    AUSTRALIA AND THE PACIFIC: THE AMBIVALENT PLACE OF PACIFIC PEOPLES WITHIN CONTEMPORARY AUSTRALIA Scott William Mackay, BA (Hons), BSc July 2018 Submitted in total fulfilment of the requirements for the degree of Doctor of Philosophy Australian Indigenous Studies Program School of Culture and Communication The University of Melbourne 0000-0002-5889 – Abstract – My thesis examines the places (real and symbolic) accorded to Pacific peoples within the historical production of an Australian nation and in the imaginary of Australian nationalism. It demonstrates how these places reflect and inform the ways in which Australia engages with the Pacific region, and the extent to which Australia considers itself a part of or apart from the Pacific. While acknowledging the important historical and contemporary differences between the New Zealand and Australian contexts, I deploy theoretical concepts and methods developed within the established field of New Zealand- centred Pacific Studies to identify and analyse what is occurring in the much less studied Australian-Pacific context. In contrast to official Australian discourse, the experiences of Pacific people in Australia are differentiated from those of other migrant communities because of: first, Australia’s colonial and neo-colonial histories of control over Pacific land and people; and second, Pacific peoples' important and unique kinships with Aboriginal Australians. Crucially the thesis emphasises the significant diversity (both cultural and national) of the Pacific experience in Australia. My argument is advanced first by a historicisation of Australia’s formal engagements with Pacific people, detailing intersecting narratives of their migration to Australia and Australia’s colonial and neo- colonial engagements within the Pacific region.

    RUGBY LEAGUE AND THE LAW CHRIS DAVIES* Abstract Rugby league has been played in Australia for over a hundred years. While some cases originate from when the sport was semi-professional, the rise of professional leagues over the last two decades has also seen an increase in the involvement of the law. It is suggested that rugby league has been involved in more litigation than any other sport in Australia, with there being legal cases in areas such as competition law, restraint of trade, torts, criminal law and copyright. It is also suggested that some of these cases could have been avoided with better governance and administration. The draft system once implemented by rugby league, for example, was poorly designed and inevitably successfully challenged. However, other cases could have happened in a number of other sports and, at other times, other sports were actually involved in the litigation. Thus, there are a number of reasons why rugby league has experienced more litigation than other Australian sports. I INTRODUCTION The North Queensland Cowboys’ win in the 2015 National Rugby League (NRL) Grand Final was the culmination of over twenty years participation in a national competition, and represented the club’s first ever premiership. For South Sydney, meanwhile, the 2014 Premiership was its first in over forty years, the length of time this represented being indicated by the fact its previous premiership, in 1971, had been won in a competition organised by the New South Wales Rugby League (NSWLR).     i Unions, Leagues and Franchises: The Social Organisation of Rugby Union in New Zealand ________________________________________ A thesis submitted for the degree of Doctor of Philosophy in Sociology at the University of Canterbury By Camilla Obel _________________________________________ University of Canterbury 2001 ii Til min mor og Matthew i ABSTRACT The amateur game of rugby union is analysed by focussing upon the struggles for control between national and local unions and players. Using historical material and interviews with administrators, current players in the New Zealand national team, the All Blacks, and Canterbury, a local provincial union, I show how the game of rugby union consolidated as the national game. I follow these actors through the shift to a global professional game sponsored by television networks and show how the local advantages in the New Zealand game come to be reconfigured in this context. In the first half of the thesis I argue that a contested and continuous process of indigenisation secured both the national popularity of the amateur game, against the threat of the rival code of professional rugby league, and maintained all-important competitive ties between the national team and Britain. Protection against threats from the rival code was secured by the centralised New Zealand Rugby Football Union (NZRFU) creating two national teams, the All Blacks (1905), composed of both ‘white’ and Maori players, and the New Zealand Maori team (1910) composed only of indigenous Maori players. Further, the establishment of a national challenge competition, the Ranfurly Shield (1902), and the formation of a national league, the National Provincial Championship (1976), secured local and national publics for the amateur game.
