Legislation Government Bill - Introduced, Considered and Passed The West Bengal University Laws (Amendment) Bill, 2019 The Bill was introduced by the Minister-in-Charge of the Higher Education Department and a statement was placed as required under rule 72(1) of the Rules of Procedure and Conduct of Business in the West Bengal Legislative Assembly. Shri Nepal Mahata and Dr. Sujan Chakraborty separately moved the following Statutory Resolution in pursuance of Article 213(2)(a) of the Constitution ofIndia: "This House disapproves the West Bengal University Laws (Amendment) Ordinance, 2019. (West Bengal Ordinance No. Iof2019)." The Minister-in-Charge ofthe Higher Education Department moved that the Bill be taken into consideration. The discussion on Statutory Resolution and Motion for consideration of the Bill were held together. The following Members took part in the debate: 1. Shri Rafikul Islam Mondal; 2. Shri Jyotirmoy Kar; and 3. Shri Nepal Mahata. The Statutory Resolution was lost. The Motion for consideration ofthe Bill was adopted and clause by clause consideration was taken up. Clauses2,3,4,5,6,7,8,9, 10, 11, 12, 13, 14, 15,'16,17, 18,19,20,21,22, 23,24,25,26,27,28,29,30 and 31 were adopted. Clause 1, the Enacting Formula, the Preamble and the Title of the Bill were adopted. The Minister-in-Charge of the Higher Education moved that the Bill, as settled in the Assembly, be passed. Ruling from The Chair Shri Nepal Mahata, M.L.A. while taking part in the Discussion in the West Bengal University Laws (Amendment) Bill, 2019 raised certain questions as regards the technicalities of promulgating the West Bengal University Laws (Amendment) Ordinance, 2019 (West Bengal Ordinance No. 1 of 2019) whereupon Mr. Speaker ruled that since the Constitution of India has not specified any date for laying Ordinance(s) in the House after the House has been summoned, the delay in laying the Ordinance in the House does not make it irregular, Mr. Speaker also pointed out that the Governor of West Bengal had been satisfied regarding the reasons for promulgating the Ordinance and this satisfaction can not be challenged. As such, Mr. Speaker disposed of the question raised by Shri Nepal Mahata stating that there was nothing irregular in the procedure. 4-51 P.M.
