THIS DEPOSIT WILL BE REFUNDED IN FULL IF THE AUCTIONEERS RECEIVE WITHIN 3 MONTHS a Bill of Loading or Certificate of Shipment from the Shipping or Transport Company showing the date, place & vessel involved as proof of shipment for HM Customs & Excise. The Auctioneers will use every endeavour to ensure that all lots catalogued are presented for Sale but cannot accept responsibility for any lots not presented, nor can they entertain any claims for expenses incurred in abortive attendance at the Sale. 11. CLEARANCE OF GOODS FROM THE SALE GROUND. Purchasers are requested to ensure that they collect their Delivery Tickets from the Auctioneers Sales Office on Site. If you are sending a representative to collect your goods, he must bring the Delivery Ticket with him, this being his only authority for obtaining lots purchased. Purchasers are reminded that all purchases are their responsibility at the fall of the hammer and are requested to clear their goods promptly from the Sale Ground and in any event by WEDNESDAY 1st MARCH 2017. The Sale Ground will be open for this purpose on Saturday and Sunday following the sale between 9 am and 12 noon ONLY. Any items left after this date will be removed at no expense to the Auctioneers or their Vendors. GOODS ARE LEFT ON THE SALE GROUND ENTIRELY AT OWNERS RISK. 12. PRIVATE SALES after Auction must be booked through the Auctioneers Sales Office, delivery cannot otherwise be obtained. 13. Any item in the sale marked with a lot number followed by an ‘X’ denotes that the description differs from the original entry in the catalogue. This lot may be a replacement of the original or an alteration of the description, therefore any items marked in this way must not be connected with the original lot number in the Catalogue and ITS DESCRIPTION WILL BE ABSOLUTELY AS GIVEN OUT BY THE AUCTIONEER AT THE TIME OF SALE. The addition of an ‘X’ to a lot no will cancel the original entry in the Sale Catalogue. 14. FARM SAFETY REGULATIONS. The attention of Purchasers of Agricultural Tractors & Machinery is drawn to the provisions of the Health & Safety at Work Act 1974, the Agricultural (Field Machinery) Regs 1962, Agricultural (Tractor Cabs) Regs 1974 and other Acts & Regulations applicable to Farm Safety. Purchasers are reminded of the provision of the above Acts & Regulations regarding the safety of guarding of machinery & implements and that some of the machinery sold at this Sale may not immediately comply with the Regs. It is an offence to use or permit to be used any machinery which does not comply with the Regs laid down in the Acts & Regulations and accordingly it is a Condition of the Contract of Sale that Purchasers shall undertake to comply with Acts & Regulations relating to such Machines & Implements as he/they shall purchase before use of the same. 15. WARRANTY. All lots are sold as seen except where specifically warranted as in working order (wo) or as good working order (gwo). Any warranty claims must be made to the Auctioneers by 9 am WEDNESDAY 1st MARCH 2017 in writing only, otherwise they will not be considered and in any case the lot/s in question must be paid for in full on Sale Day and remain the property of the Purchaser. This condition will be strictly adhered to. 16. AUCTIONEERS RIGHT TO ANNUL SALES. In the event of any dispute or refusal to pay, or non payment on the part of the purchaser, the Auctioneers may entirely at their discretion annul and cancel the sale of such lot(s). 17. THIS SALE IS CONDUCTED ON A ‘PAY ON THE DAY’ BASIS AND ALL ACCOUNTS MUST BE PAID FOR IN FULL AND IN STERLING ON SALE DAY. STRICTLY NO CREDIT WILL BE ALLOWED. 18.
