Jagdawoo & Ors Respondents JUDGMENT This is an appeal by the Director of Public Prosecutions against a judgment of the Magistrates of the Intermediate Court dismissing the 2 counts of an information brought against the respondents. Respondent No. 2 having passed away, the appeal now lies only against respondents nos. 1,3 and 4. The appeal is against the dismissal by the Court of the charge brought under count I of the information which was for an offence of “abuse of authority by public officers” in breach of Section 77 of the Criminal Code. The respondents, who were all police officers, were charged for having, on 12 January 2006 at Line Barracks Port Louis, wilfully and unlawfully committed an arbitrary act prejudicial to the Constitution of Mauritius in that they subjected one Ramdoolar Ramlogun, who was in police 2 custody as a suspect in a murder case, to inhuman and degrading treatment contrary to section 7 of the Constitution. The inhuman and degrading treatment was particularised as “physical abuse”. It is not in dispute that on 12 January 2006 Ramlogun was arrested by the police in connection with a murder case, he was detained at the Line Barracks Detention Centre and on 14 January 2006 he passed away whilst still in police custody. An initial question of law arose at the outset of the appeal concerning the scope of application of section 77 of the Criminal Code.

The first series of workshop was held during the visit of Australian Parliamentary Secretary for Pacific Island Affairs, Honourable Richards Marles in the presence of Hon. Arvin Boolell, Minister of Foreign Affairs, the Australian Ambassador, Representative of the Ministry of Gender, the Chairperson and Chief Executive Officer of Grand Port District Council, high officials of the Australian Embassy, Councillors of District and Village Councils and high officials of the District Council in March 2013. At the end of the workshop seven Gender and Gender Based Action Plans were developed for Bon Accueil,Central Flacq,St. Julien village,Clemencia,Lallmatie,Camp de Masque and L’Aventure. From 3rd to 5th September 2013 using the funding from the AUSaid Gender Links facilitated workshops for 7 villages of Flacq. The Deputy Prime Minister, Hon Anil Bachoo made the keynote address and officially launched the workshop in the presence of Dhiraj Singh Khamajeet, Second Member for Constituency No.9 Flacq and Bon-Accueil and also Parliamentary Private Secretary and the Chairperson of the District Council, Teeruthraj Hurdoyal. Five years later, the island became a French colony and was renamed the Isle de France. The French developed extensive sugar plantations on the island, and the Mauritian Creole language came into existence during their rule. The British took control of Mauritius in 1810 during the Napoleonic Wars. The country remained under British rule until it became an independent Commonwealth realm on 12 March 1968 and a republic within the Commonwealth on 12 March 1992. The country's populace is composed of several ethnicities, mostly people of Indian, African, French, and Chinese descent. Most Mauritians are multilingual; English, French, Creole and Chinese languages are used. The Mauritian Constitution is based on the Westminster model. The head of state is the President but constitutional power is vested in the Prime Minister who is the head of government.
