Whole Edition (Do Not Delete) 2/7/2011 9:49 AM Issue 1 1 Political Recoding of the Contemporary Celebrity and the First Amendment David Tan* ABSTRACT If the celebrity semiotic sign is recognized to represent the values of a majoritarian public, then the debate and opposition to these encoded ideals may be expressed by using the same signs in a “recoded” manner, and such counterpublic uses can therefore be categorized as “political speech.” Through an analysis of right of publicity claims, this Article suggests that in order for political speech to be given adequate breathing space, it would be beneficial to understand how the writings of Roland Barthes, Stuart Hall, Richard Dyer, and other cultural scholars can contribute to the articulation of a robust First Amendment defense regarding the uses of celebrity iconography. INTRODUCTION The American flag is infused with symbolic values of nationhood.1 A burning cross connotes racial hostility emblematic of Ku Klux Klan ideology.2 The use of an image of a celebrity—like Oprah Winfrey or Tiger Woods—on a t-shirt may also possess sufficient communicative elements to convey “a particularized message . [clearly] understood by those who viewed it.”3 This Article argues that an expressive use of the celebrity persona, depending on its content, form, and context, may be categorized as “political speech” protected by the First Amendment. While links between the contemporary celebrity and political speech have been raised in existing scholarship that draws on cultural studies, this Article presents an original interdisciplinary contribution to First Amendment jurisprudence by utilizing cultural studies differently from most postmodern scholars who argue against the legal recognition of a right of publicity. Interdisciplinarity has become an influential force in legal studies, and its advantages have been well canvassed.4 However, some critiques can operate at a level of abstraction that does not allow any meaningful contribution to First Amendment doctrine, while others can commit to one to a reductionism that ignores key aspects of the First Amendment ethos.5 Rather than resort to interdisciplinarity to argue for greater limits on free speech rights,6 this Article proposes that free speech interests may be 1 E.g., Texas v.     ROCK'N'ROLL’S 1ST DECADE Week One: The Roots of Rock Recommended Listening: The Delmore Brothers, Freight Train Boogie (Ace, 1993). Country-boogie songs from 1946-51 by this brother duo, whose more uptempo material was not only some of the finest country music of the era, but an important building block of rockabilly and early rock & roll. Fats Domino, The Early Imperial Singles 1950-1952 (Ace, 1996 & 1997). Thorough collections of the first few years or so of singles by the most important early New Orleans rock'n'roll star, whose singles of the early 1950s weren't all that different from the pop hits he had after rock took off. The Drifters, Let the Boogie-Woogie Roll: Greatest Hits 1953-1958 (Atlantic, 1988). Perhaps the most consistent, and certainly one of the most important, of the doo wop groups that had their first success prior to 1955. This has their mid-1950s R&B hits, some of them featuring lead singer Clyde McPhatter. The Drifters who had numerous early soul hits in the late 1950s and early 1960s had entirely different personnel, and were linked to this version of the group only by the trademark name. Bill Haley & His Comets, Rock the Joint! The Original Essex Recordings 1951-1954 (Rollercoaster, 1992). Bill Haley & His Comets were the first white band to fuse rhythm and blues with country music into something recognizable as rock'n'roll, and were doing so for four years before "Rock Around the Clock" became the first huge rock hit. This has those early recordings, including one from 1952 ("Rock the Joint") quite similar to "Rock Around the Clock," and his first single to become a Top Twenty pop hit, 1953's "Crazy, Man, Crazy."   • “Covering” the Bluesman from a Distance
    Introduction In many ways, my journey towards this thesis topic began with my brother’s music collection. Throughout my teens he would introduce me to a wide range of local and international acts, many of which were influenced by African-American blues artists. This influence is evident in both their construction of sound and the old songs that they rerecorded. From there I began tracing musical influences from song credits and interview excerpts—a path often travelled by musicians and fans alike—that would eventually lead me to an appreciation of blues music. The penultimate step towards this topic came in the form of my honours thesis—a creative project that involved rerecording several tracks from the catalogue of an early Australian country music artist, one of which was titled “Blue Mountain Blues”.1 From there I turned to blues music in Australia. Initially conceived as a history of “Australian blues”, it became apparent that this proposed sub-genre struggled to unify and explain the disparate musical styles contained therein. Although each artist was clearly addressing the musical characteristics and influences I had come to recognise as “blues music”, it all sounded different. In the meantime, I developed a keen interest in a fellow colleague’s thesis topic that addressed the role of “covers” within the Australian music industry (Giuffre, 2005). My epiphany—and catalyst for the current thesis topic—eventually presented itself while viewing a live performance from Peter Green Splinter Group. The concert was split into two courses: an acoustic entrée featuring several Robert Johnson “covers”; and, an electric main with side dishes of early Fleetwood Mac material—the band Green had help found many years ago.
