Return has been filed by the respondents/State stating inter-alia 2 that since criminal case has been registered against the petitioner on 29.11.2012 for offence punishable under Section 420, 468 and 471/34 of the IPC, therefore, he is not entitled for gratuity in view of the provisions contained in Section 64(2) of the Chhattisgarh Civil Services (Pension) Rules, 1976 (hereinafter called as 'the Rules of 1976') and he would be entitled for gratuity only upon conclusion of the trial and prayed for dismissal of the writ petition.
