1. City Manager's Fiscal Year 2018 Recommended Operating Budget ACTION: CITY COUNCIL WILL RECEIVE COMMENTS FROM THE PUBLIC ON THE CITY MANAGER'S RECOMMENDED FISCAL YEAR 2018 OPERATING BUDGET.

BACKGROUND: This is the first of two advertised public hearings on the City Manager's recommended operating budget for FY 2018.

The second public hearing will be held at 7:00 p.m. on Thursday, April 13, 2017, at the Denbigh Community Center, located at 15198 Warwick Boulevard, in Room 113.

BACKGROUND: City Council was briefed at its March 28th Work Session regarding the recent completion of a two-phase City project at the terminus of lower Jefferson Avenue.

The City project impacted SIP Parcels 12 and 16 which are currently leased from the City by Fairlead and its business operations thereon.

Consistent with your Work Session briefing, it is now appropriate to amend the SIP Parcel 12 Lease to adjust the square footage and provide for a three-month rent abatement.

The net additional square footage to be added to the leaseable area of SIP Parcel 12 is 13,071.54 square feet.

All other terms and conditions of the existing Lease will remain the same and in full force and effect.

The City Manager recommends approval.

BACKGROUND: A 4,512 square-foot drainage easement is required from the Timberwoods Condominiums common area owned by Community Partners Properties, LLC.

The drainage easement is required to eliminate a current erosion problem and to allow a culvert extension supporting new track work for the NNTC Project.

FISCAL IMPACT: The total appraised value of the acquisition is $8,500.

Funding for this acquisition is available through previously appropriated State and Federal funds.

BACKGROUND: The Newport News Golf Club provides food and beverages through a contractual arrangement with an outside vendor who utilizes the golf course's onsite restaurant and kitchen.

The previous food services vendor, Virginia Hospitality Services, Inc., ceased operations at the Golf Course in January of this year.

The City initiated a competitive bid and selection process, to which three qualified vendors were chosen.

In February, staff interviewed the vendors and selected CurtMont Global Services, Inc., a company with national experience in food and beverage services.

CurtMont currently provides similar golf food services in Portsmouth, Hampton and Petersburg, Virginia.

CurtMont's lease requires them to provide food and beverage services to golfers before, during, and after their rounds.

FISCAL IMPACT: Under the lease agreement, CurtMont would pay the City $700/month for rent.

Estimated annual revenues to the City are expected to exceed $30,000.

The lease agreement would begin on Aprill 11, 2017 for a one (1) year period and includes four (4) successive one (1) year renewals that can be exercised at the discretion of the City.

The City Manager recommends approval.

4. Resolution of Recognition: Ella Jane Fitzgerald's 100th Birthday ACTION: A REQUEST TO APPROVE A RESOLUTION OF RECOGNITION HONORING ELLA JANE FITZGERALD ON HER 100TH BIRTHDAY

BACKGROUND: Ella Jane Fitzgerald was born in Newport News on April 25, 1917.

Miss Fitzgerald and her family later moved to New York, where she was discovered after entering and winning an amateur talent contest at the Apollo Theater at the age of 16.

Soon thereafter, Miss Fitzgerald met , joined his band as a vocalist and in 1938, she helped turn the nursery rhyme "A-Tisket, A-Tasket" into a jazz hit, which she performed regularly with the Chick Webb Orchestra.

After Mr. Webb's death, the Orchestra was named as Ella and her Famous Orchestra.

In 1942, she began a solo career and in 1956, she became a featured artist with Verve Records.

During her career, was nicknamed "The First Lady of Song", recorded over 200 albums and around 2,000 songs.

Miss Fitzgerald was the first female vocalist to win a Grammy Award, winning two awards at the inaugural 1959 event, went on to win a total of 14 Grammy Awards, was honored with a star on the Hollywood Walk of Fame, and numerous other notable awards throughout her lifetime.

Miss Fitzgerald was awarded the National Medal of Arts by President Ronald Reagan, was made a Commander in France's Order of Arts and Letters, and was awarded the highest civilian award of the United States, the Presidential Medal of Freedom by President George H.W. Bush. In addition to her albums, Ella Fitzgerald appeared regularly on many memorable and highly-rated television programs.

Miss Fitzgerald created and founded the Ella Fitzgerald Charitable Foundation.

This Resolution of Recognition recognizes Newport News native, Ella Jane Fitzgerald, on the occasion of her 100th birthday, for her lifetime of artistic, creative and inspirational contributions in the United States and worldwide.

RESOLUTION OF RECOGNITION

WHEREAS, Ella Jane Fitzgerald was born in Newport News on April 25, 1917; and

WHEREAS, Ella Fitzgerald won fourteen Grammy Awards which includes the Grammy Lifetime Achievement Award presented in 1967. She was the first female vocalist to win a Grammy Award receiving two awards at the inaugural event in 1959. In 1960, Ella Fitzgerald was honored with a star on the Hollywood Walk of Fame and was a Kennedy Center for the Performing Arts Honoree in 1979. In 1989, the Society of Singers created the Ella Award given to singers worldwide for their contribution to the world of music along with their dedication to community and worldwide causes. She has also received the George Peabody Medal for Outstanding Contributions to Music in America, the NAACP Image Award, the National Academy of Recording Arts and Science’s Lifetime Achievement Award and the George and Ira Gershwin Award for Outstanding Achievement; and

WHEREAS, in 1987, Ella Fitzgerald was awarded the National Medal of Arts by President Ronald W. Reagan. Ella Fitzgerald also appeared in four films: “Ride ‘Em, Cowboy,” “Pete Kelley’s Blues,” “St. Louis Blues” and “Let No Man Write My Epitaph”, and

WHEREAS, Ella Fitzgerald’s last concert was held at Carnegie Hall in 1991 and she passed away in Beverly Hills, California on June 15, 1996. In celebration and commemoration her gifts, achievements and inspirational life, there have been many tributes in honor of Ella Fitzgerald. In 1997, the City of Newport News, in partnership with Christopher Newport University, created the annual Ella Fitzgerald Music Festival. The theater in the Downing-Gross Cultural Arts Center in Newport News is named the “Ella Fitzgerald Theater”. In 2007, the United States Postal Service, honored Ella Fitzgerald with the issuance of a commemorative stamp featuring her likeness. In 2008, 24th Street in Newport News was commemoratively renamed as “Ella Fitzgerald Way”. In 2017, to commemorate Ella Fitzgerald’s 100th birthday, the City of Newport News is conducting a year-long celebration comprised of many special events; and

WHEREAS, in 1993, Ella Fitzgerald created and founded the Ella Fitzgerald Charitable Foundation whose mission is to “endeavor to help others achieve a better life and to carry on the outstanding humanity of...Ella Fitzgerald, the great First Lady of Song”; and

WHEREAS, the Council for the City of Newport News wishes to recognize Newport News native, Ella Jane Fitzgerald, on the occasion of her 100th birthday, for her lifetime of contributions to music in the United States and worldwide, and the inspirational legacy she left behind for future generations.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Newport News, Virginia:

1. That it hereby recognizes Newport News native, Ella Jane Fitzgerald, on the occasion of her 100th birthday, for her lifetime of contributions to music in the United States and worldwide, and the inspirational legacy she left behind for future generations.

2. That a copy of this resolution be spread upon the records of this body.

BACKGROUND: Effective April 1, 2017, the City transitioned from a weekly and semimonthly pay schedule to a biweekly pay schedule for all employees.

With this transition, leave accrual rates will also be adjusted from a weekly and semimonthly accrual basis to a biweekly accrual basis.

This Ordinance amendment is needed to bring the City Code in line with the City's revised policy on biweekly pay and leave accruals.

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Newport News, Virginia:

1. That Chapter 2, Administration, of the Code of the City of Newport News, Virginia, Article IV., Employee Benefits, Division 2., Paid Personal Leave, Section 2-108, Amount prescribed; and Division 3., Paid Medical Leave, Section 2-119, Amount prescribed; accrual, Paid personal leave usage, be, and the same hereby is, amended and reordained as follows:

ADMINISTRATION

ARTICLE IV. EMPLOYEE BENEFITS

DIVISION 2. PAID PERSONAL LEAVE

Sec. 2-108. Amount prescribed; accrual.

(a) All regular full-time employees of the city shall earnaccrue paid personal leave as followsset forth below and which shall be equally distributed every biweekly pay period:

(1) All regular full-time employees of the city, except firefighters assigned to twenty- four-hour shifts, shall earnaccrue paid personal leave, as follows:

a. Thirteen (13)One hundred fifty-six (156) hours per monthyear when employed in an active pay status through the fifth year of employment.

b. Sixteen (16)One hundred ninety-five (195) hours per monthyear when employed in an active pay status after the fifth year of employment.

c. Eighteen (18)Two hundred twenty-one (221) hours per monthyear when employed in an active pay status after the tenth year of employment. d. Nineteen (19)Two hundred thirty-four (234) hours per monthyear when employed in an active pay status after the fifteenth year of employment.

e. Twenty (20)Two hundred forty and one-half (240.5) hours per monthyear when employed in an active pay status after the twentieth year of employment.

(2) Firefighters assigned to twenty-four-hour shifts shall earnaccrue paid personal leave as follows:

a. Twenty (20)Two hundred forty and one-half (240.5) hours per monthyear when employed in an active pay status through the fifth year of employment.

b. Twenty-five (25)Three hundred five and one-half (305.5) hours per monthyear when employed in an active pay status after the fifth year of employment.

c. Twenty-seven (27)Three hundred twenty-five (325) hours per monthyear when employed in an active pay status after the tenth year of employment.

d. Twenty-eight (28)Three hundred thirty-eight (338) hours per monthyear when employed in an active pay status after the fifteenth year of employment.

(3) Firefighters who transfer to or from assigned twenty-four-hour shifts shall have all leave balances for accrued paid personal leave converted to equivalent leave time in the new work schedule.

(b) Employees in regular part-time positions shall be granted thirty (30) hours of paid personal leave upon completion of fifty-two (52) weekstwenty-six (26) biweekly pay periods in which the employee has worked at least twenty (20)forty (40) hours per weekbiweekly pay period in active service with the city, in accordance with applicable policies. Thereafter such employees shall earnaccrue paid personal leave at the rate of 1.154two and one half (2.5) hours per weeklybiweekly pay period for each pay period in which the employee while in active pay status works at least twenty (20)forty (40) hours per weekbiweekly pay period, in accordance with applicable policies.

2 DIVISION 3. PAID MEDICAL LEAVE

Sec. 2-119. Amount prescribed; accrual.

(a) Paid medical leave shall accrue, for regular full-time employees in an active pay status, at the rate of five point five (5.5)seventy-one and one half (71.5) hours per monthyear to be equally distributed every biweekly pay period except that firefighters assigned to twenty-four-hour shifts shall accrue sixteen (16)one hundred ninety-five (195) hours of paid medical leave per monthyear to be equally distributed every biweekly pay period.

(b) Paid medical leave accrued but unused shall accumulate without limit.

(c) Firefighters who transfer to or from twenty-four-hour shifts shall have all accrued paid medical leave balances converted to equivalent leave time in the new work schedule.

Receipt of Bids for an Easement Located at 15401 Warwick Boulevard (Atkinson Boulevard Project) ACTION: A REQUEST TO CITY COUNCIL TO RECEIVE AND OPEN BIDS FOR GRANTING A 3,043 SQUARE-FOOT EASEMENT OVER CITY-OWNED PROPERTY LOCATED AT 15401 WARWICK BOULEVARD FOR THE ATKINSON BOULEVARD PROJECT. (After the receipt and opening of the bids, City Council is requested to refer the bids to the City Manager for review and the presentation of a recommendation at Council’s April 25, 2017 Regular Meeting).

BACKGROUND: A request to receive bids for a utility easement for placement of power lines and related items over City-owned property at 15401 Warwick Boulevard was properly advertised in the Daily Press.

A public hearing has been advertised for the April 25, 2017 City Council meeting for consideration of the Ordinance which will grant the easement to the successful bidder.

The City Manager recommends approval.

Resolution Authorizing the City Manager to Execute Lease Agreement Addendum No. 3, by and between the City of Newport News, Virginia and the Newport News Economic Development Authority (EDA) and the City of Newport News, Virginia (Department of Human Services in Rouse Tower) ACTION: A REQUEST TO APPROVE A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE LEASE ADDENDUM NO. 3, BY AND BETWEEN THE NEWPORT NEWS ECONOMIC DEVELOPMENT AUTHORITY (EDA) AND THE CITY OF NEWPORT NEWS FOR OFFICE SPACE IN ROUSE TOWER, UTILIZED BY THE DEPARTMENT OF HUMAN SERVICES (DHS).

BACKGROUND: DHS currently leases from the EDA 103,003 square-feet of space in Rouse Towers via a Lease dated December 1, 2007.

The Lease is for a five (5) year term with three (3) additional five-year renewal terms, and the current renewal term expires on November 30, 2017.

DHS has asked to lease additional space in Rouse Tower encompassing the entire 10th floor, or 11,193 square-feet. The EDA will build-out the space at its expense to agreed-upon specifications prior to DHS occupancy.

The proposed Lease Addendum exercises the second of three five-year renewal options to extend the lease term from December 1, 2017 through November 30, 2022.

All other terms and conditions of the original Lease are to remain in full force and effect.

The City Manager recommends approval.

BACKGROUND: The City of Newport News (City) has leased Parcel 8B to Omni since May 1, 1997, and the current lease between the City and Omni will expire April 30, 2017.

The current lease allows for the tenant to request a lease renewal of up to twenty (20) years at the sole approval and discretion of the City, provided all the terms and conditions of the existing lease have been met.

Omni provides vital machine shop and fabrication services to the SIP seafood harvesting fleet and vessels elsewhere along the East Coast.

Omni has requested a twenty (20) year renewal and complied with all terms and conditions of the existing Lease, which terms and conditions will remain in effect for the lease renewal.

The City Manager recommends approval.

The current Lease allows for the tenant to request a lease renewal of up to twenty (20) years at the sole approval and discretion of the City, provided all terms and conditions of the existing Lease have been met.

Blue Harvest requested a two (2) year and six (6) month renewal, to coincide with the expiration of the adjoining Parcel 7 Lease, and has complied with all terms and conditions of its existing Lease, which terms and conditions will remain in effect for the lease renewal period.

Department of Development – FY 2017 Bond Authorization: Community Development Category: Seafood Industrial Park (SIP) Projects – $250,000 ACTION: A REQUEST TO APPROVE A RESOLUTION APPROPRIATING $250,000 FROM THE FY 2017 BOND AUTHORIZATION, COMMUNITY DEVELOPMENT CATEGORY FOR SEAFOOD INDUSTRIAL PARK (SIP) PROJECTS.

BACKGROUND: The West Bulkhead repairs at the SIP are nearing completion and the City has submitted an Aid to Local Ports (ATLP) Grant application for $606,940 for the second phase of improvements, which include repairs to the outer harbor pier and dolphins.

The ATLP Grant will require matching funds of 25% of the total project costs from the City, which should the City receive the full grant amount requested, the City's local match would be $202,313.

As outlined at Council's March 28, 2017 Work Session, the EDA intends to deliver a $190,000 replacement Enterprise Zone grant to Fairlead, whose business was significantly impacted by the City's environmental remediation project work.

FISCAL IMPACT: The FY 2017 Bond Authorization, Community Development Category contains $250,000 to be appropriated for project investments in the SIP.

The $250,000 is requested in support of project investments in the SIP, including delivery of the Fairlead replacement grant and provision of the local match for the pending ATLP Grant application.
