I. Introduction Legal pragmatism is a visible movement in law academia today. The group advocating this stance is composed of a wide-ranging and diverse set of individuals. The list includes Daniel Farber,1 Thomas Grey,2 Margaret Radin3 and Judge Richard Posner4 among many others. Advocates of this stance insist that adoption a pragmatic conception of law practice can help law as a social tool function more effectively. More specifically legal pragmatism is advocated as a judicial stance. A glance at the group listed as legal pragmatists raises the question of whether there is a cohesive center to such a stance. If right-wing judges and leftist-feminists can advocate the same stance something is definitely suspicious. One suspects that there might not be any guts to a stance that can claim adherents from such otherwise radically opposed camps. -

Abstract This thesis submission interrogates the concept of mythology within the opposing philosophical frameworks of the world as either an abstract totality from which ‘truth’ is derived, or as a chaotic background to which the subject brings a synthetic unity. Chapter One compares the culturally dominant, classical philosophical picture of the world as a necessary, knowable totality, with the more recent conception of the ‘world’ as a series of ideational repetitions (sense) grafted on to material flows emanating from a chaotic background (non-sense). Drawing on Plato, Kant, and Heidegger, I situate mythology as a conception of the false—that which fails to correlate with the ‘world’ as a necessary whole. -

QUALITY IN HIGHER EDUCATION: SYSTEMS AND LIFEWORLDS IN COLLISION Jeff Aper Blackburn College ABSTRACT Questions abound about the quality and purpose of American higher educa- tion in the early 21st century. Solutions have tended to be framed in terms of economic production and manufacturing quality control models, and these terms increasingly characterize state and federal systems of authority over colleges and universities. As Habermas theorized, system logic, left to its own devices, will ultimately overpower, or “colonize,” the day to day meaning making culture or “lifeworld” of the campus. This colonization runs at counter purposes to the es- sential foundation of meaning for authentic education. A solution is proposed, suggesting that a deeper base to higher learning lies in embracing the traditional values of the academy and cultivating the faculty as a uniquely rich resource in support of student learning and the dual work of preservation and innovation in addressing the most pressing needs of humanity. -

In the study, which is a qualitative research method patterned on phenomenology, data was collected using a semi-structured interview form. Structured interviews were conducted with seven research assistants selected from a faculty of education at a state university in Ankara using the criterion sampling method. According to the research results, research assistants were determined to prefer taking faculty members as their role models in building their professional identity. They see this process as an opportunity to specialize in their field and improve themselves, feel that working at a pioneering university with prestige in its field increases their responsibilities, and are more enthusiastic about improving themselves in that direction. In relation to deficiencies in the process of building their professional identity, the participants stated that they have limited opportunities regarding practice and feel uncomfortable conducting research unrelated to their practice. The research results were discussed in the context of related literature, as well as the administrative and functional structure of the higher education system. Chapter 11 the Theory of Communicative Action
Chapter 11 The Theory of Communicative Action 11 The Theory of Communicative Action and Theory of System and Lifeworld in Relational Practice In this chapter I would like to inform our understanding of relational practice and sustainability by taking another set of ideas about communication and behaviour, which is slightly different to the Batesonian pragmatics of human communication used in the last chapter. Here I focus upon the critique of modern welfare-state capitalism to be found in the social theory of Jurgen Habermas and his associated working of behavioural communication. I first describe some key aspects Habermas’ social theory (located within a line of critical theorists from the Frankfurt school following Marx) by introducing two main elements of his theory of communicative action - the theory of system and lifeworld and the theory of knowledge constitutive interests. Having introduced these ideas - in what is again quite a theoretically dense section - I then work with Habermas’ theoretical constructs to engage in further reflection upon business- NGO relations and my own research/practice in the context of the modern welfare-state. More specifically, looking through the conceptual lenses of system and lifeworld, I suggest that perceptions of NGOs as being separate from the steering media of money and power have allowed the sector to engage in change efforts with powerful actors such as business. However, this distance is more perceived than real. As a result private sector engagement, whilst affording solutions to pressing problems, may seriously affect NGO legitimacy. I frame my own research/practice in terms of the system and lifeworld theory. -

Craver Abstract According to one large family of views, scientific explanations explain a phenomenon (such as an event or a regularity) by subsuming it under a general representation, model, prototype, or schema (see Bechtel, W., & Abrahamsen, A. My concern is with the minimal suggestion that an adequate philosophical theory of scientific explanation can limit its attention to the format or structure with which theories are represented. The representational subsumption view is a plausible hypothesis about the psychology of understanding. It is also a plausible claim about how scientists present their knowledge to the world. However, one cannot address the central questions for a philosophical theory of scientific explanation without turning one’s attention from the structure of representations to the basic commitments about the worldly structures that plausibly count as explanatory. A philosophical theory of scientific explanation should achieve two goals. The first is explanatory demarcation. It should show how explanation relates with other scientific achievements, such as control, description, measurement, prediction, and taxonomy. The second is explanatory normativity. -

D'Amato: The Moral Dilemma of Positivism THE MORAL DILEMMA OF POSITIVISM* ANTHONY D'AMATO** Not only do positivists insist upon separating law from morality, but they also appear to be unable to deal with moral questions raised by law once the two are separated. This inability stems, I believe, from their simultaneous attempt to assert and to prove that law and morality are separate; the argument reduces to a vicious circle. Neil Mac- Cormick's lectures, "A Moralistic Case for A-Moralistic Law?" which I have been asked to comment upon, exemplifies this problem. To Pro- fessor MacCormick's credit, he has attempted to lay an explicit moral foundation for the adoption of the amoralistic positivist conception of law, something which other positivists have avoided or - in H.L.A. Hart's case - let fall implicitly between two books, one addressed to positivism and the other to morality.' Professor MacCormick's grace of style and wit tend to mask the inconsistency upon which his argument is erected, and yet at the same time make it a pleasurable task for his readers, including me, to examine that argument with care.
