(“PenAir”) on five mainline routes in rural Alaska pursuant to 39 U.S.C. § 5402(g)(5)(c) (“§ 5402(g)(5)(C)”). This equitable tender is now being challenged by three mainline carriers – Northern Air Cargo (“NAC”), Tatonduk Outfitters Ltd d/b/a Everts Air Cargo (“Everts”), and Lynden Air Cargo LLC (“Lynden”) (collectively, “plaintiffs”). Specifically, plaintiffs challenge the Postal Service’s purportedly ultra vires determination that PenAir had satisfied the “Prior Service and Capacity Requirement” of 39 U.S.C. § 5402(g)(1)(A)(iv)(II) (“§ 5402(g)(1)(A)(iv)(II)”) as of Case 1:10-cv-02076-EGS Document 35 Filed 06/10/11 Page 2 of 25 December 3, 2010.1 Plaintiffs seek both declaratory and injunctive relief. See generally Compl. Pending before the Court is plaintiffs’ motion for summary judgment, as well as the cross-motions for summary judgment filed by Defendant Postal Service and Defendant-Intervenor PenAir (collectively, “defendants”).     National Transportation Safety Board Aviation Accident Final Report Location: Kodiak, AK Accident Number: ANC10LA025 Date & Time: 03/15/2010, 1230 AKD Registration: N663SA Aircraft: BRITTEN-NORMAN BN-2A-21 Aircraft Damage: Substantial Defining Event: Loss of control in flight Injuries: 2 Serious, 1 Minor Flight Conducted Under: Part 135: Air Taxi & Commuter - Scheduled Analysis The airline transport pilot was taking off on a passenger flight under Title 14, CFR Part 135, when the accident occurred. He reported that during takeoff the wind was reported from 290- 300 degrees, at 15 knots, gusting to 27 knots. He chose to make an intersection takeoff on runway 25 at its intersection with runway 29, rather than use the full length of runway 29. He said his airspeed did not develop as quickly as he had anticipated, and that with his airspeed lagging and poor climb performance, he realized the airplane was not going to clear the ridge at the end of the runway. He said he initiated a right descending turn to maintain his airspeed, but impacted trees alongside the runway. He reported that the airplane sustained substantial damage to the wings and fuselage when it impacted trees. He said there were no mechanical problems with the airplane prior to the accident. Probable Cause and Findings The National Transportation Safety Board determines the probable cause(s) of this accident to be: The pilot's failure to maintain clearance from rising terrain during takeoff resulting in collision with trees. Using data collected from the U.S. Bureau of Transportation Statistics, we analyze 110 different aircraft types from 145 airlines operating U.S. commercial domestic service between 1991 and 2010. We classify the aircraft analyzed into four categories: turboprop, regional jet, narrow-body, and wide-body.

Safety issues have been at the forefront, and as such, this year has stretched our bounds to make our industry even safer. The Regional Airline Association (RAA) plays a key role in the success of the industry. Over the past decade, the RAA has helped its 32 regional airlines form a seamless operation with their major partners, and the organization has played an integral role in our nation’s air system. Right now, more than 51 percent of daily flights are conducted by regional airlines, and we carry approximately one-quarter of our nation’s passengers. Without our service, 77 percent of US communities would cease to have any 2008-2009 air service at all. We have become a significant, and essential contributor to the airline industry and Board of Directors to the overall American economy. We employ some 60,000 professionals, and we greatly value their contribution to the regional airline industry. Chairman Scheduled passenger service has evolved to where regional and mainline airlines operate seamlessly to Rick Leach benefit the traveling public.
