Now pending before the court is defendant’s motion for summary judgment pursuant to Rule 56 of the Rules of the United States Court of Federal Claims (RCFC). Defendant’s motion has been fully briefed and is ripe for a decision by the court. Oral argument was neither requested by the parties nor required by the court. For the reasons set forth below, the court grants defendant’s motion. BACKGROUND1 I. Factual Background A. Lawrence Magdovitz and Ensley Station During the time period relevant to this litigation, Lawrence Magdovitz, an attorney, realtor, and residential contractor in Clarksdale, Mississippi, owned and/or controlled several corporations which together own hundreds of properties that are leased to the United States Postal Service (the Postal Service), including the property which is the subject of this litigation. A117-18, 122, 127-28, 130-36.2 That property, which is located at 700 18th Street in Birmingham, Alabama, and which the parties refer to as “Ensley Station,” has been leased to the Postal Service since 1965 for use as a post office.
