The proposed work, as approved, consists of installing 11' 6" high rooftop cooling towers, that will be visible from West 86th Street only, on 3' 6" dunnage, near the eastern (courtyard) side of the western section of the roof; and installing 11' 6" high rooftop cooling towers, that will not be visible from any public thoroughfare, on 3' 6" dunnage at the southern section of the roof. The proposal, as initially presented to the Commission and shown on photo montages and drawings labeled 1 through 12, dated September, 2004, and prepared by Avinash K. Malhotra Architects, included rooftop cooling towers, more visible from public thoroughfares and seen from more vantage points than those finally approved, including 11' 6" high cooling towers, on 4' dunnage, at the center of the western and eastern sections of the roof. The approved work was shown on presentation boards consisting of photo montages and drawings, labeled 1 through 7, dated February, 2004, prepared by Avinash K. Malhotra Architects and presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission noted that the designation report describes the Belnord Apartments as an Italian Renaissance style apartment building, with a central courtyard, designed by Hiss and Weekes and built in 1908-1909; and that Certificate of No Effect 99-1623 (LPC 99-1174) was issued September 18, 1998 for installing rooftop cooling towers at the northern section of the roof; that Miscellaneous/Amendements 99-2659 (LPC 99-2835) was issued November 13, 1998 for increasing the size of a proposed cooling tower and installing an additional cooling tower at the northern section of the roof; and that Warning Letters 05-0124, 05-0125, 05-0126 and 05-0127 were issued September 29, 2004 for the "installation of fixed awning ("Club Monaco") at northernmost Broadway shopfront without permit(s)," the "replacement of second and third northernmost shopfronts in noncompliance with Certificate of Appropriateness 96-0084 (LPC 96-2389) issued the 9th of June, 1998," the "installation of Broadway entrance surround in noncompliance with Certificate of Appropriateness 96-0084 (LPC 96-2389) issued the 9th of June, 1998" and the "alterations to northernmost Amsterdam Avenue storefront, including three bays on the West 87th Street elevation and two bays of the Amsterdam Avenue elevation in noncompliance with Certificate of Appropriateness 96-0084 (LPC 96-2389) issued the 9th of June, 1998" respectively. With regard to this proposal, the Commission finds that the installation of the proposed cooling towers will not alter or destroy any significant features of the building; that the proposed towers, set back from the building's primary facades and only partially visible from a limited number of vantage points along West 86th Street, between Broadway and West End Avenue, will not overwhelm the building or detract from the significant features of the facades; that the proposed towers will only be seen within the context of a partial view of the Broadway facade, therefore, they will not significantly diminish the building's silhouette; and that the presence of the towers will not diminish the special architectural and historic character of this individual landmark. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two sets of signed and sealed Department of Building filing drawings showing the approved design. Subsequently, on February 28, 2005, the Landmarks Preservation Commission received final drawings 1, 2, 3, 4, 5, 6, 7, L102, L103 and L104, dated received February 28, 2005 and prepared by Avinash K. Malhotra, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 05-5890 is being issued. Warning Letters 05-0124, 05-0125, 05-0126 and 05-0127 remain in effect and are not addressed by this application. Failure to address these conditions may result in the issuance of Notices of Violation originating from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to Bernadette Artus.
