Živimo v času, v katerem je skrb za izključevalne prakse, naj se te gibljejo na ravni spola, naroda, religije, kulture itd., posebej poudarjena. Ker je vsaka opredelitev nekega pojava neizogibno njegova (iz)ločitev od dru- gih – omnis determinatio es negatio –, je razumljivo, da smo na razprave o velikih značilnostih nekega duhovnega izročila gledali z nezaupanjem. Če temu dodamo še nelagodje ob kolonialni zgodovini ločevanja med civiliziranim belcem in črnim divjakom, je razpravljanje o tem, kaj tvori evropsko »civilizacijo«, preprosto moralo pristati na stranskem tiru. Toda ta vprašanja vseeno niso mogla popolnoma obmolkniti. Evrop- ska unija si je eksplicitno zastavila cilj, da bo kot politična tvorba pre- segala ekonomsko logiko povezovanja med državami, zato je zaprisegla nizu najvišjih humanističnih vrednot, ki naj bi jih imela v svojem teme- lju. Toda tudi na tej ravni razprava ni imela sreče. V poskusu snovanja evropske ustave pred desetletjem se je poudarilo nekaj označevalcev, ki bi jih lahko v preambuli navedli kot najširši okvir evropske identitete: grška filozofija, rimsko pravo, krščanstvo, razsvetljenstvo. Seznam je bil pravzaprav odprt, Slavoj Žižek je, na primer, predlagal tudi omembo kulture ateizma, kar je gotovo upravičeno. Toda tovrstne diskusije je vselej spremljal pomislek, da so izključevalne do priseljencev. In prav priseljenci so zdaj opravili delo namesto nas. V begunski krizi, ki je eskalirala leta 2015, je jasno sporočilo: ko ljudje iz zelo raz- ličnih dežel za kraj, v katerem bi radi izpolnili svoje življenje, izberejo prav Evropo, tacite izrekajo, da evropska identiteta vendarle obstaja. In da je ta nekaj posebnega. Hkrati priseljenci dodatno ustvarjajo kontrast med našo identiteto in drugimi, o čemer priča potreba po t. i. tečajih o evropski kulturi, ki jih oblasti organizirajo za uspešno integracijo in izogibanje konfliktom. Dejstvo je, da evropska kulturna identiteta obstaja in da se ta raz- likuje od drugih. Tega vprašanja ni mogoče več potiskati na stran, ker ima lahko teoretična zadržanost do te tematike nepopravljive posledice. 3 POLIGRAFI Čas je, da se teh vprašanj lotimo brez slabe vesti. Še posebej moramo biti pogumni pri ponovni vpeljavi religije v središče teh razprav. V tej številki Poligrafov je dvanajst prispevkov, v katerih avtorji k nakazani problematiki pristopajo s treh različnih vidikov. Prvi sklop prinaša refleksijo vloge religije pri opredelitvi evropske identitete. Zastavljeno je vprašanje statusa religioznosti v dobi, ki jo za- znamuje niz velikih premikov, vse od sekularizma do t. i. enajstega sep- tembra in njegovih posledic. Prvi prispevek v sklopu teh razmišljanj je napisal Igor Škamperle. V njem obravnava genezo štirih idejno-duhov- nih sestavin: antična grško-rimska civilizacija, judovsko in krščansko religiozno izročilo ter novoveški duhovnozgodovinski rez z vpeljavo su- bjektivizma in romantična subjektiviteta so tisti konstitutivni elemen- ti, ki so s svojim vplivom temeljno zaznamovali duhovni in družbeni prostor evropskega človeka, hkrati pa privedli tudi do skrajnih oblik in protislovja. Igor Bahovec se v prispevku osredotoča na vprašanje evropske in/ ali sekularne krščanske identitete. Zanima ga, kako je mogoče razume- ti spremembe globinske substance kulture in duhovne utemeljenosti Evrope, predvsem pa želi poudariti temeljne izzive, ki se glede evrop- skih identitet kažejo danes, in kakšni so ustvarjalni potenciali različnih družbeno-kulturnih usmeritev. Anton Mlinar obravnava vprašanje religioznosti prek pojava jezika. Razpravo uvede skozi pesniško izkušnjo Edvarda Kocbeka in jo nada- ljuje do spoznanja tistega, kar imenuje »neverjetna potreba po vero- vanju«. Gre za nekonfesionalno držo do sveta in svoje eksistence, ki poteka v notranji dinamiki jezika. To potrjujejo tudi izjemno obsežne reference na številna literarna dela. Petra Dekleva na podlagi vprašanja statusa religije in religioznosti v sodobni Evropi navede razloge za opredeljevanje tega, kaj v resnici tvori našo družbo kot evropsko. V želji po samoiskanju, samoopredeljevanju in iskanju tistih distinktivnih potez, ki opredeljujejo evropsko (tudi) religijsko identiteto, je po njenem mnenju nujno treba spregovoriti o tem, na kakšen način je, tudi na podlagi procesov sekularizacije, religi- ozen sodoben Evropejec. 4 UVODNA BESEDA - EVROPSKA IDENTITETA Drugi sklop je posvečen zgodovinskemu vidiku religije, kolikor ta prispeva k oblikovanju identitete Evrope, od krščanskih paradigem do interakciji Evrope z islamskim izročilom. Anja Zalta je prepričana, da evropske (religijske) sodobnosti ne mo- remo misliti brez heretičnega imperativa in padca gotovostnih struktur, kar je posledica dolgotrajnih in trdoživih procesov, ki so se začeli že veliko pred sodobnimi procesi sekularizacije. Zgodovinska dinamika odnosa med herezijo in ortodoksijo je po njenem mnenju pripomogla k rahljanju obstoječega epistemološkega okvira, hkrati pa je, parado- ksalno, prispevala k oblikovanju in utrjevanju krščanske (večinoma ka- toliške) monoteistične paradigme, ki zaznamuje evropsko kulturno in religijsko zgodovino. The case of the Slovene painter France Mihelič (1907– 1998) illustrates how important personal experience was in the transformation from realism to modernism as well as how crucial it was for a talented artist to be acquainted with contemporary trends in the main Western European art centres. After WW II, most Slovene artists travelled to Paris in order to advance creatively, yet France Mihelič’s stay in the French city (1950) stands out. Mihelič is an acknowledged representative of fantastic art who reached his artistic peak in the 1950s when he exhibited and received awards at key art events in Europe and South America.

The scholars, who were later gathered under the label Scandinavian Legal Realism, did not represent a static theoretical position that remained unchanged from the 1910s to the 1950s; rather, their aims and ambitions varied with changing political and philosophical circumstances. The purpose of this article is to propose a distinction between two generations of Scandinavian Legal Realists. While the goal of the first generation (Vilhelm Lundstedt and Karl Olivecrona) fell little short of revolutionising the field of jurisprudence, transforming law into a vehicle for political and social reform, one of the main objectives of the second generation (Alf Ross and Ingemar Hedenius) was to take the edge off the radicalism of their predecessors.     ME, MYSELF & MINE The Scope of Ownership _________________________________ PETER MARTIN JAWORSKI _________________________________ May, 2012 Committee: Fred Miller (Chair) David Shoemaker, Steven Wall, Daniel Jacobson, Neil Englehart ii ABSTRACT This dissertation is an attempt to defend the following thesis: The scope of legitimate ownership claims is much more narrow than what Lockean liberals have traditionally thought. Firstly, it is more narrow with respect to the particular claims that are justified by Locke’s labour- mixing argument. It is more difficult to come to own things in the first place. Secondly, it is more narrow with respect to the kinds of things that are open to the ownership relation. Some things, like persons and, maybe, cultural artifacts, are not open to the ownership relation but are, rather, fit objects for the guardianship, in the case of the former, and stewardship, in the case of the latter, relationship. To own, rather than merely have a property in, some object requires the liberty to smash, sell, or let spoil the object owned. Finally, the scope of ownership claims appear to be restricted over time. We can lose our claims in virtue of a change in us, a change that makes it the case that we are no longer responsible for some past action, like the morally interesting action required for justifying ownership claims. iii ACKNOWLEDGEMENTS: Much of this work has benefited from too many people to list. BIX1 Introduction The Scandinavian legal realists, critically-inclined theorists from Denmark, Norway, and Sweden, who wrote in the early and middle decades of the 20t century,2 are not as widely read as they once were in Britain, and they seemed never to have received much attention in the United States. This is unfortunate, as the work of those theorists, at their best, is as sharp in its criticisms and as sophisticated philosophically as anything written by the better known (at least better known in Britain and the United States) American legal realists, who were writing at roughly the same time. The focus of the present article, Alf Ross and Karl Olivecrona, were arguably the most accessible of the Scandinavian legal realists, with their clear prose, straight- forward style of argumentation, and the availability of a number of works in English.

Zahvaljujem se družini, sorodnikom, prijateljem in znancem za vso podporo ob mojem študiju. Na koncu pa se zahvaljujem Katji, ki me je vedno spodbujala in na koncu pregledala nalogo. Prispevek kulturnega in civilnodružbenega segmenta k uvedbi demokracije in neodvisnosti Slovenije V svoji diplomski nalogi sem obravnaval kulturna in civilna družbena gibanja v socialistični Jugoslaviji, ki so se borila za samostojno in demokratično Slovenijo. Največ pozornosti bom posvetil posameznikom in organizacijam, ki so se borili za samostojno Slovenijo. V začetku svoje naloge bom izpostavil delovanje Jožeta Pučnika. V 70-ih letih se mu je pridružil Edvard Kocbek s svojim prelomnim intervjujem z Borisom Pahorjem leta 1975. Moja raziskovalna naloga pa bo najbolj osredotočena v 80. leta prejšnjega stoletja. Osemdeseta je odprla alternativna glasba, ki je prebudila bodočo uporno generacijo. Svoje so dodali Pankrti in ostali pankovske skupine ter Laibach. Takrat je nastal vrhunec civilno družbene sfere, ko sta vzleteli osvobojena Zveza socialistične mladine Slovenije in Odbor za varstvo človekovih pravic, ki velja za največjo civilno družbeno organizacijo v Sloveniji, ki je zadala odločilni in končni udarec takratni vladajoči oblasti, ko se je zavzemala za osvoboditev zapornikov Janeza Janše, Ivana Borštnerja, David Tasić in Francija Zavrla.

THE CASE FOR A KANTIAN RIGHT OF PUBLICITY ALICE HAEMMERLI† ABSTRACT Rapidly developing technological opportunities for unauthorized uses of identity—from “virtual kidnapping” to digitalcasting—coin- cide with growing demand for a preemptive federal right of publicity that can replace the existing welter of inconsistent state laws. Progress is impeded, however, by intractable doctrinal confusion and academic hostility to the right as allegedly inimical to society’s cultural need to manipulate celebrity images. Because the right of publicity is tradi- tionally based on Lockean labor theory and analogized to intellectual property in created works, it is vulnerable to such attacks; to date, no serious attempt has been made to elaborate an alternative philosophi- cal justification that can withstand them. In this Article, Dean Haemmerli uses Kantian philosophy to justify an autonomy-based right of publicity. In doing so, she challenges both the traditional approach to the right of publicity and its postmodernist critiques. First, the Article’s proposed reconception of the right of publicity rejects the existing doctrinal bifurcation of publicity and pri- vacy rights and explicitly embraces both the economic and moral fac- ets of the individual’s need to control the use of his identity.     On Law, Power and Society: A View of a Moral Dialectic1 Thora Margareta Bertilsson ‘...a primary social order undergoes, on the one hand, an externalization and institutionalization process whereby the law merges as an explicit ordering system, while at the same time a parallel process of internalization and spiritualization occurs, the result of which is called morality. Consequently then, law and morality must be regarded as conceptual opposites which in the course of linear development draw further and further apart. Morality is founded on internal obligation, law on external. Morality is what I feel obligated to do; law is what the state obligates me to do.’ (Geiger 1969: 117 - 118) This occasion seems to invite a reconsideration of what Theodor Geiger (1891 - 1952) wrote as a response to the very vivid ‘realist movement’ in law and philosophy which he experienced in Scandinavia at the time of his arrival and the preceding years of his stay.2 The bifurcation of traditional moral life into, on the one hand, a militant scientism in the legal and subsequent social sciences (to be formed), and, on the other hand, a forceful featuring of the inner and often chaotic emotional life of modern men and women as depicted in drama and in art actually seem to characterize the Scandinavian mentalities evolving in the late 19th and 20th century (Geiger 1946). In such a way, the featuring of Scandinavian moral life fits the scheme which Alasdair Macintyre proposes in his bestseller After Virtue, A Study in Moral Theory (1981). The making of the modern welfare state in Scandinavia demanded the externalization of the legal language from its traditional anchorage in moral values and the subsequent internalization/subjectivation of the value-language found in great Scandinavian literature.

The analysis focuses on the works of both Slovenian professional and amateur historiographical production, that address historic developments which took place during the Second World War and in its immediate aftermath from the perspective of the post-war withdrawal of the members of various military units (and their families) that collaborated with the occupiers during the Second World War.     TOWARDS A GENERAL MANY-SORTED FRAMEWORK FOR DESCRIBING CERTAIN KINDS OF LEGAL STATUTES WITH A POTENTIAL COMPUTATIONAL REALIZATION Danny A. J. Gómez-Ramírez1 and Egil Nordqvist2 ABSTRACT Examining a 20th-century Scandinavian legal theoretical tradition, we can extract an ontological naturalistic, a logical empiristic, and a modern idealistic rationale. We introduce the mathematical syntactic figure present in the “logical empiricism” in a contemporary mathematical logic. A new formal framework for describing explicit purchase statutes (Sweden) is gradually developed and subsequently proposed. This new framework is based on a many-sorted first-order logic (MFOL) approach, where the semantics are grounded in concrete “physical” objects and situations with a legal relevance. Specifically, we present a concrete formal syntactic translation of one of the central statutes of Swedish legislation for the purchase of immovable property. Additionally, we discuss the potential implications that a subsequent development of such formalisations would have for constructing artificial agents (e.g., software) that can be used as “co-creative” legal assistance for solving highly complex legal issues concerning the transfer of property, among others.
