D. New Story – Agreement Agreements with New Story for 2021-2022. New Story provides special education for students as defined by his/her IEP: a. New Story extended school year program for the period June 21, 2021 – July 29, 2021 at a cost of $375.00 per day per student. b. New Story Tuition Agreement for 2021-2022 at a cost of $380.00 per day c. New Story Amendment – if restrictions are imposed by federal, state, or local authorities to limit New Story’s ability to provide full-time in person instruction, the agreement will be altered and amended. The cost will be $260.00 per day.

E. Title I Service Agreement between the Ephrata Area School District and Lancaster- Lebanon IU 13 Instructional Service Agreement with Lancaster-Lebanon IU 13 for Title I services to be provided at Dayspring Christian Academy, Grace Point Academy, Hinkletown Mennonite, Lititz Mennonite, Lancaster County Christian School – Leola Campus, Lancaster Mennonite, Our Mother of Perpetual Help School, and Resurrection Catholic for eligible students who reside in the Ephrata Area School District, at a cost not to exceed $27,555.00 for the 2021- 2022 fiscal year.

F. Title IIA Service Agreement between the Ephrata Area School District and Lancaster Lebanon IU 13 Title IIA Nonpublic Program and Services with Lancaster-Lebanon IU 13 to provide Professional Development services in accordance with ESSA Nonpublic requirements for Our Mother of Perpetual School and Grace Point at a cost of $6,762.72. Agreement is for the 2021-2022 fiscal year.

G. Children Deserve a Chance Foundation – Attollo Prep – Memorandum of Understanding Memorandum of Understanding with Children Deserve a Chance Foundation – Attollo Prep. This training program focuses on assisting High School students with gaining access to college. The cost for this program will be $10,500.00 to serve up to 30 juniors for a total of 1,080 student hours. The District will also compensate Attollo for the 25 current seniors who

I. ProCare Therapy Agreement Agreement with ProCare Therapy for Speech Language Pathologist Services for the period August 30, 2021- December 23, 2021. The cost is $72.50 per hour for a minimum of 35 hours per week.

Vision Corps Agreement Agreement for Vision Corporation to provide vision services that help increase vision and help educators learn how to work with student’s limited vision and assist students to learn to work with their disability. The cost of the services is $130.84 per hour, including mileage at a rate of 56 cents, for the period August 31, 2021 through June 30, 2022.

M. Salus University Affiliation Agreement Agreement with Salus University for 2021-2022. The placement from Salus will be a Speech- Language Pathology student.

N. Individual Reading Instruction Agreement Agreement with Jean Semder, Lancaster, PA, for individual reading instruction for students who require an explicit systematic instructional approach for reading during the 2021-2022 school year. The cost to the District shall be at a rate of $60.00 per hour plus the cost of travel. Total hours shall not exceed 10 hours weekly. The District will be invoiced monthly.

O. Special Education Supplemental Contract with Eastern Lancaster County School District Contracts for Special Education Services provided by Eastern Lancaster County School District for the 2021-2022 school year: a. Three students to receive Autistic Support Services at a cost of $42,893.00 per student for a total contract amount of $128,679.00 plus any related services b. One student to receive Multiple Disabilities Support at a cost of $45,740.00 per student, total cost $45,740.00 plus any related services

P. Special Education Supplemental Contracts with Warwick School District for the 2021- 2022 School Year a. One high school student to receive Multiple Disabilities Support at a cost of $24,438.84 plus any related services. b. One elementary school student to receive Multiple Disability Support at a cost of $25,916.61 plus any related services.

Q. Western School for the Deaf Transportation Agreement Transportation agreement with Western Pennsylvania School for the Deaf. Students will be transported from Camp Hill to Pittsburgh each week. The cost will be $8,000.00 for the 2021- 2022 school year.

R. The Janus School – Agreement Agreement for a student with The Janus School for the following agreements: a. Enrollment Contract for 2021-2022, cost is $31,750.00 b. Flex Options Contract for 2021-2022 for additional tutorial, speech-language and or occupational therapy at a cost of $6,625.00 per week.

S. Letter (Attachment) Letter from the Cocalico School District requesting the enrollment of a Cocalico student in The Agriculture Program at EHS for the 2021-2022. The tuition would be $12,381.73.

T. Authorization to Employ Staff Members to Fill Vacancies Authorize the Superintendent, after consultation with the Board President, to employ necessary staff members to fill vacancies within budgetary guidelines between the School Board Regular Meeting on August 16, 2021 and the School Board Regular Meeting on September 27, 2021.

II. New Story – Agreement After review and discussion, the Committee endorsed the Administrative recommendation to approve the following agreements with New Story for 2021-2022. New Story provides special education for students as defined by his/her IEP: A. New Story extended school year program for the period June 21, 2021 – July 29, 2021 at a cost of $375.00 per day per student. B. New Story Tuition Agreement for 2021-2022 at a cost of $380.00 per day C. New Story Amendment – if restrictions are imposed by federal, state, or local authorities to limit New Story’s ability to provide full-time in person instruction, the agreement will be altered and amended. The cost will be $260.00 per day.

III. Title I Service Agreement between the Ephrata Area School District and Lancaster-Lebanon IU 13 After review and discussion, the Committee endorsed the Administrative recommendation to approve an Instructional Service Agreement with Lancaster-Lebanon IU 13 for Title I services to be provided at Dayspring Christian Academy, Grace Point Academy, Hinkletown Mennonite, Lititz Mennonite, Lancaster County Christian School – Leola Campus, Lancaster Mennonite, Our Mother of Perpetual Help School, and Resurrection Catholic for eligible students who reside in the Ephrata Area School District, at a cost not to exceed $27,555.00 for the 2021-2022 fiscal year.

IV. Title IIA Service Agreement between the Ephrata Area School District and Lancaster-Lebanon IU 13 After review and discussion, the Committee endorsed the Administrative recommendation

to approve a Title IIA Nonpublic Program and Services with Lancaster-Lebanon IU 13 to provide Professional Development services in accordance with ESSA Nonpublic requirements for Our Mother of Perpetual School and Grace Point at a cost of $6,762.72. Agreement is for the 2021-2022 fiscal year.

V. Children Deserve a Chance Foundation – Attollo Prep – Memorandum of Understanding After review and discussion, the Committee endorsed the Administrative recommendation to approve a Memorandum of Understanding with Children Deserve a Chance Foundation – Attollo Prep. This training program focuses on assisting High School students with gaining access to college. The cost for this program will be $10,500.00 to serve up to 30 juniors for a total of 1,080 student hours. The District will also compensate Attollo for the 25 current seniors who are still engaged in Attollo programming at a rate of $400.00 per scholar for the 2021-2022 fiscal year.

VI. Non-Public Transportation Contracts After review and discussion, the Committee endorsed the Administrative recommendation to approve non-public 2021-2022 Pupil Transportation Contracts and daily rates as follows:

The cost is $72.50 per hour for a minimum of 35 hours per week.

VIII. Vision Corps Agreement After review and discussion, the Committee endorsed the Administrative recommendation to approve an agreement for Vision Corporation to provide vision services that help increase vision and help educators learn how to work with student’s limited vision and assist students to learn to work with their disability. The cost of the services is $130.84 per hour, including mileage at a rate of 56 cents, for the period August 31, 2021 through June 30, 2022.

XI. Salus University Affiliation Agreement After review and discussion, the Committee endorsed the Administrative recommendation to approve an agreement with Salus University for 2021-2022. The placement from Salus will be a Speech-Language Pathology student.

XII. Individual Reading Instruction Agreement After review and discussion, the Committee endorsed the Administrative recommendation to approve an agreement with Jean Semder, Lancaster, PA, for individual reading instruction for students who require an explicit systematic instructional approach for reading during the 2021-2022 school year. The cost to the District shall be at a rate of $60.00 per hour plus the cost of travel. Total hours shall not exceed 10 hours weekly. The District will be invoiced monthly.

XIII. Special Education Supplemental Contract with Eastern Lancaster County School District After review and discussion, the Committee endorsed the Administrative recommendation to approve contracts for Special Education Services provided by Eastern Lancaster County School District for the 2021-2022 school year: A. Three students to receive Autistic Support Services at a cost of $42,893.00 per student for a total contract amount of $128,679.00 plus any related services B. One student to receive Multiple Disabilities Support at a cost of $45,740.00 per student, total cost $45,740.00 plus any related services

XIV. Special Education Supplemental Contracts with Warwick School District After review and discussion, the Committee endorsed the Administrative recommendation to approve Special Education Supplemental contracts provided by Warwick School District for the 2021-2022 school year. A. One high school student to receive Multiple Disabilities Support at a cost of $24,438.84 plus any related services. B. One elementary school student to receive Multiple Disability Support at a cost of $25,916.61 plus any related services.

XV. Western Pennsylvania School for the Deaf Transportation Agreement After review and discussion, the Committee endorsed the Administrative recommendation to approve a transportation agreement with Western Pennsylvania School for the Deaf. Students will be transported from Camp Hill to Pittsburgh each week. The cost will be $8,000.00 for the 2021-2022 school year.

Budget and Finance I. District Insurance Cost Analysis The District’s insurance package cost analysis was discussed. The insurance cost is approximately $22,181.00 higher than last year.

II. Fuel for Buses The fuel for buses is expected to dip the District will lock in soon.

III. Cocalico School District Letter A letter from the Cocalico School District requesting the enrollment of a Cocalico student in the Agriculture Program at EHS for the 2021-2022. The tuition would be $12,381.73.

IV. Acknowledge Donations A. Contribution of two book selections, Where’s Rodney and Water, from the Sierra Club for the District elementary school libraries.

V. Lancaster General Medical Group Agreement An agreement with Lancaster General Medical Group to provide physicians’ services for the school nurse as needed and certified athletic trainer. Will be on the August 16th board agenda if received.

Property I. High School/Middle School Construction Project  General Obligation Bond – The District received documents for the bond closing, there is a savings of $806,196.

 RLPS Interior Design Services – Cost for these services is approximately $19,500.00.

ATHLETIC TRAINING AGREEMENT

This Agreement (the "Agreement") is dated and effective as of the 1st day of August 2021 by and between Orthopedic Associates of Lancaster, Ltd., (the “Provider”) Ephrata Area School District (the “Organization”).

Background

A. The Organization would like athletic training services at 803 Oak Blvd, Ephrata, PA.

B. Provider specializes in the operation of orthopedic services, outpatient physical therapy, rehabilitation service s, sports medicine, and athletic training programs ("Athletic Training Services").

C. The Organization desires to retain Provider to provide Athletic Training Services at their high school and middle school locations. The Provider is willing to provide such Athletic Training Services, upon the terms and conditions contained herein.

NOW, THEREFORE, in consideration of the foregoing and of the terms, covenants and conditions contained in this Agreement, Provider, and the Organization, intending to be legally bound, hereby agree as follows:

Agreement

1. Engagement.

a. The Organization engages the Provider to be a provider of (PRN) Athletic Training Services, as needed, at the Facility or any other locations as required by the, and to provide the Services set forth here in on the terms and subject to the compensation set forth herein.

b. Provider hereby accepts such engagement by the Organization and agrees that it will perform its duties and responsibilities hereunder, all as more fully set forth herein.

2. Provider Services.

a. Provider shall employ and designate one or more athletic trainer(s) certified by the National Athletic Trainer's Association Board of Certification (BOC) and licensed by the state of Pennsylvania, to serve the Organization.

b. Provider will provide a priority appointment line phone number, (717) 735-6649, for athletes and athletic trainers to make appointments for student athletes. The priority appointment line will be available from 7:30 a.m. to 10:00 p.m. Monday thru Saturday, and 8:00 a.m. to 9:00 p.m. on Sunday.

c. Monitor athletic injuries and develop injury prevention programs.

d. When requested the Provide will coordinate injury evaluation and provide injury follow-up with an orthopedic provider at one of the Orthopedic Associates of Lancaster's four office.

e. Will treat athletes not possessing a medical script, at the school for no charge. Athletes who have a medical script from a physician may be subject to health insurance billing fi seen within

the Providers clinic.

f. Will operate in accordance with standard operating procedures.

g. All athletic training coverage will be coordinated with the Providers Athletic Training Manager or Athletic Training Supervisor.

h. The provider shall also provide additional service including, but not limited to education seminars for coaches, athletes, and parents on an as needed basis at no additional cost.

i. When request, the provider shall provide comprehensive Functional Movement Screenings. These services will be bill separately at the time of the service.

j. Provider will maintain copies of all state mandated clearances and criminal background checks and will provide copies to the Organization as requested.

3. Duties of the Organization.

a. The Organization agrees to identify one or more licensed physicians who will be available and service as "team physicians." If the school does not have one the Provider will provide one at no additional cost to the Organization.

b. The Organization shall be solely responsible for determining the times of practice and for scheduling all athletic programs.

4. Compensation.

a. The Organization shall pay to Provider a fee (the "Service Fee") in an amount equal to: i. 2021-2022: $30.00 per hour of service, billed monthly

b. The Service Fee will be invoiced monthly beginning September 1, 2021 for the 2021-2022 academic school year.

5. Term and Termination.

a. This Agreement shall take effect on August 1, 2021 and will commence on July 31, 2022.

b. Termination. Notwithstanding anything herein to the contrary, either party shall have the right to terminate this Agreement, with or without cause, by giving at least 90 days prior written notice to the other party; and upon expiration of such ninety(90) day notice period, the Agreement shall be terminated and all and all obligations, duties and responsibilities of the parties shall cease, except the Organization shall be obligated to pay any compensation payments due and owing to contractor under Paragraph 4 above.

6. Confidential Information. All information or data relating to the business or operations of either party to this Agreement acquired by the other party in connection with this Agreement shall be treated as confidential by the acquiring party, and shall not, unless otherwise required by law, be disclosed by the acquiring party without the prior written permission of the party hereto to whom

the information in question relates. Violation of this provision shall represent a material breath of this Agreement. This provision shall survive termination of this Agreement.

7. HIPAA Compliance/ Protected Health Information. Provider's employees will be compliant with HIPAA and agrees to maintain compliance with FERPA regulations to the extent required by law.

8. Notices. All notices and other communications hereunder shall be in writing and may be hand delivered, sent by fax (with a duplicate copy transmitted by another method of delivery authorized hereunder) , sent by certified first class mail, postage prepaid, or sent by nationally recognized express courier service. Such notices and other communications shall be effective upon receipt if hand delivered or sent by fax (with a duplicate copy transmitted by another method of delivery authorized hereunder), five (5) days after mailing if sent by mail, and one (1) day after dispatch if sent by express courier, to the addresses and/or fax numbers set forth below.

Either party may designate, by written notice given to the other in the manner prescribed herein, any further or different addresses and/or fax numbers to which subsequent notices shall be sent.

9. Miscellaneous.

a. Assignment: Binding Effect. This Agreement shall not be assigned by either party without the prior written consent of the other party.

b. Amendment. This agreement constitutes the entire agreement between Organization and Provider with respect to the management and operation of the Athletic Training Program, and no change hereto shall be valid, unless made by supplemental written agreement, approved, and executed by the parties hereto.

c. Headings: Unenforceability. The headings used before the various Paragraphs of this Agreement are for ease of reference only and do not constitute parts of this Agreement. If any provision of this Agreement shall be declared invalid or unenforceable, the remaining terms of this Agreement shall not be affected thereby.

d. Governing Law. This Agreement shall be governed by and construed in accordance with the

laws of the Commonwealth of Pennsylvania applicable to contracts made and to be performed therein, without regard to conflict of law provisions.

e. Entire Agreement. This Agreement, including all Exhibits attached hereto, constitutes the entire understanding and agreement between the parties concerning the subject matter hereof. This agreement supersedes all prior written or oral agreements and understandings between the parties concerning the subject matter hereof.

f. Counterparts. This Agreement may be executed in several counterparts, each of which shall constitute a complete original Agreement, which may be introduced in evidence or used for any other purpose without production of any of the other counterparts.

g. Waiver. Any waiver by a party must be in writing and will not be construed as a continuing waiver. No waiver will be implied from any delay or failure by a party to take action on account of any default of the other. Consent by one party to an act of omission by the other will not be construed to be a consent to any other or subsequent act or omission or to waive the requirements of such party's consent to be obtained in any future or other instance. h. Independent Provider. It is hereby understood and agreed that Provider, in performing the services pursuant to this Agreement, is acting in the capacity of an independent contractor. Provider represents and warrants that it and its employees and independent Providers are not agents, servants, partners, nor employees of Organization. Provider shall be solely responsible to pay its own federal, state, and local withholding taxes and any and all other payments payroll related taxes incurred by Provider in the performance of the services hereunder. None of the benefits provided by Organization to its employees, including but not limited to workers’ compensation insurance, disability insurance, medical insurance, and employment practices insurance are available from Organization to Provider and/or any and all of Provider’s agents, servants, and employees. Provider has no authority hereunder to assume or create any obligation or responsibility, express or implied, on behalf of or in the name of Organization or to bind Organization in any way whatsoever.

i. Insurance. During the term, Provider agrees to carry worker’s compensation insurance and professional liability insurance coverage. All such insurance coverage shall be underwritten by insurance companies authorized to do business in the Commonwealth of Pennsylvania. Provider shall furnish Organization with copies of such insurance coverage certificates by the earlier of the commencement of services provided under the Agreement, or within ninety (90) days of such request by Organization. The amount of professional liability insurance coverage maintained by the Provider shall be at least one million dollars per event and three million dollars in the aggregate. Organization shall be named as additional insured on the Provider’s insurance coverage.

j. Indemnity. Provider indemnifies and holds harmless the Organization, its Board, agents, and employees with respect to any claims, suits, actions, liabilities, penalties, fines or demands (including the costs, expenses, and reasonable attorney(s) fees on account thereof) caused by arising out of, or in any way related to, the services or the Provider’s activities hereunder, except to the extent of the Organization’s negligence. k. List of Checks and Clearances. – All athletic trainer providing services under the Agreement shall fully comply with the below listed laws, and the Provider shall provide with Organization with safety evidence of such compliance:

i. Act 34 - Request for Criminal Record Check ii. Act 151 - Pennsylvania Child Abuse History Clearance iii. Act 114 - FBI Federal Criminal History Records iv. Act 24 – Arrest/Conviction Report and Certification Form v. Act 126 – Mandated Reporter Training related to child abuse recognition and reporting. Trainer shall be in compliance with Act. 126 and receive 3-hour training prior to employment and be retrained every 5 years. An online option will be offered by District. vi. Act 71 – Suicide awareness/prevention education. Each Trainer shall complete 4 hours of training within 60 days of employment for any trainer having students in grades 6 – 12 and be retrained every 5 years. An online option will be offered by District. vii. Any other checks or clearances that may be implemented by statute and/or state, local or federal regulatory agencies.
