WAWANESA TOY DRIVE CONTEST Contest Rules & Regulations (the “Rules”) By entering this Contest, you acknowledge having read these Rules and agree to abide by them. Contest is subject to federal, provincial and municipal law. 1. GENERAL: By entering this Contest, entrants accept and agree (i) to be bound by the terms and conditions of these Rules, and (ii) to accept the decisions of the Sponsor as final and binding in all respects. This Contest will begin on October 30, 2019 (the “Contest Period”). This Contest is being run by The Wawanesa Mutual Insurance Company (the “Sponsor”). Although this Contest may be communicated or promoted through social media, it is not sponsored, endorsed or administered by, or associated with any social media and questions or issues should be directed to the Sponsor. 2. HOW TO ENTER: Each new, unwrapped toy donated at select Canadian Hockey League (CHL) games set out in Schedule A – Toy Drive Games or at participating Wawanesa Insurance brokerage partner locations during the Contest Period will give the entrant 1 entry into this Contest. NO PURCHASE NECESSARY. To enter without donation, during the Contest Period, entrants can submit a 500-word essay on why they love their local CHL Team that includes their full name, email and phone number to [email protected] for 1 entry. 3. ENTRIES: All Contest entries become the property of the Sponsor and will not be returned. The Sponsor is not responsible for any lost, damaged or illegible entries, and retains the right to disqualify entrants who do not comply with the Rules. 4. ELIGIBILITY: This Contest is open to all legal residents of Canada who have reached the age of majority in their province/territory at the time of entry, except employees of the Sponsor and its subsidiary and affiliated companies. 5. DRAW PROCESS: To determine Contest winners, random draws will take place at the time set out in Schedule B – Contest Period from among all the eligible entries. An entry can only win once. The winning entrants will be contacted by email or phone within 48 hours after the random draw. If the Sponsor is unable to contact a selected entrant after 2 attempts in a 48-hour period, then the Sponsor reserves the right in its sole discretion to select another entry. To claim the prize, the selected entrant(s) must (i) correctly answer a skill-testing question and (ii) sign a release form declaring their eligibility and releasing the Sponsor from any other further liability other than to award the prize as described. Failure by any selected entrant to correctly answer the time limited skill testing question, or to complete, sign and return the release and declaration of eligibility, another Contest entry will be randomly selected for such prize until it is properly claimed and awarded in accordance with the Rules. 6. DETAILS OF PRIZE: a. CHL Team Prizes: 1 local CHL Team signed team jersey and 4 tickets to a future local CHL Team game. Each Local prize is valued at approximately CDN $350.00. Actual value may vary based on prize particulars. 1 prize per CHL Team as set out in Schedule C – CHL Team Prize Locations. 1/10 b. Grand Prize: A trip for two to the 2020 Memorial Cup Presented by Kia valued at approximately CDN $3,400.00 consisting of: i. Round trip economy air transportation, airport taxes, fees and fuel charges for the winner and 1 guest (the “Travellers”) to Kelowna, BC from the international airport within Canada closest to the winner’s residence as determined by the Sponsor. ii. A standard hotel room (based on double occupancy) for two nights (May 30 & 31, 2020). iii. 2 Final Game Tickets to the Memorial Cup Presented by Kia. iv. A $500 prepaid credit card for the winner. Additional Grand Prize Terms and Conditions: i. Actual retail value varies based on point of departure and flight schedule. All Grand Prize particulars are determined by the Sponsor. ii. The Travellers must be the age of majority in his or her province or territory of residence, unless accompanied by a parent or legal guardian. iii. The Travellers are responsible for: (i) ensuring they have all necessary travel documents prior to travel, (ii) a valid credit card, (iii) any and all applicable taxes, and (iv) any additional expenses not included in the prize as described such as food, flight changes, hotel incidentals, etc. iv. The Sponsor is not responsible for: (i) any cancellations, alterations, delays, diversions or other changes to the trip itinerary, (ii) any costs or expenses incurred as a result of any changes to the trip itinerary, or (iii) any damages, loss or liability in the event any Traveller is denied the ability to travel, whether due to airport restrictions or otherwise. The Sponsor is only responsible for the prize elements listed in the Rules. v. The Sponsor has the right to disqualify or remove any Traveller from any activity at any time if they are uncooperative, disruptive, abusive, unobservant of applicable rules, laws or regulations, or likely to cause or has caused damage to person, property, or the reputation of the Sponsor. 7. ACCEPTANCE: This Contest prize must be accepted as awarded and is not modifiable, transferable or convertible to cash or any other form of compensation whatsoever. The Sponsor reserves the right to substitute a prize of equivalent or greater value if the prize cannot be awarded as described for any reason. 8. CHANCES OF WINNING: The odds of winning this Contest prize are dependent on the number of eligible entries received in the entire Contest Period. 9. PUBLICITY: By entering, contestants agree to abide by the Rules and consent to their name and likeness being used in any publicity carried out by the Sponsor in all or any part of Canada and/or online, without further compensation, should they win this Contest prize. 10. RELEASE OF LIABILITY: By participating in this Contest, entrant acknowledges and agrees that Sponsor (i) will not be liable in any way for any part of this Contest, its administration or the 2/10 entrant’s participation therein, (ii) makes no warranty, guaranty or representation of any kind concerning the Prize, (iii) disclaims any implied warranty, and (iv) is not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance, use or dissatisfaction relating to the Prize. 11. PERSONAL INFORMATION: By entering, contestants also agree to the use of their personal information disclosed in or in connection with their entries by the Sponsor and its subsidiary and affiliate companies for the purpose of administering this Contest, awarding and delivering the prize, and announcing the winner as set out above in accordance with the Sponsor’s Privacy Statement at https://www.wawanesa.com/home/privacy-policy.html. The Sponsor does not knowingly collect personal information from children under the age of majority without the consent of a parent or guardian. 12. SUBJECT TO LAWS: This Contest is subject to all applicable federal, provincial, and municipal laws and regulations. The Sponsor may amend, cancel, close or suspend this Contest at any time in order to comply with any applicable laws. 13. AMEND OR RESCIND: The Sponsor may, at its sole discretion and without liability, rescind or amend this Contest without notice for any reason. All decisions made by the Sponsor with respect to any aspects of this Contest are final and not subject to challenge. 14. ERRORS AND OMISSIONS: The Sponsor is not responsible for any errors in the Rules or promotion of this Contest, including without limitation any printing, distribution or production errors and may, in its discretion, withdraw this Contest if it is found to contain any such error, without liability to anyone whatsoever.
