This journal aims at fostering and promoting harmoniza- tion of law in the SEE region with EU law and with general principles of international law, whilst providing a forum for the exchange of ideas and scholarly work of young scholars from the region and beyond. In ac- cordance with the mission of the journal, as well as the main objectives of the Harmonius association, this issue of the journal features seventeen articles on important topics, all of which present contributions to the in- ternational Conference “(Ne)moć prava u odnosu na (sve)moć zakono- davca / The Controversy of Legislators’s “Omnipotence” and “Weakness” of the Law”, with participation of professors and young scholars from Croatia, Bosnia and Herzegovina, Macedonia, Montenegro and Serbia. This Conference is organized by the Harmonius Association in coop- eration with Judicial Academy and takes place in Belgrade (Serbia) on December 9th, 2016. Last but not least, the section on international co- operation includes an important article by the IRZ on its contribution to the legal harmonization in the region. Members of the Editorial Board are particularly grateful to the IRZ – Deutsche Stiftung für Internationale Rechtliche Zusammenarbeit e.V., for the continuous support to the publication of this journal. We are also indebted to the distinguished professors and scholars who, de- spite their busy schedules, accepted to review the articles submitted for this issue. In adition to that, the Editorial Board wishes to thank all the contributors without whom the publication of this issue would not have been possible. We believe that the contributions to this issue will be of ample interest to the wide-ranging public in South East Europe. Aprovação em setembro de 2015. Abstract: The contract is the most prevalent institution for private autonomy implementation. As known, any agreement relies on mutual consent. However, sometimes there are some cases when exterior will does not coincide with the internal readiness or the will of the parties: This is caused by various objective and objective factors. Therefore, this is the vivid example of insufficient will. If so, the agreement designed in such a framework is a “voidable transaction”. The basis for such an agreement is, in this case, the contractor taken by mistake. According to the general explanation, this kind of a mistake is real when the actual contractor (the one to be authorized to be as one of the parties) is a different person and not the one to be considered as the truly willing one. The goal of the article is to consider the mistake relevant to contractors through the historical background and show this freedom, which is inherent to the current law regulating the issue concerned.
