BACKGROUND Automated Speed Enforcement, commonly referred to as Photo Radar, is a tool that has been used in municipalities across Canada as part of comprehensive traffic safety programs. In the Province of Ontario, the use of Photo Radar is legislated as part of the Highway Traffic Act. In an effort to reduce the occurrence of speeding on local roads, Ottawa City Council, as a result of Motion NO. 60/8 carried on June 14, 2006 and Motion NO. 66/9 carried on May 13, 2009, petitioned the Province to allow the use Photo Radar in Ottawa as outlined below: Motion NO. 60/8 – moved
