PART TIME ENROLLMENT

The Board of Education recognizes that children excused from school attendance by the Superintendent of the Butler County Education Service Center and children enrolled in nonpublic schools are not the direct educational responsibility of the District. However, the Board believes public school programs are available to all residents of the community if they choose to participate. Therefore, the Board allows part-time enrollment and participation in school activities by children educated in nonpublic schools or at home in accordance with A.C. 3301-34-01 – 3301-34-06.

For purposes of this policy, “home educated” is education directed and delivered by the parent or guardian of a child who is of compulsory school age and not enrolled in a public or a nonpublic school; and “nonpublic school” is defined as a school (chartered or not chartered) that operates wholly or in major part outside the system of public schools operated through local, state, and federal public resources and under the Ohio Department of Education.

Prior to or at the time of part-time enrollment, the child and his/her parent(s) or guardian(s) shall be provided annually a copy of this policy with a copy of the current building student handbook.

The Superintendent shall promulgate administrative guidelines to provide definition and consistency for processes and procedures to be used in part-time enrollment of students.

Part-time Enrollment Procedures

The parent-guardian of the child requesting part-time enrollment must be a legal resident of the District, residing in the attendance zone of the school where part-time enrollment is requested or completing the requirements for requesting an alternate school of choice. If legal residence is not maintained, enrollment shall be terminated pursuant to R.C. 3313.64.

Part-time enrollment is permitted in Grades K-6 in a maximum of two (2) special subject areas. (art, vocal music, instrumental music, or physical education only).

Part-time enrollment is permitted in Grades 7-12 in a maximum of two (2) regularly scheduled or credit generating courses. For courses normally requiring a prerequisite (e.g., Spanish III or calculus), part-time enrolling students are asked to provide the most recent assessment report pertinent to the area in which enrollment is sought. Part-time enrolled may also be asked to take the District end-of-course assessment for the prerequisite course. Parents/guardians of children seeking part-time enrollment are responsible for prerequisite study and/or experiences. BOARD OF EDUCATION STUDENTS LAKOTA LOCAL SCHOOL DISTRICT 5111.03/page 2 of 4

Consideration for part-time enrollment is subject to the building capacity and class or program size and limitations. The final decision regarding admission and location of part-time enrolled students rests with the Superintendent or designee.

Part-time enrollment is allowed one (1) time each school year and is expected to be for the remainder of that school year. Attendance must begin within the first week of the school semester or program or within one (1) week of the date on which the child’s parent/guardian becomes a legal resident of the District.

Part-time enrollment is allowed without regard for the child’s status as home educated or enrolled in a nonpublic school, and the District assumes no responsibility for the education of the child enrolled part-time except for the courses in which the child is enrolled.

The child’s parent/guardian must complete the normal enrollment process and forms required by the District and/or the building for enrollment of all children. The parent/guardian shall provide written notice to withdraw a child from part-time enrollment. An exit interview with the parent/guardian may be requested upon withdrawal.

School Procedures

Grade level placement is at the discretion of the building principal and shall be based on:

A. age of the child;

B. recent assessment report, if provided;

C. results of standardized achievement tests, if provided, compared to District students of similar age;

D. interviews with the child or parent/guardian; and/or

E. other evaluative methods used with the consent of the parent/guardian to determine preparation and prerequisites for the courses or grade level requested.

The content of instruction provided in the District is determined by District curricula and courses of study approved by the Board and available for review at the Board office. BOARD OF EDUCATION STUDENTS LAKOTA LOCAL SCHOOL DISTRICT 5111.03/page 3 of 4

A part-time enrolled child is entitled to special education and related services under IDEA, classroom accommodation under Section 504 of the Rehabilitation Act, and/or District Intervention Assistance Team services subject to applicable eligibility requirements and parent consent for the areas in which the child is enrolled.

During classes or other school activities, children are under the direct supervision of a certificated staff member of the District.

Transportation of a child enrolled part-time is the responsibility and obligation of the parent/guardian. When the child’s schedule at school is compatible with established routes and schedules of the District’s bus transportation and space is available, the child may be permitted to use District transportation. Arrangements for transportation are to be made with the Executive Director of Business Operations.

Attendance for activities outside the regular school day that may be required for children enrolled in curricular programs or for activities during the regular school day that may be required for children participating in extracurricular programs shall be the responsibility of the child/parent/legal guardian.

The child enrolled part-time is subject to all policies of the Board (including those pertaining to enrollment, immunizations, grading, attendance, fees, conduct) and to all procedures (including those pertaining to medical emergency information, program eligibility, reporting absence, consequences imposed for discipline) of the school and the District. Attendance, ethnic, and performance data for each child enrolled in public schools in Ohio are collected for building, District, and State reports.

A child enrolled part-time is permitted to participate in all District-wide achievement testing programs during the regular testing cycle with the parent/guardian responsible for making arrangements for participation with the school.

A child enrolled part-time in grades 7-12 is required to take the Ohio achievement test(s) or Ohio Graduation Test(s) in the subject area(s) in which the student is enrolled.

To be eligible for a grade point average for class rank or for valedictorian or salutatorian honors, a student must enroll full-time in a Lakota high school for the last four (4) consecutive semesters, excluding summer school. Optional High School Credit for Home Education Courses

If desired by the parent/guardian, children enrolled part-time may receive high school credit for transferred courses completed under the direction of a home educator. To receive such transfer credit, the parent/guardian must provide an academic assessment report for each course for which credit is desired, including, but not limited to:

A. portfolio of work done;

B. examples of tests and test scores;

C. resources and books used in class;

D. samples of the student’s work;

E. standardized test scores demonstrating the student’s ability;

F. course of study;

G. the number of hours devoted to each subject area; and/or

H. grades from previous schools.

Four (4) weeks of advance notice is needed to review the academic assessment report.

Credits given for course work in Grades 9-12 completed under the direction of a home educator will be given a grade of P/F (Pass/Fail) and transcripts will denote home education grades and credits assigned.

Participation in Extracurricular Activities

Participation in an extracurricular activity is subject to Board Policy and District administrative regulations regarding eligibility and participation fee requirements, as well as requirements set forth in OHSAA by-laws. Students participating in interscholastic athletics must sign and abide by the Student Athletic Code of Conduct.

CARE OF STUDENTS WITH CHRONIC HEALTH CONDITIONS

Students with chronic health conditions will be provided with a free appropriate public education. If their impairment does not require specially designed instruction for them to benefit educationally, they will be eligible for accommodations/modifications/interventions of the regular classroom, curriculum, or activity (i.e. the school setting) so that they have the same access to an education as students without disabilities. Such accommodations/modifications/interventions will be provided pursuant to a Section 504 Plan (Form 2260.01 F13).

Chronic health conditions, for the purposes of this policy, shall include but are not limited to:

( )A. "peanut" and other food allergies;

( )B. allergies;

( )C. asthma;

( )D. diabetes;

( )E. ADD/ADHD. ______; and

( ) ______.

All information regarding student identification, health care management, and emergency care shall be safeguarded as personally identifiable information in accordance with Policy 8330 and Policy 8350.

The District will coordinate school health practices for management of a chronic health condition and shall provide for:

( )A. identification of individuals with chronic health conditions;

( )B. development of individual health care action plans;

( )C. coordination of health care management activities by school staff;

( )D. communication among school staff who interact with children with chronic health conditions;

( ) awareness and training of school staff regarding Board policy on acute and routine management of chronic health conditions, information on signs and treatment of chronic health conditions, medication and administration, and emergency protocols for dealing with reactions in "unusual" situations such as field trips;

School health practices shall provide students with chronic health conditions the opportunity for:

( )A. full participation in physical activities when students are well;

( )B. modified activities as indicated by the student's health care action plan, 504 plan, or Individualized Education Plan (IEP);

( )C. access to preventative medications before activity (as prescribed by their medical providers) and immediate access to emergency medications during activity;

( )D. communication regarding student health status between parents, physicians, teachers (particularly physical education teachers), and coaches;

( )E. prevention strategies to avoid causal elements.;

( ) case management for students with frequent school absences, school health office visits, emergency department visits, or hospitalizations due to chronic health conditions;

( ) management and care of the student's chronic health condition in the classroom, in any area of the school or school grounds, or at any school related activity or event;

Staff will be trained about chronic health conditions and their control

( ) at least annually in each school in which there is a student with a chronic health condition.

[ ] Designated staff who have responsibility for specialized services such as giving inhaler treatments or injections, or conducting glucose and/or ketone tests shall be provided training specific to the procedures, ( ) at least annually, by a licensed health professional.

GRADING

The Board of Education believes that the District’s grading system should be a reliable system that ensures each student’s grades accurately signify his/her degree of accomplishment of expected learning objectives. These objectives should be stated for every program, kindergarten through twelfth grade.

The Board directs the Superintendent to develop administrative guidelines and procedures for grading which:

A. provide clear, consistent criteria and standards applicable across the District;

B. provide frequent opportunities for students to obtain information about their progress toward meeting appropriate learning objectives;

C. provide that final grades are a reflection of multiple evaluation techniques and that no single activity is weighted so heavily to change an overall grade by more than one letter grade (advanced written notice of its possible impact shall be given within the first two weeks of the quarter);

D. shall ensure that academic grades are based solely on academic performance and not behavior, attitude, effort, or other factors;

E. shall allow limited extra credit for content-related activities which enrich and enhance the curriculum;

F. shall provide all students with the opportunity to complete the academic work associated with their coursework or program of student;

Suspensions, other disciplinary actions, and absences shall not eliminate this opportunity for any student. The concept of failure must be minimized if a student has made progress consistent with his/her ability.

The Superintendent shall set the minimum percentage that shall be awarded to all students who complete homework, tests, quizzes, etc. Zeros shall not be awarded except to students who fail to complete any of the above.

G. shall establish a clear and consistent scale of reductions that will be applied to late work across the District; BOARD OF EDUCATION STUDENTS LAKOTA LOCAL SCHOOL DISTRICT 5421/page 2 of 2

H. ensure that when no grades are given and the student is evaluated informally in terms of his/her own progress, the school staff provides a realistic appraisal of the student's standing in relation to his/her peer group when requested by the parents to do so;

I. establish consequences for plagiarism;

J. address expectations for grading group work;

K. ensure that poor or failing grades trigger a variety of instructional and intervention activities to assist the student in achieving better grades by the next grading period, if possible; and

L. shall be subject to continual review by staff, students and parents.

Establish Board Service Fund at $10,000 as authorized by ORC 3315.15 which provides for the setting aside from the General Fund a sum not to exceed two dollars per student or $20,000 whichever is greater to be used only in paying expenses of Board of Education members in the performance of their duties effective July 1, 2014 through June 30, 2015.

IV. Authorize members of the Board to attend workshops, seminars, and meetings for professional development, and to benefit the governance, academic or financial status of the district.

V. Authorize the superintendent, on behalf of this Board, to accept resignations which have been submitted by employees during times when this Board is not in session, subject to a follow-up ratification by this Board; provided however, that upon ratification by this Board, such resignations shall be deemed effective as of the date and time of the superintendent’s acceptance.

VI. Authorize the superintendent, during periods when this Board is not in session, to make offers of employment directly to candidates for either teaching or nonteaching positions on behalf of this Board, and to acknowledge acceptance of such offers on behalf of this Board, subject to a subsequent vote of ratification by this Board; provided however, that upon ratification by this Board, the employment shall be deemed effective as of the date and time of the employees acceptance of the superintendent’s offer.

VII. Adopt the following resolution to secure tax advances from Butler County:

WHEREAS, Ohio Revised Code Section 321.34 provides that the Board of Education of an Ohio public school district may request from the appropriate County Auditor advance payment of tax funds assessed and collected for and on behalf of such school district; and

WHEREAS, the aforesaid statute requires that such request be made by a formal resolution and that such advance payment of tax funds be paid to the treasurer of the school district;

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF EDUCATION OF THE LAKOTA LOCAL SCHOOL DISTRICT THAT:

Section 1: Pursuant to Ohio Revised Code Section 321.34, the Board of Education of the Lakota Local School District hereby requests that the Butler County Auditor advance to the treasurer of the Lakota Local School District taxes assessed in 2013 for and on behalf of the Lakota Local School District and collected in 2014.

VIII. Authorize the treasurer to pay bills as per appropriations, and to invest funds when possible.

ENTERPRISE ZONE COMPENSATION AGREEMENT

This Agreement is made between the BOARD OF EDUCATION OF THE LAKOTA LOCAL SCHOOL DISTRICT (“Board of Education”), a public school district with its principal offices at 5572 Princeton Road, Liberty Township, OH 45011 and CONTINGENT NETWORK SERVICES, LLC (“Company”), an Ohio limited liability company with its principal offices at 4400 Port Union Road, West Chester, OH 45011.

WHEREAS, the Ohio Enterprise Zone Program, pursuant to Ohio Revised Code §§5709.61 through 5709.69, authorizes municipalities and counties to grant real and/or personal property tax exemptions on eligible new investments; and

WHEREAS, West Chester Township, Butler County, Ohio (“Township”), and the Butler County Board of County Commissioners (“County”) have designated an Enterprise Zone pursuant to Ohio Revised Code §5709.61 et seq. within the boundaries of the County and the Township to encourage the development of real property and the acquisition of personal property located within the Enterprise Zone; and

WHEREAS, Company seeks to arrange for the construction of approximately 75,000 square feet of office space (the “Improvements”) at an estimated cost of $4,500,000 provided that appropriate development incentives are available, and Company has submitted an Enterprise Zone Application to the County pursuant to Ohio Revised Code §5709.63, which application requests a tax incentive for an abatement of 65% percent of the value of real property improvements for eight years pursuant to Ohio Revised Code §5709.63 (the “Abatement”); and

WHEREAS, as a pre-condition to the Township’s authorization of the Abatement, the Township requires the Company to enter into this Agreement to specify the manner and procedure to be used to compensate the Board of Education for a portion of real property tax revenue that it would otherwise lose as a result of the Abatement.

1 NOW, THEREFORE, in consideration of the foregoing and the mutual promises, covenants and agreements hereinafter set forth, the Board of Education and Company agree as follows:

1. Compensation. During each year of the Abatement in which Company receives a real property tax benefit pursuant to the Abatement, the Company shall pay to the Board of Education an amount equal to 50% of the amount the Board of Education would have otherwise received from real property tax revenue, but for the Abatement (“School District Compensation”).

1.1 Calculation of School District Compensation.

For all School District Compensation calculations made hereunder, the parties agree to use the abated valuation of the parcels that are subject to the Abatement as determined by the Butler County Auditor (the “Abated Valuation”). The Board of Education’s total commercial and industrial effective millage rate shall then be divided in half and applied to the Abated Valuation to arrive at the School District Compensation due to the Board of Education.

In determining the amount of School District Compensation required by the Company, it is expressly agreed and relied upon that the value of the abated property shall be the increase in value of the parcels from and after the date that the legislation granting the Abatement was adopted by the legislative authority regardless of the date on which the exemption from real property taxation is certified to the Butler County Auditor by the Tax Commissioner of the State of Ohio.

The obligation to make School District Compensation payments to the Board of Education is made for the benefit of the Board of Education. Company may not assign this Agreement without the written permission of the Board of Education, which shall not be unreasonably withheld. However, Company may assign this Agreement without the permission of the Board of Education if said assignment is to an affiliate, subsidiary or related entity of Company.

2 1.2 Estimated School District Compensation.

An estimated calculation, attached hereto as Exhibit A (“Formula”), has been prepared and agreed upon based on the information provided to the Board of Education by the Company and Township. Should there be material changes in the projected investment numbers in aggregate or project schedule, both parties will agree to revise this Agreement in accordance with the Formula, subject to changes in the variables as necessary. Property classification shall be determined in accordance with Ohio Revised Code Section 5701.02 & 5701.03. Company acknowledges and agrees that the annual amount of School District Compensation may vary depending upon effective millage rates over the term of this Agreement and the Valuation of the parcels subject to the Abatement.

2. Timing of Payments.

A. By January 31st of each year in which the Abatement is effective, the Company shall calculate and forward to the Board of Education’s Treasurer and the Board of Education’s legal counsel designated in Section 9 of this Agreement the amount of School District Compensation calculated by Company to be paid to the Board of Education for the preceding year under the terms of this Agreement. The Treasurer shall verify whether the Company’s calculation is accurate and, if so determined, shall notify the Company in writing within thirty (30) days of receipt of Company’s calculation. If the Treasurer notifies the Company that the Company’s calculation is accurate, the Company must pay the agreed upon amount of School District Compensation to the Board of Education by March 31st of each year. If the Treasurer notifies the Company that the Company’s calculation is believed to be inaccurate, the parties shall follow the Resolution of Disputes procedure in Section 3 of this Agreement.

B. Except for the case where a School District Compensation payment is delayed pursuant to a dispute as provided in Section 3 of this Agreement (so long as the dispute of the School District Compensation payment amount is reasonable), any late School District Compensation payments shall bear interest at the rate of six percent (6%) per annum.

3 3. Resolution of Disputes. In the event either party disputes the amount of the School District Compensation as calculated above, the disputing party shall certify in writing the basis for the dispute and the amount that the disputing party claims is the correct amount of School District Compensation to be paid to the Board of Education. Within ten (10) days thereafter, the Treasurer of the Board of Education and a designee of the Company shall meet to discuss and resolve the dispute. In the event the Treasurer of the Board of Education and the Company are unable to mutually agree on the amount of School District Compensation, the parties shall next mutually select an impartial arbitrator to settle the dispute and determine the amount of School District Compensation.

The cost of such arbitration shall be borne equally by the Board of Education and the Company in the event that they are able to mutually arrive at a settlement of such dispute. In the event that the parties are unable to arrive at a mutually acceptable settlement and the arbitrator is required to make a decision, the cost of such arbitration shall be borne by the losing party to such arbitration. The “losing party” shall be determined by comparing the amount of School District Compensation sought by each party to the amount of School District Compensation awarded by the arbitrator and the “losing party” shall be determined to be the party that has a greater difference between the amount of School District Compensation sought and the amount of School District Compensation awarded by the arbitrator.

The Company shall pay such agreed amount or determined amount within 30 days thereafter; provided that nothing contained in this Section 3 shall limit either the Board of Education’s or the Company’s ability, after payment and receipt of such School District Compensation amount, to seek recovery of amounts deemed overpaid or underpaid.

4. Enforcement. The obligation to make a School District Compensation payment to the Board of Education may be enforced directly against Company by the Board of Education without the requirement of involving or joining the County or West Chester Township in any legal action. Company shall also provide to the Board of Education a copy of any real property exemption form filed with the County Auditor

4 promptly following the filing thereof or within thirty (30) days of the effective date of this Agreement in the event that the exemption form has already been filed.

5. Valuation of Real Property. Nothing contained herein shall limit either party’s ability to challenge the Butler County Auditor’s Valuation of the parcels that are subject to the Abatement by filing a complaint and/or counter-complaint with the Butler County Board of Revision. Should the Valuation of the parcels that are subject to the Abatement be modified as a result of a challenge made hereunder, and all appeals have been exhausted, the parties agree to calculate the amount of refund or additional School District Compensation due for applicable prior tax years and make such refund or additional School District Compensation payments within thirty (30) days of the exhaustion of all appeals and legal proceedings.

6. Amendments. No amendments to this Agreement shall be effective unless it is contained in a written document, approved for legal process and signed on behalf of all parties hereto by duly authorized representatives.

7. Waiver. No waiver by the Board of Education of the performance of any terms and provisions hereof shall constitute, or be construed as, a waiver of performance of the same or any other term or provision hereof.

8. Entire Agreement. This Agreement sets forth the entire agreement and understanding between the parties as to this subject matter contained herein and merges and supersedes all prior discussions, agreements, undertakings of any kind and nature between the parties with respect to the subject matter of this Agreement.

9. Notices. All payments, certificates, reports and notices that are required and may be given pursuant to the provisions of this Agreement shall be sent by certified mail, postage prepaid, and shall be deemed to have been given and delivered when so mailed to the following addresses:

10. Severability of Provisions. The invalidity of any provision of this Agreement shall not affect the other provisions of this Agreement; this Agreement shall be construed in all respects as if any invalid portions were omitted.

11. Binding Authority. The individuals executing this Agreement on behalf of their respective organizations hereby verify that they have proper legal authority to bind said organizations as to the terms of this Agreement.

WHEREAS, the Ohio Enterprise Zone Program, pursuant to Ohio Revised Code §§5709.61 through 5709.69, authorizes municipalities and counties to grant real and/or personal property tax exemptions on eligible new investments; and

WHEREAS, West Chester Township, Butler County, Ohio (“Township”), and the Butler County Board of County Commissioners (“County”) have designated an Enterprise Zone pursuant to Ohio Revised Code §5709.61 et seq. within the boundaries of the County and the Township to encourage the development of real property and the acquisition of personal property located within the Enterprise Zone; and

WHEREAS, Company seeks to arrange for the construction of approximately 50,000 square feet of additional space at its existing headquarters and manufacturing facility (the “Improvements”) at an estimated cost of $2,100,000 provided that appropriate development incentives are available, and Company has submitted an Enterprise Zone Application to the County pursuant to Ohio Revised Code §5709.63, which application requests a tax incentive for an abatement of 55% percent of the value of real property improvements for seven years pursuant to Ohio Revised Code §5709.63 (the “Abatement”); and

WHEREAS, as a pre-condition to the Township’s authorization of the Abatement, the Township requires the Company to enter into this Agreement to specify the manner and procedure to be used to compensate the Board of Education for a portion of real property tax revenue that it would otherwise lose as a result of the Abatement.

The cost of such arbitration shall be borne equally by the Board of Education and the Company in the event that they are able to mutually arrive at a settlement of such dispute. In the event that the parties are unable to arrive at a mutually acceptable settlement and the arbitrator is required to make a decision, the cost of such arbitration shall be borne by the losing party to such arbitration. The “losing party” shall be determined by comparing the amount of School District Compensation sought by each party to the amount of School District Compensation awarded by the arbitrator and the “losing party” shall be determined to be the party that has a greater difference between the amount of School District Compensation sought and the amount of School District Compensation awarded by the arbitrator.

The Company shall pay such agreed amount or determined amount within 30 days thereafter; provided that nothing contained in this Section 3 shall limit either the Board of Education’s or the Company’s ability, after payment and receipt of such School District Compensation amount, to seek recovery of amounts deemed overpaid or underpaid.

4. Enforcement. The obligation to make a School District Compensation payment to the Board of Education may be enforced directly against Company by the Board of Education without the requirement of involving or joining the County or West Chester Township in any legal action. Company shall also provide to the Board of Education a copy of any real property exemption form filed with the County Auditor

4 promptly following the filing thereof or within thirty (30) days of the effective date of this Agreement in the event that the exemption form has already been filed.

5. Valuation of Real Property. Nothing contained herein shall limit either party’s ability to challenge the Butler County Auditor’s Valuation of the parcels that are subject to the Abatement by filing a complaint and/or counter-complaint with the Butler County Board of Revision. Should the Valuation of the parcels that are subject to the Abatement be modified as a result of a challenge made hereunder, and all appeals have been exhausted, the parties agree to calculate the amount of refund or additional School District Compensation due for applicable prior tax years and make such refund or additional School District Compensation payments within thirty (30) days of the exhaustion of all appeals and legal proceedings.

6. Amendments. No amendments to this Agreement shall be effective unless it is contained in a written document, approved for legal process and signed on behalf of all parties hereto by duly authorized representatives.

7. Waiver. No waiver by the Board of Education of the performance of any terms and provisions hereof shall constitute, or be construed as, a waiver of performance of the same or any other term or provision hereof.

8. Entire Agreement. This Agreement sets forth the entire agreement and understanding between the parties as to this subject matter contained herein and merges and supersedes all prior discussions, agreements, undertakings of any kind and nature between the parties with respect to the subject matter of this Agreement.

9. Notices. All payments, certificates, reports and notices that are required and may be given pursuant to the provisions of this Agreement shall be sent by certified mail, postage prepaid, and shall be deemed to have been given and delivered when so mailed to the following addresses:

10. Severability of Provisions. The invalidity of any provision of this Agreement shall not affect the other provisions of this Agreement; this Agreement shall be construed in all respects as if any invalid portions were omitted.

11. Binding Authority. The individuals executing this Agreement on behalf of their respective organizations hereby verify that they have proper legal authority to bind said organizations as to the terms of this Agreement.

RESOLUTION APPROVING ENTERPRISE ZONE COMPENSATION AGREEMENTS

WHEREAS, West Chester Township (the “Township”) and the Butler County Board of Commissioners (the “County”) have entered into an Enterprise Zone Agreement with Systecon, Inc. (“Systecon”) concerning the construction of approximately 50,000 square feet of additional space at Systecon’s existing headquarters and manufacturing facility located at 6121 Schumacher Park Drive, West Chester, Ohio 45069 at an estimated cost of $2,100,000; and

WHEREAS, the Township and County Enterprise Zone Agreement with Systecon exempts 55% percent of the value of real property improvements for seven years pursuant to Ohio Revised Code §5709.63; and

WHEREAS, the Township and the County have also entered into an Enterprise Zone Agreement with Contingent Network Services, LLC (“Contingent”) concerning the construction of approximately 75,000 square feet of office space at Contingent’s facility located at 4400 Port Union Road, West Chester, Ohio 45011 at an estimated cost of $4,500,000; and

WHEREAS, the Township and County Enterprise Zone Agreement with Contingent exempts 65% percent of the value of real property improvements for eight years pursuant to Ohio Revised Code §5709.63; and

WHEREAS, the Township and County award of the aforementioned exemptions is contingent upon Systecon and Contingent entering into a compensation agreement with the Board of Education for a portion of real property tax revenue that the Board of Education would otherwise lose as a result of the exemptions.

NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Lakota Local School District, County of Butler, Ohio:

SECTION 1. The Board hereby approves the Enterprise Zone Compensation Agreement with Systecon attached hereto and incorporated herein as Exhibit A or a modified agreement that is in substantially similar form to the Enterprise Zone Compensation Agreement attached hereto and incorporated herein as Exhibit A that is acceptable to the Board’s Treasurer and legal counsel.

SECTION 2. The Board hereby approves the Enterprise Zone Compensation Agreement with Contingent attached hereto and incorporated herein as Exhibit B or a modified agreement that is in substantially similar form to the Enterprise Zone Compensation Agreement attached hereto and incorporated herein as Exhibit B that is acceptable to the Board’s Treasurer and legal counsel.

SECTION 3. Upon the finalization of the Agreements attached hereto as Exhibits A & B (or modified Agreements in substantially similar form), said Agreements shall be executed by the Board President and Treasurer.

The aforementioned announcements shall be made as one whole project or as two separate projects as determined by the Chief Operations Officer.

4.
