1. Section 5-11-101, MCA, provides that if ". . . a legislator is or would be a member of the Legislative Council by virtue of a legislative leadership position and the legislator will not serve in the following legislative session because of term limits, the legislator may designate another member of the same house and the same political party to serve on the legislative council in the legislator's place."

2. If there is a vacancy on the committee at the beginning of a legislative session because a member's term of office as a legislator has ended, a member of the same political party must be appointed in the same manner as the original appointment, no later than the 10th legislative day, to serve until a successor is appointed . (This provision applies to the Environmental Quality Council, Legislative Audit Committee, Legislative Consumer Committee, and Legislative Finance Committee.)

3. Vacancies for public members of the Environmental Quality Council are subject to the a notice requirement by 5-16-104, MCA: When a vacancy on the Environmental Quality Council of a public member appointed under 5-16-103(3), MCA, has occurred or is expected to occur, the appointing authority shall have posted in a conspicuous place in the state capitol a notice announcing the actual or anticipated vacancy and describing the procedure for applying for appointment. A copy of the required notice must be sent to the Lieutenant Governor, who may publish the notice in an appropriate publication.

4. Under 5-15-102, MCA, a person who is an employee, agent, officer, partner, or director of any regulated company or who has served a regulated company in any capacity within the 3 years previous to his or her appointment may not be a member of the committee.

5. Under 5-1-101, MCA, the commission of five citizens must be appointed in the session. Legislators select the first four members and those for must select a fifth member within 20 days or turn the process over to the Supreme Court. The Supreme Court is not under a time deadline.

6. Appointments must be in the order indicated. See letter from Susan Fox and Robert Person to the appointing authorities dated January 29, 1999, for more details.

7. Section 5-5-211 requires that membership be provided for by legislative rules. (See Joint Rule 30-70.) The appointing authority shall attempt to select not less than half the members from the designated standing committees. Appointing authorities are to take into account term limits of members. No legislator may serve on more than one interim committee unless no other legislator is available and willing to serve.

8. Other members include the Executive Director of the Legislative Services Division, Legislative Auditor, and Legislative Fiscal Analyst. It has been customary for House and Senate representatives to include at least one of the staff members listed and one legislator who has an active interest in the application of information technology in the legislative branch to serve.

9. The members must live in the state, but there is no requirement legislative appointments be legislators.

10. Each Gaming Advisory Council member serves a 3-year term. A legislator serves for 3 years or until his or her term as a legislator ends, whichever occurs first.

11. Reviewed for appointments and civil office 2/08 (legislators may not serve in a civil office).
