for any holiday observed on the regularly scheduled day off regardless of the day of week on which the holiday is observed.

Regular/Irregular Scheduled Part-Time Employees:

1. Holiday pay shall be paid for that portion of the holiday that the employee is normally scheduled to work. 2. An employee who is required to work on a holiday observed by the Board of County Commissioners will receive holiday pay in addition to pay or at management’s discretion compensatory time at the rate of time and one-half for the hours actually worked.

Seasonal Employees:

1. Seasonal full-time or regularly scheduled part-time employees shall receive holiday pay for holidays which fall within the actual pay periods worked. 2. A seasonal employee, who is required to work on the day a holiday is observed by the Board of County Commissioners, shall receive holiday pay based on policies for part-time employees as applicable.

Temporary/Intermittent Employees:

1. Temporary and/or intermittent employees normally shall not be scheduled to work holidays and shall not receive holiday pay.

2. A temporary and/or intermittent employee who is required to work on the day a holiday is observed by the Board of County Commissioners, shall receive holiday pay based on policies for part-time employees as applicable.
