These Explanatory Notes relate to the Local Transport Act 2008 (“the Act”), which received Royal Assent on 26 November 2008. They have been prepared by the Department for Transport in order to assist the reader in understanding the Act. They do not form part of the Act and have not been endorsed by Parliament. 2. The notes need to be read in conjunction with the Act. They are not, and are not meant to be, a comprehensive description of the Act. So where a section or part of a section does not seem to require any explanation or comment, none is given. SUMMARY AND BACKGROUND 3. The provisions in the Act are intended to address increasing road congestion and to improve the quality of local bus services. Cheryl Gillan MP Proposed Order in Council on Highways and Transport Legislative Competence Orders (LCOs) are Orders in Council made under section 95 of the Government of Wales Act 2006 (the “2006 Act”) which confer legislative competence on the National Assembly for Wales. This LCO was proposed by the National Assembly for Wales’ Enterprise and Learning Committee, and would confer further legislative competence on the Assembly by inserting a Matter into the Field of Highways and Transport (Field 10 in Part 1 of Schedule 5 to the 2006 Act).
